July 13 , 1971
Minutes of the Regular Monthly Meeting of the Town Board of the Town of
Dryden held July 13 , 1971 ., at the Town Hall , commencing at 7 : 30 P . M .
Present were Supervisor McCord , Councilmen Gridley , Cotterill , Tarr and
Webb , Zoning Officer Stewart and Attorney Amdur .
The Meeting was called to Order by Supervisor McCord .
The Meeting was opened with the Pledge Allegiance to the Flag .
Supervisor McCord asked the Board if there were any additions or corrections
to the Minutes of the June 8th Regular Monthly Board Meeting .
Motion was made by Councilman Gridley , seconded by Councilman Tarr that
the Minutes of the Regular Monthly Board Meeting of June 8 , 1971 , as
submitted by the Town Clerk be approved .
411 COUNTY BRIEFING : No report - Mrs . Schickel absent .
CITIZENS PRIVILEGE OF THE FLOOR :
Mr . Woodrow Wood from Lewis Street in the Village of Dryden was present to
request a review of the bridge on Lewis Street . Supervisor McCord reported
that Superintendent Case had looked at the bridge and his recommendation
w as that the bridge will have to be replaced sometime in the future . Mr .
Wood was not happy with this answer as he felt it should be taken care of
n ow rather than a promise of " sometime in the future " . Supervisor McCord
✓ eported that the Village started last year to widen the whole area down
there and has been widened enough : : to take the flow and the bridge can
handle the flow during flood time , but further downstream about 100 or
200 yard8 west of the bridge it narrows down , to such a point that it
backs the water up . Bob Watros opinioned that the bridge is inadequate on
the basis that from all the work done by the Village , during the spring run -
off they still had the deposit of gravel on the upstream side of the bridge
✓ esulting in a slowing down of the flow . Mr . Watros reported that the advise
they got from. the Conservation Department was that a wider bridge would
solve the problem , as the current bridge slows down tHe ' flowTa'nd ^leaves
deposits to build up and narrow the outlet . The situation was discussed
at length with the Village taking the stand that the bridge is at fault and
the Town contending that the narrow stream downstream is of major concern .
Supervisor McCord said there was no money in the budget for a new bridge
' at this time , but it would be under consideration when setting up the budget
for 1972 . Mr . Wood questioned the performance of Highway Superintendent
Case ih answering to the people . Mr . Watros said he felt the position
should be brought up as appointive rather than elective . Attorney Amdur
said it was put to the people a few years ago and badly defeated . Bob
Watros said he felt the people were not properly informed as to the
advantage of having an appointed official , the people generally felt a
right was going to be taken from them . Supervisor McCord said the Board
can not direct the activities of an elected official , but they can an ("
appointed official . Supervisor McCord said he would get in touch with
Highway Supt . Case and have him get in touch with Mr . Wood and give him an
answer , yes or now , put a ' time on it , and why . -
ZONING ORDINANCE AMENDMENTS
At this time Supervisor McCord reported that there would be discussion
regarding amendments to the Zoning Ordinance . One amendment under
consideration would be adding a section on " Quarries and Excavations " .
Copies of this proposed amendment were passed out to members of the Board .
It was discussed at length and some changes were suggested . Attorney Amdur
• was advised to make the changes as quickly as possible so that it might
be presented to the public . Attorney Amdur reported that she had a heavy
y schedule and that the amendments must go to Frank Liguori , County Planner ,
for approval before it can be brought to a Public Hearing . Supervisor
McCord said we need a better definition of ayard to control the junk car
situation as the Zoning Officer is having a difficult time enforcing the
control of the junk cars because the people claim that the cars do not
sit in their " yard " . This was discussed at length . There were 3 requests
for a change from RC zone to RB zone . Barbara ' Caldwell reported that there
appeared to be an oversite in one section of the ordinance in the final
adoption and she did not have the paper with her nor could recollect just
what occurred , but she would find the paper in her files and get it to
Attorney Amdur .

