The regular meeting of the Town of Cortlandville
Town Board was held at the Town Hall, 15 Terrace Road
Cortland, NY with Supervisor Nadolski presiding.
Board members present were Supervisor Nadolski,
and Councilmen Edwin O'Donnell, Warren Manning and
Melvin Pierce.
Others present were: Town Clerk, Pauline
Parker; Attorney, John Folmer; Confidential Sec'y,
Edna Puzo; Engineer, Charles Feiszli; Justice, Donald
Eaton; Assessor, Robert Wells; Zoning Officer, Don
Fowler; Water & Sewer Sup't, Fred Walker; Legislator,
William Thomas; Newsreporters, Dave Domeshek, R.N.
Camareno, and Eric Scutts, Betty Palm, and Ken Andrews.
The meeting was called to order by Supervisor
Nadolski at 7:30 p.m..
Reading of the minutes were dispensed with as all
board members had received copies prior to the meeting.
Motion was made by Councilman Manning to approve
the minutes of September 3, 1980. Councilman Manning
withdrew the motion, as all Councilmen had not read the
minutes. The matter Was tabled.
Motion was made by Councilman Manning, seconded by
Councilman Pierce, to approve the minutes of September
15, 1980, special meeting, as written. All voting aye,
motion was carried.
Reports of department heads are on the table.
They are also on file in the Clerk's office and are
available upon request.
RESOLUTION # 161 AUTHORIZE PAYMENT OF VOUCHERS
Motion by Councilman Manning
Pay vouchers Seconded by Councilman Pierce
VOTES: ALL AYE ADOPTED
BE IT RESOLVED that the vouchers submitted have been
audited and shall be paid as follows:

Supervisor Nadolski requested the board members to
review a booklet "The First Five Years,' prepared by
Glen Goldwyn.
The contents of the booklet will be discussed at
the next meeting.

A Western Union Mailagram was received from the
Bureau of the Census. They advised that the preliminary
population count is 8310 and the preliminary housing
count is 3003, as a result of the 1980 Census Count.
The final count is forthcoming.
A salary schedule of Town Officials in Cortland
County for 1980 was received from the Clerk of the
County Legislature. It is available to be reviewed.
® Supervisor Nadolski has received from the Cortland
County Industrial Development Agency, their Environmental
Assessment Form, Resolution, and Negative Declaration
concerning their proposed Shortline Railroad project.
They have received funding from the State to
purchase the railroad section from Cortland to Overhead
Door and Gutchess Lumber property.
Upon motion by Councilman O'Donnell, seconded by
Councilman Pierce, the report was received and filed.
All voting aye, motion was carried.
The Cortland County Planning Board forwarded a copy
of their Resolution #80-21 in reference to Charles Stafford's
subdivision request.
Upon motion by Councilman Manning, seconded by
Councilman Pierce, the resolution was received and filed.
All voting aye, the motion was -carried.
The Cortland County Planning Board forwarded a copy
of their Resolution #80-22 in reference to Clarence
Homer's subdivision request.
Upon motion by Councilman Pierce, seconded by
Councilman Manning, the resolution was received and filed.
All voting aye, the motion was carried.
The Cortland County Planning Board forwarded a copy
of their Resolution #80-23 in reference to Clarence
Homer's Bulk Variance request.
Upon motion by Councilman O'Donnell, seconded by
Councilman Manning, the resolution was received and filed.
All voting aye, the motion was carried.
The Town of Cortlandville's Assessment Update
Program has been approved by the state, pending satisfactory
completion.

Assessor Wells confirmed that our

Attorney Folmer has reviewed the

Councilman Manning made a motion,
seconded by
Councilman O'Donnell, to proceed as planned
as per
Resolution #157, adopted September 15,
1980. All voting
aye, the motion was carried.
A letter was read from Harry Dunks, Director of
Cortland County Real Property Tax, expressing approval
of the assessment update.

