A transcript of this hearing is on file in the Town Clerk's Office. The Regular Town Board meeting for the month of December was held at 15 Terrace Road, Cortland, New York with Supervisor Nadolski presiding. Board members present were Councilman Warren Manning, Councilman Ray Thorpe, Councilman Ray Miller and Councilman Melvin Pierce. Others present were Town Clerk Pauline Parker, Deputy Town Clerk Nancy Ross, General Clerk Edna Puzo, Town Justice Donald F. Eaton, Assessor Robert Wells, Highway Superintendant Carl Eaton, Water & Sewer Superintendant Fred Walker, Sr., Zoning Enforcement Officer Don Fowler, Town Attorney John J. Gardner. Others in attendance were Legislature Delmar Palm, Newsreporter Skip Chapman and other interested citizens. The Meeting was called to order by Supervisor Nadolski at 8:15 P.M. CALL TO ORDER With all board members having read the minutes of the regular Town Board Meeting of November 1, 1978 and the minutes of the Special Meetings APPROVE MINUTES held on November 3, November 15 and November 20. There being no corrections or deletions, motion was made by Councilman Thorpe, seconded by Councilman Pierce, All Voting Aye.... the minutes were approved as written. RESOLUTION # 163 AUTHORIZATION TO PAY BILLS AS AUDITED FOR THE MONTH OF NOVEMBER Motion made by Councilman Miller, seconded by Councilman Manning, PAY BILLS All Votes: Aye APPROVED. BE IT RESOLVED, that the bills be paid as audited for the month of November: General Fund Claims # 430-513 $ 10,915.26 Highway ff152-179 6 , 513.21 Water I of117-128 4,639.65 Water 4 it 8 200.00 Water 5 it11-12 1,238.07 Sewer 1 it18-20 3,062.4.5 $ 26, 568.64- The reports for the Town Clerk's Office, Zoning Enforcement Officer, REPORTS Justice's report and Supervisor's report are filed in the Town Clerk's Office and are redil y available to be viewed at the request of anyone in the Town Clerk's Office. Supervisor Nadolski gave the privilege of the floor to the people. There were no questions or comments from the audience. TOWN CLERK'S CORRFSPONDANCE PRIVILEGE OF THE FLOOR Town Clerk Pauline Parker apprised the board of a check she received from Charlotte Kelley Epp for her trailer renewal permit. Zoning Enforcement Officer Don Fowler has inspected the trailer and it meets all specifications for approval RESOLUTION # 164 AUTHORIZATION TO 'ISSUE A HOUSE TRAILER RENEWAL PERMIT TO CHARLOTTE KELLEY EPP, TRAILER RENEWAL PERMIT CHARLOTTE Motion was made by Councilman Manning, seconded by Councilman_ KELLEY EPP Miller, All Votes: Aye.... APPROVED. BE.IT RESOLVED, that the Town Clerk be, and she is hereby authorized and directed to issue a renewal permit to Charlotte Kelley Epp. Highway Superintendant Carl Eaton advised the board of the figures he was given by two sources for materials to repair a 1965 Bulldozer. One REPAIR 1965 source quoted a price $ 1000. less than the other. Mr.Eaton has one more BULLDOZER source to check out and will then accept the lowest offer to purchase the necessary materials to repair the Bulldozer. RESOLUTION # 16f AUTHORIZATION FOR HIGHWAY SUPERINTENDANT CAM EATON TO PURCHASE THE NECESSARY MATERIALS TO REPAIR A 1965 BULLDOZER Motion made by Councilman Manning, seconded by Councilman Miller, All Votes Aye... APPROVED. Wednesday, December 6, 1978 Page 2. WHEREAS, Carl Eaton will check one more source for an estimate for equipment repair and after checking it, will choose the lowest estimate BE IT RESOLVED, that authorization is hereby given for Carl Eaton to purchase the necessary materials to repair a 1965 Bulldozer. PRED WALKER'S Water and Sewer Superintendant Fred Walker, reported to the board that water DEPORT construction at.Bob Bean and Doctor Potter's Development is 601111o, completed, he also stated that the water and sewer at Primo Development is 'about 90% completed. )ON FOWLER Zoning Enforcement Officer Don Fowler apprised the board that building 12/5/78 permits issued this year totaled; -,over 22 million dollars as compared to SEMINAR 12 million dollars last year. Mr. Fowler reported on the State Energy Conservation Construction Code Seminar he attended in Syracuse December 5, 1978. He stated that the new State Energy Conservation Construction Code would take effect January 1, 1979. Mr. Fowler also stated that the new code is alot more technical and has new requirements that will have to be met. In the future special attention will now be given to energy consumption during construction. RESOLUTION # 166 AUTHORIZATION TO PAY STOLAR CONSTRUCTION COMPANY THEIR CONST. PAY RETAINER IN THE AMOUNT OF $ 1621.61 CO.C. Motion made by Councilman Pierce, seconded by Councilman Miller, All Votes, Aye.... APPROVED. BE IT RESOLVED, that on December 19, 1978 Water District # 5 contract will be satisfied by the Stolar Construction Company BE IT FURTHER RESOLVED, that authorization is hereby given to pay Stolar Construction Company $ 1621.61, which had been held back RESOLUTION # 167 AUTHORIZATION TO INCREASE ACCOUNT # A210, PETTY CASH INCREASE FUND _ _ UP TO $ 19150.00 TO COVER POSTAGE FOR THE NEW POSTAGE METER A210 Motion made by Councilman Thorpe, seconded by Councilman Pierce, All Votes, Aye...... APPROVED. BE IT RESOLVED, that authorization is hereby given to increase account # A210, Petty Cash to $ 1,150.00 making an increase of $ 750.00 BE IT FURTHER RESOLVED, that this is to cover the Postage for the postage meter. ATTY GARDNER TO PURCHASE LAW BOOKS Motion made by Councilman Miller, seconded