Blatchley presiding. Other board members present were: Justice,Donald Eaton; Justice,Ronald Fish; Councilman, Ray Miller. Councilman,Sherman ' Griswold was absent as he was still on vacation. Others present were: Town Clerk, Christine Canestaro; Town Attorney, John Gardner; Town Engineer, William Rowell; Zoning Enforcement Officer, Don Fowler; Town Assessor, Robert Wells; Bookkeeper, Lena Warren; news reporter, Skip Chapman; and several residents of the town. Reading of the minutes of the previous town board meeting was dispensed with as all board members had reviewed copies of the minutes prior to tonight's meeting. Justice Fish noted one correction. Page 2 ® of the minutes (pg. 174 of the minute book) should read "Mr. Ed Stiles showed some concern for property he owns on Luker Rd.". Motion was made by Justice Fish, seconded by Justice Eaton that the minutes be approved as corrected. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. I An informal policy was set by the town board to prohibit smoking NO SMOKING during the town board meetings. AT MEETING NOTIFICATION Town Cler/;,Christine Canestaro, read a notification she had OF ACCIDENT received from National Grange Mutual Insurance Co. stating the CLAIM PAID claim #06-F-5715 for property damage had been paid by their company JOS. & PATRIC, to Joseph & Patricia Little in the amount of $4.21.90. Highway Supt., LITTLE Carl Eaton advised that this was in satisfaction of a claim resulting from an accident which occurred on January 22, 1977 with the town snow plow. Motion was made by Councilman Miller, seconded by Justice Eaton that the letter be received and filed. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. Mrs. Canestaro read a report she had received from County Treasurer, Walter Spencer, Jr., regarding monies paid by him to Supervisor Blatchley as follows: Dog Tax $ 1,526.70 CO. TRES.REPORT Sales Tax 83,330.91 OF MONIES PAID Mortgage Tax 25,161.42 TO TOWN SUPERVISO; Equipment Rental 612.33 1976 TOTAL $110,631.36 Motion was made by Justice Eaton, seconded by Justice Fish that the report be received and filed. Justice Eaton made the following report on the activities of his office during the month of February, 1977: JUSTICE REPORT FEBRUARY 197 cases completed $3,526.00 paid to the State Comptroller in fines and forfeitures $3,455.00 being held in pending cases Motion was made by Justice Fish, seconded by Councilman Miller that the report be received and filed. Votes: Justice Eaton,aye; Justice Fish,aye; Councilman Miller, aye; Supervisor Blatchley, aye— Motion carried. 178 Wednesday, March 16, 1977 Pg. 2 RESOLUTION #48: AUTHORIZATION FOR SUPERVISOR BLATCHLEY TO ATTEND SUPERVISORS & COUNTY LEGISLATORS REGIONAL CONFERENCE AUTHORIZATION Motion by: Justice Fish, seconded by Councilman Miller SUPERVISOR ATTEND Votes; Justice Eaton, aye; Justice Fish, aye; Councilman CONFERENCE Miller, aye; Supervisor Blatchley, aye. Adopted. BE IT RESOLVED, That Supervisor Blatchley is hereby authorized to attend the supervisors and county legislators regional conference being held at the Sheraton Inn, Ithaca, N.Y. on 3/31/77, and BE IT FURTHER RESOLVED, That all necessary expenses be reimbursed subject to audit by the town board. COUNTY Supervisor Blatchley advised that he had replied to the INTERIM County Planning Board's request concerning differences in the LAND USE town land use plan as prepared by the county planning department PLAN verses the one prepared by the Town of Cortlandville planning Board. There was a list of 22 di*rences pointed out in the letter, he said. COUNTY PLANNING Supervisor Blatchley apprised the board that the county planning BOARD REQUEST department had submitted a bill for $1,005.00 for work they had FOR PAYMENT completed on the 701 project and that he would pay it according to TOWN LAND the agreement made 7/16/75, resolution #115. This is for the land DEVELOPMENT development study completed in 1976. He advised that an additional PLAN charge of approximately $1,000.00 will be charged for any further maps made. This is due to changes made on the county plan by the town planning board. REPORT ON Justice Eaton reported he had examined the roof of the municipal REPAIRS building on West Rd. and found that it was cracking in several places. NEEDED TO He recommended that it be coated with an asbestos, aluminized fibrated ROOF coating. The board asked him to obtain quotes on this project and MUNIC.BLDG. present them at the next board meeting. WEST RD . REQUEST FOR Mrs. Allen of Allen Dr. requested that a stop or yield sign Yield SIGN be installed where the three roads come together at the end of ALLEN DR. Allen Dr. where the new Woodridge subdivision is proposed to be developed. High ay Supt., Carl Eaton, said the town would erect such a sign, if it in town property. ALLEN DR. Mrs. .Greene, also of Allen Dr. wished to know if a proposed fire EXT. ACCESS access road was legally necessary since the developer did -not wish to RD. DISCUSSED construct the road if it was not necessary. The residents, she said, were concerned that a proposed wooden barricade would not be sufficient to prevent traffic entering Allen Dr. from Holiday Dr. through the proposed Allen Dr. Extension. Attorney Gardner advised her that the recommendation for this easement for emergency vehicles was made