HomeMy WebLinkAbout1966-09-13 0. 8 September 13 , 1966 PUBLIC HEARING The Public Hearing was called to order by Supervisor Todd at 7 : 30 P . M . in the Town Hall . Present were Supv . Todd , Councilmen Lee , Jones & O gden . Supervisor Todd read the following Ordinance : BE : IT ORDAINED , that pursuant to Section 467 of the New York Real Property Tax Law , real property owned by one or more persons , each of whom is sixty - five ( 65 ) years of age , or over , shall be exempt from taxation by the Town of Dryden to the extenet of 50 ' percentum of the assessed valuation thereof , subject to the following conditions : no exemption shall be granted ( a ) if the income of the owner or the combined income of the owners of the property exceeds the sum of Three Thousand Dollars ( $ 3 , 000 . 00 ) for the twelve ( 12 ) consecutive months immediately preceding the date of making application for exemption . Where title is vested in either the husband or the wife , their combined income may not : exceed such sum . Such income shall include social security and retirement benefits , interest , d ividends , rental income , salary or earnings , and income from self employment , but shall not include gifts or inheritances ; ( b ) Unless the title of the property shall have been vested in the owner or all of the owners of the property for at least sixty ( 60 ) consecutive months prior to the date of making application for exemption ; ( c ) Unless the property is used exclusively for residential purposes ; ( d ) Unless the real property is the legal residence of and is occupied in whole or in part by the 'owner or by all of the owners of the property . Application for such exemption must be made by the owner or all of the owners of the property , on forms to be furnished by the Town Assessor , and shall furnish the information and be executed in the manner required or prescribed on such form . Application for such exemption shall be filed in the Office of the Town Assessor during the period commencing January 1 and ending February 1 of each year . . The Assessor may require any applicant to furnish such other and further information as may be reasonably necessary for him to establish the qualification for exemption of said applicant . He may establish such rules and procedures and take such other steps as may be necessary to implement the provisions of this ordinance . The applicant must verify as to the truth of the statements contained in such application . Any - conviction of having made any willful false statement insuch application shall be punishable by a fine of not more than one Hundred Dollars ( $ 100 . 00 ) and shall disqualify the applicant or applicants from further exemption for a period of five ( 5 ) years . This Ordinance shall take effect on Tax Roll filed May 1967 . Some questions were asked from the ten people present at this hearing . One question dealt with pensions , whether or not they had to claim that as they had already paid taxes on it once . Supervisor Todd felt that this would need a legal explanation , - andwould look into it . Some felt that $ 3000 . 00 was a very low figure and Supv . Todd explained this was set by the State and not bythe Town and their was nothing this Board could do about it . He also explained that each individual governing 410 body had to pass this exemption . We were doing it for the Town only , the County would have to do it for County Taxes , and the School for S chool Taxes . . RESOLUTION #125 ADOPT ORDINANCE 65 EXEMPTION Councilman Ogden offered the following resolution and asked its adoption . RESOLVED that . this Town Board adopt this Ordinance . 2nd Councilman Lee Carried . BOARD MEETING Supversior Todd called the Town Board Meeting to order at 8 : 15 P . M . Present were Supv . Todd & Clm . Lee , Ogden , Jones & Benson . WATER DISTRICT #1 109 Mr . Richard Fennoco from O ' Brien & Gere was present to bring the Board up - to - date on the schedule . He reported that the Water Resources Commission had a back log of work and it would be at least forty - five days before they could get to our application . At the present time they are in the process of procuring easements , and that the final design would be submitted this week . The schedule could be set up as follows : Advertise - First week of October for 3 weeks Is Publish - 10/ 6/ 66 Canvass bids and Award . Contracts - November 1st . Break Ground - . 1st week of November RE-APPRAISAL • There was some discussion on the re - appraisal_ . .as so many people had been in complaining about their taxes for the coming year should it be adopted . The Board felt that as long as it was backed by the III County and paid for by the County , they could not throw it out as it would cost the. .Town to much to do this , our money would be spent twice for the same thing . However , the Board felt that many of the properties were either to high or to low and this must be corrected before they would accept it . The Board decided that before they make any decisions they would like to know the bases of appraisal and would like to see a copy of the original contract made between the County and the Cleminshaw Company . GARBAGE COLLECTION Mr . Charles Collins was present as requested by Councilman Benson . The Board wanted to discuss with Mr . Collins what if anything he could do about garbage collection