April 8 , 1991 A regular meeting of the Town of Danby Town Board was held at the Town Highway Barns at 93 Hornbrook Road , Ithaca , New York . Board Members and members of the public were encouraged to tour the new facility . PRESENT : Councilpersons : Eckstrom , Oltz , Marisa , Schwartz Supervisor Dietrich O thers Present : P lanning Board Chair - N . Weitzel Tompkins County Representative - F . Roberts , Ray Axtell , Joel Gagnon , Sally Gagnon , Dorothy Roberts . Supervisor Dietrich called the meeting to order at 8 : 00 P . M . Approval of April 3 , 1991 Town Board Minutes : A motion was made by Councilperson Eckstrom and seconded by Councilperson Marisa to approve the April 3 , 1991 Town of Danby Town Board Minutes as published . Discussion followed in regard to the Town Board meeting with Community Council . The Town Board will meet on April 10 , 1991 at 8 : 00 P . M . with Community Council . A roll call vote on the motion resulted as follows : Eckstrom Aye Marisa Aye O ltz Aye Schwartz Aye D ietrich Aye Carried Unanimously Approval of February 11 , 1991 Public Hearing Minutes and February 11 , 1991 Town Board Minutes ; A motion was made by Councilperson Schwartz to approve the minutes of February 11 , 1991 Public Hearing and the February 11 , 1991 Town of Danby Town Board Minutes as published . A roll call vote on the motion resulted as follows : E ckstrom Aye Marisa Aye O ltz Aye Schwartz Aye D ietrich Aye Carried Unanimously Tompkins County Representative Report : Representative Proto reported on the following : 1 ) NYS Budget cuts to Tompkins County 2 ) Funding for the reading rooms at Danby and Caroline have been restored 2 Town Board Minutes April 8 , 1991 3 ) EMT and fire training programs for fire departments will no longer be reimbursed 4 ) Part 75 A of NYS Septic Regulations and Permits - - Tompkins County is reviewing the NYS septic regulations Discussion followed in regard to lot size requirements and the size of the new systems . 5 ) Solid Waste Committees - - Hillview Road Landfill Committee will be held Wednesday , April 10 , 1991 at 7 : 30 in West Danby . A Tour of the Tompkins County Landfill is scheduled for Thursday , April 11 , 1991 . The group will meet at West Danby Fire Hall at noon . 6 ) Airport Development Committee - - will meet Tuesday , April 9 , 1991 at 8 : 00 a . m . There will be a formal presentation to the Board of Representatives on April 16 , 1991 of the selected airport terminal design . 7 ) Environmental Management Council - - Don Barber has been reappointed as Chair . 8 ) Environmental Health Fees - - Tompkins County Health Department issued permits are under review . 9 ) Tompkins Community Hospital - - Tompkins Community Hospital Annual Meeting was held last week . The community needs to continue to utilize its services . 10 ) Bus Service to Danby - - will begin Monday , April 15 , 1991 . Park and Ride service stop will be at the Danby Fire Department Parking Lot . Members of the Public : Clifford DeMayo of East Miller Road addressed the Board and public and said he would like to give credit to Highway Superintendent Pete Coddington for the work on Gilbert Road and for taking the time to personally explain exactly what was necessary to repair and w iden the road . He thanked Pete for a job well done . Herb Engman of 571 S . Danby Road , Spencer addressed the Board in ✓ egard to the Rural Health Care Council and said they have developed a Rural Health Care Coalition to negotiate with NYS to g et them to recognize that needs are different in rural areas . The Coalition is looking for new members to get more people involved . E dw . M . Roberts of 47 Bald Hill Road - asked if the Town of Danby can do something to extend the natural gas lines in Town . Mr . Roberts also reported that the Town Hall stairs need to be painted and he is going to obtain estimates for the upstairs hallway carpet . Ashley Westmiller of Brown Road , Spencer NY - - addressed the Board in regard to the condition of Bruce Hill Road from Brown Road to the top of the hill . He reported that the road was in very bad condition and has not been opened this spring . Superintendent Coddington reported that Bruce Hill Road is a seasonally maintained road and it will be graded soon . COMMUNICATIONS : Supervisor Dietrich reported on the following communications : 1 ) Tompkins County Area Development Seminar Series on Community Survival for the 1990 ' s . 2 ) Letter to Town Board from Harry Bowers , 1740 Danby Road in regard to ACC TV Cable service in Danby , debris flowing down the creek causing damage to his property , and summer camp reimbursement request for 1990 . Supervisor Dietrich responded that negotiations with ACC for the Town of Danby Franchise Agreement are on - going and the Highway Department will look into the issue of creek maintenance . • 3 Town Board Minutes April 8 , 1991 Environmental Management Council Report : Representative Herb Engman reported on the following : The public is invited to the next meeting of the Environmental Management Council on April 23 , 1991 at 7 : 30 P . M . at City Hall , 108 East Green Street , Ithaca , NY . The Meeting agenda includes discussion on Fingerlakes Land Trust Program Video and the DR - 7 Natural Resources Study report . Also on the Agenda will be the Environmental Impact Statement for Tompkins County Airport and the State of the Environment Report . Community Council Quarterly Report : S upervisor Dietrich submitted the Community Council Quarterly Report for the first quarter of 1991 . The Town of Danby Town Board will meet with Community Council on April 10 , 1991 at 8 : 00 P . M . Town of Danby Highway Report : Superintendent Coddington reported on the following : 1 ) New road grader will be shipped on April 15 , 1991 . 