Page 1 The regular Town Board meeting for the month of July was held at 15 Terrace Road, Cortland, N.Y., with Supervisor Stanley Nadolski presiding. Other board members present were: Councilman Warren Manning, Councilman Ray Miller, Councilman Melvin Pierce, Councilman Ray Thorpe. Others present were: Town Attorney, John Gardner, -Town Clerk Pauline Parker, Zoning enforcement officer Don Fowler, Town Assessor Robert Wells, Water and Sewer Superintendent Fred Walker, Sr. and Highway Superintendent Carl Eaton. Also present were Legislators Delmar Palm and Shirley Fish, Newsreporter Paul LaDolche and several_ Town residents. • The meeting was called to order by Supervisor Nadolski at 7:30 P.Me Reading of the minutes of previous meetings was dispensed with as all board members had reviewed copies Min. Approve prior to tonight's meeting. Upon motion by Councilman Miller, seconded by Councilman Manning, all voting aye the minutes of the last regular meeting and the minutes of the special meeting were approved as written. A Town resident, Mr. Martin Gibson of Halstead Road presented a petition against Locko Glazer Corporation Locko-Glazers concerning noise and odor emitted by same. Motion was made by Councilman Miller to receive and file the petition, seconded by Councilman Manning, all voting aye. Motion.Carried. Supervisor Nadolski directed Councilman Thorpe and Councilman Pierce to investigate this matter. Supervisor Nadolski read a letter from Mr. John Curtis of the Cortland Department of Public Works, Cortland DPW concerning a request for permission to enter various manholes for the purpose of investigating sources of infiltration and/or inflow which may be present in the Tompkins St, sewer trunk. Supervisor Nadolski will respond to this letter. Motion to receive and file the correspondence was made by Councilman Manning, seconded by Councilman Pierce all voting aye. Motion carried. Supervisor Nadolski presented Justice Eaton's report of the activities of his office for the month of June: Justice Rep LP12 Cases completed $9,338,00 turned over to the State Comptroller in fines and forfeitures. The reports for the following offices are available in the Tov.m Clerk's Office: a. Town Clerk's report to the Supervisor b. Zoning enforcement officer, Don Fowler report of building permits issued. • c. Justice Eaton's report d, Supervisor's monthly financial statement Highway Superintendent, Carl Eaton requested 1966 GMC permission to sell a 1966 GMC ton truck at junk price. Motion was made by Councilman Manning, seconded by Councilman Pierce that permission be granted. All voting aye. Motion carried. Supervisor Nadolski apprised the board that Water Dist. #5 Stolar Construction Company has brought in some equipment and it appears they will start restoration efforts in Water District #5 - South Cortland Area. July 5, 1978 Page 2 Sewer #1 Supervisor Nadolski apprised the Payne Construction Company will start in Sewer District #1 on July 6 or 7th, board that the Stan restoration efforts 1978. Supervisor Nadolski mentioned that there are copies of the Cortlandville Development Plan Books available in the Town Clerk's Office.The books sell for $10.00 each. Town Clerk, Pauline Parker requested permission Plater to order twenty(20) new Rockwell water meters. Meters RESOLUTION #96 AUTHORIZATION TO ORDER TWENTY (20) NEW ROCKWELL WATER METERS Motion by Councilman Pierce, seconded by Councilman Miller, Votes: All Aye Adopted BE IT RESOLVED THAT the Town Clerk be and she hereby is authorized to order twenty (20) new Rockwell Water meters at the current retail price. Supervisor Nadolski apprised the board that the construction costs for water hook-up at the Woodridge Sub -Division have been paid for by the developer, Barden - Robeson Homes Inc., and he suggested that the developer be forgiven the cost of installation fees and charged. only the cost of the water meters. Meter Charfi�tSOLUTION #97 AUTHORIZATION TO FORGIVE WATER INSTALLATION CHARGES FOR WOODRIDGE SUB -DIVISION Woodridge Motion by Councilman Pierce, seconded by Councilman Manning Votes_ -. All Aye Adopted BE IT RESOLVED, THAT authorization is