HomeMy WebLinkAbout1971-02-09 17 February 9 , 1971 Minutes of the Regular Monthly Meeting of the Town Board of the Town of Dryden held February 9 , 1971 , at the Town Hall , commencing at 7 : 35 P . M . Present were Supervisor McCord , Councilmen Gridley , Cotterill , Tarr and Webb , Zoning Officer Stewart , Attorney Amdur and ' County Representative Lee . The Meeting was called to order by Supervisor McCord . The Meeting was opened with the Pledge Allegiance to the Flag . Roll Call was by the Town Clerk . Supervisor McCord asked the Town Board if there were any corrections or • additions to the three sets of minutes , December Regular Meeting , Public Hearing - Snowmobile Ordinance and Organizational meeting in January . RESOLUTION # 45 APPROVAL OF MINUTES . Councilman Gridley offered the following resolution and asked its adoption . RESOLVED that the Minutes of, the December 8th Meeting and the December 22nd Public Hearing and the January 1st Organizational Meeting all be approved as sent out . 2nd Councilman Cotterill Carried COUNTY BRIEFING County Representative Lee passed out his copy of the proposal and recom- mendations of the Sanitary Sewer District for the County . He said he thought that Attorney Amdur should look it over being legal counsel . He suggested that copies be made and distributed to members of the Board . Snowmobiles : He has had several calls . Most of the complaints have come from the Snyder Hill area . He has reported to the County Board relative to a particular situation . He also reported that he has ask the Public Safety Committee to invite Armand Adams , State Police and Sheriff ' s Department IIto a Board Meeting in the near future and talk about this . He said he thinks we have a law we can not enforce . He said that the troopers have reported that they respond to a call and by the time they get there the snowmobiles are across the field and they can not chase them on foot or by car . Tompkins Cortland Community College : Representative Lee reported that the meeting on the 2nd of February was , he thought , a good meeting in terms of the " town and gown " relations that we are going to have to live with for a long time . He said there are two phases we are dealing with : ( 1 ) getting it constructed and the type of concerns we will share together and ( 2 ) fdresees the long range concerns that we have got to set up the mechanisims to make sure that we work out fire protection , security , traffic flows , etc . Town Water & Sewer District : He recommended that the Town Board consider the formation of a Town Water & Sewer District surrounding the area and the college site . He reported there was one of two ways this could be done , ( 1 ) as a county district or ( 2 ) as a town ;, , district ( section 12A of Town Law give the Board the initiative to form such a district ) . In order to pursue it on a county basis , he and Mrs . Schickel should have a resolution from the Town Board asking them to pursue it on that level . Wood and Tower Report : Re expanded medical facilities at the hospital . The report has been to the Hospital Board of Managers , back to the Medical Board and back to Wood & Tower for some revisions . They are expecting a meeting to be called any day with the • Board of Managers of the Hospital and the County Board of Representatives to discuss this program . Out Patient Clinic : The hospital has contracted with three doctors at $ 25 , 000 per doctor per year to have a clinic open IIfrom 8 A . M . to midnight for any kind of care . The emergency room at the hospital has been converted to the 'clinic . Mr . Lee expressed the hope that the Board is pushing on the Route 13 situation to get the settlement built there and the other settlement down through the west end octopus which would improve the traffic flow there . Dog Contract : The general consensus is that they want the Sheriff to enforce the law and other types of activity that that they should be charged with . They do not feel tracing dogs is a normal routine process . He said that the people who are supporting this proposal want . more aggressive enforcement of dogs that are running loose . Industrial Development Agency : He reported that he plans to reintroduce this proposal to the Board . The purpose of such an agency is ( 1 ) to preserve the industry that a community has , and ( 2 ) objection to try to induce or to attract new industry to the community . He reported that this agency will issue revenue bonds for reconstruction , construction or financing commercial i 118 . industry facilities . Preservation is the primary objective .according to Mr . Lee . He suggested that the Town of Dryden be the leader Local Grievance situation : Suggested that the Town make their appointments to the local grievance board as this will be comming up in Jun : . Members of the Board discussed Mr . Lee ' s suggested re Industrial Develop - ment Agency . RESOLUTION # 46 INDUSTRIAL DEVELOPMENT AGENCY Supervisor McCord offered the following resolution and aske " its adoption . RESOLVED that the Dryden Town Board fully support County Re ;' resentative L ee ' s motion at the county level to support the county appointing an Industrial Development Agency . 