December 14 1971 Minutes of the Regular Monthly Meeting of the Town Board of the Town of Dryden held December 14 , 1971 , at the Town Hall , commencing at 7 : 30 P . M . Present were Councilmen Gridley , Tarr , Webb , and Cotterill , Attorney Amdur , & Zoning Officer Stewart . Supervisor McCord arrived at 8 : 10 P . M . Councilman Gridley presided and called the meeting to order . The meeting was opened with the Pledge Allegiance to the Flag . Roll Call was : by the Town Clerk . Tompkins County Sewer District : . Public . Hearing for said district will • be held in - January . The county will be buying the ' Cayuga Heights Plant . Water Agency : Reported that the Towns of Lansing , Ithaca , portion of Dryden and Village of " Cayuga Heights have agreed to go the intermunicipal route . Rural Representatives and Rural Supervisors : Reported that they met with Mr . Hurlbutt , who spoke on behalf of the Civil Service Law . County Budget : Reported the following figures : County Budget at 22 million , 2 million increaseover last year , approximate increase of 1 . 2 million was in wages and salaries . Town of Dryden : assessed valuation this year ts , 440 . 9 million vs 39 . 6 million last year . County tax rate for Dryden is $ 5 . 12 , down 32 * from last year . Reapportionment Committee - : Appointed and functioning and scheduled to report in March on the new county- representative districts : Public Defender : Called attention to the rising cost of the Public Defender and the probability of creating a full - time position in this capacity . Board of Assessors : Public Hearing to be held by the County Board regarding a Local Law which would change the Board of Assessors and will consist of 3 members . The local advisory boards used in the past will continue . ALHPA Committee : Survey conducted in the surrounding counties regarding the need for low level care institutions . ' Tompkins - Cortland Community College : Public service asked to change from natural gas to fuel oil or some other form of heat and the specs had to be redesigned to meet this request , therefore , delaying the bid process . 1 Thomas Payne and Bob Cochran from the Assessment Department of Tompkins County were present at the request of the Town Board to discuss the four year plan of revaluation of the towns , villages and city of Ithaca . There was discussion as to how they assess mobile homes , mobile home parks and sub - divisions . CITIZENS PRIVILEGE OF THE FLOOR Robert Oltman , manager of Cortland Video , reported that there is now a new ownership and they be recognized as such . Attorney Amdur said that is pro - vided for in the franchise so it can be signed and transferred on appli - cation earapproval by the Town Board . RESOLUTION # 149 APPROVE CHANGE OF OWNERSHIP TO SAMMONS COMMUNICATIONS , INC . Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that this Board approve the change in the franchise from the Cortland Video to Sammons Communications , Inc . 2nd Councilman Tarr Carried ' There was continued discussion regarding the franchise which expires 12 / 31 / 71 . They requested and applied for reinstatement for 10 years . Supervisor McCord • proposed a clause for 1 % of the gross revenues from the town , excluding the villages . RESOLUTION # 150 RENEW FRANCHISE Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that this Board renew the Franchise for an additional 10 year period ( expiring 12 / 31 / 81 ) to Sammons Communications , Inc . with the same terms upon the condition that 1 % of the gross income derived ` from the town , exclusive of the villages , will be paid annually to the Town of Dryden . 2nd Councilman Cotterill Roll Call Vote - all Voting - YES Gerald DeCelles , Legal Advisor for Dryden Youth Court , reported difficulty in getting cases before them . He reported that he has been working on getting publicity . He will teach the bar course the following semester and about 12 students have signed up so far . . 179 COUNCILMEN PRIVILEGE OF THE FLOOR Councilman Webb said he checked with the Town Clerk and found that the insurance coverage for town highway equipment for use for firemen if the need should arise . He has talked with Highway Superintendent Case and he is willing to cooperate and he will determinewhat equipment can be used . RESOLUTION # 151 USE OF TOWN EQUIPMENT - 14 . Councilman Webb offered the following resolution and asked its adoption . RESOLVED , that this Board approve the Highway Superintendent ' s use of Town of Dryden equipment for major fires within the area at the request of fire chiefs or fire coordinator . 2nd Councilman Gridley Carried ATTORNEY Attorney Amdur reported that Diebler Drive ( off Caswell Rd . ) has been approved by Highway Superintendent Case . It is 775 feet with 50 foot turn 0 arounth RESOLUTION # 152 ACCEPT DE;IBLER DRIVE Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that this Town Board accept the road Deibler Drive in the Town of Dryden . . 2nd Councilman Cotterill Carried Attorney Amdur reported that the Furman Case is in Justice Court . TOWN CLERK : The Town Clerk requested an increase of $ 1 -. 00 for the Marriage Certificate making the total cost of a marriage license $ 4 :' 00 . RESOLUTION # 153 INCREASE FEE . POR CERTIFICATE OF REGISTRATION OF MARRIAGE Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that this Board increase the fee '_: fof the certificate of registration of marriage from $ 1 . 00 to $ 2 . 00 effective immediately . 