by Councilman Pierce, All Votes Aye.... APPROVED. RESOLUTION # 168 AUTHORIZATION FOR ATTORNEY JOHN GARDNER TO PURCHASE 2 LAW BOOKS FOR A TOTAL OF $ 100.00 FROM THE MATTHEW BENDER COMPANY BE IT RESOLVED, That Attorney Gardner is hereby authorized to purchase 2 Law Books @ $ 50.00 each from the Matthew Bender Company BE IT FURTHER RESOLVED, that after Attorney Gardner's term has expired these books shall become property of the Town of Cortlandville. STREET LIGHT Supervisor Nadolski apprised the Board of a request given to him by REQUESTS Mr. and Mrs. Albert Twentyman of 1271 Fisher Avenue, Cortland, New York. Mr and Mrs. Twentyman have requested a street light in front of their house. Mr. Nadolski also referred to a letter he received from Mr. and Mrs. John Woodard of Stupke Road. They too requested a street light on their road. Councilman Miller stated that there is a moratorium on street lighting in the Town of Cortlandville at the present time. Councilman Miller made a motion to table the discussion until further review is made concerning the two locations. Councilman Thorpe seconded the'motion , All Voting Aye.... Motion was carried. CT'VILLE Supervisor Nadolski apprised the board of a proposal he received from 150th ANN. Town Historian Alice Blatchley regarding the Town of Cortlandville's 150th anniversary. This will be celebrated for 2 years, 1979 and 1980. Mrs. Blatchley has suggested many ways in which to commemorate the occasion. Further information will be available at a later date. 1 is 1 is 1 Wednesday, December 6, 1978 Page 3. 11-1 1 1-1 11 1 Supervisor Nadolski read a letter addressed to Mr. Benny GunzenhauserENVIRONMENTAL from Mr. Arch Petty, Chairman of the Environmental Manageme;'It Gouncil. MrCOMMISSION COUNC Nadolski read from a copy which was sent to him. They are requesting for someone from the Town of Cortlandville to serve on the council. Supervisor Nadolski apprised the board of a letter he received from INT. OF LIME HOL Mr. Irving Olp of Lime Hollow Road. The letter was in regard to the haz- & RT. 13 (HAZARD ardous traffic situation at the intersection of Lime Hollow Road and Rt 13. It was the wishes of the board that Supervisor Nadolski make application to the state of New York investigating the dangers and perils at this int- ersection. RESOLUTION # 169 AUTHORIZATION FOR SUPERVISOR NADOLSKI TO APPLY TO THE STATE TO INVESTIGATE THE DANGERS & PERILS AT THE INTERSECTION OF LIME HOLLOW RD AND ROUTE 13 Motion made by Councilman Pierce, seconded by Councilman Miller, All Votes..... Aye... APPROVED. BE IT RESOLVED, that authorization is hereby given for Supervisor Nadolski to make application to the State of New York to investigate the dangers and perils at.the intersection of Lime Hollow and Route 13, Supervisor Nadolski made reference to correspondence received by him DESIRE OF FORMIN( from Mr. Neil Gingold from the New York State Department of Environmental SEWER DIST. # 2 Conservation, James Feuss from the Cortland County Department of Health; and Kenneth Anderson,who has recently purchased property near the intersection of Groton Avenue and West Road.. They are hoping the Town of Cortlandville will take the necessary steps to create a new sewer district for that area in the near future. Supervisor Nadolski requested a resolution for the following Budget transfers: RESOLUTION # 170 AUTHORIZATION OF BUDGET TRANSFERS Motion made by Councilman Miller and seconded by Councilman Manning, All Votes: Aye.... APPROVED. Library Contract WHEREAS, cert,�n anti -recession funds were set up for payment of Library contract expenses in account # 74.11.4 in the amount of $ 6,361.58 WHEREAS, charges for.July, August and September in the amount of $ 4,999.99 should have been accounted for in account # B74.11.4 but were accounted for in B74.1 0.4-, in error NOW THERFORE, be it, RESOLVED, that the supervisor in his bookeeping system be authorized to charge account # B74.11.4 the amount of $ 4,999.99 and to credit account # B74.10.4 the amount of $ 4,999.99 Water District # 1 WHEREAS, on November 30, 1978, Water District # 1's accounts were reviewed and it was found that actual revenues to date had exceeded estimated revenues; and that actual expenses were going to exceed the estimated expenses in the budget because in April of 1978 approx- imatley $ 20,000. was spent for repairs and services to well # 3 WHEREAS, upon reviewing account # 909 and 599, it was determined that there were surplus funds available, THEREFORE BE IT RESOLVED, that Water District # 1's Budget be amended and $ 15,000. be transferred to SW834.0.4, and be it FURTHER RESOLVED, that $ 25.00 be transferred to SW834.0.1 Water District WHEREAS, there were no provisions allowed in the budget in Water District # 5 to pay for meters and labor charges to that district BUDGET TRANSFERS 112 BE IT RESOLVED, that $ 2000.00 be transferred from SW9730.7 to SW834.0.4 to cover expenses, and be it further RESOLVED; that $ 300.00 be transferred from SW9730.7 to SW8320.4 to cover expenses Supervisor Nadolski apprised the board that a date should be set for the Near end meeting of the Town Board to final ize finances etc. for the year. The meeting will be held on December 28, 1978'at 7:30 at the Town Hall, 15 Terrace Road, Cortland, New York There being no further business, motion was made to adjourn by Councilman Miller seconded by Councilman Pierce, All Voting Aye.... the mebting,was adjourned at 8:4.5 P.M.