EPA Study
If the balance of the County Update is completed
for the 1982 assessment rolls, Mr. Jacobs has advised
that they will update Cortlandville's rolls at no
charge with the exception of field reviews and the
informal hearings.
Engineer Feiszli reported on the recent meetings
held by the Citizens Advisory Committee in regards to
the EPA Study of nitrates in the water in the Lamont
Circle area.
The study indicated that sewers were not
warrented at this time to protect the acquifer.
A vote, taken by residents of the Lamont Circle
area, showed a negative response.
As a result of the study, the engineer expressed
doubt that we could obtain EPA funds for sewering for
that area in the future.
Councilman Pierce stated that the wells we are
now using show .:.06 milligrams nitrate content, which
is something to be concerned with, and we should be
concerned about protecting our acquifer.
The Town Clerk reported that she has received the
received Tentative Tentative Budget from the budget officer, and has
Budget distributed copies to the Town Board.
Councilman Nanning made a motion, seconded by
Councilman Pierce, to receive and file the tentative
budget. All voting aye, the motion was carried.
RESOLUTION # 162 AUTHORIZE HOUSE TRAILER RENEWAL
PERMIT TO MICHAEL L. BATSFORD.
Motion by Councilman Pierce
Seconded by Councilman Manning
Votes: ALL AYE ADOPTED
BE IT RESOLVED that the Town Clerk be, and she hereby
is authorized to issue a renewal permit to Michael L.
Michael L. Batsfor&atsford, upon payment of the proper fee, to park a
House Trailer house trailer in the Town of Cortlandville, RD #1,
Permit renewal Ridge Road, McGraw, NY.
RESOLUTION # 163 AUTHORIZE PURCHASE OF 1981
CITY DIRECTORY
Motion by Councilman Manning
Seconded by Councilman O'Donnell
VOTES: All AYE ADOPTED
purchase 1981 BE IT RESOLVED that the Town Clerk be, and she hereby
City Directory is, authorized and directed to purchase the 1981 City
Directory. The cost, including the full page ad, will
not exceed $86.
The Cortland County Legislature has a new official
County flag, and may be purchased from them.
The County will hold an Open House for the new
County Office Building on Sunday, October 5, 1980
from 1:00 P.M. to 5:00 P.M.

RESOLUTION # 164 AUTHORIZE TRANSFER OF FUNDS FROM
SS199O.4 TO SS812O.4
Motion by Councilman Manning
Seconded by Councilman Pierce
VOTES: All AYE ADOPTED
BE IT RESOLVED that the Town Board hereby authorizes
the transfer of $880. from contingent fund SS1990.4
to Sewage collecting system SS812O.4 to cover the cost
of the voucher received from the Village of Homer for

emergency cleaning of sewers.
The -pillage of Homer cleans our sewers about every
three .months. A discussion followed whereby it was the

consensus of the town board that eventually we would
need to purchase a sewage cleaner for proper maintenance
purposes t the Budget officer was instructed to set aside monies
over a period of the next two years time to purchase
the equipment)
Warning signs designating tractor crossing's
have been placed on the Bennie Road near the Goodale
Farm by the Highway Department.
Clayton Alcorn Jr., local chairman of the American
Heart Association, has requested, by letter, for
volunteers to assist with the annual fund raising drive.
RESOLUTION # 165 AUTHORIZE SUPERVISOR AND BOOKKEEPER
TO ATTEND SEMINAR

BE IT RESOLVED that the Supervisor and Bookkeeper are and Bookkeepe
hereby authorized to attend the Comptroller's Seminar to attend
concerning improved budgeting and financial reporting Seminar
practices in Syracuse on October 21, 1980, and
RESOLVED that any expense incurred by same, be reimbursed,
subject to audit by the Town Board.
A letter from Paul Dennis of Sherbrook Apt's was
read concerning his past due charges of their 3rd
quarter water and sewer bills.

It was the consensus of the Town Board that the
procedures stated in the ordinance would apply and
requested the Supervisor to contact Mr. Dennis and
advise him of same.
RESOLUTION # 166 SETTING DATE FOR SECOND PUBLIC
HEARING FOR FEDERAL REVENUE
SHARING FUNDS
Motion by Councilman Manning

VOTES: All AYE ADOPTED
BE IT RESOLVED that the second Public Hearing will be
held at the Town Hall, 15 Terrace Road, Cortland, NY Date for Second
on November 6, 1980 at 7:30 P.m., for the purpose of public hearing
reviewing the proposed use of Federal Revenue Sharing Federal Revenue
Funds for 1981, as required by law. sharing

