HomeMy WebLinkAbout1969-04-16 244 April 16 , 1969 PUBLIC HEARING Supervisor Lee called the Public Hearing to order for Dryden Sewer District # 2 at 7 : 10 P . M . Supervisor Lee opened the Hearing by reading the legal advertisement for bids for this District . He then went on to report that at this time that $ 26 , 716 . 76 had been spent in this district for a Feasibility Study , Legal Fees , Engineering Fees , the purchase of the Ashton Property and test borings and whether or not the people in Sewer District # 2 voted for or against the District they would have to pay the $ 26 , 716 . 76 , which would be added to their taxes next year and paid back in one lump sum . He further reported that the Town Board would obviously not be there that e vening if they had not already received approval from Audit & Control to increase the District $ 140 , 500 . 00 . He reported that several bids had been received and low bidder was Compagni Construction Corp of Cortland , New York at $ 266 , 069 . Supervisor Lee then informed the residents pre - sent that this was subject to a permissive referendum , that 5 % of the property owners could get a petition for this to come to vote , it must be submitted to the Town Board within thirty ( 30 ) days from this date , o therwise the Town Board would make a motion putting the machinery in motion in thirty, days . Supervisor Lee went into the history of this district . He stated that back in 1966 Mr . Relyea had come to the Town Board as a petitioner of one asking for a sewer district for Taggin Wagon Park . Many residents in Varna then asked if they could be in the district and a meeting had been held in Varna to discuss the extension , expense etc . Supervisor Lee reported that expansion in this district w ithout public sewerage cannot be done , several people in the district w ere in serious trouble , however , the Board would respect the wishes of the District . Supervisor Lee passed out to those present a copy of the total project cost from Mr . T . G . Miller , Engineer . Supervisor Lee again brought up the expansion problem without public sewerage . He further stated that he knew of several proposed developments should public sewer go through . Mr . Herbert Snow stated at this time that he knew of several people having septic system problems which would cost between $ 600 to $ 800 to correct . Supervisor Lee then stated that at the present time the district had 230 base units with a possible 366 units in the future based on information filed in Town Hall . The question then was asked as what comprises a Unit . One unit is an apartment , trailer , single family dwelling . Supervisor Lee reported the cost would be as follows : 230 Units $ 76 . 00 366 Units - $ 47 . 81 City of Ithaca Charge 28 . 80 City Charge 28 . 80 Billing , Electricity Etc . 10 . 00 Billing , Elec 10 . 00 $ 114 . 80 $ 86 . 61 Mr . Dodge stated that it would increase value of property and he favored going forward for the following reasons . 1 . Increase not excessive 2 . Improvement over Septic System 3 . Control Pollution 4 . Cost would increase in the future Mr . Euvard stated he favored going forward before construction costs go up again . Mrs . Amdur was asked about the Bond Issue position limit at this time . She stated that it was very good presently at 2 . 5 million and the only indebtness for the Town of Dryden was Water District # 1 and Sewer District # 1 at $ 164 , 000 and Sewer District # 2 at $ 26 , 716 . 76 . Mr . Snow asked aout the pump and Supervisor Lee informed him it was a factory made pump , subsurface and the cost was around $ 19 , 000 . 00 tonsiasinairrirMEIni emour 2 4 5 Mr . Thomas Bossack asked the cost , and why the District must go a for the total $ 340 , 500 . 00 if they were receiving Federal and State Aid . Supervisor Lee informed him we must go for the total amount and that the extimates on Water # 1 and Sewer # 1 had been high , and he was hopeful this will be high , and that the borings had already been done so the Contractor already knew what he would be running into . Mr . Carl James stated he felt the Community should go forward , as a delay in going ahead will increase the amount of money heeded . Mr . Thomas Bossakc made the motion that this project be approved and to increase the district to $ 340 , 500 . 00 gross , less Federal & State Aid 2nd Herbert Snow . Supervisor Lee asked for a show of hands for all in favor . 