The first regular town board meeting of the month was held at
the town hall, 15 Terrace Rd. with Supervisor, Robert P. Blatchley
presiding. Other board members present were Justice,Donald Eaton;
Justice,Ronald Fish; Councilman, Sherman Griswold; Councilman, Ray
Miller. Others present were: Town Clerk, Christine Canestaro; Town
Attorney, John Gardner; Town Engineer, William Rowell; Town High-
way Supt., Carl Eaton; Town Assessor, Robert Wells; Zoning Enforce-
ment Officer, Don Fowler; Legislator, Henry Wadsworth; Fire Chief,
Homer Fire Dept., Bruce Moss; Mr. Kenneth Hodges; Skip Chapman, news
reporter and several residents of the town.
Reading of the minutes of the previous town board meeting was
dispensed with as all board members had reviewed copies of the
minutes prior to tonights meeting. Motion was made by Justice Fish,
seconded by Councilman Griswold that the minutes be approved as
written. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman
Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye.
Motion carried.
A petition requesting a lower speed limit on Lime Hollow Rd. Petition for
and Stupke Rd. was presented by Robert Moore of Pheasant Run and lower speed
read by the town clerk. The petition was signed by 28 residents limit on
of the area. Mr. Moore stated that the Lime Hollow Rd. and Stupke Lime Hollow Rd

made by Councilman Miller, seconded by Justice Eaton to receive and

RESOLUTION #51: REQUEST FOR LOWER SPEED LIMIT ON LIME HOLLOW AND
STUPKE RDS. Request to

Stupke Rd.
WHEREAS, A petition has been received by the town board,
requesting a lower speed limit on Lime Hollow Rd. and Stupke
Rd., and
WHEREAS, The Town Board of the Town of Cortlandville does
agree that the interesection of Lime Hollow Rd. and Stupke
Rd. is dangerous and that a lower maximum speed limit on
these two roads should be imposed,
NOW THEREFORE BE IT RESOLVED, That the town clerk is hereby
directed to request the New York State Dept. of Transportation,
pursuant to Sec. 1622.1 of the Vehicle and Traffic Law, to
establish a lower maximum speed at which vehicles may proceed
on Stupke Rd. between McLean Rd. and Lime Hollow Rd. and on
Lime Hollow Rd. between Gracie Rd. and New York State Rte.281.
Zoning Enforcement Officer, Don Fowler gave his report for the month
of March regarding building permits issued. A copy of the report is
attached to and made a part of these minutes.
Legislator, Henry Wadsworth advised that the impact notices Impact
regarding the re-evaluation of property assessments will be mailed notices
out on April 15th.
Highway Supt., Carl Eaton reported that he had contacted
Brockway Motor Co., Elmira regarding the Brockway truck ordered on
Feb. 16, 1977 (Resolution #42�' Production of this new truck cannot
be completed as the Brockway factory has closed down all manufacturing
operations. The Elmira dealer offered the town a new 1976 model,which
meets all the Jq9n specifications for the 1977 model, at a reduced
price. The cost of the 1977 truck was $38,250 and the 1976 truck is
$36,500, a decrease of $1750.00. He was assured that parts will be
available for this truck for a period of at least 10 years.

RESOLUTION #52: AUTHORIZATION TO PURCHASE ONE NEW 1976 BROCKWAY TRUCK
IN LIEU OF THE 1977 BROCKWAY TRUCK ORDERED_

WHEREAS, A bid was awarded to Brockway Motor Trucks, Elmira,
N.Y., on February 16, 1977 (Resolution #42) , for the
furnishing and delivery of one new and unused Brockway, two
axle, heavy duty dump truck, snow plow combination for the
net delivered price of $38,250, and
WHEREAS, the Brockway Motor Truck factory has closed down
all manufacturing and therefore the 1977 model Brockway
truck ordered has not been manufactured, and
WHEREAS, Brockway Motor Trucks, Elmira, N.Y. (the successful
bidder on the 1977 model truck) has offered the Town of
Cortlandville a new and unused 1976 model Brockway truck
which meets all the specifications with the exception of the
year model date, of the 1977 Brockway truck ordered, at a
reduced price,
NOW THEREFORE BE IT RESOLVED, That the Town.Board of the Town
of Cortlandville does hereby authorize the Supt. of Highways,
Carl Eaton to purchase the 1976 model new and unused Brockway
two axle, heavy duty dump truck, snow plow combination for
the net delivered price of $36,500.
Fire Chief's Homer Fire Dept. Chief, Bruce Moss gave his annual report for the
annual report year 4/l/76-3/31/77. A copy of this report is attached to and
made a part of these minutes. Motion was made by Councilman Miller,
seconded by Justice Eaton, that the report be received and filed.

aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried.
Mr. Edward Stiles inquired as to what the procedure is to deed
Sylvan Way Sylvan Way to the town so that Mike Arnold, who purchased property
Sub -division on Sylvan Way can proceed with his building plans. Engineer,William
Rowell advised him that the road has to be brought up to specifications
relative to grade, fill and surface. Since a period of time has to
elapse before paving of the road can be accomplished, a performance
bond in the amount of $2,000 must be given to the town to be held in
escrow until the paving of the road is completed, inspected by the
town highway suet. and the town engineer, and accepted by the town
board. Attorney Gardner advised that a one lot sub -division has been
approved by the town planning board subject to the attorney's approval
of the deed for the street and the turn around and subject to the
delivery of a performance bond to the town of $2,000.
The town clerk advised that she has not, as yet, received any
fees for this sub -division or any papers relative thereto. The sub-
division ordinance calls for a $25.00 preliminary filing fee plus
$5.00 for each lot. The application for this sub -division was not
made through the town clerk as called for in the sub -division ordinance.
Application was made to the town planning board.
R.Fragnoli Justice Eaton inquired if Robert Fragnoli had installed a
water meter water meter at his property on Tompkins St. per the policy adopted
by the town board on 12/1/76, resolution #136. The town clerk
advised that the meter had not been picked up as yet. Supervisor
Blatchley said he would check on this matter.
Private sale Supervisor Blatchley apprised the board that he had invited
of Municipal the First National Bank of Cortland, the Homer National Bank and
bonds the Marine Midland Bank, Cortland to bid on the private sale of
municipal bonds for the funding of the Pyramid Properties water
facilities. Homer National Bank and Marine Midland Bank declined
to bid, he said. The bid received.from the First National Bank of
Cortland was opened by the town clerk and read aloud as follows:

The First National Bank of Cortland submits the following bid
for $97,000, (ninety-seven thousand) Town of Cortlandville,
County of Cortland bonds.
Said bonds shall bear interest at the rate of 6% per annum and
the principal shall be payable at 1/20th each year.
• We hereby agree to accept delivery of and make payment for
said bonds on April 7th, or as soon thereafter as such bonds
are ready for delivery against payment. The bid is subject
to their legality and the opinion of our attorneys.

First National
Bank bid on
private sale of
municipal bonds
Justice Eaton stated he felt the residents in the proposed
sewer construction area should be given the preference of local bond interest
bonding if the interest rate was thought to be less expensive rates
then bonding through a bonding agency in New York City. A discussed
discussion followed regarding this method of bonding. Attorney
Gardner explained that, under the law, a municipality can only
borrow up to $100,000 in one year through a private sale of bonds.
Justice Fish inquired if the interest rate would be less if
the money was borrowed through a bonding company in New York City. bond interest
Attorney Gardner explained that each municipality is given a rates discusses
rating in accordance with the maturity date of the bonds. The
longer the issue, the higher the rating.
Mr. Rowell explained that Mr. McNeil of Pyramid Mall had
indicated, in one of their meetings, that if the local bonding was
available, they would like to proceed under this program with a
maximum rate of interest at 6%.
Motion was made by Justice Fish, seconded by Justice Eaton Attorney to

FISHER AVE. DRAINAGE: Supervisor Blatchley advised he had called
Mr. Tom Pitts of the Agricultural':Stablization Conservation Committee
regarding the Fisher Ave. drainage problem. Mr. Pitts advised him
that his committee will be.looking at the problem about the middle
of April and will notify him when they will be there.

TERRACE ROAD SEWERS: Engineer,William Rowell reported that, at the Terrace Rd.
present time, there are eight sets of drawings and specifications Sewers
out to prospective bidders on the.proposed project.
Attorney Gardner was directed to obtain detail information
regarding bond anticipation notes for the proposed sewer project.
Justice Fish stated, since the last meeting he had made a study plastic
on the use of plastic pipe vs cast iron pipes /,called for in the town
ordinance. In view of this study, he feels that the town board pipes
should consider amending the ordinance to permit the use of plastic
pipes. He said the use of plastic pipe has been approved by the discussed
County Health Dept.. Local plumbers, with whom he had spoken,
praised its use,, The Village of Marathon,he said, has used the

plastic plastic pipes in its new sewer system. He introduced Kenneth
Hodges, a former pipe salesman, whom he had invited to discuss
pipes the qualities of the plastic pipes. Mr. Hodges explained that
discussion if the plastic pipe was properly installed, it would be as
durable as cast iron pipes and less expensive. He emphasized
that proper installation was an important point in the use of
plastic pipes. He said that plastic pipes have been used very
extensively in Europe and in the southern United States.
Mr. Rowell stated he had no objection to the use of the
plastic pipe but that he was concerned with the actual method
of construction. In the experience he has had with the use
of plastic pipes, problems have arisen because of improper
installation. If the plastic pipe is to be used, he said,
it would demand close supervision and inspection by the town
and himself.
Specifications for the proposed sewer system call for
cast iron pipes. Mr. Rowell recommended that if the home owners
wished to use the plastic pipes from the curb to the house, the
present ordinance will have to be amended.
Mr. Rowell advised the cost of various pipes as follows:

hereby authorized and directed to review the present
1960 Town of Cortlandville Sewer Ordinance and prepare
an amendment thereto which will include specifications
for the use of PVC (plastic) sewer pipes.
Terrace Rd.Sewers
Discussion Mr. Brooks of Pleasantview Dr. asked what procedure he should
follow to have his plumber accepted by the Town as qualified
Plumbers to do the installation of his sewer. He was advised to have
the plumber write a letter to the town board stating his
qualifications and experience and asking that he be recognized
as qualified to do the work, pursuant to Section 4.15 of the
1960 Town of Cortlandville Sewer Ordinance.
Mr. Kenneth Bennett of McLean Rd. asked if the town would
trees assume responsibility if his birch tree was injured or killed
because of the sewer construction. He said the tree was
appraised at $1,000 two years ago. Mr. Rowell advised him to
file a bona fide appraisal with the town.

bldg. roof resurfacing of the municipal building roof and hoped to have more
resurfacing for the next meeting.
