Pg.l The final meeting of the year 1974 of the Town Board was held at 15 Terrace Rd with Deputy Supervisor, Coucilman Sherman Griswold presiding in the abscense of Supervisor Robert P. Blatchley. Other Board members present were: Justices Donald Eaton and Ronald Fish. Councilman Ray Miller was absent due to a work commitment. Others present were: Town Clerk, Christine Canestaro; Bookkeeper to the Supervisor, Rudy Krauklis; Renee Biladeau; and Legislator, Shirley Fish. The Town Clerk read the minutes of the last meeting. There were no corrections or additions. Upon motion of Justice, Donald Eaton, seconded by Justice, Ronald Fish, all voting aye, the minutes were approved as read. The Town Clerk read the following letter from the Cortland County Planning Board: December 20, 1974 Ms. Christine Canestaro Town Clerk Town of Cortlandville GENERAL MUNICIPAL LAW REVIEW 15 Terrace Road Section_23S_l=m______________ Cortland, New York 13045 Zoning Amendment -Section 1500 Dear Ms. Canestaro: Pursuant to your request, the Cortland County Planning Board has reviewed your proposed zoning amendment to Section 1500 of the Town's Zoning Ordinance. The Board finds that the creation of the position of Zoning Enforcement Officer to replace the Town Clerk is a procedural amendment but one which, we believe, is in the best interests of the Town's planning program. The Board has no objection to the proposed amendment and therefore approves the amendment. We would greatly appreciate a copy of the action taken by the Town Board. Very truly yours Carl Kimberly, Chairman Cortland County Planning Board Upon motion of Justice Donald Eaton, seconded by Justice Ronald Fish, all voting aye, the letter was ordered received and filed. Relating further to the above, Justice Eaton stated he had challanged Mr. Zollendeck's statement that the change indicated above, should have been submitted to the County Planning Board before any action was taker' by the Town Board, pursuant to Section 239 1-m of the General Municipal Law and asked him to show him where this was stated in the General Municipal Law. Mr. Zollendeck could not do so. RESOLUTION #157: AUTHORIZATION TO AMEND SECTION 1500 OF THE 1968 TOWN OF CORTLANDVILLE ZONING ORDINANCE Upon motion by Justice, Donald Eaton and seconded by Justice Ronald Fish and unanimously carried, the following was adopted: BE IT ORDAINED, that Section 1500 of the 1968 Zoning Ordinance of the Town of Cortlandville, New York, adopted on October 2, 1968, and thereafter amended on June 4, 1969, be amended to read as follows: "Section 1500. Enforcement. This Ordinance shall be enforced by the Zoning Enforcement Officer who shall be appointed by the Town Board." 116 Friday, December 27, 1974 Pg.#2 The matter of Alfred Zogg Jr."s claim for $150.00 for rental of his auction barn as a polling place was discussed again. It was decided to pay the claim in the budgeted amount of $50.00. RESOLUTION 1158: AUTHORIZATION TO PAY $50.00 ON CLAIM #427 SUBMITTED BY ALFRED ZOGG, JR. Upon motion of Justice, Ronald Fish, seconded by Justice Eaton, all voting aye, the following resolution was adopted: RESOLVED, that claim voucher #427 submitted by Alfred Zogg, Jr. in the amount of $150.00 be compromised and paid in the amount of $50.00, as budgeted. Justice, Ronald Fish brought up the subject of the street lighting on Route 11, between the Cortland City line and the Village of Homer line. He advised the Board that some action should be taken on this as Niagara Mohawk would no longer supply service to these lights after December 31,_1974. The matter was tabled until the next meeting of the Town Board. Claim voucher #430, submitted by Mildred Brookins, Secretary of the Town Planning Board was brought up for discussion, as there were no receipted bills attached to the voucher. Another item of discussion was the charges claimed for copying of the Board's minutes. It was determined that the Town's Zerox Copier should be utalized for this purpose, since it is rented on a contractual basis and any copies of Town Business not done on this machine would be considered a duplication of cost and'not to be authorized for payment by the Town Board, in the future.. Still another item was her claim for mileage, for which she did not submit when, where, and for what reason the mileage was being claimed. As a result of the above discussion; the following motion was made by Justice, Donald Eaton and seconded by Justice Ronald Fish and unanimously carried: That the Town Clerk be directed to write a letter to Mr. Gordon Hathey, Chairman of the Town Planning Board, with a carbon copy to be sent to Mrs. Brookins, advising him that he, as Chairman, was responsible for the proper presentation of vouchers for payment and asking that all future vouchers be submitted properly before he signs the department approval; and that the Town Board would not approve any vouchers submitted for copying service. RESOLUTION #LU: AUTHORIZATION FOR AMENDMENTS TO AND SUPPLEMENTAL APPROPRIATIONS CONCERNING TOWN BUDGET FOR 1974 Upon motion made by Justice Donald Eaton, seconded by Justice Ronald Fish, all voting aye, the following amendments and supplemental appropriations concerning the Town Budget for the year 1974 were adopted: BE IT RESOLVED: to increase apppropriation A 1110.4 (Justice Contractual) from $3,700.00 to $6,550.00 - net increase $2,850.00 Increase appropriation A 1355.4 (Assessor Contractual) • from $2,500.00 to $3,700.00 - net increase $1,200.00 Increase appropriation A 1410.4 (Tovvm Clerk Contractual) increase $300.00 from $875.00 to $1,175.00 - net Increase appropriation A 1620.4 (Building Contractual) from $4,000,00 to $5,300,00 - net increase $1,300.00 Increase appropriation A 1670.4 (Central mailing) from $1,600 to to $2,000.00 - net increase $400.00 Increase appropriation A 1920.4 (Municipal Dues) from $215.00 to $295,00 - net increase $80.00 Friday, December 27, 1974 Pg® 3 n • 1 • 1 BE IT FURTHER RESOLVED, to appropriate $755.00 for engineering special services account A 1440.4 and account A 9995 (misc. and judgements) $256.88 (Court Order) refund to James Brown. Total supplemental appropriations and modifications in the sum of $7,141.88 shall be transferred from General Fund 1973 unexpended balances. RESOLUTION #160: AUTHORIZATION TO PAY AUDITED BILLS Upon motion by Justice Donald Eaton, seconded by Justice Ronald Fish, all voting aye, the following audited bills were approved for payments General Fund claims #405-436 $3,862.61 Water District #1 claims #140-150 1,163.98 Sewer District #1 claim #19 50.00 Highway Fund claim #259-273 2.209.71 7, 886.30 Legislator, Shirley Fish, reported on the investigation she had made on the complaint of Mr. John Barrett, McLean Rd. She advised the Board that she had traveled the mile and one quarter of new road with Mr. Walter Tennant, County Highway Supt. and true to the complaint, there were no shoulders. However, she reported, that shoulders -have --since been put in temporarily and would be completed in the Spring.