hereby given to charge the developer of Woodridge Sub -Division, Barden -Robeson Homes, a fee constituting only the cost of a water meter - the cost of installation is to be forgiven. BE IT FURTHER RESOLVED, that the three meters that are now available in the Town Clerk's office should be sold at $53.39 each and the cost of any future meters will be determined by the current retail cost of same. RESOLUTION #98 AUTHORIZATION TO SEND BOOKKEEPER TO Bookkeeper SCHOOL FOR DOUBLE ENTRY BOOKKEEPING Motion by Councilman Thorpe, seconded by Councilman Miller. Votes: All Aye Adopted BE IT RESOLVED, that authorization is hereby given for the bookkeeper, Holly Riese to attend school for double entry bookkeeping. Sessions to be held in Granby, New York August 29, 30, 31 and September 6 and 7, 1978. BE IT FURTHER RESOLVED, that an advance of $150,00 will be given to cover the expenses incurred for same. BE IT FURTHER RESOLVED, that any other expenses incurred will be paid subject to audit by the Town Board. I • 1 1 July 5, 1978 Pg. 3 6 3 Supervisor Nadolski apprised the board that he has received a letter from the Smith Corona:,:.Operations regarding the Lime Hollow, Stupke Road project. The Supervisor will respond to this letter. SCM RESOLUTION #99 AUTHORIZATION FOR TOWN JUSTICE, DONALD EATON TO ATTEND SEMINAR. Motion by Councilman Miller, seconded by Councilman Manning. Votes: All Aye Adopted, BE IT RESOLVED, that authorization is herebygiven • for Justice Donald F. Eaton to attend a Justice,,- _Seminar at St. Lawrence University on July 24 thru 28, 1978. Any expenses incurred by same will be reimbursed, subject to audit by the Town Board. 1 • 1 Supervisor Nadolski apprised the board that questions have been raised concerning legal rights of land owners to develop their land. (See Cortlandville Planning Board Minutes - June 26, 1978 - with special attachment of report dated June 20, 1978). These questions concern the development of Hoxie Gorge area. Supervisor Nadolski directed Councilman Miller and Councilman Manning to study the report, compile information regarding legal rights and report at the next regular Town Board Meeting. Some discussion followed concerning the procedures for declaring a road abandoned. No action was taken, Judge Eaton school Hoxie Gorge Supervisor Nadolski expressed appreciation to Mrs. Betty Palm for the display that was presented at Betty Palm Little York in observance of the July 4th celebration. At 8:00 P.M. the regular meeting was recessed and receiving of bids for one new address machine was officially closed. The Town Clerk opened and read aloud the following bid. Bids Duplicating Products Ithaca, New York $2,085.00 The bid was turned over tothe Town Attorney to examine for sufficiencies and legalities. The regular meeting was reconvened at 8:03 P.M. Supervisor Nadolski apprised the board that Town Assessor, Robert Wells has received notification that Gutchess Lumber Gutchess Lumber Company of Cortland has purchased 1.6 acres of railroad property in the Town of Cortlandville. Supervisor Nadolski apprised the board that he has received a complaint regarding the enforcement of the speed Lime Hollow limit signs at Lime Hollow and Stupke Roads. A lengthy-.` dis%ctission followed, however no action was taken at this time. Supervisor Nadolski directed the Town Attorney, John Gardner to write a letter to Mr. John Fitzgerald in regard to any further insurance claims for damages to his fence. The initial damage has been repaired and six or seven feet of the fence remain in the confines of the highway. Due to this fact, future claims to the Town of Cortlandville cannot be honored for damages to this portion of the fence. Supervisor Nadolski apprised the board of an inquiry received from Mr. Stanley Weddle, President of the Cortland Holstein Holsle+ Club, Mr. Weddle is concerned about the zoning club regu a ions for the Holstein,Barn at the CortlandFair Grounds. Supervisor Nadolski directed the Zoning Enforcement Officer, Don Fowler to make an interpretation of the Zoning Ordinance and advise the Holstein Club of their rights regarding the sale of cattle at the barn. The regular meeting was recessed at 8:15 P.M. and receiving of bids for a new voting machine was officially blosed. 