Other board members present were: Councilman Ray Miller, Councilman Warren Manning, Councilman Melvin Pierce, and Councilman Raymond Thorpe. Others present were Town Clerk, Pauline Parker; Deputy Town Clerk, Bonnie Call; Town Attorney, John Folmer; General Clerk, Edna Puzo; Bookkeeper, Holly Reese; Zoning Enforcement Officer, Don Fowler; Highway Sup't, Carl Eaton; Water & Sewer Sup't, Fred Walker; Justice, Donald Eaton; Legislator, Henry Wadsworth; Newsreporter, Skip Chapman and a few town residents The meeting was called to order by Supervisor Nadolski. ® Reading of the minutes of the previous meeting was dispensed with, as all board members had reviewed copies of the minutes approve prior to the meeting. Motion was made by Councilman Miller, minutes seconded by Councilman Thorpe, that the minutes be approved as written. All voting aye. Motion was carried. RESOLUTION # 37 AUTHORIZATION TO PAY BILLS AS AUDITED FOR THE MONTH OF FEBRUARY Motion made by Councilman Thorpe Seconded by Councilman Miller All Voting: AYE ADOPTED pay bills BE IT RESOLVED that the bills for the month of February as auditec be paid as audited. General Fund Claims #61 - 76 #78 - 94 _ $6 , 644- . 04- Highway Claims #60 - 88- = 9,646.77 Water District.#1 Claims #16 - 27 = 2,634.47 The -Supervisor's annual report and the monthly reports of all department heads are on the table`to, be viewed by anyone reports interested and also are on file in the *Town Clerks office and may be seen upon request. ' Supervisor Nadolski apprised the town board that upon the Sammons recommendation of the Town Attorney, he had written a letter to Communi- „ Sammons Communications stating the franchise and permit to use caLion. the streets issued to Cortland Video; Inc. (Sammons Communications of New York, Inc.).Paragraph A (#2) implies the permission extends to buried facilities as well -as overhead facilities strung from poles." as per their request of February 1, 1979• RESOLUTION # 38 ACCEPTANCE OF THE CONTRACT OF STAN PAYNE _ CONSTRUCTION CO. '® BEITRESOLVED that accepts the contract Sewer District # 1. s ie Stan Payne the Cortlandville Town Board hereby Sewer -of Stan Payne Construction Co. for Contract RESOLUTION # 39 RESCIND RESOLUTION # 30 OF FEBRUARY 7, 1979 Motion made by Councilman Thorpe Seconded by Councilman Manning All Voting: AYE ADOPTED Rescind Res. #30 BE_IT RESOLVED that Resolution #30, adopted February 7, 1979 is hereby rescinded, and shall become null and void. 12 2 Wednesday March 7, 1979 page 2 RESOLUTION # 40 AUTHORIZATION TO ESTABLISH A CAPITAL RESERVE FUND FOR UNEMPLOYMENT INSURANCE - SUBJECT TO PERMISSIVE REFERENDUM. Motion made by Councilman Miller Unemployment Seconded by Councilman Pierce Insurance Fund All Voting: AYE ADOPTED WHEREAS, it is the intent of this board to accumulate all the cost of the unemployment benefits. The maximum dollar amount for which the reserve will be established, shall be $48,500.00 with a yearly contribution rate of $2,500.00 WHEREAS, pursuant to Section 67C of the General Municipal Law, as amended BE IT RESOLVED that this Town Board does hereby establish a Capital Reserve Fund to finance the cost of unemployment payments, subject to permissive referendum. BE IT FURTHER RESOLVED that the supervisor is hereby authorized and directed to deposit monies of this reserve fund in a separate bank account to be known as "The Unemployment Insurance Reserve Fund" and to invest from time to time, the monies of this fund pursuant to Section 6-F of the General Municipal Law. BE IT FURTHER RESOLVED that no expenditure shall be made from this account without authorization of the town board. Supervisor Nadolski read the reply from N.Y.S. Dept. of Transportation regarding the situation at the intersection of %L Lime Hollo'time Hollow Road and Rt. #13. The letter dated February 20, 1979 & Rt #13 stated they found no significant factors which would cause them to alter the traffic controls at that intersection. A copy of the letter was sent to Mr.. Irving Olp of Lime Hollow Road, who replied with concern. Councilman Manning made a motion, seconded by Councilman Miller to receive and file the letters. All voting, Aye. Motion carried. Supervisor Nadolski apprised the Town Board that the vouchers submitted by Hayes Ambulance Service for January and February exceed the monthly breakdown according to the contract. Hayes He also stated that the computations for Hayes Ambulance is Ambulance predicated on