Blatchley presiding. Other board members present were Justice, Donald Eaton; Justice, Ronald Fish; Councilman, Sherman Griswold; Councilman, Ray Miller. Others present were: Town Clerk, Christine Canestaro; Deputy Patricia Barber; Town Attorney, John Gardner; Town Engineer William Rowell; Water Superintendent, Fred Walker; Highway Superintendent; Carl Eaton; Zoning Enforcement Officer, Don Fowler, and several town residents. Reading of the minutes of the previous town board meeting was dispensed with as all board members had reviewed copies of the minutes prior to tonights meeting. Motion was made by Justice Eaton, seconded by Councilman Miller that the minutes be approved as written. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. • Town Clerk, Christine Canestaro read a letter from the Homer Central School, commending Highway Superintendent, Carl Eaton on the fine job done during the winter. Motion was made by Councilman Miller, Letter seconded by Justice Eaton that the letter be received and filed and that from Homer the town board extends their deep appreciation to Highway Superintendent Carl Eaton and his'crew for a job well done, Votes: Justice Eaton, aye; High Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; School Supervisor Blatchley, aye. Motion carried. Town Clerk, Christine Canestaro read a letter from Brockway Motor Trucks to all Brockway Customers regarding acquisition of service parts Letter for Brockway Trucks. Customers were assured of continued service and that all standard Brockway Warranties would be fully honored. Motion from Brockway was made by Councilman Miller and seconded by Justice Eaton that the Motors letter be received and filed. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. A copy of this !letter is attached to and made a part of these minutes. Councilman Miller reported that he had received a complaint from Mr. Ross Hall of Lamont Circle regarding tractor- trailer traffic on Lamont Circle. Zoning Enforcement Officer, Don Fowler was asked to investigate this matter. Justice Fish reported that he had received a complaint that Myrl Foster had moved some trailers from a lot on the Corner of Port Watson Street to Tioughnioga Ave., a residential area. Zoning Enforcement Officer, Don Fowler was asked to investigate this matter. Justice Fish reported that Mrs. Fish would like to know how the town board would like to have her act on the Interimland use plan. This Interim matter will be coming before the County Board and Mrs. Fish wishes to Land Use know the town board feelings on it. Justice Eaton suggested that the plan Supervisor write a letter to each of the legislators expressing town board feelings on the plan, explaining that the consensus of the town board being that they do not agree with the County Plan and they will not accept the plan until it conforms more to the needs of the Town of Cortlandville. Supervisor Blatchley agreed to do this. Supervisor Blatchley informed the Public board of a Public Hearing scheduled May 5th at 7:30 P.M. at the Cortland Hearing Court House Auditorium concerning the InterimLand Use Plan and urged all interested parties to attend. • Justice Eaton gave the following report on the activities of his office during the Month of 1977- fyARc.ff 394 cases completed $7,274.00 paid to State Comptroller in fines & forfeitures $3,245.00 being held in pending cases. Justice Eaton report Highway Superintendent Carl Eaton reported that the request for a lower speed limit on Lime Hollow Road and Stupke Road intersection has been sent to the County.and that they have forwarded it to the State. 188 Wednesday April 20, 1977 Pg. 2 Highway Superintendent, Carl Eaton reported that an 80' culvert on Hobart Hill Road has caved in and should be replaced as soon as possible. Mr. Eaton had asked the town Engineer William Rowell to inspect the culvert and Mr. Rowell confirmed the urgency for replacement. RESOLUTION #55: AUTHORIZATION FOR IMMEDIATE REPLACEMENT OF AN 80' CULVERT ON HOBART HILL ROAD. Adopted BE IT RESOLVED THAT whereas an emergency condition does exist, Highway Superintendent, Carl Eaton is authorized to proceed with immediate replacement of 80' culvert on Hobart Hill Road. At 8:00 p.m. receiving of bids for construction of sewer facilities on Terrace Road and McLean Road was offically closed. Supervisor Blatchley gave the following report regarding the financial status of the town as of March 31, 1977 SUPERVISOR General Fund Balance $125,850.00 FINANCIAL Federal Revenue Sharing Fund Balance 33,035.65 REPORT- MARCH Water District #1 Balance 60,114.17 Water District #2 Balance 1,144.57 Water District #3 Balance 6,589.01 Sewer District #1 Balance 33,427.46 Highway Fund Balance 226,854.93 comprised of: Repairs & Improvements $96,556.76 Bridges 7,601.16 Machinery 84,347.15 Snow Removal 38,349.86 RESOLUTION #56 AUTHORIZATION FOR SUPERVISOR TO ATTEND PUBLIC MEETING ON THE