The second regular town board meeting of the month was held at the
town hall, 15 Terrace Rd. with Supervisor, Robert P. Blatchley presiding.
Other board members present were: Justice Donald Eaton and Justice
Ronald Fish. Councilmen Ray Miller and Sherman Griswold were absent
as they were on vacation. Others present were; Town Clerk, Christine
Canestaro; Town Attorney, John Gardner; Town Engineer, William Rowell;
Town Highway Superintendant, Carl Eaton; Zoning Enforcement Officer,
Don Fowler; news reporter, Skip Chapman; and two area residents,
Ron Petrecca and Mrs. Delmar Palm.
Reading of the minutes of the previous meeting of the town board.
was dispensed with as all board members had reviewed copies of the
minutes prior to tonights meeting. There were no corrections or
additions. Motion was made by Justice Fish, seconded. by Justice Eaton

Mrs. Canestaro read the following correspondence:
1. A letter from New York State Dept. of Audit and Control stating Pemission
that the Dept. of Audit and Control had granted permission to from Audit &
the Town Board of the Town of Cortlandville to establish Control to
Water District P5. The Letter was accompanied by the order Establish
granting this permission. A copy of the order is attached to Water Dist.#5
and made a part of these minutes. Motion was made by Justice
Eaton, seconded by Justice Fish to receive and file the letter
and order. Votes: Justice Eaton, aye; Justice Fish, aye;
Supervisor Blatchley, aye. Motion carried.
2. A letter from New York State Dept. of .Environmental Conservation
regarding a hearing to be held on 3/2/77 at 2:00 p.m. at 7:30 p.m.
at the first floor meeting room -room 1j.06, 50 Wolf Rd.. Albany, N.Y. Fresh -
for the purpose of hearing the views of all persons, corporations, water
or civil divisions of the State of New York who appear with wetlands
respect to the proposal of the Freshwater Wetlands Appeals Board.
to add part 647 to Title 6 of the Official Compilation of Codes,
Rules and Regulations of the State of New York.Part 647 establishes
rules of procedure for appeals to the Freshwater Wetlands Appeals
Board from orders, determinations or decisions of the Dept. of
Environmental Conservation, the appropriate agency of any village,
town, city or county, or the Adirondact Park Agency acting under
authority of the Freshwater Wetlands Act.
Motion was made by Jutice Eaton, seconded by Justice Fish to

3. A notice from the State of New York Public Service Commission N.Y.Stat
regarding a public hearing to be held on 2/21/77 at the Commission Elec & Gas
offices, Agency Bldg. 1'r'3, Empire State Plaza, Albany, N.Y. hearing
commencing at 10:00 a.m. and to continue from day to day as required re: rate
on the following: increase

Case 27104-N.Y.State Elec. & Gas Corp. Gas Rates

BE IT -RESOLVED THAT the town clerk is hereby authorized and
directed to issue a trailer park renewal permit to Robert
P. Bean for the operation of his Penguin Starr Trailer Park
located on Tompkins St. Ext. upon the receipt of a Health
Dept. permit and the proper fee.
JUSTICE Justice Eaton gave the following report on the activities of •
REPORT his office during the month of January 1977:

$2,690' paid to the State Comptroller in fines & forfeitures
$3,305 being held. in pending cases.
Zoning Enforcement officer, Don Fowler advised that he was
back to work, after his illness and would make his yearly report
for 1976 and his monthly report for January and February at the
next meeting of the Town Board.
SUPERVISOR Supervisor Blatchley gave the following report regarding the
FINANCIAL financial status of the town as of 1/31/77:

Mr. Blatchley advised that these balances do ho�'-include any,
new appropriations and represent only unexpended balances for..:1976.
GROTON AVE. Mr. Blatchley read a copy of a letter written by Mr. Porter of
SEWERS. William Porter Real Estate to Mr. Neil M. Gingold, Regional Attorney -.
for N.Y. State Dept. of Environmental Conservation regarding the
proposed Sanitary Sewer Dist. #2, Town of Cortlandville in the area
of the Groton Ave. Shopping Plaza. The letter advised that:
1. the owners of a portion of the property must agree to the
sewer district (these people, no name stated, are located in
Connecticut). Mr. Porter will contact them as soon as his
attorney researches the law as it regards his position should the
Connecticut people refuse to agree to the formation of the
sewer district.
2. They are awaiting word from Firestone as to their participation in

the proposed sewer district.
Supervisor Blatchley advised that:

3. He had talked with Douglas Spring of the State Dept. of Transportation
R.R.Right of way Albany, who advised that the town should develop an agreement with
the county for the future use, by the town, of the railroad right-of-way.

He read a proposed resolution he had drawn up to be presented
the County Legislature. The Board asked Attorney Gardner to
review the resolution and make any corrections or changes he
necessary.

�1. He had written a letter to the Dept. of Audit & Control requesting
an audit be made. Mr. Blatchley read a -reply from Mr. John L.
Hasselwander of the Dept. of Audit & Control stating that due to
staff limitations, audits of -towns in Cortland County will not be
made this year. Motion was made by Justice Eaton, seconded by
Justice Fish, that the letter be received and filed. Votes:

5. Mrs. Karen Goddard requested that she be exempt from the $5.00 Karen
quarterly service charge imposed by the town for sewers Goddard
connected to the Village of Homer seiner system. The consensus sewer
of the board was that everyone who connects to this sewer system
must pay the $5.00 quarterly charge pursuant to policy set :forth
at a regular meeting of the town board on 6/2/76 (pg.62 of the min.).
6. Final formal application for Appalachin funds for South Cortland Water
has been completed and sent to the regional office in Binghamton So.Cort.