assessed valuation for the Town of Cortlandville, the City of Cortland, and those neighboring towns contracted for ambulance service. Recently the mayor, or his clerk, has revised the schedule. This has resulted in an increase for us. RESOLUTION # 41 AUTHORIZATION FOR SUPERVISOR TO WRITE TO HAYES AMBULANCE SERVICE. Motion made by Councilman Pierce Seconded by Councilman Manning All Voting: AYE ADOPTED • BE IT RESOLVED that Supervisor Nadolski shall, and is hereby directed to write a letter to Mr. Richard Purdy of Hayes Ambulance Service stating that we will abide by the existing contract. A copy is to be sent to Mayor Poskanzer. BE IT FURTHER RESOLVED that a corrected voucher be submitted for the month of February. Supervisor Nadolski read a memorandum from the Cortland County Treasurer's Office regarding an extension of time for the collection of taxes to June 1, 1979- Wednesday March 7, 1979 Page 3 RESOLUTION # 42 AUTHORIZATION FOR SUPERVISOR TO SIGN APPLICATION FOR AN EXTENSION OF TIME FOR TAX COLLECTION TO JUNE 1, 1979 Motion made by Councilman Pierce Seconded by Councilman Thorpe All Voting: AYE ADOPTED extension of time for taxes BE IT RESOLVED that authorization be, and it hereby is given for the supervisor to sign an application for an extension of time for the Tax Collector of The Town of Cortlandville, to collect taxes until June 1, 1979• ® RESOLUTION # 43 AUTHORIZATION FOR PLANNING BOARD TO AUDIT ALL SITE PLANS Motion made by Councilman Manning Seconded by Councilman Miller Planning All Voting: AYE ADOPTED Board BE IT RESOLVED that the Planning Board has authorization to audit all site plans. Supervisor Nadolski apprised the board of a telephone call from Richard Buck. He owns 5.4 acres of land near our water tank. He has offered to sell this to us at a cost -of $4,000.00 to $5,000.00. Much discussion followed. RESOLUTION # 44 AUTHORIZATION TO WRITE TO RICHARD BUCK REGARDING LAND NEAR OUR WATER TANK. Motion made by Councilman Manning Seconded by Councilman Miller Richard All Voting: AYE ADOPTED Buck WHEREAS Richard Buck has offered to sell the land owned by him, which is located near our water tank BE IT RESOLVED that authorization be and it hereby is given for Supervisor Nadolski to write a letter to Richard Buck advising him that the Town Board is not interested in purchasing his property at this time. Supervisor Nadolski informed the Town Board of letters offers of received from the engineering firms of John MacNeill and engineers Robert Charlebois offering to assist as consultants on the McLean Trunk Line Sewer. Supervisor Nadolski read correspondence from Senator Tarky Lombardi offering his assistance in obtaining state approval for the McLean Trunk Line Sewer. Assemblyman. Riford, Congressman Hanley have been contacted, and an appointment has been set for next week with Senator Monyniham in Oneonta. Supervisor Nadolski also plans to contact Senator Javitts. McLean The Preliminary Application submitted for the McLean Trunk Trunk ® Line Sewer is now in Washington. We have been placed 6th on theSewer priority list of 47 by the Regional Planning Board in Binghamton. Our preapplication has been approved in Syracuse, in Albany, and is now in Washington. RESOLUTION # 45 AUTHORIZATION FOR BOOKKEEPER TO ATTEND WORKSHOPS .AND CLASSES Motion made by Councilman Manning Seconded by Councilman Miller All Voting: AYE ADOPTED WHEREAS schooling will be offered in Newfield on April 3,4,5,10, and llth for double entry bookkeeping, and 124 Wednesday, March 7, 1979 page 4 WHEREAS a workshop will be offered in Syracuse on April classes for 6th for budget preparation and cash management bookkeeper BE IT RESOLVED that'authorization is hereby given to Holly Reese, bookkeeper for the town, to attend these classes, and BE IT FURTHER RESOLVED that all necessary expenses incurred regarding same, with an approximate cost of $300.00, be reimbursed, subject to audit by the Town Board. Attorney Folmer reported to the Town Board concerning a Leash Law for a control of dogs. He felt it would be Leash Law an impossibility to adopt a Town Wide Leash Law. There might be a possibility of creating districts for a small area, such as Lamont Circle. He would be willing to discuss this with those people if they were to show further interest. RESOLUTION # 4.6 PLACING A MORATORIUM ON STREET LIGHTING IN THE'TOWN OF CORTLANDVILLE street Motion made by Councilman Miller lighting Seconded by Councilman Manning 