2nd Councilman Tarr Roll call Vote - all voting YES ill ZONING OFFICER Zoning Officer reported that he had issued 15 building permits for the monthly period , total 217 vs 189 last year . He has scheduled 2 public hearings for the 28th of December , both on billboards . Reported he had a complaint regarding Shulman)' s trailer park . Mr . Shulman has placed a tank too close to the ptspeny line . He contacted Mr . Shulman and his attorney claims it is not a structure . Attorney Amdur said it should be screened and the proper `; distance from the side. yard ( 15 feet ) . . This was discussed and Supervisor McCord suggest that the Zoning Officer write Mr . Shulman out - lining the things the board expects him to do . LETTERS Supervisor McCord received a copy of a letter from Walter Schwan to Representative Howard W . Robison urging him to use his influence to deny funds fequested by the Cayuga Lake Basin Board to do a multi - purpose upland dam study . In Mr . Schwan ' s opinion , it would be a waste of tax - payers money as the Towns of Ithaca , Lansing , Dryden and Village of Cayuga Heights have decided to go the inter- municipal route using Bolton Point as their source . He urged Supervisor McCord to write a similar letter . McCord received a letter from Ernest J . Cole requesting the * Supervisor consideration and approval in lending the Boards . support toward a long term lease negotiations with Cornell University on a parcel of land near the corner of Handshaw Road and Route 13 . Their purpose would be to develop it into a site for a permanent County . Fair Grounds . This , was discussed among the members - of the Board . Attorney Amdur said for recre - atignal use " it would be an allowed use in zoning . RESOLUTION # 156 RE- APPOINT DON ROSE Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that this Board re - appoint Donald Rose to the Board of Zoning Appeals to a term - of 5 years expiring December 1976 . 2nd Councilman Cotterill Carried FUNDS RESOLUTION # 157 TRANSFER / TO INSURANCE Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that the sum of $ 1 , 484 . 00 from Surplus Monies in . RESOLVED , that the sum of $ 12 , 942 . 80 from Item la in the Highway Fund be transferred to Item 1 in the Highway Fund . 2nd Councilman Tarr Roll Call Vote - all voting YES ' RESOLUTION # 164 EMPLOYEES RETIREMENT Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that this Town Board of the Town of Dryden agrees to pay the State $ 135 . 00 for a preliminary valuation on the New York State Employees Retirement System . 2nd Councilman Tarr Roll Call Vote - all voting YES At this time Supervisor McCord read a letter from the Justices , Town Clerk and Mrs . Wallenbeck explaining the importance of the informational newsletters , training schools, etc . derived from the Association of Towns . Discussion was had on this subject . • RESOLUTION #165 TABLE MEMBERSHIP TO ASSOC . OF TOWNS Councilman ridley offered the following resolution and asked its adoption . RESOLVED , e .: r- equest to reconsider_ . membership ,. be ; tabled for a month . 2nd Councilman Cotterill Carried NEW BUSINESS Organizational Meeting set for Tuesday at 8 P . M . , January 4th . Supervisor McCord requested members of the Board to meet at 7 : 30 with members of the Board of Zoning Appeals and also the Town Justices to talk about enforcement of the zoning ordinance . It was noted that the test for the snowmobilers had not been done due to the lack of snow and it was questioned as to what to do about the other amendments to the Snowmobile Ordinance . It was suggested that it be left to the discression of the group to set another date for the test . Meeting adjourned Charles G . McCord - Supervisor Rosemary Stelick - Town Clerk 182 Public Hearing - White Adv . Co . December 28 , 1971 The Public Hearing was called to order at 7 : 35 P . M . by Supervisor McCord . Present Supervisor McCord , Councilmen Webb , Tarr , Cotterill ; Zoning Officer Stewart ; Absent were Councilman Gridley and Attorney Amdir . Supervisor McCord read the Notice of Hearing as advertised in the news - papers . It was noted that the people in the area were notified by cards . Supervisor McCord reported that the purpose of this Hearing was the application for a Special Permit by the White Advertising Company to erect a new billboard for the Sheraton Inn on the Riley Hemingway property 3 miles north of the Village of Dryden . At this point Supervisor McCord opened the meeting to questions . ' Matthew Yob , Representative for White Advertising , was present and stated that it would be a small sign for southbound traffic, there would be no lights . • Supervisor McCord read a . letter from Mr . and Mrs . Charles Keleman , 50 South St . , Dryden , registering objection to allowing anymore billboards to be erected in the Town of Dryden . Their reasons stated was visual pollution and detraction from the surrounding natural beauty . Mr . Yob explained that a site selected for billboards is according to view , angle toward the highway ., no obstruction , not around a house if possible , about 15 miles from the advertised business and not congested with other signs . Being no other questions or comments the hearing was declared closed at 8 : 45 P . M . The Board decided to reserve decision . December 28 , 1971 Public Hearing - National Adv . Co . Supervisor McCord called the Public Hearing to order at 8 : 00 P . M . for the purpose of hearing all interested parties regarding the application for a Special Permit by the National Advertising Company to erect a billboard for Cortland General Agency , Kemper Insurance and Stafford ' s Garage on the Riley Hemingway on Route 13 approximately 2 . 5 miles north of the Village of Dryden . It was noted that it was advertised in the newspapers and residents of the area were duly notified by cards . Representative from National Advertising was present and reported that the Stafford Garage sign is there , they just want to back it up with Kemper Insurance and Cortland General Agency sign preferably in a V- shape position . The Zoning Officer passed pictures around showing the existing sign . Set back requirements were discussed . Being no other questions or comments , the Public Hearing was declared closed at 8 : 10 P . M . The Board chose to reserve decision . At this time the Board discussed billboards and it was noted that they all advertise businesses in Cortland or Ithaca and not that beneficial to businesses in the Dryden area . Councilman Cotterill said he did not see where the billboards were a credit to our town or to the citizens of Dryden . Similar sentiments were expressed by other members of the Board .