for the whole Town . Mr . Collins stated that it was economically feasible , that he could handle garbage for the entire Town and perhaps treat it as a unit . He would take anything people had out but brush , stone and building materials . He further stated that his dump was sufficient to take care of any garbage he would be collecting for some time , and that people could dump there themselves fora -small fee . In order to quote a price he w ould heed a list of the number ^ of houses and stores . Rates for stores would be different . Councilman Benson stated that we would keep in touch , and in the meantime get a list of all properties . At this - time he complimented Mr . Collins on the fine job he had been doing , that it was done in a decent manner at a decent price . DRYDEN SEWER" -DISTRICT #1 Supervisor Todd reported that Lozier Engineers , Inc had sent proposals , Contracts and Specifications for this District . - Bids had been opened Monday September 12th at 2 P . M . . The two low bidders were being checked by Lozier , and the certified checks from the other bidders were being returned . As soon as Supervisor Todd heard from Lozier and one of the bidders had been accepted they would award the contract . DRYDEN SEWER DISTRICT #2 Supervisor Todd reported that he had received a letter and two copies o f a proposed contract covering engineering services to be rendered in this district from T . G . Miller . He further reported that Mr . Miller would receive fees equal to six percent ( 6%) for the work done in ✓ espect to field surveys and measurements and receiving and tabulating bid proposals and assisting in awarding the contract for construction . The Town will be allowed a credit of $ 1500 . 00 for the preliminary III work , and the job inspection will be on a per diem basis . At this time it was felt the bids for this district could be let out about 3 / 30 / 67 and this would compensate for any delays . ` RESOLUTION #126 EXECUTE CONTRACT - Councilman Benson offered the following resolution and asked its adoption . RESOLVED that Supervisor Todd execute this Contract with Mr . Miller 2nd Councilman Ogden . Carried . WATER - DISTRICT #1 Supervisor Todd at this time asked the Board if they felt they would like to vote on the advertising of bids for Dryden Water District #1 RESOLUTION #127 ADVERTISE FOR BIDS Councilman Benson offered the following resolution and asked its adoption . ' RESOLVED that this Board authorize the clerk to advertise for bids on Dryden Water District #1 2nd Councilman Ogden Carried I ® RESOLUTION # 128 GENERAL BILLS Councilman Lee offered the following resolution and asked its adoption . RESOLVED that the General Bills be paid as audited . 2nd Councilman Jones . Roll call vote - all voting YES . RESOLUTION #129 HIGHWAY BILLS Councilman Benson offered the following resolution and asked its adoption . RESOLVED that the Highway Bills be paid as audited . 2nd Councilman Ogden . Roll call vote - all voting YES . The minutes of the previous meeting were corrected as follows : Resolutions # 106 & #107 Untable Town Clerk Appointment and Untable Highway Superintendent Appoint . To insert 106B and 107B Resolutions calling for these appointments . Minutes approved as corrected . VARNA LIGHTS Mr . Duane Winters of the New York State Electric & Gas Corp . was present as requested by Councilman Lee . He was present in regard to the replacing of two or three lights in dark spots in the Hamlet o f Varna . Mr . Winters stated that a rate reduction was possible for the Town of Dryden at large , intersection lighting such as in front of the Gas of Electric . Varna was presently under the new rate and this year the Town would have a savings of , $ 305 . 50 and would they be interested in spending this money in this manner . The Board felt not at this time , they would rather put in the two or three lights at a ✓ ate of $45 . 00 per light per year . Supervisor Todd at this point ✓ equested that Mr . Winters send the new rates to the Board for budgetary purposes . . Mr . Dedrick was present and asked why utilities were not listed on the new re - appraisal sheets . Supervisor Todd reported that the Unit Costs were supplied by the State and the job was not completed in time to make this list . Mr . Dedrick asked if the Town mould be publishing these figures when they were available . Supervisor Todd ✓ emarked . that when the figures were available they would be published . GEORGE JUNIOR REPUBLIC RESOLUTION #130 RECIND RESOLUTION #74 Councilman Ogden offered the following resolution and asked its adoption. RESOLVED that Resolution #�4 be recinded . 