The first regular meeting of the year of the Town Board was held
at the town hall, 15 Terrace Rd. with Supervisor, Robert P. Blatchley
presiding. Other board members present were; Justice,Donald F. Eaton;
Justice,Ronald Fish; Councilman,Sherman Griswold and Councilman,Ray
Miller. Others present were: Town Clerk, Christine Canestaro; Town
Attorney, John Gardner(!&,t4'-9Engineer, William Rowell; Town Highway
Supt., Carl Eaton; Town Assessor, Robert Wells, Bookkeeper, Wayne
Ezick, Deputy Town Clerk, Theresa Fortin; Legislators, Shirley Fish; &
Henry Wadsworth; news reporter, Skip Chapman (came in late) and several
residents of the town.
Supervisor Blatchley called the meeting to order and the pledge
of allegience was given by all in attendance.
Town Clerk, Christine Canestaro read the minutes of the last meeting. Request
Supervisor Blatchley said he would like to amend Resolution #147 to to amend
reflect a correction in the amount of $900.00 in unallocated insurance res.#,147
a/c #B1910.4. In going over the budget, he found that $500.00 of this
item had been allocated in Water Dist.#1 and$400.00 had been allocated
in Sewer Dist.#l, thus decreasing the supplemental allocation necessary
from General Fund unexpended balance-part,,town.

sum of $4,521.20 shall be transferred from General Fund 1976 unexpended
balance -part town.

The Town Clerk reported she had received a letter from the

Association of Towns giving notice that the annual meeting of the

Association of Towns will be held at the New York Hilton and the
Americana. Hotels, New York City, February 21, 22, 23, 1977. Mrs.

Supervisor Blatchley reported the Association of Towns Bulletin

WHEREAS, a petition of the residents of Ridge Road requesting
that `the road passing through Sunset View Terrace, formerly
Ridge Rd. known as "Ridge.Road" still be named "Ridge Road", as per
Resolution map layout of Sunset View Terrace dated August 11, 1966, was
duly received and filed with the town clerk on December 1,
1976, and
WHEREAS, said petitioners own land in excess of 50% of the
assessed valuation on said road,
NOW THEREFORE
BE IT RESOLVED, That the road formerly known as "Ridge Road"
and changed to "Sunset View Terrace" on May 17, 1967 be
changed back to the original name "Ridge Road" from New York
State Rte. 11 to South Hill Road and that the entire road
from New York State Rte. 11 to the town line shall henceforth •
and hereafter be known as "Ridge Road", and
BE IT FURTHER RESOLVED, That the Town Clerk shall within
ten (10). days notify the Town Assessor, the Town Planning
Board, the Cortland County Clerk, the Cortland County
Highway Superintendent, and the Postmaster of McGraw, New
York of this change.

suggested that since it was not customary for the city to
bill private individuals outside the city -and in order to
facilitate a more equitable charge to the individual, the
owner of the hydrant should transfer ownership of the
hydrant and the pipeline and a suitable easement to the
Water District. Then there would be no bharges made to the
private hydrant and the district would absorb any charges
thereon.
Supervisor Supervisor Blatchley reported that it has proven a hardship for
Financial his bookkeeper to prepare the supervisor's monthly report for the
report first meeting of the month due to fact that bank statements are
late coming in. The board concurred that this report carii:,be made
at the second monthly meeting.

