The first regular town board meeting of the month was held at
the town hall, 15 Terrace Rd. with Supervisor, Robert P. Blatchley
presiding. Other town board members present were: Justice Donald
Eaton, Justice Ronald Fish and Councilman Ray Miller. Councilman
Sherman Griswold was absent as he was still on vacation. Others
present were: Town Clerk, Christine Canestaro; Deputy Town Clerk,
Patricia Barber; Town Attorney, John Gardner; Town Engineer, William
Rowell; Zoning Enforcement Officer, Don Fowler; Highway Supt., Carl
Eaton; Town Assessor, Robert Wells; Legislator, Henry Wadsworth; Town
Planning Board members, William Clemens and Willard Griswold, news
reporter, Skip Chapman and several residents of the town.
Reading of the minutes of the previous meeting of the town
board was dispensed with as all board members had reviewed copies
of the minutes prior to tonight's meeting. There were no corrections
or additions. Motion was made by Councilman Miller, seconded by Justice
Fish that the minutes be approved as written. Votes: Justice Eaton, aye;
Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley, aye.
Motion carried.
Mrs. Canestaro read a letter she had received from the State of APPROVAL
New York Dept. of Health, Albany, N.Y. regarding South Cortland water STATE HEALTH
Supply project, stating that they endorsed -the proposed project and DEPT.-SO.
that when the town was ready to proceed with the project, the town CORTLAND
engineer should submit final plans and specifications in accordance with WATER
the requirements of part 5-1.2 N.Y.Codes,Rules & Regulations, directly PROJECT
to their office and one set to the Cortland County Health Dept. for
approval.
Mrs. Canestaro gave each member of the town board a copy of "An OPEN
Act to Amend the Public Officers Law" in relation to open meetings which MEETINGS
she had received from Robert J. Fieman, Executive Director, Committee LAW
on Public Access to Records, Albany, N.Y. Motion was made by Justice AMENDMENT
Eaton, seconded by Justice Fish that the material be received and filed
and that each board member review their copy. Votes:Justice Eaton, aye;
Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley, aye.
Motion carried.

BE IT RESOLVED, that in compliance with section 94 of the Public
BOARD
Officers Late, the town clerk is hereby authorized and directed
to publish in the Cortland Standard, a single notice of scheduled
regular meetings of the town board to be held during the year.
Zoning Enforcement Officer, Don Fouler gave his annual report on
building permits issued during 1976 and his report on building permits
issued during January & February of 1977. A copy of both these reports
is attached to and made a part of these minutes.
Supervisor Blatchley gave each member of the town board. a copy of
SUPERVISOR
his "Summary of Cash -All Funds" from his annual report for the year

ended 12/31/76. Motion was made by Justice Fish, seconded by Councilman

Supervisor Blatchley announced there would be a meeting for town COUNTY
board members only on March 23, 1977 at 7:30 P.m. at the town hall. The SEWER TREAT
purpose of the meeting will be to discuss the impact of the new sewer PLANT MTG.
treatment plant on the Town of Cortlandville.
Mr. Blatchley read a letter he had written, at the request of the COUNTY
town board, to Mr. Allen Kryger of. the Cortland County Planning Dept. INTERIM
regarding the County Interim Land Use Plan. A copy of the letter is LAND USE PLAN
attached to and made a part of these minutes.

APPROVE Mr. Bob Edmonds reported his company, Gutchess Lumber Company,
GUTCHESS LBR. were planning to fence their property with an eight foot high, chain
TREE PLANTING link fence and wanted the town's permission to plant trees on the
town's side of the fence. The town board gave their unanimous
approval for this project.
At 8:00 p.m. the regular meeting of the town board was
recessed to open bids received on the hydraulically controlled,
towed paver for the highway dept. Motion was made by Justice Eaton,
seconded by Justice Fish that receiving of bids for the paver be
declared closed. Votes: Justice Eaton, aye; Justice Fish, aye;
Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried.
Town Clerk, Christine Canestaro, opened and read aloud the
following bids received:

The bids were turned over to Attorney John Gardner and Highway
Supt., Carl Eaton to examine for legalities and sufficiencies.
TOWN DEVELOPMENT Mr. William Clemens, member of the Town of Cortlandville Planning
ELAN
Board made a presentation on the latest revised "Development Plan" map.
PRESENTATION
The last modification of the map, he said,occurred within the last
two weeks and now represents the consensus of opinion of the members
of the town planning board and the citizens advisory committee. Stating,
that there were no further changes to be made, he asked that the town
board accept the planning board's concept of the plan. A discussion
followed.
Mr. Ed Stiles showed some concern for property he owns onGroton-,
A,for which he has a prospective buyer, pending the zoning

classification of the property. He was advised to make a formal
request for a zoning change under the provisions of the present
zoning ordinance.
Mr. Edmonds of Gutchess Lumber Co. was concerned with the
classification of lands owned by Gutchess Lumber now zoned industrial
which the County Interim Land Use Plan shows as open space. Mr.
Clemens advised him to make his concern known to the County Planning
Dept.

BE IT RESOLVED, That the Town Board of the Town of Cortlandville
does hereby accept the concept of the Town of Cortlandville
Development Plan map as presented to the Town Board on March 2,
1977. Said map being dated May 19, 1976 and revised December 6,
1976, January 27, 1977 and February, 1977.
ENGINEER, WILLIAM ROWELL REPORTED:
WELL #3-Pump WELL #3 PUMP - pump was removed and returned to factory.
SEWER DIST.#1 SEWER DISTRICT #_1_ now proceeding with easement details.
IMPROVEMENT Home owners in the area will be contacted within the next
(Terrace Rd.Sewers) week to 10 days.
Plans have been approved by the State Health Dept., therefore
the town can now proceed with the project at the board's
discretion.
Attorney Gardner advised easements should_be obtained before
going to bid on the project.