2nd Councilman Cotterill Carried The Town Clerk was instructed to send a copy of resolution ) 46 to the 411 Clerk of the. Board of Representatives , Mr . Lee and Mrs . Schickel . CITIZENS PRIVILEGE OF THE FLOOR : N othing at this time . COUNCILMEN PRIVILEGE OF THE FLOOR : . Councilman Cotterill reported that the Dryden Grange has volunteered to w ork with the Zoning Officer so that a - town directory can be brought up to date and printed by late spring . He reported that the G ange did not d esire to make money on this venture ; they would be offeri g their services as . a public service . He reported that the Grange ould like to list the villages of Dryden and Freeville with their coope ation . Mr . Lee ✓ eported that Dr .:. Wright of Cornell has a program ( Data Processing ) which g ets at this problem and he suggested getting in touch wit Ernie Cole to find out more about this program . Councilman Cotterill sal • he would - . check into this . Zoning Officer Stewart reported that he h . s been working o n the directory . He reported that he is having trouble fi ding people at home , the neighbors disagree on who lives on their street and it appear to be quite confusing at times . He reported that he got hi - own street up to date and already two houses have changed bwners . Co ncilman Cotterill suggested that something be put in the newspaper - that the Town ' is developing a directory of every resident in the Town of Dryden and that the Town is seeking the cooperation of people , who have moved ± n ' the Town within = �� the last few years, to notify the Zoning Office ' at the Town Hall . RESOLUTION # 47 TOWN DIRECTORY Councilman Cotterill offered the following resolution and .asked its adoption . RESOLVED that the Dryden Grange be empowered to work with he Zoning Officer to update and publish a town directory , and be it FURTHER RESOLVED that the Dryden Grange be empowered to sell °4: • to merchants to help finance this project and any costs will be supported by the Town of Dryden . 2nd Councilman Webb - Carried Councilman Gridley reported that the new highway building is partly covered • with siding . He reported . that . the weather has caused some delay . ATTORNEY : Attorney Amdur • reported that a resolution was passed in J . nuary that has • to be rescinded and that a resolution be proposed to exec to a statutory installment bond for $ 16 , 300 for a 2 year period for the ' own highway building . Supervisor McCord read the resolution as it apteared in the J anuary minutes : RESOLVED that the Supervisor be authorized to obtain a Revenue Anticipation Note in the amount of $ 16 , 000 . 00 for the Highway Building addition . He said this resolution must be rescinded . RESOLUTION # 48 RESCIND RESOLUTION # 4111 Councilman Cotterill offered the following resolution and asked its adoption . RESOLVED that this Board rescind . Resolution # 41a- Revenue A ticipation Note . 2nd Councilman Tarr Carried 119 . RESOLUTION # 49 STATUTORY INSTALLMENT BOND Councilman Cotterill offered the following resolution and asked its adoption . RESOLVED that the Supervisor be authorized to execute a Statutory Install - ment _ Bond in the amount of $ 16 , 300 for a 2 year period for the town high - w ay building . 2nd Councilman Tarr Roll call vote - all voting YES TOWN CLERK : Taxes collected as of February 8 $ 330 , 419 . 26 gkII Disbursed to Supervisor 2 / 8 328 , 107 . 49 Balance - 2 / 8 / 71 $ 2 , 311 . 77 The Town Clerk also reported that the delinquent dog list has been made • up and there remains approximately 300 dogvunlicensed . ZONING OFFICER : Zoning Officer Stewart called to the Board ' s attention that cars have been parking overnight at the Town Hall parking lot . It was suspected that the cars might be from the apartment house across the road . Mr . Stewart ✓ eported that he tried to find out who the cars belonged to but he was u nable to find any information regarding the ownership of the cars . Chief VanZile investigated and recommended that the Town put up some " no all n ight ' ° parking " signs . Councilman Cotterill suggested that a letter be written to Bob Wells telling him of the problem and that it could possibly be from his tenants , and request that he talk to his tenants about it . RESOLUTION # 50 SIGN Councilman Cotterill offered the following resolution and asked its adoption . RESOLVED that the Town Clerk send Mr . Wells a letter re all night parking , and be it FURTHER RESOLVED that a sign " NO ALL NIGHT PARKING " be posted between the two town buildings . 