21 ayes . Supervisor Lee then asked for a show of hands for all against . - None Motion Carried . Sewer District # 2 Public Hearing concluded . TOWN BOARD MEETING • Supervisor Lee called the regular Town Board Meeting to order at 8 : 30 P . I . Present were Supervisor Lee , Councilmen Ogden , Todd , Gridley and Cotterill , Attorney Amdur and Assessor Wells . Supervisor Lee opened the meeting with the Pledge Allegiance to the Flag . Supervisor Lee asked if there were any corrections or additions to the March minutes as sent out . Being none the minutes were approved . Supervisor Lee at this time turned the meeting over to Citizens privilege of the floor . Mr . O ' Connell of Park Advertising Corp . , Ithaca , New York asked that the proposed zoning of January 1969 , Article # 15 , Section 1502 be changed from a miximum 160 square feet to 300 square feet . He stated that the paper for Billboards is standard throughout the United States and that Companies print only one size paper . Supervisor Lee informed him the letter would be delivered to Mr . Peter Curtiss , Chairman of the Town Planning Board for their deliberation . Mr . Henry Kirchgraber presented to the Town Board a petition for Zoning signed by some 800 persons and read a leeter which stated that the petition is in support of the general principles of the proposed Zoning Ordinance and signed by a large number of citizens ofthe Town . These signatures were obtained by more than 50 people who were con- cerned enough about the issue to personally solicit supportive signatures from their neighbors . There are no ineligible persons , each signature is a registered voter or tax payer in the Town of Dryden . They are hopeful that this demonstration of support will encourage the Town Board to vote early adoption of the zoning ordinance soon to be presented to them . This letter was signed by Edwin H . Kirchgraber and Nancy P . Seebass for Rural Citizens ' for a better Dryden . Supervisor Lee accepted the Petition on behalf of the Town Board and stated he had received many letters favoring zoning for the Town of Dryden . One from Gordon Nesbitt of Schuyler Lake , New York who owns property in the Town of Dryden and feels that if the Town is planned and zoned his investment is protected . Supervisor Lee then went on to re - port that once the proposed ordinance is received it will be turned over to Attorney Amdur for her determination as to the legality of the docu - ment . Two Public Hearings will be held , the first with no modification and the 2nd after corrections or revisions by the Town Board . • STANDING COMMITTEES : General Fund Committee RESOLUTION # 57 GENERAL FUND BILLS Councilman Todd offered the following resolution and asked its adoption . RESOLVED that the General Bills be paid as audited . 2nd Councilman Cotterill Roll call vote - all voting YES Highway Fund Committee RESOLUTION # 58 HIGHWAY FUND BILLS Councilman Ogden offered the following resolution and asked its adoption . RESOLVED that the Highway Bills be paid as audited . 2nd Councilman Gridley Roll call vote - all voting YES Sanitation & Refuse Committee Councilman Todd reported he had been to see Mr . Collins , and that the X46 h ours of 9 A . M . - 3 P . M . Monday - Friday and 9 A . M . - 12 Noon on Saturday would be enforced . He also reported that Mr . Collins was turning away a large number of people who were not residents of the Town . Supervisor h ee at this time read a letter from Mrs . Elizabeth Pealo , Secretary of the West Dryden Community Center stating that she was writing this letter in behalf of the people of West Dryden to protest against the hours of Collins ' Dump . She stated that the hours are now arranged so that any person working a " normal working day " can get garbage to the dump only on Saturdays and Gold help the man who takes a week- end trip as he must live with his garbage an additional week . She asked that the Town Board ask Mr . Collins for more reasonable hours or withdraw our tax dollars from the dump . Letter referred to Councilman Todd . Supervisor Lee further reported that the County had put $ 100 , 000 in their Budget this year for acquisition of land for a County Land Fill Dump . At the present time Mr . Liguori is studying sites . Building & Grounds Committee - Councilman Ogden had nothing to report at this time . Planning Committee • Councilman Ogden reported that the proposed Zoning Ordinance would be h anded over to the Town Board on April 30th . He further reported that Egner & Neiderkorn had completed the 701 project , and that this study was available at the Town Hall . Supervisor Lee reported that copies of this study had been put on file in all of the local libraries . Supervisor Lee read a letter from Mr . Peter Curtiss , Chairman of the Planning Board informing the Town Board that he was submitting his resigna - tion effective as soon as possible , but in no case later than July 1st . He reported that he and his wife had purchased a home in Ithaca and would be moving by Summer . Supervisor Lee reported at this time that he h ad talked with Mr . Curtiss and had asked him if he would stay until the conclusion of zoning . Supervisor Lee reported that Highway Superintendent Case had talked with h im and told him that they would be using the paver less this summer as he felt he should go back to previous paving jobs and do more maintenance . Clerk Luss reported that the State Auditor was her going over the books for the years 1966 , 1967 & 1968 . . Assessor Wells reported he had received a copy of a letter from Mr . - George Guest of the Tompkins County Department of Health to Mr . Kenneth Brotherton , Sr . regarding five trailers on his property . Mr . Wells