2nd Councilman Benson . Carried . RESOLUTION #131 GJR RESOLUTION REPLACING #74 Councilman Jones offered the following resolution and asked its adoption . WHEREAS , Community relations between the George Junior Republic and areas of the Town of Dryden have seriously deteriorated over the past several years , and . WHEREAS , this unfortunate development has been acknowledged and accepted by the George Junior Republic executive Director as having been primarily the responsibility of the George Junior RepublicT° it :!: a :_ neighbors in the surrounding community , and WHEREAS , the officials of the George Junior Republic , the Village of ' Dryden. , the Village of Freeville , and the Town of Dryden acknowledge and support the necessity to pursue the critical objectives of improving ✓ elationships and communications between the community and the George Junior Republic , NOW , THEREFORE BE IT ' RESOLVED THAT a permanent George Junior Republic Citizens Committee be created . Membership of said committee shall consist of three Village of Freeville citizens appointed by the Village. o f Freeville Trustees ; two Village of Dryden citizens appointed by the Village of Dryden Trustees ; two at - large representatives residing outside- the' Villages appointed by the Town Board , and two members of the George Junior Republic Staff to be designated by the Executive Director BE IT FURTHER RESOLVED , that this George Junior Republic Citizens Committee is specifically charged with the responsibility to hear and explore all problems of individual concern between this community and the George Junior Republic , to explore all feasible means for improving ✓ elationships between this community and George Junior Republic , and to engage in such mutual endeavors as will strenghten the purposes o f the residents of the community and of the George Junior Republic . That in any case , this committee shall meet quarterly at a minimum . THAT , this committee shall determine the organizational structure and o perational procedures that best serve its responsibilities . September 27 , 1966 The Special Meeting was called to order by Supervisor Todd at 9 : 45 P . M . \/ The following resolution was presented to the Board : RESOLUTION FOR HOLDING OF SPECIAL ELECTION At a Special Meeting of the Town Board of the Town of Dryden , Tompkins County , New York , held on the 27th day of September , 1966 . RESOLVED , that a special town election be held at the following polling places : 1 . Varna Community Hall , Varna , New York 2 . Houtz Hall , Etna , New York _ 3 . Village Hall , Dryden , New York 4 . West Dryden Church , West Dryden , New York 5 . Town Hall , Dryden , New York 6 . Village Hall , Freeville , New York 7 . Bethel Grove Community Hall , 1Bethel Grove on the 25th day of October , 1966 with the polls to be opened at 2 : 00 o ' clock in the afternoon , and to be closed at 8 : 00 P . M . in the afternoon , and that the following prepositions be voted upon at said special election : Proposition #1 . Shall the office of Town Clerk be an appointive -v office in the Town of Dryden effective January 1st , 1968 ? Proposition #2 Shall the office of Town Superintendent ' p rintendent of Highways„ �be an appointive office in the Town of Dryden effective January 1st , 1968 ? Passed by voice vote by all members . RESOLUTION #134 execute LIGHTING CONTRACT t Councilman Lee offered the following resolution and asked its adoption . RESOLVED that the written Contract submitted by the New York State Electric & Gas Corp for lighting the Streets and Public Places of the Town of Dryden dated October 3 , 1966 and the same is approved and that the Supervisor and the Clerk of this Board be , and they hereby are , authorized , empowered and directed to execute the same in the name and in behalf of the Town of Dryden . 2nd Councilman Jones . Carried . This meeting was adjourned at 11 : 10 P . M . TOWN OF DRYDEN • DRYDEN, NEW YORK �k In the Heart of the Finger Lakes Region 1 OFFICE OF THE TOWN CLERK • 11± BE IT FURTHER RESOLVED , that this committtee shall report formally to the Town Board of Dryden , the Village Board of Freeville , and the Village Board of Dryden , at least annually in written communications . 2nd Councilman Benson . Carried . Supervisor Todd will set a time for a meeting under this new Resolution . Supervisor Todd called a budget meeting , for the Town on September 19 , 1966 at 9 A . M . in the Town Hall . Councilman Ogden reported that he had seen a -Contractor about the door throught the Clerks ' Office into the Assessor ' s Office and the estimate had been exactly the same figure as the one previously given to Clm . Lee . Councilman Benson reported that Mr . Neiderkorn would be present at the 701 Meeting to be held here in the Town Hall , and that both he and Councilma-e ' Ogden would be present . Supervisor Todd reported that some monies should be set aside for the purpose of obtaining easements . RESOLUTION #132 AUTHORIZATION OF MONIES Councilman Ogden offered the following resolution and asked its adoption . RESOLVED that the Supervisor be authorized to set aside $ 500 . 00 from the General Fund for Dryden Water District #1 . This money to be returned on sale of bonds . 2nd Councilman Benson . Carried . Councilman Lee reported that Governor Rockefeller and the President of the United States have proclaimed Citizenship Day and Constitution Week beginning Saturday , September 17 , 1966 . It was asked that each Town issue a proclamation calling for local observance . RESOLUTION #133 PUBLISH PROCLAMATION Councilman Lee offered the following resolution and asked its adoption . RESOLVED that we do as outlined and publish . 2nd Councilman Ogden . Carried . Councilman Benson reported that he had the completed questionnaire sent to residents of the Town of Dryden by the 701 Program . He felt it should become part of the public records and filed in its entirity . He stated that it contained some very interesting data , such as where do people shop 206 Dryden 189 Ithaca 54 Freeville The meeting was adjourned at 9 : 55 P . M .