RESOLUTION 40: AUTHORIZATION FOR SUPERVISOR TO SIGN APPLICATION FOR
APPALACHIN FUNDS FOR SOUTH CORTLAND WATER PROJECT. South
Motion by JusticeFish, seconded by Justice Eaton Cortland
Votes: Justice Eaton, aye; Justice Fish, aye; Supervisor Blatchley,aye Water

BE IT RESOLVED, That Supervisor Blatchley is hereby authorized to
sign application forms for Appalachin Funds for the proposed South
Cortland Water System project.
At 8:00 p.m. the regular meeting of the Town Board was recessed Brockway
to open bids received on the 1977 Brockway truck. Motion was made by truck bid
Justice Eaton, seconded_ by Justice Fish, that receiving of bids for opening
the 1977 Brockway truck be closed. Votes: JusticeEaton, aye; Justice
Fish, aye; Supervisor Blatchley, aye. Motion carried.
Town Clerk, Christine Canestaro opened and read aloud the only
bid received as follows:
Bidder: -Brockway Motor Trucks, 3050 Lake Rd., Elmira, N.Y. 141Q01
1 new Brockway Truck model #N761L with a model HH11 Heil body,
hoist and Frink snow plow attachments.
Net delivered price less all taxes $38,250.00
Delivery in 60 days
The bid was turned over to Attorney Gardner and Highway Supt., Carl
Eaton to examine for legalities and sufficiencies.
The County Interim Land Use Plan was discussed. Supervisor Blatchley County

was authorized to write a letter to the County Planning Board advising
them that the Town Board of Cortlandville approves the concept of the

Supervisor Blatchley advised that his bookkeeper had not been able

instead of 1/31/77. He said he had talked with Mr. Phillip Frye of

Audit and Control who told him the report could be submitted to the

state comptroller 2/28/77. Town Law, he said, stipulates that this report file
must be filed with the town clerk within 30 days after the close of the
fiscal_ year unless the time is extended to 60 days by resolution of the
town board. After some discussion, Attorney Gardner and the town Board
advised him to file -the report as a late filing when it was completed.
A resolution was not adopted.

RESOLUTION #41: AUTHORIZING APPLICATION TO COUNTY TREASURER FOR
Application EXTENSION OF TIME TO COLLECT TAXES

BE IT RESOLVED, That, pursuant to Real Property Tax Law 1938,
Supervisor Blatchley is hereby authorized and directed to make
application to the county treasurer for an extension of time
until June 1, 1977 for the collection of taxes in the Town of
Cortlandville for the reason that the collector has been unable
to collect all the taxes in the Town of Cortlandville
Attorney Gardner -.and Highway Supt., Carl Eaton advised that the
bid submitted by Brockway Motor Trucks for the Brockway truck was
proper as to legalities and sufficiencies.

were solicited for the furnishing and delivery of one new and unused
Brockway, two axle, heavy duty dump truck -snow plow combination, in
accordance with the specification and terms set forth in the
information to bidders, and
WHEREAS, one sealed bid was received, opened and read aloud by the
town clerk,
NOW THEREFORE BE IT
RESOLVED, That the Town Board of the Town of Cortlandville does
hereby award the bid to Brockway Motor Trucks, 3050 Lake Rd.,
Elmira, New York, the lone bidder, for the furnishing and delivery
of one new and unused Brockway, two axle, heavy duty dump truck -
snow plow combination for the net delivered price of $38,250.00
delivery to be made within 60 days.

working out the funding details for this project.
Attorney Gardner advised he had contacted Mr. James Spaulding
regarding monies due Pyramid Investors for the lines. There is
some question as to the amount of money due because of an
easement involved.
Water Dist.5 3. WATER DIST.5: - South Cortland - Final application for FHA funding
now in process of being made.
Sewer Dist.l 4. SEWER DIST.1 - plans have been submitted to the County Health Dept.
The County Health Dept. has not been able to approve the plans
due to the absence of County Engineer, James Feuss who must
give the final approval. Easements and funding details are
being worked on by Attorney Gardner.

anticipated 900 per thousand assessed valuation to 650 per thousand.

A great deal of discussion followed. The consensus of the board
was to proceed with the bidding on the construction plans and then
hold an informational meeting to inform the people in the construction
area of the costs involved.
Mr. Rowell advised that the town board should be setting
priorities regarding public works programs for the year 1977•
There being no further business, upon motion of Justice Eaton,
seconded by Justice Fish, all voting aye, the meeting was adjourned
at 8:53 p.m..

WMEAS, application has been duly made to the undersigned
by the .town board of the Town of Cortlazadville, Cortland County,
Now York, by its.Supervisor, pursuant to section 194 of the
Town Law, for the permission of the State Comptroller to establish
Water District No. 5 in said town, in accordance with such applica-
tion and a resolution of said board adopted on October 6, 1976;

has been duly given to the Clerk of the County Legislature of
Cortland County, New York, by the State Comptroller in the
manner prescribed by section 194 of the Town Law; and

that this project is eligible for a loan of 620,000.00 for
40 years, with interest at five per cent, and a grant of up
to WtOOO.00-9 depending on the actual cost of the project,
and we are informed by the Southern Tier East Regional Planning
Development Board that the New York State Department of State
has scheduled this project for a grant of up to 030,000.00S
depending on actual cost, from the Appalachian Regional
Commission; and