further reported that he had them on the rolls last year as a Trailer Park , however , the Health Department was not aware of these trailers and told Mr . Brotherton that he should have a Trailer Park Permit and a Health Department Permit . , and a check of the records did not show the sewage systems serving these trailers being constructed under a Health Department Permit . He requested that they stop any further development , and not allow occupancy of any of the trailers until such time as they comply with the requirements of the New York State and Tompkins County Sanitary Code requirements . Supervisor Lee read a letter from the Tompkins County Department of Health to Supv . Lee regarding Trailer Site , Mr . Harry Austin , informing him that the trailer occupied by Mr . Harry Austin has been moved from the site in accordance with the agreements reached at a Health Commissioners Hearing on January 28 , 1969 . . Assessor Wells reported that the Trailer Park on Wood Road owned by • Cliff Wallace , Jr . was in violation with the Health Department as they had placed more trailers in the park then they were allowed and there was a problem of effluent running openly in the ditch on the east side of Wood Road . Supervisor Lee was asked to write a letter to the Health D epartment informing them of this . Supervisor Lee read a letter from Clifford Bower , Chairman of the Tompkins Cortland Community College for the Board of Supervisors to Ronald Space , Chairman of the Board of Trustees T- C C . C . enclosing a rough - draft copy of that portion of the minutes that covers , in summarized form the d iscussion and comments pertaining to the Trustees ' recommendation of Dryden Site # 1 as the permanent site for our Community College . Also g reater depth and detail on all three sites pertaining to projected cost , site preparation , extension of sewer and water etc . Letter attached to Minutes . Supervisor Lee read a letter from Mr . & Mrs . Duane Church of 51 Freese Road who wish to be considered as a property owner for the extension of the Varna Sewer District with the option to reject if unable to meet 247 the cost . NNKMUUXMNM Supervisor Lee reported he had talked with Mr . T . G . Miller , Engr . and one possibility he advanced was that the Church ' s acquire professional advise on the lay out of their system w ith the delivery point being to the South side of Fall reek at their e xpense . Councilman Todd at thistime stated that he felt the District should be constructed and operational before the Board considered ex - tending . Supervisor Lee was asked to write a letter to Mr . & Mrs . Church informing them of this . Supervisor Lee read a letter from Peter A . Curtiss to Mr . C . W . Sadd ✓ egarding Mr . Sadd ' s request to allow approval of Lots # 514 & # 515 on Corn Crib Road as a minor subdivision , with subsequent approval of Stage 13 as a major subdivision . Mr . Curtiss stated that the Planning Board had decided they would have to approve this as a major subdivision , and a Public Hearing would be held for this on April 17th at 8 P . M . Letter put on file in Town Clerk ' s Office . Supervisor Lee read a letter from Armand L . Adams regarding Dryden 0 Zoning in respect to Parcel 73 - 1 - 4 comprising some 22 acres owned by Crispell Automotives , Inc . asking that this R - B zone be changed back to R - D Zone which permits light industrial use . He further stated that Crispell is now about to start construction of $ 160 , 000 garage facility o n the property , and that even though a variance for a portion of this land could be obtained this was not enough land . He asked the Town Board to give this matter consideration when they had received the proposed Zoning Ordinance . Supervisor Lee read a letter to the Supervisors of Tompkins & Cortland Counties from the Groton Committee regarding this committees sincere dedication for education of young people , and stating they were still working to have a new and very promising site considered for the Community College . They stated that since the initial site proposal w as voted down in all fairness to both communities , the whole picture of sites should be re - evaluated and that within the past two weeks another site has become available in Groton , and if this site is not brought up they feel that a great injustice will be done to both Counties . They asked for consideration on this matter and would welcome the opportunity to speak with any or all on the new site proposal . Egypt Creek Water Shed Project - Supervisor Lee reported that he had talked with Mr . Anderson of Syracuse and at this time a feasibility 0 study had not been done , and that it was still eight to twelve months away . Jayne House Number - Supervisor Lee reported that the Spaulding House number had been corrected by Attorney Amdur , Legal Counsel for the Spaulding Estate and no longer was the same as the Jayne house number . Sewer District # 2 - Attorney Amdur reported that she needed a resolution from the Town Board in the matter of the Increase of the Maximum Amount to be expended for Dryden Sewer District # 2 in the Town of Dryden . She pointed out at this time that the Bond would be for forty years instead o f thirty years . RESOLUTION # 59 INCREASE SEWER # 2 $ 140 , 500 Councilman Todd offered the following resolution and asked its adoption . RESOLVED that this Town Board authorize the increase of $ 140 , 500 . 