Pg. 1 ;-f E 1 The regular meeting of the Town Board for the month of June, 1979 was held at Town Hall, 15 Terrace Rd, Cortland, N.Y. with Supervisor Nadolski presiding. Other board members present were Councilman Ray Miller, Councilman Warren Manning, Councilman Melvin Pierce, and Councilman Raymond Thorpe. Others present were Attorney, John Folmer; Town Clerk, Pauline Parker; Deputy Town Clerk, Bonnie Call; General Clerk, Edna Puzo; Assessor, Robert Wells; Highway Sup't, Carl Eaton; Engineer, Charles Feiszli; Zoning Officer, Don Fowler; Water & Sewer Sup't, Fred Walker; and Newsreporter, Skip Chapman and a few residents of the Town. The meeting was called to order by Supervisor Nadolski. .Reading of the minutes of the previous meeting was dispensed with, as'all board members had reviewed copies of the minutes of minutes May 2, 1979 and May 16, 1979 prior to the meeting. Motion was approved made by Councilman Thorpe, seconded by Councilman Pierce, that the minutes be approved as written. All voting aye. Motion was carried. Authorization has been received from Audit & Control regarding establishing McLean Road Sewer (Sewer District # 2). estab li.shir The Town Clerk read the order to the Town Board. new sewer district RESOLUTION # 95 ORDER ESTABLISHING M61EAN ROAD SEWER DISTRICT (SEWER DISTRICT # 2) Motion made Seconded by All Voting' by Councilman Thorpe Councilman Pierce AYE (see attached roll call vote) ADOPTED a 164 Wednesday, June 6, 1979 page 2 RESOLUTION # 96 AUTHORIZATION TO PAY BILLS AS AUDITED FOR THE MONTH OF MAY Motion made by Councilman Manning Seconded by Councilman Miller All Voting: AYE ADOPTED BE IT RESOLVED that the bills submitted for the month of May pay bills shall be aid as audited with the exception of General Fund Vouchers#177 and #179. Water District #1 Claims # 56 - # 72 6,1960-53 Water District #5 Claims # 3 1,268.49 Sewer District #1 Claims # ;6 _ # 11 197.13 • Mr. William Pauldine requested the Town Board to take the Pauldine necessary action for a change of Zoning Classification for his Fisher AvEproperty located on Fisher Ave. He presented his request by petition. A motion was made by Councilman Thorpe, and seconded by Councilman Manning to receive and file the petition. All voting aye. Motion was carried. The request shall be forwarded to The Cortland County Planning Board for their review and approval. Councilman Pierce and Councilman Thorpe reported on their street investigation of street lighting requests. lighting Supervisor Nadolski stated he has been notified by Niagara Mohawk Power Corp. that the cost for street lighting next year . is expected to increase about $5,000. It is $28,000. now. RESOLUTION # 97 DENY REQUESTS FOR ADDITIONAL STREET LIGHTING ON STUPKE ROAD AND LYNCOURT DRIVE. denial of Motion made by Councilman Pierce street Seconded by Councilman Thorpe lights All Voting: AYE ADOPTED WHEREAS the request for additional street lights by John and Judy Woodward of Stupke Rd. and Gerald Miller of Lyncourt Dr. has been investigated, and WHEREAS it has been determined that neither location existed as a hazard for the protection and preservation of public safety, and WHEREAS, there is a moratorium on street lighting in the Town of Cortlandville, therefore, BE IT RESOLVED that the requests for street lighting shall be denied. sewer Supervisor Nadolski advised that he had not sent a letter to hookups the County Board of Health yet, regarding those not connected to • the sewer. RESOLUTION # 98 AUTHORIZATION FOR TOWN CLERK TO WRITE A LETTER TO DRAKES DINER Motion made by Councilman Manning Seconded by Councilman Pierce All Voting: AYE ADOPTED WHEREAS the Town Clerk advised of problems collecting the sewer rents owed by Drakes Diner, therefore, BE IT RESOLVED that the Town Clerk shall, and is hereby Drakes authorized and directed to send a letter to Drakes Diner Diner and to advise the attorney if payment is not received soon. Having completed all that was required, Primo the Zoning Officer has issued the Certificates of Occupancy. All department heads will get together soon to discuss revision of the vacation and sick pay schedule. Bert Ferris, contractor, will start next week building the office extra office in the meeting room. space Reply from Assemblyman Riford regarding the reduction of Revenue Sharing and how.it affects New York City compared to letter ' municipalities was read. Councilman Thorpe made a motion, (Riford) seconded by Councilman Miller to receive and file ® the letter. All voting, Aye. Motion was carried. A copy of a letter sent to Mr. Joseph Powers of DOT from Mr. Irving Olp was read. This was in reference to the intersection of Rt. #13 and Lime Hollow Rd. hazards. Motion was made by Councilman Pierce to receive and file the letter. This was sec- letter onded by Councilman Miller. All voting, aye. Motion carried. IrvingOlp Letter from Basil Paterson, Secretary of State, advising that the application for Sewer District # 2 has been forwarded ARC to ARC for their approval. Sever D3,s- #2 Councilman Manning gave a report for the Recreation Committee. SCM has given permission to use the baseball diamond near the SCM plant. Marcel Levsque feels $7 in not enough for mowing the lawn at Lamont Circle. It was the consensus of the Town Board that this should be taken before the Recreation Committee first. Letter from Manpower regarding their summer program. It Manpower will be investigated to determine if we can utilize the program. Councilman Pierce received a telephone call expessing concern about dumping of refuse along Stupke Rd. After