64 July 5, 1978 Page 4 The Town Clerk opened and read aloud the following bid: Bid A.V.M. Election Systems Division Jamestown, New York $2,397.00 The bid was turned over to the Town Attorney, John Gardner to examine for sufficienies and legalities. The regular meeting was reconvened at 8:16, P.M. Attorney, John Gardner apprised the board that he has prepared the necessary papers for the adoption of Local LawLocal Law #1, 1978 and that copies of these papers will #1 be delivered to each board member at least seven days before it is to be acted upon. RESOLUTION # 100 SETTING A DATE FOR A PUBLIC HEARING Public REGARDING ADOPTION OF LOCAL LAW #1 1978. Hearing Motion by Councilman Miller, seconded by Councilman Manning Votes: All Aye Adopted Al Zogg Public Hearing BE IT RESOLVED, that a public hearing will be held on Monday, JtIly 17, 1978 at 7:30 P.M. at 15 Terrace Road regarding the proposed adoption of a local law #1 for -the year 1978. Supervisor Nadolski read a letter from Mr. Al Zogg, dated July 3, 1978, requesting that a 1publi.c hearing be held regarding a zoning determination. RESOLUTION #101 SETTING A DATE FOR PUBLIC HEARING FOR, ZONING DETERMINATION OF AL ZOGG PROPERTY Motion by Councilman Thorpe, seconded by Councilman Miller Votes: All Aye Adopted BE IT RESOLVED THAT A PUBLIC HEARING will be held on Monday July 17, 1978 at 8:00 P.M. at the Town Hall, 15 Terrace Road concerning a zoning determination for Mr. Al Zogg. Pay RESOLUTION #102 AUTHORIZATION TO PAY BILLS AS AUDITED FOR THE MONTH OF JUNE bills Motion by Councilman Thorpe, seconded by Councilman Miller. L OF SAID TOWN. Bond Resolution Motion by Councilman Ray Thorpe, seconded by Councilman Ray Miller. WHEREAS, the Town Board of the Town of Cortlandville, Cortland County, New York, adopted a Bond Resolution on July 6, 1977, authorizing the sale of $90,000,00 serial bonds of s�dd Town to finance the construction of lateral sewers within the confines of Sewer District No. 1 of said Town; and WHEREAS it is now necessary to pprovide for the details and authorizing the sale of $72,000.00 of said bonds and to provide for other matters in connection therewith. NOW, THEREFORE, be it resolved this 5th day of July 1978, by the Town Board of the Town of Cortlandville, Cortland County, New York, as follows: SECTION 1. The said $72,000.00 in serial bonds shall be a statutory installment bond issued pursuant to Section 62.10 of the Local Finance Law of the denomination of $72,000.00, dated July 20, 1978, maturing in twenty (20) equal annual installments of $3,600.00 on the 20th day of July in the years 1979 to 1998, inclusive, and shall bear interest on the unpaid principal balance of such principal sum at a rate not exceeding six per centum (6%) per annum, to be paid on the 20th days of January and July in each year from the date of said bond until it matures. The said bond°shall be signed in the name of the Supervisor of the Town and sealed with the corporate seal of the Town and attested by the Town Clerk; and !-both principal and interest of said bond shall be payable in lawful money of the United States of America at First National Bank of Cortland at Cortland, New York. SECTTON 2.The faith and credit of the- Town are hereby pledged to the payment of the principal of said bond and the interest thereon when due. Such bonds are to be payable from amounts which shall annually be levied on all the taxable real property in Sewer District No. 1 of the Town. SSECTION 3. This resolution shall take effect immediately. 1 P° P, July 5, 1978 Page 6 Attorney, John Gardner apprised the board that he Bids found the bids for the voting machine and the address machine to be satisfactory. Supervisor Nadolski requested that the bids be tabled until further investigation can be made. Upon motion by Councilman Thorpe, seconded by Councilman Miller, all voting aye, the motion was carried. There being no further business upon motion by Adjourn Councilman Thorpe, seconded by Councilman Manning, all voting aye, the meeting was adjourned at 8:35 P.M.