2nd Councilman Gridley Carried The Zoning Officer further reported that the Collegetown billboard is / still up and wanted to know what he should do . Attorney Amdur said Mr . Stewart should write a letter requesting that the billboard be moved w ithin 10 days and that necessary steps will be taken to protect the interest of the town . Attorney Amdur said she would check out the procedure . She said this may be the case whereby we will have to get an order . The Zoning Officer also reported that he had the correspondence from the Anderson Outdoor Advertising ,Co . to Mr . Wells relating to the sign on Route 13 that Mrs . Nielsen claimed was installed in November , 1969 . The Advertising Co . claimed that this sign had been up since 1963 . Mrs . Nielsen had claimed that nothing was there except for two rotted posts until November 1969 when that sign went up . Mr . Stewart said he would check into this further . Mr . Stewart reported that he and the Multiple Residence State Inspector went to the Love Inn . They found that the Love Inn has six ✓ ooms with accomodations for twelve , no windows , undersized and definitely a fire trap . They are not in compliance with Multiple Residence Law , but they are willing to cooperate and do what is necessary . The State Inspector suggested that they build a small building near the Love Inn with a corridor then it would not be a multiple residence . Mr . Stewart said that • he would be informing the Love Inn on what they had to do to comply . LETTERS IISupervisor McCord read a letter from Mrs . Paul Nielsen thanking the Board for its prompt action re the application for a special permit to construct a billboard on Route 13 and Etna Lane by the Collegetown Motor Lodge ., Supervisor McCord read a letter from P . J . Davies re the landscaping restoration of the intersection of Snyder Hill and Sodom Roads . Councilman Cotterill checked into this and Superintendent Case will be doing some - thing about it this spring . . .. , 120 Supervisor McCord read a letter from Tom Payne re appointment to the Assessment Review Board and Supervisor McCord reported that he would serve on the Assessment Review Board . ; Supervisor McCord read a letter from Bernard VandeWeert informing the Board that he has purchased a farm in King George , Va . and will be leaving the area and is , therefore , resigning as a member of the Board o f Zoning Appeals . effective February 15th . Supervisor McCord suggested that Councilman Webb try to find someone to replace Mr . VandeWeert and let Mr . McCord know immediately . Supervisor McCord read a letter from Tompkins County Chamber of Commerce ✓ equesting individuals and groups write to President Nixon and Howard Robinson re Earl Butts heroic deed back in December . Since that time , Mr . Butts has received a Presidential Citation . Supervisor McCord noted receipt of a letter from Mr . and Mrs . . Thomas L . Bonn re zoning ordinance amendments . He reported that they are requesting 411 . that the Town of Dryden through the zoning ordinance ban billboards o utside urban areas . Attorney Amdur replied that we already have control through the Zoning Ordinance . Supervisor McCord reported that he had correspondence from Frank Liguori ✓ e Tompkins County Water Agency . Supervisor McCord said he will attend the meeting February 18th . RESOLUTION # 51 HIGHWAY BILLS Councilman Gridley offered the following resolution and asked its adoption . RESOLVED that the Highway Bills be paid as audited. 2nd Councilman Tarr Roll call vote - all voting YES RESOLUTION # 52 GENERAL. BILLS Councilman Cotterill offered the following resolution and asked its adoption . He suggested that the board delay action on the definition of a factory - manufactured structure or if it should be a modular structure . Attorney Amdur suggested that perhaps add the term modular home . She said the way we propose to make the determination between whether it was a trailer or a factory - manufactured structure was by the. size . This was discussed and Supervisor A14/ ► ' ARTICLE XV : SIGNS . Section 1502 , 7 : Amended to read as follows : Signs advertising the sale , lease or rental of the premises upon . which the sign is located : one sign , 10 square feet if located upon the land and 50 square feet if located on the building . Section 1502 , 9 is deleted . Section 1502 , 10 is renumbered 1502 , 9 . ARTICLE XVIII : ADMINISTRATION - SECTION 1801 . BUILDING PERMITS : Amended to read as follows : No building in any district shall be begun , enlarged or extended or any work commenced that will change the present use of any building without a Building Permit issued by the Zoning Enforcement Office . No mobile home , replacement mobile home , or extension shall be placed on an individual lot without a Building Permit . Every applicant for a Building Permit shall state in writing on a form supplied by the Town Clerk the intended use of the building or mobile home and shall be accompanied by a sketch drawing showing the plot shape and dimensions and indicating the size , shape and locaction of said building . Said Building Permit shall expire. 