May 13 , 1991 P RESENT : S upervisor Dietrich Councilpersons : Eckstrom , Marisa , Oltz , Schwartz OTHERS PRESENT : P lanning Board Chair - N . Weitzel Town Clerk - C . Levan , Herb Engman , Charlotte Walsh , Joel Gagnon , Penny Peterson , Mary Ann Kozak S upervisor Dietrich called the Town of Danby Town Board Meeting to order at 8 : 00 P . M . P LEDGE OF ALLEGIANCE : Supervisor Dietrich led all present in the Pledge of Allegiance to the American flag . APPROVAL OF APRIL 8 , 1991 TOWN BOARD MEETING MINUTES : A motion was made by Councilperson Marisa and seconded by Councilperson Oltz to approve the . April 8 , 1991 Town Board Meeting Minutes as published . A roll call vote on the motion resulted as follows : E ckstrom Aye Marisa Aye O ltz Aye Schwartz Aye D ietrich Aye Carried Unanimously PRIVILEGE OF THE FLOOR : Councilperson Marisa expressed appreciation to Representative Proto for all the work in getting bus service to Danby . He reported that he uses the bus on a regular basis , it is great and recommends it highly . Bus schedules are available at the Town Clerks Office , Pyps Grocery and Benjamin ' s One Stop . Supervisor Dietrich reported that bus service may also be extended to West Danby and to South Danby Road area later this year . Senior Citizen discounts are also available . Town Clerk Carol Sczepanski presented a Tompkins County Board of Representatives " Certificate of Appreciation " to Supervisor Dietrich for his service on Tompkins County Youth Board . Tom • kins Count Re • resentative ' s Resort : In the absence of Representative Proto , Councilperson Oltz gave the following County Report : 1 ) Bus Service - - Park and Ride Bus Service is now available at the Fire Station . 2 ) Stream Maintenance Pro ram - - residents making application for the Stream Maintenance Program should also send a copy to Representative Proto . 3 ) Hillview Landfill Committee - - is now a functioning committee and he has attended several meetings . Town Board Minutes May 13 , 1991 2 4 ) Assessment Board of Review - - Tax Assessment Grievance Day is May 16 , 1991 . at the Danby Town Hall from 3 - 6 P . M . 5 ) Rabies - - Tompkins County Health Committee is concerned with the growing concern of Rabies in the County . Tompkins County may hold rabies clinics this summer . Councilperson Marisa reported that he understands that all cats in Tompkins County must be vaccinated for rabies . Town Clerk Carol Sczepanski reported that she has received a communication from the Health Department in regard to how to d ispose of dead animals if found on or near your property . They suggest that all dead animals should be buried immediately if they h ave not been in contact with humans or your pets . If residents h ave questions they can call Mr . Chase at the Tompkins County H ealth Department . D iscussion followed the Tompkins County Report in regard to the Assessment Board of Review and the grievance procedure . Councilperson Eckstrom explained the county wide reassessment and the assessment methodology . DANBY POND : S upervisor Dietrich reported that due to an increase in the Town of Danby Taxes for 1991 it was not possible to fund all program requests . Community Council was asked to review their programs and set priorities for their programs . The decision to cut the pond program was due to cost of operation and salaries for lifeguards . ( The cost of lifeguards is approximately $ 10 , 000 . ) Supervisor Dietrich has talked with the New York State Parks Commission and it is possible that the pond area may be opened for picnicking , games , etc . There will be no swimming allowed and the State will post the area with " swimming prohibited " signs . The Town must raise $ 500 . 00 to pay for the maintenance of the Pond for mowing and trash disposal . D iscussion followed in regard to providing lifeguards part time such as weekends only , community groups raising the money through fund raisers , and charging admission at the pond Councilperson Marisa explained that it will be necessary to have a person or persons to take the responsibility of organizing a g roup to get the pond open , obtain Health Department approval , stocking supplies , telephone , and other general operation . D iscussion followed with residents expressing concern that undesirable activities occur when the pond is closed for the season . Councilperson Marisa suggested that residents interested in providing summer programs and programs for youth should come to Community Council meetings to help plan and organize activities . Residents in attendance will submit a petition to Community Council requesting the opening of Danby Pond for swimming this summer . COMMUNICATIONS : 1 ) Memorandum from Doug Staley in regard to proposed zoning changes - - referred to Planning Board Super Group . 