Pg. 1. 9 The first town board meeting of the month was held at the Town Hall, 15 Terrace Rd., Cortlandville, New York, with Supervisor Stanley Nadolski presiding. Other board members present were: Councilman Warren Manning, Councilman Raymond Thorpe, Councilman Melvin Pierce. Councilman Ray Miller was absent. Others present were: Town Clerk, Pauline Parker, Deputy Town Clerk, Patricia Barber, Town Attorney, John Gardner, Zoning enforcement officer, Don Fowler, Water and Sewer Superintendent, Fred Walker, Sr., Town Assessor, Robert Wells, Newsreporter, Paul LaDolce and several town residents. Reading of the minutes of,the previous Town Board meeting Min. was dispensed with, as all board members had reveiwed copies of the minutes prior to tonight's meeting. Motion was made approved • by Councilman Thorpe, seconded by Councilman Manning that the minutes be approved as written. Votes: All Aye. Motion Carried. CORRESPONDENCE- Supervisor Nadolski. (1) Letter received from the attorney for C.O. Falter Construction Co. Th this letter the attorney requests that an arbitration day be arranged concerning the settle- ment of Contract #10 between the Town of Cortlandville and C,.O. Falter Construction Co. Attorney Gardner apprised the board that he has received correspondence from the above mentioned attorney and if the Town Board wished he would take the correspondence mentioned and proceed with-fthe-':matter. Motion was made by Councilman Thorpe, seconded by Councilman Pierce that the correspondence be received and turned over to the Town attorney, John Gardner. Votes: All aye. Motion carried. Letter Re: Contract 10 (2) Letter from Mr. Robert Lesser regarding the acquisition Letter Re of an easement for the sewer line at the Grot:on,-on.' Sewer lin property. Attorney Gardner was directed to write at Groton Plan a letter to Mr. Lesser and report at a later time. Supervisor Nadolski apprised the board that the Bank Notes have been signed and final payment has been made for the construction of Water District #5 at South Cortland. However, an F.H.A. form #449-10 is needed to complete this file. Mr. William Rowell reported that he has been in verbal contact with Mr. Jennison of F.H. A., this form will be obtained and completed. Supervisor Nadolski presented the December report for the activities of the office of Town. Justice Donald Eaton. Report as follows: IP69 Cases completed $9,234.60 turned over to the State Comptroller in fines and forfeitures. $3,395.90 received and being held in pending cases. Final Pay. Water #5 Justice Report -Dec. 1977 Supervisor Nadolski presented the year-end re ort for • ofthe activities of the office of Town Justice Donald Eaton. Motion by Councilman Thorpe, seconded 1977 by Councilman Manning that the Justice report be received and filed. Votes: All aye. Motion carried. Councilman Pierce reported that the heating system Heating Proj. project at the Municipal building is near completion. However, Town Attorney John Gardner was directed to Munc. Bldg. write a letter in an attempt to hurry the completion along. Attorney Gardner will report on -this matter at the next regular Town Board meeting. Wednesday February 1, 1978 Pg. 2 Water and Sewer Superintendent, Fred Walker, Sr.,,reported New Pickup that -the new four wheel drive pickup truck that was purchased Water ##1 for Water District #1 has arrived and is satisfactory. Su ervisor Nadolski apprised the board that the Bank Final nay. Notes for Sewer District #1 will be signed this week at the First National Bank and final payment will -be made to Sewer ##1 the Stan Payne Construction Co. for the sewer project at McLean Rd., Terrace Rd, Munson Ave, and Pleasantview Drive. RESOLUTION ##18 AUTHORIZATION TO AMEND RESOLUTION #4 for Amend Salary THE. YEAR 1978. SALARY SCHEDULE FOR DEPUTY TOWN Deputy Tovan CLERK Clerk Motion by Councilman Manning, seconded by Councilman Thorpe. WHEREAS, The Town Board at it's regular meeting on January fib, 1978 approved the salary schedule for the Deputy Town Clerk to read $6400.00 and WHEREAS, the figure was read in error. NOW THEREFORE, BE IT RESOLVED, That the salary schedule for the Year 1978 for the Deputy Town Clerk read $6650.00 Said salary to be effective from January 4, 1978, Supervisor Nadolski asked the consensus of the board concerning the adoption of a resolution regarding Town Board approval for the hiring of Town Employees. RESOLUTION #19 AUTHORIZATION FOR THE TOWN BOARD TO APPROVE To�fn Board THE HIRING OF ALL EMPLOYEES. approve all Motion by Councilman Thorpe, seconded by Councilman hiring Manning. Adopted, RESOLVED, That all officers and employees of the Town, except those who are elected and except any Deputy Clerk, shall be appointed by the Town Board, and shall receive such compensation as provided by the Town Board. Supervisor Nadolski apprised the board of the need App. David for the appointment of a member_ to the Zoning Board of Appeals, appointment of Mr. Raymond Thorpe expired on Flew t° December 31, 1977. Mr, David Plew has been recommended Zoning BD, for this position. Appeals RESOLUTION ##20 APPOINTMENT OF MR. DAVID PLEW TO THE TOWN ZONING BOARD OF APPEALS Motion by Councilman Manning, seconded by Council- man Thorpe. Votes: Councilman. Manning, aye; Councilman Thorpe, aye; Councilman Pierce, aye; Supervisor Nadolski, aye. Adopted. BE IT RESOLVED, That