12 months from the date of issuance , unless there has been substantial progress in the work for which the Building Permit was issued . Sa1d permit shall be posted or displayed in a conspicuous , place and shalt be visible from the nearest public road . DEFINITIONS : MOBILE HOME : Amended to read as follows : A vehicle either standing on wheels or with wheels removed and resting on cribbing , ties , blocks or a wall and used for year round human habitation . A mobile home shall ' not be considered to be a dwelling or dwelling unit for the purposes of this ordinance . STRUCTURE : Amended to read as follows : Anything constructed or erected with a fixed location on the ground or attached to something having a fixed location on the ground . Structures include , but are not limited to , buildings , walls and fences over six feet in height , radio towers , • • f swimming pools , billboards , poster panels and signs . The following shall not be classified as structures for the purposes of this ordinance : fireplace chimneys , flagpoles and antennas . Eff . 3 / 5 / 71 A T _ . 4) 121 McCord said do we want to pass this part of the ordinance or do we want to delay . Councilman Cotterill suggested that it b°e brought up at the next public hearing on the Mobile Home Park Ordinance . Attorney Amdur said the Board could pass the amendments leaving that part out . Supervisor McCord reported that the Board would be acting upon the following amend - ments : Sec . 1801 - Building Permits , Sec . 1502 - Signs , definitions of Mobile Home and Structure . . RESOLUTION # 53 AMENDMENTS - ZONING ORDINANCE Councilman Cotterill offered the following resolution and asked its adoption . RESOLVED that this Board adopt the amendments of Section 1801 Building Permits , Section 1502 Signs , and definitions of Mobile Home and Structure , as set forth at the Public Hearing February 1 , 1971 . 2nd Councilman Tarr Carried Supervisor McCord ask Councilmen Webb and Gridley if they had their recommendations for the Supervisor ' s Committees . They reported that they • did not feel the need for a refuse committee and as for Public Relations , they felt this is something that everyone should work at and did not feel the need for this committee either . The following was recommended : GENERAL FUND Webb and Cotterill HIGHWAY FUND Gridley and Tarr BUILDINGS & GROUNDS Cotterill and Webb Supervisor McCord wanted to know how everyone felt about designating one night a month for public hearings . The consensus of the Board was to schedule the 4th Tuesday of each month for Public Hearings . NEW BUSINESS Supervisor McCord suggested that a committee be appointed to represent the Town Boare1 Village Board , snowmobilers , and non - snowmobilers to work o ver the present ordinance ; . to study what the state may or may not do and to work through this winter and then decide if any major revisions n eed to be made in the Snowmobile Ordinance . If revisions are necessary , present it to the Town Board in the early fall to allow sufficient time to revise the ordinance if necessary and be prepared for next season . Mr . Underwood from Snyder Hill said he would be willing to serve on this committee . Mr . Underwood wanted to know who was suppose to post the signs . Supervisor McCord replied that this was up to the snowmobilers , but it can not be done piece - meal . He said no one has approached the Town Board to organize the posting of signs . Supervisor McCord said information re authorize standard for signs has been put out by the Department of Transportation and believed it was available from the Extension Service at Cornell and Garth Jackson of the Dryden Bank has a copy . Mr . Underwood said the speed limit of 10 mph is ridiculous . He said it will burn the belts right out of the machines . Supervisor McCord expressed that by n ext year we hope to have things co - ordinated and the signs posted . Mr . Underwood reported that he lives on Snyder Hill Road about 1 / 4 mile from the Town of Ithaca line and that road has been oiled and stone and the shoulders are about 1 - 2 inches low on each side . He wanted to know what had to be done about getting something done with the shoulders so that they will be level with the road . Supervisor McCord said he would ✓ efer this to Superintendent Case . Supervisor McCord reported that only in the Town of Caroline has the Landon • Road and the Besmer Road been designated open for snowmobile travel . In the Town of Dryden they have not been so designated . He noted that all l unplowed roads are open without designation . I Supervisor McCord reported that as aTown - Board they are requesting residents in the Town of Dryden to donate to the Village Clock Tower Fund . The village needs about $ 1600 to restore the clock in the library tower . Councilman Tarr reported that there is not a crossroad marker on Route 13 at Mineah and Kirk Roads on the side toward Dryden . This was discussed and the Town Clerk was instructed to write to State Highway Department to request a crossroad marker at this point in the Town of Dryden .. Meeting adjourned 10 : 10 P . M .