2 ) Letter from ACC in regard to theft of cable service . 3 ) NYPRIG ( New York Public Interest Research Group , Inc . ) may be doing door - to - door research in our area from May 7 , - August 31 . gip Town Board Minutes May 13 , 1991 3 4 ) Letter from Rhonda Engman in regard to Danby State Forest and a ten ( 10 ) year management plan land - - referred to Planning Board . 5 ) Letter from Penny Peterson in regard to proposed zoning map changes . OTHER REPORTS : EMC Report - - Herb Engman reported on the following : 1 ) . Tompkins County will have a hazardous waste day in the fall . There will also be a paint exchange with paint to be donated to housing projects . 2 ) The EMC has recommended an environmental impact study of the entire airport area : 1 ) study of plants and animals ; 2 ) well water testing in that area ; and 3 ) surface stream analysis such as runway run offs . Highway Report 1 ) The new road grader has arrived and in service . 2 ) The Highway Superintendent met with Agway and the problem with the gas service has been solved . Senior Citizens Report Edw . M . Roberts reported that regular monthly meetings of the Danby Senior Citizens will not be held for the summer . Code Enforcement Officer ' s April 1991 Report Councilperson Marisa read the following report from the Code Enforcement Officer : For the month of April 1991 - - permits were issued for one ( 1 ) addition , one ( 1 ) alternation and one ( 1 ) garage - - total fees collected $ 167 . 00 for a construction value of $ 35 , 660 . 00 . One Certificate of Occupancy was issued . The Code Enforcement Officer reported that approximately 25 Order to Remedy Violations have been cited and six ( 6 ) violators were served with notice . Planning Board Report : Planning Board Chair Nancy Weitzel reported that the Planning Board has requested the Code Enforcement Officer include in his monthly report the locations ( roads ) building permits are issued for . Super Group - Discussion : Super Group and its function was discussed in detail . Chairperson Weitzel reported the Planning Board passed a motion that the new zoning ordinance will be coordinated and directed by the Planning Board at regularly scheduled working sessions with the Town Board and Board of Zoning Appeals encouraged to participate . She explained that it is necessary to have official documentation and minutes of for all Planning Board Meetings . OLD BUSINESS : • Resolution # 29 of 1991 - - Conveyance of West Danby Methodist Cemetery - - Raise from the Table A motion was made by Councilperson Eckstrom and seconded by Councilperson Schwartz to raise from the table Resolution # 29 of 1991 - - Conveyance of West Danby Methodist Cemetery . Discussion followed in regard to who is responsible for providing maintenance of the property at this time . Supervisor Dietrich reported that he is still waiting for a ruling from New York State to ensure that we have received all the necessary information for liabilities . 37// 4 • Town Board Minutes e� May 13 , 1991 4 Tabling Motion : A motion was made by Councilperson Oltz and seconded by Councilperson Eckstrom to table Resolution # 29 of 1991 - - Conveyance of West Danby Methodist Cemetery until we have received a ruling from New York State . A roll call vote on the motion resulted as follows : E ckstrom Aye Marisa Aye O ltz Aye S chwartz Aye D ietrich Aye Carried Unanimously Appointment to Economic Opportunity Corporation Board of Directors : A motion was made by Councilperson Schwartz and seconded by Supervisor Dietrich to appoint Councilperson Oltz as the Town of Danby Representative to the Economic Opportunity Corporation Board of Directors ( EOC ) for a term to expire on March 31 , 1992 . A roll call vote on the motion resulted as follows : E ckstrom Aye Marisa Aye O ltz Aye Schwartz Aye D ietrich Aye Carried Unanimously RESOLUTION # 31 OF 1991 APPROVAL TO PAY BRUIELLY PLUMBING AND HEATING By Supervisor Dietrich : Seconded by Councilperson Eckstrom WHEREAS , The Town of Danby has withheld one half of Application # 6 to Ken