HomeMy WebLinkAbout1971-03-09 dui - • t• March 9 , 1971 Minutes of the Regular Monthly Meeting of the Town Board of the Town of Dryden held March 9 , 1971 , at the Town Hall , commencing at 7 : 30 P . M . Present were Supervisor McCord , Councilmen Gridley , Cotterill , Tarr and Webb , Zoning Officer Stewart , Attorney Amdur and County Representative Schickel . The Meeting was called to order by Supervisor McCord . The Meeting was opened with the Pledge Allegiance to the Flag . Roll Call was by the Town Clerk . Supervisor McCord asked the Town Board . if there - were . any additions or corrections to the Minutes ' of the Public Hearing of February 1st re Mobile Home Park Ordinance . 411 RESOLUTION # 54 APPROVAL OF MINUTES Councilman Gridley offered the following resolution and asked its adoption . RESOLVED that the Minutes of the Public Hearing held February 1st be approved as sent . 2nd Councilman Tarr Carried Supervisor McCord asked the Board if there were any additions or corrections to the Regular Board Meeting Minutes of February 9th . RESOLUTION # 55 APPROVAL OF MINUTES Councilman Gridley offered the following resolution and asked its adoption . RESOLVED that the Minutes of the Regular Board Meeting held February 9th be approved as sent . 2nd Councilman Cotterill Carried DRYDEN YOUTH COURT . Supervisor McCord reported that the first item on the agenda will be a presentation by George Patte and Wayne Sherwood concerning the newly formed Dryden Youth Court . Mr . Patte explained that he is a teacher at the Dryden School and has been involved with this program since November . Mr . Sherwood ° explained that a County Youth Court was started several years ago by the Bar Association and interest has warmed . The Dryden Youth Court will apply only to residents of the Town of Dryden . It is removed from the school and not a school function . They will serve youths between the ages of 12 - 18 . The biggest advantage is that the defendent does not have any criminal record . There will be a defense , prosecution and three judges . If the defendent is found guilty , the penalty will be charged off in work around the community . Mr . Patte felt strongly that it is a needed function and that it will put some real responsibility with kids . They requested use of the Town Hall to hold Court between the hours 3 - 5 P . M . one night a week . Supervisor McCord said he did not see any problem with them using the Town Hall for this purpose . The submitted a request for funds : $ 45 . 00 for filing cabinet , $ 200 . 00 for supplies ( paper , stationery , envelopes , stamps , etc . ) and $ 750 . 00 for Mr . Patte ' s salary as legal advisor ( $ 15 per week for 50 weeks ) ; representing a total of $ 995 requested . They reported they have received $ 100 from Administrative Board and $ 40 from the Bar Association . Mr . Patte said he expects to work about 5 hours a week on this program . Supervisor McCord said he would have to study the budget to see if funds were available . t ` . COUNTY BRIEFING County Representative Schickel was present to make hers report at the county level . County Planning : Now called a Temporary Board of County T . Planning . There will be 15 members and membership from other organizations that have to do with different types of planning in the county . The term will be for one year . There will now be a representative from each town and village . It will be an advisory type of board . Dag ct : Has been awarded to SPCA to take care of the dogs of the county . Industrial Development Agency : County Board has written to the State Legislature to — form an Industrial Development Agency in this county . College : Now in the design development stage and the plans will be presented to the Board of Trustees on March 18 and then will be presented to the County Board for approval on March 22 . They hope to start construction on the road as soon 123 tas the weather breaks . Aged Exemption : The County Board voted to raise he income exemption from $ 3000 to $ 4000 for reduced taxes on real estate . EOC : Mrs . Schickel reported that there are some vacancies on the EOC membership and she asked for recommendations for anyone who was really interested to serve on this Board and she would pass this on . CITIZENS PRIVILEGE OF THE FLOOR Mr . Donald McKee from Cortland was present with preliminary drawings for a proposed mobile home park on the . Fall ° Creek Road . The first section w ill consist of 99 units on 50x100 lots . He said the Health Department ✓ eported to him that they were having a lot of trouble throughout the county with the packaged sewage treatment plants and they recommended individual systems if the soil tests out all right . He said the roads w ill be paved , utilities underground if possible and his own water supply . He hopes to convert the barn into an office , laundromat and ✓ ecreational building to go with the park . Supervisor McCord said he • would have to schedule a public hearing . COUNCILMEN : Councilman Cotterill reported that he has had several calls from residents on Livermore Road . They complained that the highway has not been main - tained for a school bus to turn around during this winter . Mr . Levengood claimed that in previous winters since he lived there , the highway department opened it up by Perkins and provided a turn - around there and since Perkins