Lehigh Supervisor Blatchley reported he had received a letter from the
Valley RR Lehigh Valley Railroad Co.._,_-SHe..said his interpretation of the letter
was that "It gave the town an opportunity to dispense with its
preferential treatment to own the railroad property". He explained
that when a "railroad becomes defunct, the first municipality to get
a chance to own it is the state; the next municipality, is the county
and the third municipality is the town'. He recommended the town not
give up their "preferential treatment" as he thought, in years to come,
"the lines could be valuable to the town for water systems and sewer
lines".
Attorney Gardner advised the town that if the county took over
the preferential treatment, the town under Town Law, could use the
right-of-way for water and sewer. He also advised that Legislator,
Robert Bays, Chairman of the Board of Legislators, was planning a
meeting with the local municipalities to discuss this matter.
ENGINEER REPORT:
WATER PUMPING STATION: the pump has been installed and tested. They
Water Pump are now in thei_?process of testing valves and other equipment.
Station They ran into some difficulty but he hopes to have the facility
in operating condition shortly.
WATER DISTRICT #4: He has had further correspondence with Mr. McNeal
Water Dist. of Pyramid Properties, Inc. Additional data required has been
#4 submitted by Pyramid Properties, Inc. and Mr. Rowell suggested
the board consider what action they wish to take at this time.
The former W.T.Grant store has been rented and the first month's
rent has been paid, according to documents submitted. A lease on
the property will run from 1776-1998.
A discussion followed. Justice Eaton stated that the consensus
of the board at the last meeting was, that the board did not
want to commit the town to this expenditure until they were given
assurance that the mall had a "bonefide tennant" who would stay.
If the mall was unsuccessfull, he said, the town would be left
with the bond to pay off. "That is the reason the board is
concerned with the legal sufficiencies of the lease", he said.
Attorney Gardner stated he had read the certified copy of the
lease agreement between Pyramid Properties, Inc. and K-Mart
and that )it was legal as to text and contents and that he had
seen the certification of the first month's rent payment and he
felt the lease would not be broken within the next 90 days.
There was some reservations as to whether the town should
undertake the formation of this district at this time. After
further discussion, Justice Fish stated he felt that, as long
as everything was legal and in order, the town should go ahead
with the formation of this district especially since the town
was anticipating the formation of Water District #5. This would
necessitate tying into the Water District #4 line and he felt the
town should own the lines in this district. Attorney Gardner and
Engineer Rowell concurred that the town should have control of the
Water District #4 lines.
In answer to a question from Justice Eaton, Mr. Rowell stated it
was his recommendation to form the district at this time. "The
Town has an agreement with Pyramid Properties, Inc. to make use
of their water mains to feed water to South Cortland if the town
so desires. It would be desirable for the town to have control
of the lines. In order to do so, Water District #4 should be
formed". He said, "as a result of negotiations with Pyramid
Properties, Inc., at the time of development of the mall, they were
requested to install pipe lines of adequate size and that the
line be extended to the edge of the state road so that it could
become useful for extension to South Cortland at some later date'.'
Pyramid Properties, Inc. had complied with this request.

In the Matter

the Petition and Application for the Creation of
DISTRICT
Water District No. Four (4) of the Town of Cort-
landville, Cortland County, New York,

A petition in this matter for the creation of a Water
District having been duly presented to the Town Board, together
with the necessary map and plan attached thereto, and an order
having been duly adopted by the Town Board on November 6th, 1974
for the hearing of all persons interested in the matter on the
4th day of December, 1974, at 7:15 o'clock in the p. m., at the
Town Hall, in the Town of Cortlandville, Cortland County, New
York, and a hearing by the said Board having been duly held at
such time and place, and it having been duly resolved and deter-
mined following such hearing, that the petition herein was signed
and acknowledged, or approved as required by law and othrwise
sufficient, that all the property and property owners within the
proposed district were benefited thereby, that all property and
property owners benefited were included within the limits of
the proposed district and that it was in public interest to grant
in whole thezelief sought, and it having been then and there duly
resolved that the establishment of such. district as proposed, be
approved, and an application having been thereafter and on Dec-
ember llth, 1974, duly made in duplicate to the State Department
of Audit and Control at Albany, New York, for permission for
the creation of such district as more fully provided for by
Section 194 of the Town Law, and the State Comptroller having
duly made an order in duplicate, dated February 23rd, 1976,
granting permission for the creation of the district in all
respects as petitioned for and approved by the Town Board as
aforesaid; and one copy of such order having been duly filed in
the office of the State Department of Audit and Control at Albanyi
New York, and the other in the office of the Town Clerk of this
Town, and the Town Clerk having duly presented such order to

Supervisor Blatchley reported:
Re: Drainage -Fisher Ave.; that the Soil Conservation Service engineer
had looked over the problem and advised that he felt it was a Fisher
feasible project. An economist would be sent to look over the Av.Drainage
project and establish the potential loss. Mr. Blatchley hopes a
50% grant will be forthcoming to help finance the project. Attorney
Gardner advised that the town, in certain instances, does have the
authority, under the Town Law, to go onto private property to work
on drainage.

master ranking list of FY-76-77 Appalachia Regional Commission (ARC) funding
requests from project sponsors within the 14 Appalachian Counties of New
York State. The above cited project has been assigned a ranking of 56 out
of the 225 projects considered and has been placed in the To Be Funded category.
The Department of State has indicated that ARC will fund all projects in this
category during FY 76-77 provided the normal requirements for ARC funding are
met.