PREPARATION OF THE APALACHIAN REGIONAL PLAN ON APRIL 29, 1977 Supervisor AT BROOME COUNTY GOVERNMENT BUILDING, BINGHAMTON, NEW YORK to attend Motion made by Councilman Griswold, seconded by Justice Fish. Adopted BE IT RESOLVED THAT Supervisor Blatchley is hereby authorized to attend Public Meeting at Broome County Government Building Binghamton, N.Y. on April 29, 1977. It was decided that Justice Schedule Eaton, Town Clerk, Christine Canestaro and Supervisor Blatchley would for closing work on a schedule and present it to the board at the next regular meeting. town hall Mr. Ross Hall of Lamont Circle attended the meeting in person to present, to -.the town board, a complaint regarding tractor -trailer traffic on Lamont Circle. Folic Co. Bread Supplies is using Lamont Circle, a residential area, as a truck terminal. Zoning Enforcement Officer, Don Fowler has been asked to investigate this situation. Supervisor Blatchley presented a Notice of Public Hearing of the New York State Assembly Environmental Conservation and Senate Conservation Departments, to be held April 25-26-27 in the Legislative Office Building Albany, New -York. Motion was made by Justice Eaton and seconded by Councilman Griswold to receive and file the letter. Supervisor Blatchley introduced Mr. Al Coburn of the State Conservation Department who spoke on the State.Envirorm6ntal Quality Review Act. State Environmental The State Law requires the town board to adopt rules and procedures that Quality take into consideration all actions taken by the board. Review Act Type 1 List. This list must include items listed on State's type one list plus any others that may have an impact on the environment of Cortland- ville. Type 2 Lists This list would include all ministerial actions, 1.6. issuing a building permit - any actions that do not affect the environment are exe�3pt from Environmental Quality Review Act. Action should be taken by Town Board by June 1, 1977. It was decided that town board members review the available literature, lists and handbooks, prepare a resolution to be adopted at next scheduled town board meeting. Kenneth Andrews of Lamont Circle made a request that the town be responsible for mowing the lawn at the recreation area at Lamont Circle. Christine Canestaro suggested that funds for this be taken out of the budget that Maintenanc is reserved for the recreation area. It was determined that Supervisor Blatchley would contact Fran Tokar of the City of Cortland Recreation of rec. area Commission to inquire about programs for youths. Perhaps it would be at Lamont Cr. possible to hire a couple of teenagers to mow the ball -..:park. Supervisor Blatchley read a letter from Homer Fire Department. Fire Chief, Doug Staley requests that something be done about heating status of the municipal building. Re: Motion made by Councilman Miller to receive and file the letter, seconded by Councilman Griswold. Justice Eaton was asked to study installation of new heating system and report back to the town board. Town of Cortlandville Planning j3oard would like to have a map printed of Land Use Plan. They have estimated that 400 to 500 copies can be printed for about $1,000.00. Supervisor Blatchley has inquired about using anti -recession funds to pay for the printing of such a map. It was determined that further discussion of this map be done after a map has been approved by the planning board. Letter from Homer Firemen Heating statu in Municipal Building Land use Map. Supervisor Blatchley has suggested that some thought be given to Individual Risk Individual Risk Insurance. It was determined that -Warren Barth be Insurance contacted and asked to come to a town board meeting aril explain -the details of such insurance. Town Attorney, John Gardner read proposed resolution regarding Water District'#4. He advised that the First National Bank of Cortland will loan money on Serial Bond Issue at 6% over a period of 20 years. Department of Audit and Control approved change in maturity date from 30 to 20 years. Wednesday April 20, 1977 Pg. 4 RESOLUTION #57 BOND RESOLUTION OF APRIL 20, 1977, AUTHORIZING THE ISSUANCE i90 AND SALE OF SERIAL BONDS OF THE TOWN OF CORTLANDVILLE, CORTLAND COUNTY, NEW YORK. IN THE AMOUNT OF $97,000.00, FOR THE PURCHASE OF A WATER SUPPLY SYSTEM FOR WATER DISTRICT N0. 