have moved away , they have quit doing it . Supervisor McCord suggested that Councilman Cotterill check this out with Highway Superintendent Case . TOWN CLERK Mrs . Stelick reported that she checked out the request of the Board that the State erect a crossroad sign at Mineah and Kirk Roads on the south side of Route 13 . She reported that the State Highway Department will not put up a sign at this location because the visibility is over 700 feet . Visibility under 700 feet would require a sign . ATTORNEY Attorney Amdur reported that she had written to Mr . Jetter with a copy to Mr . Shulman re Kenton Plaza sign and she has not heard anything yet . She reported that there are two signs , one already existed and the other has been built and erected 11 - 11 - 69 , which was after the zoning ordinance was passed . . ZONING OFFICER Mr . Stewart reported that he has informed the Love Inn that people should stop living there until they have corrected the situation . He said that he also wrote them a letter giving them 30 days to comply . Attorney Amdur said this was actually an informal notice . She said in order to give them 30 days notice , we will have to give a specific list of violations indicating by law they have 30 days to comply . Zoning Officer Stewart reported that he received a letter from the Love Inn informing him that they are taking steps to conform with the laws of the State of New York . They have changed doors , and electrical outlets and switches have been covered . They requested that they be allowed to continue as is on an emergency basis in order that they may be able to continue the rehabiltation program . Mr . Stewart said he did not feel it should be his decision re extension of time . He reported that he will be meeting with Mr . Dixon from the State . Supervisor McCord suggested that the Zoning Officer , with Mr . Dixon ' s advice , come up with what they have to do to at least meet the • safety regulations . Attorney Amdur reported that she has checked and the town will not be liable in the event that the multiple residence does not conform to the multiple residence law . She said we can extend the 30 day period to a reasonable time , but she questioned what is a reasonable time . She said there has been a fire call there at one time . Zoning Officer Stewart said he will proceed on this with Mr . Dixon . Zoning Officer Stewart also reported that he has taken pictures of all billboards presently erected . He also reported that he is working on the directory . CORRESPONDENCE Supervisor McCord reported on correspondence re County Water Agency meeting that was held on February 18th . The Town of Ithaca is proceeding with their exploration of test wells in the inlet valley area . The City reported that they were proceeding their investigation from the Inlet Creek for their supply of water . Cayuga Lake Basin Board reported on their progress on the 124 Upland Multi - Purpose Reservoir study . Town of Lansing reported on their progress on the Bolton Point Source from Cayuga Lake . And E . Abbott ' s proposal to Senator Day that the Regional Water Resources Boards be authorized to implement water resources plans . Also Gary A . lee asked the County Water Agency to consider the possibility of a cou ty sewer district to serve Community College project and adjacent lanes in the Town of Dryden . Supervisor McCord reported that he had a copy of a letter to Mr . Howell from Frank Liguori regarding the request for changes in oper . ting hours at the refuse site . Mr . Liguori informed Mr . Howell that the would not change any hours at this time and there will be a revaluatio July 1 and at that time they will see if a change should be made . It was noted that the refuse site is now open to 3 : 00 Saturdays . Supervisor McCord reported that the equalization rate is set . t 77 which is down from 83 in 1970 . Supervisor McCord noted that the equalization ✓ ate for all the towns in the county has been dropping fairly significantly over the last few years . He noted that the percent in change or the Town o f Dryden between 1969 - 1970 was 11 . 85 % , the county average wa . 9 . 65 % . He said this means that the Town is roughly 2 % above the county average and that we should be receiving about 2 % more in state aid . Discu % sion followed . Supervisor McCord reported that he had a copy of a letter fro Walter Schwan to the Town Board concerning Cayuga Lake Basin Board ' s request for state funding of $ 190 , 000 to study the Multi - Purpose Upland Dam . Copies of this were sent to members of the legislature , conservation department and Governor Rockefeller . Mr . Schwan requested that the Town board of the Town of Dryden furnish their support toward their efforts to ave this funding request deleted from the 1971 state budget . Mr . Schwan noted that if the funding is approved , the Basin Board study when complet - d will have the effect of being a policy decision of the State of New York which will be binding on the Water Resources Commission of the Envir . nmental Conservation Commission . Any municipality in Tompkins County w ich request permission of the State to draw up anyother water source , will have to prove to the state that their proposal is better than the basil board ' s proposal an thus the completed _ basin board study becomes one more hurdle to surmount Albany when we need water . Mr . Schwan wrote that i the town board concurres with their statement that the board send a sim lar statement to the same people they have sent their statement to . . This was discussed . Consensus of the board was to lend support against pending anymore money at this point . Supervisor McCord said he would d aw up the letter . . JUSTICE REPORT Justice Hoagland $ 1012 Justice Newhart $ 530 RESOLUTION # 56 HIGHWAY BILLS Councilman Tarr offered the following resolution and asked its .adoption . Less : Investment 10 , 000 . 