by the Cortland County Planning Board and that it will be the final decision of the Town of Cortlandville Planning Board whether or not this easement will be required. Mrs. Allen wished to know if the residents of Allen Dr. will be SEWER HOOK -up required to hook up to the sewer system which will service the proposed ALLEN DR. new development. Engineer, William Rowell explained that the DISCUSSED residents of Allen Dr. were not presently in the sewer district and therefore would not be required to hook up to the system. The system for the proposed development, he said, will be constructed with an 8" line, as required by the State Health Dept. This will supply an adequate capacity if,at some future date, the residents of Allen Dr. petition for an extension of the sewer district. However, the pump station to be installed by the developer may or may not be adequate to serve an extension to the district, he said. Supervisor Blatchley advised that Mrs. Lena Warren was doing an excellent job and recommended that her salary be increased to $4,000. He said anti recession monies INCREASE can be used for this purpose. BOOKKEEPERS SALARY RESOLUTION #49: AUTHORIZATION TO INCREASE BOOKKEEPER, LENA WARREN'S SALARY Motion by Justice Eaton, seconded by Councilman Miller Votesa Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted BE IT RESOLVED, That Bookkeeper, Lena Warren's salary be increased $1,000.00 to make an annual salary for this position ® of $4,000.00, and BE IT FURTHER RESOLVED, That this increase be appropriated from anti recession funds. Mr. Edward Brown of Terrace Rd. compal ined of the junk cars JUNK CARS stored on the property of the Cortland Foreign Motors. The matter was COMPLAINT turned over to Zoning Enforcement Officer, Don Fowler for investigation. An informational period was held to discuss the proposed sewer construction project on Terrace Rd., McLean Rd., Pleasantview Dr. and Munson Ave. Several residents of the area were present. TERRACE RD Engineer, William Rowell advised that the project had been AREA proposed for the protection of the water supply wells from any SEWER possible contamination from the septic systems in the area. This CONSTRUCTIC danger is not immediate but should be guarded against. He said if DISCUSSION contamination does occur, it will be too late and the wells will have to be abandoned. He urged that the residents accept the proposed project and bids be obtained as soon as possible. The proposed facility, he said, was designed to minimize costs. Therefore, construction of the facility will be considerably ,off ,the pavement along the south side of McLean Rd., due to the water and gas lines on the south side of McLean Rd.. This will require permanent easements in TERR.RD the area involved. On the side streets, the facility will be constructed SEWERS in the right-of-way al the osite side of the street from the DESIGN & existing water lines. asEmeno will be needed in these areas for COST trenching . Temporary easements will be required in most areas for construction purposes. These temporary easements will be for a period of 2 years. Laterals will be provided to the curb for each house. Installation from the curb to the house will be the responsibility of the home owner. Estimated cost of the project is $90,000. Projected cost to home owner is approximately $101.00 as described at the town board meeting 2/16/77. This cost was discussed in great detail. Supervisor Blatchley read a letter he had received from Engineer, William Rowell. A copy of the letter is attached to and made a part of these minutes. Motion was made by Justice Eaton, seconded by TERR.RD. Justice Fish that the letter be received and filed. Motion carried. ® Some of the residents wished to know if they could use plastic pipes as it would be less costly than the cast iron pipes required by the towh's sewer ordinance. They were advised this could not be done unless the ordinance was amended. Residents were also concerned with what should be done with their septic systems after the sewers were installed. Mr. Rowell advised them that this will be a home owners responsibility. He suggested that if they had a steel tank, they either fill it with gravel or remove it. If the tank was conrete, there would not be a probable chance of collapse and the home owner could remove it if he wished or leave it. Mrs. Bennett inquired regarding the easement needed on her property. Attorney Gardner advised that a 25' easement from the south edge of the McLean Rd. would be required; 15' from the edge of the road would be a permanent easement and the remaining 10' would be a temporary easement. She asked if trees, shrubs, lawns and driveways damaged would be replaced. Attorney Gardner advised that the easements were written so that these items were substantially covered. CONST. MATERIAL DISCUSSED EASEMENTS I ; 180 Wednesday, March 16, 1977 Pg. 4 Some discussion was had on whether or not one had to be a PLUMBERS licensed plumber to install the sewer service from the curb DISCUSSED to the house. It was determined by the town board that the ordinance did not specifically state that the person had to be a licensed plumber. However Article IV, Section 401 of the ordinance provides that no unauthorized person can perform this work without first obtaining a permit from