00 for Dryden Sewer District # 2 2nd Councilman Ogden Roll call vote - all voting YES LEGAL RESOLUTION ATTACHED TO MINUTES 248 Carey Insurance - Supervisor Lee reported that Attorney Amdur was still pursuring this issue with Mr . Lambert . Records Disposition - Supervisor Lee reported that the Town Clerk had received the Disposition for the Highway and Mr . Charles Downey had finished cleaning the vault , that all records were not stored in uniform size boxes by the year . Brockway Truck - Supervisor Lee reported that the new Brobkway Truck had been delivered and was now in use . Abbott Proposal - Supervisor Lee reported he had received a copy of a " . letter to Mr . David Abbott from Peter Curtiss regarding Mr . Abbott ' s development on Lower Creek Road , Hanshaw Road and Route 13 triangle . Mr . . Curtiss had informed Mr . Abbott that since they had rezoned that area his 12 buildings with 12 apartments each would be alright if public or commercial sewer and water facilities are installed and if written Board of Health approval is obtained . Supervisor Lee reported that the 0 Town of Lansing had already approved water to this development . Mrs . Allen Hayes stated that she did not understand how Mr . Abbott could build 144 units on this property as she had been informed by the Health Depart - ment some time ago that they would not allow only a certain number on this particular site , and this far exceeds the number she was given . Supv . Lee informed Mrs . Allen that the Town Board could do nothing to prevent Mr . Abbott from building 144 units this was strictly up to the Board of Health , but that he would wfite a letter to the Health Department regarding this matter and send her a copy of his letter . Hurlbutt Apartments - Supervisor Lee reported that Mr . Hurlbutt was putting up an additional 90 apartments on Pinckney Road known as the Plymouth Village Apartments . NEW BUSINESS Supervisor Lee asked the Town Board what they wanted to do about paying for the use of Houtz Hall in Etna . A request of $ 35 . 00 per year had been asked . He further reported that Varna had asked for $ 15 . 00 per year and should the Town Board not pay all communities where we use their buildings for registration , elections etc , and should it not be a uniform amount . RESOLUTION # 60 PAYMENTS POLLING PLACES Councilman Todd offered the following resolution and asked its adoption . RESOLVED that this Town Board authorize Supervisor Lee to pay $ 35 . 00 to Varna Community Center , Bethel Grove Community Center , Houtz Hall , Etna , Freeville Community Center and Dryden Village Hall for a total of $ 175 . 00 per year . 2nd Councilman Gridley Roll call vote - all voting YES Supervisor Lee asked the Town Board if they would like to have a Spring Road tour with Highway Supt . Case . Councilman Cotterill stated that althought he did not mind riding around three or four hours he felt that a report from Supt . Case in respect to road conditions and what he pro - posed to do would be sufficient . COUNTY BRIEFING Supervisor Lee reported that the position of Budget & Administration established by the County Charter would be filled in the next few months . This appointment would be made by the Board of Supervisors , and they would ' also be appointing a County Assessor . 411 Community College - Supervisor Lee reported that the Board of Trustees had h ired Bob Mann to look at all sites and make a recommendation to them and also see about reducing the acreage of Site # 1 North of Dryden Village . He further stated that the Cortland Board of Supervisors were not negative about the Dryden # 1 site nor were they negative about the College , however , they would like to reaffirm that we want a community college and would like to scrutinize enrollment and cost , as the budget in one year h as doubled . Planning - Supervisor Lee reported that Mr . Liguori was working on the refuse problem and the County Sewer Agency . He further stated that they h ad $ 15 , 000 which had not been expended and they had contracted with O ' Brien & Gere for an extimate for a County Sewer District . D eWitt Park - Supervisor Lee reported that a group was interested in a beautification project for this Park . They would like to build a Fountain 249 and they were also interested in seeing less loitering in the Park . They have asked the City and the County to contribute money for this project . Supervisor Lee further stated that the County now owns some buildings . adjacent to this Park and they have asked Architect Mr . Levitich to look over the buildings for remodeling and also to suggest parking facilities . RESOLUTION # 61 . ADJOURNMENT Councilman Ogden offered the following resolution and asked its adoption .