RESOLUTION # 167 SETTING DATE FOR PUBLIC HEARING
OF THE PRELIMINARY BUDGET FOR 1981
Motion by Councilman Manning
Seconded by Councilman Pierce
VOTES: All AYE ADOPTED
Setting date for BE IT RESOLVED that a Public Hearing will be held at
public hearing the Town Hall, 15 Terrace Road, Cortland, NY on
of Preliminary budgNt)vember 6, 1980 at 7:45 p.m. for the purpose of discussing
the Preliminary Budget for 1981, and
RESOLVED that the Town Clerk is hereby directed to
make 20 copies of the Preliminary Budget, to be
available to the residents, upon request.
A proposed resolution from the County Legislature
was read in regards to their Roadway Sign Program.
Because of the sizeable expense of the program, they
are considering forthcoming changes as of January 1,1981.
In the past, the County has been placing the proper
signs and we have reimbursed our share of the cost by
vouchers submitted by them.
Supervisor Nadolski will discuss the matter further
with our Highway Sup't. and the County Highway Sup't.
No action was taken.
RESOLUTION # 168 AUTHORIZE ISSUANCE OF SERIAL BOND
ANTICIPATION NOTE FOR THE McLEAN
TRUNK LINE SEWER
Motion by Councilman Pierce
Seconded by Councilman O'Donnell
VOTES: All AYE ADOPTED

anticipation note nd directed to issue a Bond Anticipation Note in the

Line Sewer, with the First National Bank of Cortland.
Engineer Fieszli reported that Pall Trinity and
Overhead Door, plus a few residents, have requested to
connect to the new sewer system.
Applications have been prepared for industrial
users and we have received approval to proceed with
hook ups.
Attorney Folmer reported that the proposed sewer
contract with the City of Cortland has not been signed
yet. This is still pending until an agreement is
reached with the Village of Homer due to the similarity
clause included in the contract.
A letter was read from Assemblyman Steven Riford
concerning the Governor's veto of the Donovan Plan.
We now have two roads, the Stupke Road and Hoy
Road, which have been approved under the Donovan Plan.
They have been resurfaced but not completed.

Attorney Folmer reported on our present insurance
program covering legal defense for Town Officials. Our
present policy covers town officials when acting as an
agent for the Town of Cortlandville, but not as an
individual. This coverage has recently become available,
but at an additional cost.
Attorney Folmer advised that a letter was mailed
to Mr. Bean in regards to the flooding on Kingsley Ave.
Responding to the letter, Mr. Bean advised that
the catch basin has been cleaned at that location
and the problem should be corrected. The dirt had
® been placed in the town right-of-way by a resident.
Supervisor Nadolski reported that the fellows
from Camp Georgetown are expected next week and will
be cleaning sti-jeams and working at the recreation
field located behind the Municipal Building.
RESOLUTION # 169 AUTHORIZE ABANDONMENT OF
ALCANDER STREET
Motion by Councilman O'Donnell
Seconded by Councilman Manning
VOTES: All AYE ADOPTED
BE IT RESOLVED that the Highway Sup't. is hereby Abandoment of
authorized and directed to sign the certificate Alcander St.
abandoning Alcander Street, located in the Town
of Cortlandville.
RESOLUTION # 170 AUTHORIZE ATTORNEY TO FORWARD
NOTICE OF HEARINGS FOR ABANDONMENT
OF PORTION OF HOXIE GORGE ROAD
AND KINNEY HILL ROAD
Motion by Councilman Manning Abandonment of
Seconded by Councilman O'Donnell ortion of Hoxie.
VOTES: All AYE ADOPTED Gorge Rd. and
Kinney Hill Rd.
BE IT RESOLVED that the Attorney is hereby authorized
and directed to forward notice of hearing to the
County Superintendent of Highways for abandonment of
the easterly portion of the Hoxie Gorge Road and the
Kinney Hill Road, off the Clute Road. Both roads are
located in the Town of Cortlandville.
Councilman Pierce, Councilman O'Donnell and
Attorney Folmer have met recently with representatives
from the Village of Homer to discuss the Fire Contract.
A motion was made by Councilman Manning to recess
the regular meeting to an executive session to discuss
legitation. Councilman Pierce seconded the motion.
All voting aye, the motion was carried.
Councilman Manning made a motion, seconded by
Councilman Pierce, to adjourn the executive session
and reconvene the regular meeting. All voting aye,
the motion was carried.

MEETINGS