A petition In this matter for the creation of a Water District havinj
been duly presented to the Town Board, together with the neoessary map
and plan attached thereto, and an order having been duly adopted by the
Town Board on August 4th, 1976, for the hearing of all persons interested
In the matter on the 25th day of August, 1976, at 8a00 o'clock In the p.
m., at the Town Hall, In the Town of Cortlandville, Cortland County,
New York, and a hearing by the said Board having been duly held at such
time and place, and it having been duly resolved and deterinined following
such hearing, that the petition herein was signed and acknowledged, or
approved as required by law and otherwise sufficient, that all the prop -
arty and property owners within the proposed district were benefited
thereby, that all property and property owners benefited were Included
within the limits of the proposed district and that It was In public In-
terest to grant in whole the relief sought, and It having been then and
there duly resolved that the establishment of such district as proposed,
be approved, and an application having been thereafter and on October
14th . , 1976, duly made in duplicate to the State Department of Audit and
Control at Albany, New York, for permission for the creation of such
district as more fully provided for by Section 194 of the Town Low, and
the State Comptroller having duly made an order in duplicate, dated
February 7th, 1977, -:,ranting perrission for the creation of the district
in all respects as petitioned for and approved by the Town Board as

Clerk having duly presented such order to this Board at its meeting held
on February 16, 1977, being its first meeting held after said order was
filed herewith;
NOW, THEREFORE, it is
ORDERED, that a Water District be established in the said Town of
Cortlandville, Cortland County, New York, as described in the order of
the State Comptroller aforesaid, to be designated as Water District No.
5 of the Town of Cortlandville, and to be of the following description
and boundaries, to wits
All that tract or parcel of land situate in the
Town of Cortlandville, Cortland County, State of New York,
being part of Lots No. 82, 92 and 93 in said Town, and
being more particularly described as follows:
A parcel of land being located in Lots 82, 92 and 93,
of the Town of Cortlandville, Cortland County, New York,
more definitely described as follows:
Beginning at a point situate 200 feet easterly of the
centerline of N.Y.S. Route 13 and marking the northerly line
of lands of Smith -Corona -Merchant, Inc., and the southerly
limits of lands of the Cortlandville Mall, thence, running
southerly along a line parallel to and 200 feet easterly of
the centerline of said Route 13, a distance of 1350 feet,
more or less, to a point in the northerly line of Yaryan;
thence, running easterly along the northerly line of lands
Of said Yaman a distance of 10 feet, more or less, to the
northeasterly corner of lands of said Yaman s thence, run-
ning southerly along the easterly line of lands 'of said

WHEREAS, The Town Superintendent of Highways did, on the
2nd day of March, 1977, duly recommend the purchase of certain
equipment pursuant to the provisions of Section 142 of the
Highway Law,
NOW, THEREFORE, BE IT RESOLVED That the Town Superintendent
® of Highways is authorized to purchase, in accordance with the
provisions of Article 5-A of the General Municipal Law, and
with the approval of the County Superintendent of Highways,
the following:
One 1976 Miller Model MS708ARTHSEH Hydraulically
controlled paver
for a maximum price of Five Thousand Nine Hundred Ninety and no/100
Dollars ($5,990.00), delivered at Cortlandville, New York by
March 15, 1977.
A contract for the item purchased shall be duly
executed in triplicate between the Town Superintendent of
Highways and such vendor, and when approved by the County
Superintendent of Highways, it shall become effective. When the
contract has been executed and approved, and upon delivery of the
item purchased, the supervisor shall pay the following amount
as specified:

Justice Eaton apprised the board that a leak in the roof of

contacted Mr. Lang who will make the necessary repairs.

Justice Eaton apprised the board that Sec. 165.50 of the Criminal
Procedure Law which became effective 9/l/76 and amended effective 1/l/77 INCREASE
mandates that anyone having a satisfactory termination of a criminal

proceeding,the Court must notify the arresting agency, the District
JUSTICE DEPT
Attorney, the law enforcing agencies having relativity to the case
and the Division of Criminal Justice Service of the State of New York.
Based on last years figures, he said, this will make 800 to 1000 more
reports that will have to be furnished by his office to meet this
requirement. Ultimately, this will require the hiring of additional

help in his office.
Priorities for the year 1977 were discussed and listed as follows:

I am writing on behalf of the Cortlandville town board concerning
the County interim land use plan.
We general:brapprove of the concept of the plan, i. e., the
preservation of open space and urual--urban harmony. We approve of
the idea of the several rural residential areas proposed:'in:the plan.
However, as you know there are -many discrepancies between what
our town planning board envisions for the town of Cortlandville and
those propsed in the present interim land use plan. There seems
to be a reluctance on the part of our -town planning board.as well
as our town board to make so many businesses non conforming although
we fully realize that this is not a zoning map. Also, some of our
developers feel that the proposed interim land use plan may lead to
zoning which will severely curtail or even prevent their furore
development plans.
We feel that if and when the interim plan conforms more closely
to our proposed town land use plan then it will stand a good chance
of being approved first by our town planning board and then by
our town board.
We appreciate the efforts of your board and of the County
planning dept. in taking a good long look at the future of Cortland
County.
