HomeMy WebLinkAbout11-15-1979Thursday, November 15, 1979 4:30 p.m. 209 page 1 SPECIAL MEETING A special meeting of the Town Board was held on Thursday, November 15, 1979, at the Town Hall, 15 Terrace Road, Cortland New York, with Supervisor Nadolski presiding. Other board members present were Councilman Melvin Pierce, Councilman Raymond Thorpe, and Councilman Edwin O'Donnell. Others, present were Town Clerk, Pauline Parker; Zoning Officer, Don Fowler; Justice, Donald Eaton, Newsreporter, Skip Chapman, and Doug Staley. The meeting was called to order by Supervisor Nadolski. ® RESOLUTION # 175 DISSOLUTION OF FIRE PROTECTION DISTRICT AND ESTABLISHMENT OF TOWN OF CORTLAND- VILLE FIRE DISTRICT I�15.56 i_(na,, , P6102z w d Motion by Councilman Thorpe r?����� , ` Seconded by Councilman Pierce i)we ov Councilman O'Donnell - Aye Supervisor Nadolski - Aye Councilman Pierce - Aye Councilman Thorpe - Aye WHEREAS, heretofore and on the.15th day of November, 1978, this Town Board adopted a resolution directing that a public hearing be held on the creation of a Fire District in the Town of Cortlandville within certain territories therein designated, and the disolution and discontinuance of the existing Town of Cortlandville Fire Protection District, created by the Town Board on April 8, 1937, and extended by the Town Board on October 17, 1938, and WHEREAS, the Town Clerk caused a notice of such public hearing to be published on November 22, 1978, in the Cortland Standard, a newspaper having general circulation throughout the proposed district and being the newspaper designated by this Town Board for the publications of the legal notices of the Town, and such notice having been published not less than 10 days,'nor more than 20 days before the day designated therein for the hearing, and WHEREAS, the Town Clerk also having posted the notice of said public hearing on the sign board of the Town, as re- quired by law, and WHEREAS, the published notice and -also the posted notices contained a description of the,,--.proposed-Fire District as well as the boundaries of the present Fire Protection District, and also the place where the Town Board would meet to consider the creation of said proposed district and discontinuance of the present Fire Protection ® District and to hear all persons interested in the subject concerning the same, and 4,LNEREAS, this Town Board did meet and held a public hearing as provided .in said notice on the 6th day of December, 1978 at Town Hall in the evening of that day at Town Hall on Terrace Road, Town of Cortlandville, Cortland County, New York, said Town Hall being located within the Town of Cort- landville and within the Territory,embraced within the boundaries of the proposed -district as well as within the boundaries of the present Fire Protection District, and WHEREAS, various persons appeared and all persons who desired to be heard were duly heard; �10 Thursday, November 15, 1979 page 2 Now, upon all the evidence given at such public hearing and due deliberation having been had, it is hereby RESOLVED, that pursuant to Article II of the Town Law of the State of New York, it is hereby determined that it is in the public interest to create the Fire District pro- posed.in the notice of hearing, and there hereby is es- tablished a Fire District within the Town of Cortlandville, Cortland County, New York, the same to be known as the Town of Cortlandville Fire District and to be contained in the territory embraced within the following boundaries, to wit: All the territory within the corporate limits of the Town of Cortlandville and outside the corporate limits of the City of Cortland and Villages of Homer and McGraw; and it is further RESOLVED, that upon the approval and establishment of the said Town of Cortlandville Fire District#as created by the Town Board on April 8, 1937 and extended by the Town Board on -October 17, 1938, embracing all of the territory within the corporate limits in the Town and outside the corporate limits of the City of Cortland and Villages of Homer and McGraw shall be disolved and discontinued, and it is further * (the existing Town of Cortlandville Fire Protection District) RESOLVED, that this Board does hereby find and determine that all the property, property owners and interested persons in the territory embraced within the foregoing boundaries of the proposed Fire District are benefited thereby; and it is further RESOLVED, that the Assessor of the Town of Cortlandville, be, and he hereby is directed to apportion the assessment of the property with the district for Fire District purposes; and it is further RESOLVED, that the Town Clerk of this Town, within 10 days, shall cause a certified copy of this Resolution, in duplicate, to be forwarded to the Department of Audit and Control, Albany, New York, with an appropiate application for permission to establish such Fire District; and it is further RESOLVED, that such portion of this resolution dealing with the discontinuance and dissolution of the present Fire Protection District is adopted subject to permissive referendum as required by Section 185 of the Town Law. RESOLUTION # 176 ADOPTION OF BUDGET FOR THE TOWN OF CORT- LANDVILLE FOR 1980 AND ADOPTION OF SPECIAL DISTRICTS BUDGET FOR 1980 Motion by Councilman Pierce Seconded by Councilman Thorpe Votes: All Aye ADOPTED WHEREAS, on the 8th day of November 1979, the Town Board of the Town of Cortlandville, held a public hearing on the preliminary budget approved by the Town Board and filed with the Town Clerk for the fiscal year commencing January 1, 1980, and having heard all persons in favor of or against the preliminary budget as compiled, or for or against any item or items therein contained, be it RESOLVED, that the preliminary budget, as approved and filed, and presented before this board at the above public hearing, be amended by making the following changes therein: Account No. A1110..1 from $27,875. to $28,544. Account No. A1620.4 from $10,170. to $11,870. • 1 • 1 and be it further Thursday, November 15, 1979 page 3 1 • • 1 RESOLVED, that the preliminary budget approved and filed, with the amendments hereinbefore set forth, and the same hereby is adopted and established as the annual budget of thi town for the fiscal year beginning January 1, 1980, and such annual budget as so adopted be entered in the minutes of the Town Board; and be it further RESOLVED, that the Town Clerk of this town shall prepare and certify as provided by law, duplicate copies of the annual budget hereby adopted, together with the assessment rolls for the benefit of improvement, for Water District No. 1, Water District No. 2, Water District No. 3, Water District No. 4, Water District No. 5, and Sewer District No. 1, adopted pursuant'to Section 202-a of the Town Law, and with- in five days thereof, deliver two copies to the Supervisor of the Town, and the Supervisor shall present the copies of the annual budget to the Legislature of Cortland County with- in taia days after his receipt thereof from the clerk. There being no further business, a motion was made'to adjourn, by Councilman O'Donnell, seconded by Councilman Thorpe, all voting Aye... The meeting was adjourned at 4:45 p.m..