00 Ending Balance 2 - 28 - 71 $ 17 , 612 . 48 OLD BUSINESS Supervisor McCord offered his -recommendations for- the Committees , as follows : GENERAL FUND - Councilman Gridley & Councilman Cotterill • HIGHWAY FUND - Councilman Webb and Councilman Tarr BUILDINGS & GROUNDS - Councilman Gridley & Councilman Tarr Supervisor McCord reportedthat last month it was discussed that a snow- mobile committe be formed to look over the present ordinance and note what the state may or may not be doing and work until this fall to come up with changes in the present ordinance or modifications to make it a more useful ordinance . He offered the following appointments to the Snowmobile Committee : Supervisor McCord Councilman Webb Councilman Cotterill Warren Underwood Garth Jackson Alton Reed Supervisor McCord expressed the desire to find one or two more people to serve on this committee . Supervisor McCord noted that Mr . VandeWeert has moved and , therefore , a vacancy exists on the Zoning Board of Appeals . He reported that he had asked Councilman Webb to investigate possible replacement and at that time asked Councilman Webb if he had any recommendations to report . Councilman Webb reported that Kermit Marquis , a farmer from the Freeville area , would be willing to serve as a member of the Zoning Board of Appeals . RESOLUTION # 58 APPOINT KERMIT MARQUIS Councilman Webb offered the following resolution and asked its adoption . RESOLVED that this Board appoint Kermit Marquis as a member on the Zoning Board of Appeals to fill the term left vacant by the resignation of Mr . VandeWeert . 2nd Councilman Cotterill Carried County Water & Sewer study : Supervisor McCord mentioned that Gary Lee had talked of this and indicated that h` twould like to know if the town board approves of this agency . Supervisor McCord said that it was not discussed at the last meeting and he felt it should be discussed now . Councilman Webb inquired about the financial part of such a district . Supervisor McCord replied that it is based on the assessed valuation of the district in question . He noted that Lansing has included a much larger area in their • district than will be directly serviced by water and sewer immediately or perhaps even in the next five years . He further explained that Lansing has zoned the total district so that those areas that will be serviced by water and sewer will pay substantial portion of costs of the district , but every - body in the district will be taxed a certain amount . This is what would happen if the Town of Dryden became a part of the northeast water district with the Town of Ithaca and the southern part of the Town of Lansing . The financing in the district would be on that basis . Supervisor McCord said what we are basically talking about is a Tompkins County Water & Sewer District . The idea is to have a commission to oversee the operation or the implementation of this ,�t p proposed district . Edward DiGiacomo said it would be like paying for the horse you won ' t get . He said where he lives ( West Dryden ) the possibility of getting water and sewer could take 15r years . Discussion centered around taxing other for something they won ' t `� receive . Supervisor McCord said if it is necessary to have water and sewer ,` for an area to grow and the people want to promote growth , then that is what would have to be done . Councilman Webb said as long as there will be 126 a hearing on this and people will have the opportunity to object , then he , . i , . was for it . The consensus of the Board was favorable to forming such district . Supervisor McCord said he would communicate that to Gary Lee . Town Water & Sewer District : Supervisor McCord asked the Board if they felt they should pursue the formation of a Town Water & Sewer District surrounding the community college area and the village of Freeville . Attorney Amdur said that before there was any great discussion about this proposed district , the board along with the County Representatives , the college trustees and the Dryden Village Board should get together and discuss this because the village has some strong feelings . It was mentioned that raw sewage is being dumped into Fall Creek and that Freeville needs something . Supervisor McCord said he will talk to Mayor Watros about this . NEW BUSINESS Supervisor McCord said he would like to set a schedule for Town Board meetings , April , May , June and September at various parts of the town as 411 has been the policy for the last few years . He noted that meetings have been held in West Dryden , Etna , Varna and Bethel Grove . He suggested that the Town Clerk contact the appropriate people and set up the schedule . Supervisor McCord ask Jeanne Vanderbilt if it could be possible to hold the April meeting at West Dryden . Mrs . Vanderbilt said it could be arranged .