4 OF SAID TOWN. This resolution was offered by Justice Ronald Fish who moved its adoption, seconded by Councilman, Sherman Griswold. Bond Resolution BE IT RESOLVED, this 20th day of April, 1977, by the Town Board of the Water Dist. Town of Cortlandville, Cortland County, New York, as follows: #4 Section 1. For the object and purpose of acquiring a water supply system for Water District No. 4 of the Town of Cortlandville, Cortland County, New York, and to provide funds to defray the cost theregf, $9 000.00 serial bonds of the Town of Cortlandville, to be of the terms, form a ci contents hereinafter provided for, shall be issued pursuant to the provisions of the Local Finance Law of the State of New York. Section 2. $97,000.00 is estimated as the maximum cost of the object or purpose for which such serial bonds are to be issued, to wit: the acquisition of a water supply system for said water district. Section 3. The plan for the financing of such object or purpose, consists of the issuance of serial bonds of said Town in the principal sum of $97,000.00, thereby providing such sum toward the maximum estimated cost of such object or purpose. Section 4. It is hereby determined that the period of probable usefulness of the aforesaid object or purpose is forty years, pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Fihance Law. Section 5. The proposed maturity of the serial bonds hereby authorized will be in excess of five years. Section 6. The said $97,000.00 in serial bonds shall be a statutory installment bond issued pursuant to Section 62.10 of the Local Finance Law of the denomination of $97,000.00, dated May lst, 1977, maturing in twenty (20) equal annual installments of Four Thousand Eight'Hundred Fifty Dollars ($4,850.00) on the 1st day of May in the years 1978 to 1997, inclusive, and shall bear interest on the unpaid principal balance of such principal sum at a rate not exceeding six per centum (6%) per annum, to be paid semi-annually on the 1st days of May and November, in each year from the date of said bond until it matures. That said bonds shall be signed in the name of the Supervisor of the Town, and sealed with the corporate seal of the Town, and shall be attested by the Town Clerk, and both principal of and interest of said bond shall be payable in lawful money of the United States of America at First National Bank of Cortland, at Cortland, New York. 1 • Section 7. The faith and credit of the Town are hereby pledged to the payment of the principal of said bonds and interest thereon when due. Such bonds are to be payable from amounts which shall annually be levied on all the taxable real property in Water District No. 4 of the Town. Section 8. This resolution shall take effect immediately, The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Supervisor Robert P. Miller voting aye The resolution was.thereupon declared duly adopted. is Town Clerk, Christine Canestaro reported that Mrs. Natoli, of Homestead Road Complaint had complained about excess water bill and that Fred Walker had changed Re: Water bill the meter register. Water Superintendent Fred Walker was asked to take Mrs. Natoli another reading and report this at the next town board meeting. RESOLUTION #58 AUTHORIZATION FOR TOWN CLERK, CHRISTINE CANESTARO TO ATTEND VITAL STATISTICS MEETING IN SYRACUSE, MAY 18th, 1977• Town clerk to Motion made by Councilman Miller and seconded by Justice Eaton. BE IT RESOLVED THAT Town Clerk, Christine Canestaro has been given authorization to attend a meeting in Syracuse on May 18, 1977 concerning Vital Statistics. BE IT RESOLVED THAT "In accordance with the Town of Cortlandville Sewer District No. 1 ordinance, enacted July 13, 1960, the following alteration will be permitted for building sewers, in accordance with Section 406. • PVC PIPE MATERIALS PVC pipe materials conforming to ASTM Designation D303A, SDR-35, will be (.permitted as an alternate building sewer material for Sewer District No. 1, except for the following conditions: a) Jointing Materials - solvent cement joints shall not be permitted for any PVC pipe joints. All joints shall be made using the Elastomeric gasket joint material, consistent with paragraph 6.2. b) Laying Lengths - The laying length for all PVC materials 6 inches or less in diameter, shall not exceed 12-1/2 feet. c) Installation - Installation of PVC pipe shall be in accordance with ASTM Designation D-2321. The type of pipe bedding and other details of installation shall meet the referenced AS 11 specifications." RESOLUTION #61 AUTHORIZATION TO MAKE GENERAL CLERK, EDNA PUZO A PERMANENT EMPLOYEE AND RAISE HER SALARY FROM $5200.00 to Permanent employment $5'S00.00 a YEAR. of General Clerk Motion made by Justice Fish and seconded by Councilman Miller. Justice Eaton: "She is a valuable employee and I feel she should have more than the $5500.00." BE IT RESOLVED THAT General Clerk, Edna Puzo become a permanent employee and have her salary increased from $5200.00 to $5500.00 a year. Lang to coat the roof of the municipal building - per agreement - at a cost not to exceed $600.00 . Job is to be completed by July 1, 1977 and anti -recession funds will be used to pay for it. Clarence Homer inquired about proper procedure to follow to burn a pile of Burning rubbish on his property. Supervisor Blatchley advised Mr. Homer to Rubbish contact the Cortland Health Department and the Homer Fire Department of his intentions and Mr. Blatchley could see no reason for them to refuse him the permission to burn the rubbish.