7oratorium All Voting: AYE ADOPTED WHEREAS, the cost of installing and maintaining street lights within the Town of Cortlandville has increased to such an extent that the cost of addit- .ional lighting installations has become economically unfeasible to the tax payers of the Town of Cortland- ville; and WHEREAS, the additional lighting installations and the cost of operations of such additional lighting facilities is not consistent with efforts being made to conserve use of energy; and WHEREAS, it is the desire of the Town Board to set forth its position regarding installations of street lighting facilities within the town, NOW THEREFORE BE IT RESOLVED that.there is hereby established a moratorium on the installation of street lighting facilities within the Town of Cbrtlandville; and BE IT FURTHER RESOLVED that no street lighting install- ation shall be accomplishbd within the Town of Cortland- ville in the absence of a specific finding by the Town Board that any proposed street lighting installation is necessary for the protection and preservation of public sa,fety; and BE IT FURTHER RESOLVED that this resolution shall take effect immediately and shall continue to be in effect until such time as it shall be rescinded by the Town Board. Leigh Valle Attorney Folmer has contacted the representative of The Railroad yLehigh Valley Railroad concerning the right-of-way needed for the McLean Trunk Line Sewer. He was advised that that portion needed is a subsidized line. this means our request would need to be approved by Leigh Valley Railroad, Con -Rail and by the State Department of Transportation. This could take considerable time. 1 • 1 • 1 Wednesday, March 7, 1979 W 4`y page 5 L Attorney Folmer has contacted Mr. Butler, from the Erie Lackawanna Railroad Company regarding purchasing the land Lackawanna owned by them from the City of Cortland to the Village of Railroad McGraw. The attorney will proceed further -on this. Supervisor Nadolski apprised the Town Board that next year a new census will be taken by The United States Department of Commerce. We will be given the opportunity to review census the"census before they finalize their findings. Supervisor Nadolski reported on a meeting he attended Groton Avc recently concerning the present sewerage system at the Groton Plaza - Avenue Shopping Plaza. Pressure is being put on Mr. Porter sewer and Mr, Anderson by D.E.C. to have the sewer taken over by the Town of Cortlandville. Supervisor Nadolski apprised the board that we will have to form a new sewer district for that locality in the very near future. Supervisor Nadolski apprised the Town Board that he has received the annual statement of Operations for the County Self Insurance Fund. RESOLUTION # 47 AUTHORIZATION FOR SUPERVISOR TO REQUEST THE COUNTY LEGISLATURE TO PROCEED WITH A COMPUTER UPDATE OF THE REAL PROPERTY INFORMATION SYSTEM Motion made by Councilman Miller Seconded by Councilman Pierce All Voting: AYE ADOPTED WHEREAS the assessor has recommended and explained to the Town Board.the need of an up -,date Program of Up -Date Property Assessements, of the AssessmentE BE IT RESOLVED that authorization is hereby given to the Supervisor to write a letter to the Cortland County Legislature endorsing their implementing a computer up- date of The Real Property Information System of Cortland County, for the whole county. RESOLUTION # 48 AUTHORIZATION FOR THE ZONING OFFICER TO ATTEND INFORMATIONAL MEETINGS Motion made by Councilman Miller Seconded by Councilman Pierce, All Voting; AYE ADOPTED BE IT RESOLVED that Don Fowler, be and he hereby is authorized to tend a one day schooling in Liverpool, NY and another one day schooling in Clay, NY for up- dating the code schooling for Zoning Officer BE IT -FURTHER RESOLVED that any expenses incurred by same, be reimbursed, subject to audit by the Town Board. Supervisor Nadolski read the Planning Board minutes of Hoxie February 26,, 1979 for information only. There was further Gorge discussion pertaining to a road for the Hoxie's Gorge Development. Bean, upon payment of the proper fee, for the operation of the trailer park known as Penguin Trailer Park, located at Tompkins Street Ext., Cortlandville, New York for the year 1979- Supervisor Nadolski stated it will be necessary to call a Special Meeting at -a later date for the purpose of setting a date and time for a public hearing regarding the establish- ment of the McLean Trunk Line Sewer District.