investigating, he learned that Mr. GutQhess had been given permission to dispose of refuse wood chips there. But, there are refrigerators and other things wtupke-Rd left there also. The Town Board requested the Zoning Officer to investigate further. Reply from Governor Carey®s office acknowledging receipt of State our letter regarding our Resolution #66 _ Opposing New Mandated Mandates Programs. Reply from DOT in Syracuse regarding the flooding conditions along Rt. #13 in South Cortland. Cortland Res Blodgett Mills ® Hallstead Residence ® The County Health Dept. have reported that they have gone to the Hallstead residence on two :.occasions, but have not found a garbage truck there. The Town Board requested the Supervisor to Blodgett write again to the County Board of Health, requesting them to go Mills - there at night or on a weekend. Hallstead. The Sewer Committee for The Town of Cortlandville shall be reactivated® There will be forthcoming, many hearings, etc. for Sewer the County Sewer Agency. Comm. Res Changing of Calculation of the County Sales Tax. The Town Board requested Attorney Folmer to contact the County County Attorney, Jim Woods, to obtain more information regarding the wording sales of the Legislation when it started. `_i'ax Invitation from the Willet Town Clerk. They will have an Open House, June 9, 1979 from 1s00 to 5s00 P.M. at their new Town Hall. 166 Wednesday, June 6, 1979 page 4 Letter from Association of Towns. They are urging us to Assoc O-vrite to our Assemblymen and Senators in regard to further Town:- legislation for arbitration with the unions. This was tabled for Unions further review. The Supervisor & Engineer reported on the conference they DEC & attended in Albany with DEC and EPA. Delegates from the Villages EPA - of McGraw and Homer, the City of Cortland, and the Town of Cortland - Albany ville were in attendance. EPA gave permission to the Villages of McGraw and Homer to make application for funding for Stage 2 for sewers. Ours was declined because we had had no documented failures. The Town Engineer has written to them requesting more information for denial, after having the chance to review the 201 Facility Plan. RESOLUTION # 99 AUTHORIZATION FOR THE STOP SIGN AT THE INTERSECTION OF WEST RIVER ROAD,AND THE CLUTE ROAD TO BE CHANGED TO A YIELD SIGN Motion made by Councilman Miller Stop sign Seconded by Councilman Manning to yield All Voting: AYE ADOPTED sign B. Mills BE IT RESOLVED that the Stop Sign at the intersection of the West River Road and the Clute Road, located in Blodgett Mills shall, and is hereby authorized to be changed to a yield sign. RESOLUTION # 100 AUTHORIZATION FOR EXTENSION OF PIPE AT HOXIE GORGE Ext of Motion made by Councilman Manning pipe e Seconded by Councilman Pierce HoxieGorge All Voting: AYE ADOPTED WHEREAS, the culvert pipe at the lower Hoxie Gorge Road continues to wash out each spring, and WHEREAS, this has been inspected by the Highway Sup't and the Town Engineer, and.recommended by both, BE IT RESOLVED that Authorization is hereby given to purchase and install additional culvert pipe to add an.extension tb the existing pipe, the cost not to exceed $1,950.00 RESOLUTION # 101 ACCEPTANCE OF AGREEMENT OF EXPENDITURES OF HIGHWAY MONIES Highway Motion made by Councilman Miller Agreement Seconded by Councilman Manning, All Voting: AYE ADOPTED BE IT RESOLVED that the Agreement of Expenditures of Highway Monies for 1979 be signed and accepted by the Town Board according to Section 284 of the Highway Law. Supervisor Nadolski apprised the Town Board of a recent meeting with several residents from the McLean Road, beyond the Stupke Rd. flooding They presented a petition from many residents in that area that MCLeanRd are concerned with the flooding problem that 6.xists there. Because this is a County Road, Walt Tennant, County Highway:Sup@t, was contacted. He also attended the meeting. He will investigate further for a possible solution. Another meeting will be held at that time. Camp Camp Georgetown has been contacted by letter requesting their Georgetowork crews to work on projects in abandoned cemeteries again this year in The Town of Cortlandville. 1 1 • 1 Wednesday, June 6, 1979 Page 5 167 Highway Sup't, Carl Eaton advised the Town Board of the savings of $2•®400., by purchasing sand and salt for next winter, before June lst of this year. Upon motion by Councilman Pierce, seconded by Councilman Miller, the meeting was adjourned to executive session. All voting, aye. Motion was carried. Councilman Manning made a motion to adjourn the executive session and return to the regular session. Councilman Miller, seconded the motion. All voting, Aye. Motion'was carried. RESOLUTION # 102 AUTHORIZATION FOR THE ATTORNEY TO RETAIN SERVICES OF TWO EXPERT WITNESSES IN THE ® BARKER'S CERTIORARI Motion made by Councilman Miller Seconded by Councilman Thorpe All Voting: AYE ADOPTED WHEREAS, upon recommendation of the Town Attorney and Barkers discussion thereof, certiorary BE IT RESOLVED that Attorney Folmer be, and he hereby is,. authorized and directed to retain the services of two (2) expert witnesses to represent the Town of Cortlandville in the Barkers Certiorari► if required. RESOLUTION # 103 RESCIND RESOLUTION # 69 OF APRIL 4, 1979 Motion made by Councilman Thorpe Seconded by Councilman Pierce All Votings AYE ADOPTED BE IT RESOLVED that Resolution #69 adopted April 4, 1979 is hereby rescinded There being no further business, upon motion by Councilman Thorpe, seconded by Councilman Miller, all voting, aye, the meeting was adjourned at 10;00 P.M.
