The public hearing was called for the purpose of discussing the Establishment of a Sewer -;District. The transcript of this hearing shall be filed in the Town Clerk's office. A. Special Meeting of The Town Board was called to order by Supervisor Nadolski immediately following the public hearing. Board members present were: Councilman Manning, Councilman Pierce, and-Cofncilman Thorpe. Others present were: Attorney, John Folmer; Town Clerk, Pauline Parker; Deputy Town Clerk, Bonnie Call; Assessor, Robert Wells; Justice, Donald Eaton; Zoning Officer, Don Fowler; News - reporter, Kevin Howe and Town Residents. Attorney Folmer reviewed with the Town Board those conditions which must be met for the Establishment of a new district. He advised that we have complied with such requirements to date according to Section 209C of the Town Law. Upon the advise of Attorney Folmer, the Town Board decided to wait until the next board meeting to take further action.. This will allow the necessary time to prepare the forms to forward to Audit & Control. There being no further business, upon motion of Councilman Thorpe, seconded by Councilman Manning, all voting; Aye, the meeting was adjourned at 8:50. Respectfully su mitted, 4z Pauline H. Parker Town Clerk TOWN BOARD TOWN OF CORTLANDVILLE RESOLUTION No.. 55 WHEREAS, on the 12th day of March, 1979 there was filed in the Office of the Town'Clerk of the•Town of Cortlandville, Cortland County, New York, maps, plans, and an engineering report relating to the establishment of a sewer district within the'said town -as required by Section 209c of the Town Law, said maps, plans and reports having been prepared by Lawrence Fabbroni, an engineer, duly licensed by the .State of New York, and WHEREAS, an order was duly adopted by the Town Board on March 15, 1979 reciting the filing of said -maps plans and reports, the .improvements proposed, the boundaries'of the proposed district Iand the -estimated expense thereof -and specifying 14arch.2.9, 1979 at 7 o.'clock p.m. as the time and the said Town Hall in the said Town of Cortlandville as the place where the.said board would.me'et to.. consider the documents' filed as -aforesaid and to .hear .all persons' interested in the,subject-thereof, concerning the same, and WHEREAS; such order was duly -posted and published as required by ' law, and WHEREAS', a hearing in the matter was duly held by the Board on this 29th day of March, 1979 commencing at 7 p.m. at the Town Hall in. the said town and discussion upon the matter having been 1;,had and all persons desiring to be heard having been duly heard including members of the Board and various other persons, and NOW, upon the evidence given upon such hearing and upon motion of Raymond Thorpe , Councilman, seconded by Melvin H. Pierce , lCouncilman and unanimously passed, it is y�! RESOLVED AND DETERMINED, that (a) the maps, plans and engineering ;reports heretofore filed with the Town Clerk of the Town of Cort- 'landville are in compliance with Section 209c of. the Town Law of jthe State of New York and are otherwise sufficient; (b) all the ,!the property owners within the proposed district are benefited thereby; (c) all the property and property owners bene- 1fited are included within the limits of the proposed district; and 1(d) to establish the aforesaid sewer improvement district is in'the. public interest,.and it is further RESOLVED AND DETERMINED, that the establishment of a sewer !district as proposed in said maps, plans and reports be approved; 'that the improvement.therein mentioned be constructed and the ser-' vice therein mentioned be provided for upon the required funds being made.available or provided for; and that such district shall ,be designated and known as the "McLean Road Sewer District (Sewer District #2)" and shall be bounded and described as indicated on Schedule A annexed hereto, made part hereof, and incorporated here in by -reference® and it is further . . . . . RESOLVED, that the proposed improvement, including costs of rights of way, construction costs, legal fees and all other ex- penses shall be financed as follows: 80 percent of the cost thereof will be paid with funds granted to the Town of Cortland- ville, County of Cortland, State of New York by the Appalachian Regional Commission; the remaining 20 percent of the cost thereof will be financed through bonds issued by the Town of Cortlandville and purchased by the United States of America acting through.the Farmer's Home Administration for a term of 30 years at the interest rate prevailing at time of sale,. said bonds to be retired by pay- ments received from the users of the sewer which is the subject matter of the proposed district, and it is further RESOLVED, that the Town Clerk of this Town shall within -ten days after the adoption of this resolution file certified copies 1-he.re6f in duplicate in the office of the State Department of i' Audit and Control at Albany, New York, together with an application by this Board in duplicate for permission. to create such district as provided for by the Town Law, Section 209-f; and that such application.shall be executed by and in behalf of the Town Board by the. supervisor of the Town,., and it is further RESOLVED, that this resolution is adopted subject to per- missive referendum, as required by Section 209-e3 of the Town Law of the.State of New York, Dated April 4, 1979 tei.G:�sialrt� :��• � J� D06RIPTION.OF PROPOSED.
