HomeMy WebLinkAbout09-15-19800.Q Monday, September 15, 1980 page 1 SPECIAL MEETING A Special Meeting of the Cortlandville Town Board was held on September 15, 1980 at the Town Hall, 15 Terrace Road, Cortland, NY, with Supervisor Nadolski presiding. Board members present were: Supervisor Nadolski, Councilman Melvin Pierce and Edwin O'Donnell. Others present were Town Clerk, Pauline Parker; Attorney, John Folmer; Justice, Donald Eaton; Engineer, Charles Feiszli; Zoning Officer, Don Fowler; and Ken Andrews and Ernest Pace. Supervisor Nadolski called the meeting to order at 4:15 and recessed to the Public Hearing. PUBLIC HEARING AMENDING DOG ORDINANCE TO INCREASE LICENSING FEE The Public Hearing was opened by Supervisor Nadolski at 4:15 p.m. The legal notice was read by the Town Clerk as follows: Legal notice is hereby given that pur- suant to Section 130 Of the Town Law of the State of New York, and pursuant to a resolution of the Town Board of the Town of Cortlandville adopted September 3, 1980, the said Town Board will hold a public hearing at the Town Hall, Terrace Road, Town of Cortlandville, on the 15th day of September, 1980, at 4:15 o'clock p.m., eastern standard time, to hear all interested parties and citizens for or against the adoption of a proposed amendment to the dog control ordinance of the -Town of Cortlandville, said amendment to provide for licensing fees as follows: a) U-50 .50 for each spayed or neutered dog; and b) for each unspayed or unneutered dog. Ken Andrews was in attendance and discussed the new program with the Town Board. Councilman Pierce made a motion to recess the public hearing until 7:30 p.m. to allow more interested persons to attend. Councilman O'Donnell seconded the motion. All voting aye, motion was carried. PUBLIC HEARING AMEND SEWER ORDINANCE The Public Hearing was opened by Supervisor Nadolski at 4:30 p.m. The legal notice was read by the Town Clerk which follows: Legal notice isl@reby given that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a resolution of the Town Board of the Town of Cortlandville adopted September 3, 1980, the said Town Board will hold a public hearing at the Town Hall, Terrace Road, Town of Cortlandville, on the 15th day of September, 1980 at 4:30 o'clock p.m., eastern standard time, to • rj • 1 Monday, September 15, 1980 page 2 Z 91 9 hear all interested parties and citizens for or against the adoption of two proposed amendments to the sewer ordinance of the Town of Cortland- ville, said amendments to provide as follows: a) to make said sewer ordinance applicable to all sewer districts within the Town of Cortlandville, and b) to fix sewer use charges within the Town of Cortlandville at the rates of $1.35 per 1,000 gallons of usage for non -industrial users. • Ken Andrews and Ernest Pace were citizens in attendance. Attorney Folmer explained the need of an increase of fees due to the proposed contract with the City of Cortland. Engineer Feiszli reported that $1 per thousand gallons rate is being proposed. Councilman Pierce made a motion to recess the public hearing until 7:45 p.m. to allow more interested person to attend. Councilman O'Donnell seconded the motion. All voting aye, motion was carried. The Special Meeting was reconvened. RESOLUTION # 156 AUTHORIZE PAYMENT OF VOUCHERS AS SUBMITTED Motion by Councilman O'Donnell Seconded by Councilman Pierce VOTES: All AYE ADOPTED BE IT RESOLVED that the vouchers submitted have been audited and shall hereby be paid as follows: General Fund Vouchers #321 - 322 $ 747.16 Highway if #216 - 223 24,365.17 Water District # 1 it#109 - ill 284.46 Sewer District # 1 it # 20 35.25 Sewer District # 2 if # 13 750.00 Councilman Pierce made a motion to recess the meeting, to reconvene at 7:30 for the purpose of the Public Hearings. Councilman O'Donnell seconded the motion. All voting aye, motion was carried. • The meeting was recessed at 5:00 p.m. pay vouchers 30 ® Monday, September 15, 1980 page 3 PUBLIC HEARING AMENDING DOG ORDINANCE TO