Mr. David Plew of McGraw, N.Y. be and he hereby is appointed a member of the Cortlandville Zoning Board of Appeals. NICHOLAS PAULDINE AS TOWN HISTORIAN FOR THE TOWN OF CORTLANDVILLE FOR A PERIOD OF ONE, YEAR. Motion by Councilman Thorpe, seconded by Councilman Pierce. Votes: Councilman Manning, ayd; Councilman Thorpe, aye; Councilman Pierce, aye; Supervisor Nadolski, aye. • Adopted. BE IT RESOLVED, That Mr. Nicholas Pauldine be and he hereby is, appointed Historian for the Town of Cortlandville for a period of one year, l/1/78 to 12/31/78. Water District #5 - Supervisor Nadolski requested the boards App. for approval to make application for completed works to the D.E.C. Department of Environmental Conservation for the South Cortland Water #5 Water project - Water District #5. RESOLUTION #22 AUTHORIZATION FOR SUPERVISOR TO MAKE APPLICATION FOR COMPLETED WORKS FOR WATER DISTRICT #5. Motion by Councilman Manning, seconded by Councilman Thorpe. Votes: Councilman Manning, aye; Councilman Thorpe, aye; Councilman Pierce, aye; Supervisor Nadolski, aye. Adopted. BE IT RFSOLVED,That authorization is hereby given to Supervisor to sign an application for the approval of completed works to the Department of Environmental Conservation. Supervisor Nadolski apprised the board that the Water Meters have arrived at the Town Clerk's Office and are ready for distribution to the residents of South Cortland. However, application must be made and the required fee collected before the meters can be distributed. It was decided that a letter should be'formulated in the near future for the residents advising them of the procedure to make application and 'procure a meter. Water Meters for Water #5 Supervisor Nadolski apprised the board of the possible Fire Dist. need for the Tom of Cortlandville to form -.-a Fire District. for Motion was made by Councilman Thorpe, seconded by Councilman Cortland - Pierce that the Town Attorney be instructed to make a study ville of the legal procedures involved in forming a Fire District. Votess All aye. Motion carried. Councilman Thorpe asked to be advised of the possible ramifications involved in establishing a. fire district in the Town of Cortlandville. Mr. Douglas Staley spoke to the board as a resident and D. Staley taxpayer in the Town of Cortlandville. He explained that in 1975 when the fire contract was signed between the Village Re: Fire of Homer and the Town of Cortlandville that it was discussed Dist, as a possibility that the contract would not be renewed in five years when it expired. In 1980, should this happen, it would be necessary for the Town of Cortlandville to form a fire district. Consequently, in preparation of this, the Town should perhaps give the matter some consideration at this time. 12 Wednesday, February 1, 1978 Pg. 1P The consensus of the Board is that the Town of Cortlandville should proceed with an investigation concerning the establisment of a Fire District for the Town. Court action Town Assessor, Robert Wells referred the board to an authorization given in November 1977 - Resolution Re: Barker's #163 - The preliminary appraisal has been completed and the Pomeroy Appraisal Co. has recommended that the Town proceed with a full court action in this matter. RESOLUTION #23 AUTHORIZATION TO PROCEED WITH A FULL COURT ACTION REGARDING BARKER'S CERTIORARI PROCEEDING. Motion by Councilman Thorpe, seconded by Councilman Pierce. Votes: Councilman Manning, aye; Councilman Thorpe,' aye; Councilman Pierce, aye; Supervisor Nadolski, aye. Adopted. WHEREAS, a preliminary appraisal has been made and it has been determined that the Town of Cortlandville has a valid position, NOW THEREFORE BE IT RESOLVED, That authorization is hereby given to proceed with a full court proceeding regarding Barker's Certiorari proceedin€. Cost of said action to be $1500.00. Mr. Wells also apprised the board that the cost of the preliminary appraisal and the cost of the court action exceeds the assessment budget and requested that the costs be considered a General fund expense. The total of these to be $2000.00. �2000.00 from gen. fund RESOLUTION #24 AUTHORIZATION FOR COSTS OF PRELIMINARY APPRAISAL .AND COURT ACTION TO BE CHARGED TO THE TOWN GENERAL FUND IN THE AMOUNT OF $2000.00. Contract has arrived and is on file in the Town Clerk's Office. The amount of said contract is - "$333:33 per month a period of one ,year. The 1978 contract with the Cortland Free Library has been received and is on file in the Town Clerk's office. BE IT RESOLVED THAT, approval of qualifications is hereby given to Mr. Norm Grant of Cortland, N.Y. to make sewer connections in the Town of Cort1_andville. Town Clerk, Pauline Parker reported that she has received renewal applications for Penquin Trailer Park, C.& H. Trailer Park, Douglas Thompson Trailer Park and an application for a house trailer renewal from Lena & Ralph Warren. Zoning enforcement officer, Don Fowler has investigated these sites and conditions met the require- ments of the Trailer Ordinance. Applications were accompanied by a Health Department permit. The clerks in her office are working from petty cash sep<erate drawers and more cash is needed. BE IT RESOLVED, That the Town Clerk, as Tax Collector for the Town, be and she hereby is authorized an additional sum of $200.00 in petty cash to be used only during the tax collection period.