the superintendent to do so. Section 415 provides that "any plumber wishing to be recognized as competent by Sewer District #1, shall file in the office of the town clerk his application in writing giving the name of his firm, its place of business and ask to be permitted to perform work in connection with said Sewer District #1." Mr. Becker of Pleasantview Dr. said he had just installed TIME PERIOD a new septic system and wanted to know how long he would have FOR HOOK UP before he was mandated to hook up to the new sewer system. Engineer, William Rowell advised this will have to be determined by the town board. CONSTRUCTION Construction of lines were discussed relative to slope of DESIGN pipes, placement of pipes -inside or outside of house, constructions materials to be used, wye's, etc. Engineer Rowell advised that in answer to a previous question , adjoining property owners will not be permitted to use one sewer lateral and then wye off in back of the houses. DAMAGES TO Mr. Bogart wished to know if the root system of his trees ROOT SYSTEMS were damaged and the trees died after a period of time (1 yr. or so), OF TREES would they be replaced. Mr. Rowell assured him that the facility was designed, as much as possible, to avoid the trees. HAND VOTE OF Supervisor Blatchley took a hand vote of the residents present RESIDENTS which comprised approximately 50% of the residents of the area. PRESENT Everyone present was in favor of construction of the proposed sewers. RESOLUTION#50: AUTHORIZATION TO ADVERTISE FOR SEALED BIDS FOR AUTHORIZATION CONSTRUCTION OF SEWERS ON TERRACE RD., MC LEAN RD., TO GO TO BID PLEASANTVIEW DR. AND MUNSON AVE. Motion by Justice Eaton, seconded by Councilman Miller Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley, aye. BE IT RESOLVED, That the town clerk is hereby authorized and directed to advertise for sealed bids for the furnishing, delivery and installing, complete, approximately 3000 feet of eight inch sewer line in Sewer District #1, Town of Cortlandville on Terrace Rd., McLean Rd., Pleasantview Dr., and Munson Ave. in accordance with plans and specifications prepared by Rowell and Associates, P.C., Surveyors, Planners & Engineers, and BE IT FURTHER RESOLVED, That sealed bids received will be opened at 8:00 P.M. on April 20, 1977 at the town hall, 15 Terrace Rd., Cortlandville, New York. PYRAMID MALL FINANCING FOR Regarding financing for Pyramid Mall water facilities, Supervisor TAKE OVER OF Blatchley advised that a state law permits the private sale of WATER municipal bonds of less than $100,000.00 to local financing institutions. FACILITIES He read a proposed letter he had written inviting local banks to bid on the sale of these bonds. The letter stated that the bonds should bear a minimum term of 20 years and a maximum rate of interest of 6%. Bid to be opened April 6, 1977 at 8:00 p.m. at the town hall with the town board reserving the right to reject all bids. A discussion followed. A resolution was not made on this matter. However, the board concluded that the letter should be sent but.: that the letter should request a minimum rate of interest rather than stating the maximum interest figure. SEWER PROJECT Justice Eaton'stated.he felt the sewer bonds should be sold FINANCING locally this year as this would possibly prove least expensive to the DISCUSSED local residents. Engineer Rowell advised that the sale of these bonds is limited to $100,000.00 per year. Therefore sale of bonds for Pyramid Mall financing and Sewer District #1 financing could not both be done in the same year. The actual sewer bond sale, he said, could be held next year. Justice Eaton said he still felt the local residents should be given the priority of the local bond sale this year. There being no further business, upon motion of Councilman Miller, seconded by Justice Eaton, all voting aye, the meeting was adjourned at 9:38 p.m.. (315) 455-5973 March 3.6 , 1977 Mr. Robert Blatchley, Supervisor and Town Board Town of Cortlandville 15 Terrace Road Cortland, New York 13045 Re: McLean Road Sewer Project Gentlemen: We have obtained approval from the Cortland County Department of Health for plans previously sent to them regarding the 8-inch sanitary sewers in the McLean Road area. A copy of ` the letter of approval is attached. I advised at one of the earlier meetings that we have received this letter_ of approval and at that time suggested that the Town consider advertisement for the work involved so that we could hopefully obtain the benefits of the construction season and obtain a lower price for installation of the utilities. If the project is delayed until the contractors have programmed their summer work then we may expect that they will bid higher for the project involved. We realize that the easements have not vet been obtained but believe that it is possible before it is necessary to award a contract and, if necessary, some minor changes can be taken care of through change orders if easements are difficult to obtain. We wish to advise that the plans and specifications are ready to go out for bid when we are authorized by the Town Board, that we have obtained approval from the County Health Depart- ment for the work, and that we have completed all of the work requested by us to date on obtaining the necessary easements.