INCREASE LICENSING FEES Supervisor Nadolski reconvened the public hearing at 7:30 p.m. in the Town Clerk's office. Several residents of the town were in attendance. Supervisor Nadolski explained that anticipated revenues for 1980 were not sufficient to cover the cost of the dog program for this year. The tape of the hearing is on file in the Clerk's • office. Councilman Pierce made a motion to close the hearing. Councilman O'Donnell seconded the motion. All voting aye, motion was carried. The hearing was closed at 8:00 p.m. PUBLIC HEARING AMEND SEWER ORDINANCE Supervisor Nadolski reconvened the public hearing at 8:00 p.m. in the Town Clerk's office. Several residents of the town were in attf�-)ndance. Attorney Folmer explained the need of an increase in rate due to the proposed contract with the City of Cortland for a sewer use charge. The tape of the hearing is on file in the Town Clerk's office. Councilman Pierce made a motion, seconded by . Councilman O'Donnell to close the hearing. All voting aye, motion was carried. The Special Meeting was reconvened. RESOLUTION # 157 AUTHORIZE SUPERVISOR TO SIGN THE CONTRACT WITH THOMAS L. JACOBS AND ASSOCIATES INC. Motion by Councilman Pierce Sign Contract with Seconded by Councilman O'Donnell Thomas L. Jacobs and Associates Inc. VOTES: All AYE ADOPTED - • BE IT RESOLVED that Supervisor Nadolski is hereby authorized and directed to sign the contract with Thomas L. Jacobs and Associates Inc., after the contract was edited and approved by Attorney John Folmer RESOLUTION # 158 AUTHORIZATION TO AMEND TOWN OF CORTLANDVILLE SEWER ORDINANCE Amend Town of Cortlandville Motion by Councilman Pierce Sewer Ordinance -Seconded by Councilman O' Donnel-1 VOTES: All AYE ADOPTED 301 Monday, September 15, 1980 page 4 WHEREAS a Public Hearing was held by the Town Board of the Town of Cortlandville, at the Town.Hall, on September 15, 1980 at 4:30 p.m. and again at 8:00 p.m., in the matter of amending the Sewer Ordinance, therefore, BE IT RESOLVED that an Ordinance amending the Sewer District #1 Ordinance, enacted July 13, 1960, as amended. The Town of Cortlandville Sewer District # 1 Ordinance enacted July 13, 1960 and thereafter amended, is hereby amended as follows: ® 1. All references in said ordinance, including the title thereof, to the phrase Sewer District #1 are deleted and the following phrase substituted for each reference: "SEWER DISTRICTS". ® 2. The following is added to Section 204 of said ordinance: "the charge for sewer usage by non --industrial users shall be the rate of $1.00 per 1,000 gallons of water usage. AND, RESOLVED that this resolution shall become effective upon publishing and posting, as required by law. RESOLUTION # 159 AUTHORIZATION TO AMEND TOWN OF CORTLANDVILLE DOG ORDINANCE Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: All AYE ADOPTED Amend Town of Cortlandville WHEREAS a Public Hearing was held by the Town Board of Dog Ordinance the Town of Cortlandville, at the Town Hall, on September 15, 1980, at 4:15 p.m. and at 7:30 p.m., in the matter of increasing the dog licensing fees for 1981, THEREFORE, BE IT RESOLVED that an Ordinance amending the Dog Control Ordinance of the Town of Cortlandville, Cortland County, New York, as enacted on December 5, 1979 is hereby amended by adding the following to Section 3 of said ordinance: The fee for such license shall be the sum of $3.50 for each spayed or neutered dog and the sum of $8.50 for each unspayed or unretered dog. AND RESOLVED that this amendment shall be affective for licensing or renewals for the period commencing ® January 1, 1.981 and thereafter. ® RESOLU`.PION ,# l60 SETTING DATE FOR PUBLIC HEARING FOR FEDERAL REVENUE SHARING FUNDS Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: All AYE ADOPTED BE IT RESOLVED that a Public Hearing will be held at the Town Hall, 15 Terrace Road, Cortland, NY, on September 25, 1980 at 7:00 p-m. for the purpose of reviewing the proposed use of Federal Revenue Sharing Funds, as required by law.