Bruielly Plumbing and Heating until the heating system was in satisfactory working order . and WHEREAS , Highway Superintendent Ken Coddington has informed the Town of Danby Town Board that this problem has now been repaired and is now in working order , now therefore be it RESOLVED , That the Town of Danby Town Board approve the balance of Application # 6 payment to Bruielly Plumbing and Heating for services rendered . Thursday , May 16 , 1991 from 3 - 6 P . M . and asked for two ( 2 ) volunteers to sit on the Board . ` Councilpersons Eckstrom and Marisa volunteered their service . Approval for Highway Superintendent to Expend Funds for Trash D isposal of Trash Along Roadways A motion was made by Councilperson Eckstrom and seconded by Councilperson Schwartz to authorize Highway Superintendent Coddington to expend funds for trash disposal of trash found along roadways in the Town of Danby . Town Board Minutes / May 13 , 1991 5 A roll call vote ongthe motion _ resulted as follows : E ckstrom Aye Marisa Aye O ltz Aye Schwartz Aye D ietrich Aye Carried Unanimously Operation Desert Shield / Desert Storm - Appreciation A motion was made by Supervisor Dietrich and was seconded by Councilperson Schwartz that the Town Board of the Town of Danby acknowledges and extends their heartfelt thanks to all the men and women in the Town of Danby who were called to serve in Operation Desert Shield / Desert Storm . A roll call vote on the motion resulted as follows : E ckstrom Aye Marisa Aye O ltz Aye Schwartz Aye D ietrich Aye Carried Unanimously Town of Danby Senior Citizen Tax Exemption Supervisor Dietrich reported that he would like the Town of Danby to consider an increase in the income eligibility for Senior Citizen Tax Exemption for the Town of Danby . Discussion followed and the Town Board will look into revising our Senior Tax Exemption schedule . Maintenance of Danby Pond for the 1991 Summer Season Supervisor Dietrich reported that funds are needed for maintenance of the Danby Pond area and dumpster service for trash disposal for the 1991 summer season . Supervisor Dietrich reported that he would like to enter into a contract with New York State Parks and Recreation for Danby Pond . He explained that the contract can be cancelled in ten ( 10 ) days , and must have Tompkins County Health Department approval . These documents must be sent out immediately if the Danby Pond can open this summer . Supervisor Dietrich asked for Board authorization to send a contract to the State . Discussion followed in regard to the ten ( 10 ) day cancellation period for the State contract , how to pprovide a swimming program and the community efforts to raise money help to fund a swimming program . RESOLUTION # 32 OF 1991 By Councilperson Marisa : Seconded by Councilperson Eckstrom RESOLVED , that the Town of Danby Town Board agrees to accept responsibility for the costs of mowing the area , garbage disposal at Danby Pond and to authorize the Town of Danby Supervisor to submit the contract to New York State and to proceed with information gathering on from Tompkins County Health Department on certification of Danby Pond for use this summer . M . Roberts submitted estimates for the purchase and installation of carpeting of the Town Hall Offices , the upstairs h allway and the vestibule . D iscussion followed in regard to having new carpeting or having the carpets cleaned at this time . Motion to Approve A motion was made by Councilperson Eckstrom to authorize Edw . M . Roberts , Building Custodian to expend funds to have new carpeting installed in the Town Hall Offices , the upstairs hallway , and the vestibule . D iscussion followed in regard to the many kinds of commercial carpeting available . Motion Withdrawn Councilperson Eckstrom withdrew the motion to approve funding for new carpeting at this time to allow research of other vendors and consultation with the town bookkeeper . P ainting of the Town Hall Bid Specs E dw . M . Roberts submitted a draft of Bid Specs for the painting of the Town Hall for review . APPROVAL OF WARRANTS : Adjustment of February 1991 Warrants: A motion was made by Councilperson Marisa and seconded by Councilperson Oltz to approve the adjustment of the February Warrants - - General Fund Warrant from $ 10 , 112 . 65 to $ 7 , 631 . 29 ( a d ecrease of $ 2 , 481 . 36 ) and Highway Fund Warrant from $ 13 , 670 . 12 to $ 14 , 313 . 39 ( an increase of $ 643 . 27 ) .