COUNCILMEN PRIVILEGE OF THE FLOOR
Councilman Cotterill reported that the directory is progressing and hopes
to have it to a printer in a couple of weeks .
Councilman Webb said he saw that the sign is still up on Route 13 aid
wanted to know why . Zoning Officer Stewart reported that originally he
g ave the sign company 10 days to remove it and they called and wanted
2 weeks which he granted and the time is about up he thought . Super isor
McCord instructed the Zoning Officer to call them and tell them to •, et
it out of there .
ATTORNEY
Attorney Amdur reported that she is involved in two cases in court . One
involving Mr . Furman . His attorney moved for a stay of proceedings and
claimed that the Zoning Board was acting arbitrarfly, Also he claims t at
the Zoning Ordinance does not contain the amendments for 1970 . Attor ey
Amdur said it does and is printed to that effect in the Ordinance on •
page 1 . And they also claimed that the Zoning Board ' s Oath of Office
h ad not been filed and she reported that they had been .filed and. made
27 copies of the Oaths . She reported that the strange thing about it
is that Mr . Furman came in , plead guilty and paid a fine of. $ 100 . 00 . The
other case is with Michael Pichel - and he will now move the case to the
Grand Jury on the grounds that it is a misdemeanor , she said in her
opinion there is a violation . She reported that there is going to be a
h earing on Thursday .
TOWN CLERK
N othing to report .
ZONING OFFICER .
Zoning Officer Stewart reported that he has issued 23 permits since 1 . st
month ' s meeting - a . total of 92 for the year compared to 115 issued t e
same time a year ago . He has had 3 complaints , 3 violations have been
turned over to Court . He has set a Public Hearing for a Special Permi
on the 27th of July at the Town Hall at 7 : 30 P . M .
L ETTERS
Supervisor McCord received a letter from the Department of Transportalion
whereby they have denied the request for a reduced speed limit on Upp ° r
Creek Road in Etna due to the fact that the density has not changed .
Supervisor McCord said he plans to write to them and tell them just
because the density hasn ' t changed , doesn ' t mean that the condition ol the
road warrants an increase of 5 miles and hour to the new state speed . f
55 MPH .
A letter was received from the Etna Community Association stating that
they were against the expansion of the trailer park owned by David Pa ke .
Zoning Officer Stewart reported that he has , never returned to apply for
a Special Permit since their first converstation .
PLANNING BOARD
Barbara Caldwell reported that residents in Etna had inquired as to th -
procedure for a petition to change that area from RC to RB zone . She
referred them to Attorney Amdur . Attorney Amdur said she never heard f om
anyone in Etna concerning changing zones . Mrs . Caldwell said that the
Planning Board was concerned that if a zone was changed that it would of
just change in a small stretch of a few houses . She asked to Board what
they should do if a member of the Planning Board has missed several ( 6 - 7 )
meetings in a row . This was discussed and Supervisor McCord recommendes

that the Planning Board draft a letter of resignation , send it to the
person desiring to resign and have them sign it and return it , •tthen th =
Town Board will appoint someone to fill the vacancy . She wanted to kno
if the Town Board had any direction or instruction that the Planning
Board should follow . Supervisor McCord said he would like to see them
work on the Etna- Freeville sewage problem , involving George Jr . Republic .

Councilman Gridley offered the following resolution and asked its adoption .

RESOLUTION # 98 SUMMER RECREATION PROGRAM - PAYROL
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED that the Supervisor be authorized to process a payroll every
two weeks for the Town of Dryden Youth Program as approved by the Rec eation
Chairman . Vouchers will be audited at the following meeting of the Tom
Board .

RESOLUTION # 99 REFUND UNIT CHARGE - SEWER # 2
Councilman Gridley offered the following resolution and asked its adoration .
RESOLVED that the Supervisor be authorized to refund the sum of $ 162 . 113
to John Paribello for the overcharge of sewer units on parcel # 56 - 3 - 6

RESOLUTION # 100 REFUND UNIT CHARGE - WATER DIST . # 1!
Supervisor McCord offered the following resolution and asked its adoption .
RESOLVED that the Supervisor be authorized to refund the sum of $ 43 . 8
to John Paribello for the overcharge of water units on parcel # 56 - 3 - 6 .

The Regular Monthly Board Meeting will be held at the Town Hall , August 10 ,
at 7 : 30 P . M .
Motion was made by Councilman Gridley , seconded by Councilman Cotteril
that this meeting be adjourned .

PUBLIC HEARING
July 27 , 1971
Public Hearing was called to order at the Town Hall by Lewis Gridley as
Chairman at 7 : 30 P . M . Present were Councilmen Gridley , Cotterill , Webb
and Tarr .
The purpose of the Hearing was the application of White Advertising to
double - face an existing sign on the Arthur Anderson farm on Route 13 ,
north of the Village of Dryden .
Mr . Stairs indicated he saw no harm in having the sign double - faced . Mr .
Anderson recommended same . Mr . Yobb of White Advertising stated lighting
would be from the bottom as per sign presently facing northbound traffic .

Being no other discussion , the Public Hearing was closed at 7 : 45 P . M .
Supervisor McCord and Attorney Amdur entered at this time .
Open discussion followed re : zoning changes , voting on zoning , etc .
Decision was reserved .
PUBLIC HEARING
July 27 , 1971 .
Public Hearing was called to order by Supervisor McCord at 8 : 10 P . M .
The purpose of the Hearing was the application of Mr . Blodgett to expand
his present business at Webster Cleaners on Dryden Road .
Mrs . DeGroff talked of the noise problem with snowmobiles at night . She
felt there should be established reasonable business hours .
RESOLUTION # 101 DISMISS THE APPLICATION
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED that the application of Mr . Blodgett be dismissed on the grounds
of his non- appearance at the hearing ; he having been made by mail aware
of said hearing including time and place .

Once again Mrs . DeGroff talked of the noise problem re snowmobiles and
other cycles . .