2 ) A storm with high winds and ice caused a lot of damage in the Town . Supervisor Dietrich reported that Danby residents would like a Spring clean - up day to dispose of yard debris ( limbs , etc . ) accumulated from winter snow and ice storms . Some townships in the County do provide a clean - up day . D iscussion followed and Superintendent Coddington said that it was h is understanding that Tompkins County does not allow the dumping o f trash for spring clean - up by towns . The Superintendent also reported that the Tompkins County Landfill dumping fee charged to towns for disposal of trash dumped along roadsides was discussed at the Superintendents Meeting . 3 ) Richard A . Rust , Architect for the new Highway Barns has advised the Town to pay the plumbing and heating contractor the balance of his contract . S upervisor Dietrich reported that there is still a problem with the heating system in the building that the Town feels needs to be ✓ esolved before final ( or full ) payment is made . There is also new contracted work for the plumbing and vents in the roof . Supervisor D ietrich suggested that maybe the Town should withhold some payment . Approval for payment of New Highway Barns Application 16 and Change Order submitted by Mr . Richard A . Rust for Ken Bruielly Plumbing and Heating Contract : After further discussion the Town Board approved payment of Application # 6 and Change Order submitted by Richard A Rust for Ken Bruielly Plumbing and Heating Contract for the New Highway B arns as follows : Warrant # 9 - New Highway Barns : One half of Application # 6 - $ 2 , 544 . 58 Change Order 504 . 00 Total Payment $ 3 , 048 . 58 D iscussion followed in regard to the change order billing from the plumbing and heating contractor . Senior Citizen Report : Senior Citizen Housing Report Councilperson Oltz reported that the Danby Senior Citizens have asked the Town Board to investigate the possibility of senior housing in Danby . She reported that the Town of Danby and the Town 40? 4 Town Board Minutes April 8 , 1991 of Enfield are the only towns in Tompkins County that do not have senior housing . Becky Bilderbeck , Executive Director of Better Housing in Tompkins County met with representatives of Danby . Councilperson Oltz reported that the seniors in Danby will be polled to determine whether there is a need . If a need is determined there are some grant monies available to towns . The process of providing senior housing is approximately a four ( 4 ) year process . A notice will be put in the Danby Area News for senior residents to respond to . She also attended a workshop sponsored by Tompkins County Cooperative Extension on HOST Housing ( Housing Options for Seniors Today ) . Discussion followed in regard to Senior Housing . Edw . M . Roberts reported that in regard to HOST Housing that the units are 700 to 800 sq . ft . and are temporary units constructed without permanent foundations and basements . Mr . Roberts has provided copies of the Town of Freeport Zoning Ordinance for reference in regard HOST Housing . Councilperson Marisa responded that the first part senior housing is to obtain a survey to assess the need of A providing project grant application cannot be done informally and the Town would need to pay for a formal survey . We need written su p commitment ) from individuals who are interested in living intsenior housing quarters . Code Enforcement Officer ' s March 1991 Report : Supervisor Dietrich read the Code Enforcement Officer ' s March 1991 Report as follows : New Home Construction Permits - three ( 3 ) Building Permit Renewals - one ( 1 ) Certificates of Occupancy - six ( 6 ) Order to Remedy Violations - two ( 2 ) Total fees collected - $ 816 . 00 Planning Board Report : Planning Board Chair , Nancy Weitzel reported that at the regular meeting of the Town of Danby Planning Board held on March 20 , 1991 they unanimously passed a resolution recommending the Town of Danby Town Board consider the recommendation of Paul Viscuso to Tompkins County Planning Board to fill the unexpired term of Joel Gagnon . The term of appointment will expire on December 31 , 1994 . Community Council Report : Supervisor Dietrich reported that he has submitted the breakdown from Tompkins County of projections of cuts in youth It appears the cuts to the County will be a yo programing . pproximately 58 % . NEW BUSINESS : RESOLUTION NO . 27 OF 1991 APPOINTMENT TO TOMPKINS COUNTY PLANNING BOARD By Councilperson Schwartz : Seconded by Councilperson Eckstrom WHEREAS , Joel Gagnon has submitted his resignation as the Town of Danby representative to the Tompkins County Planning Board , and WHEREAS , the Town of Danby Planning Board unanimously recommends the appointment of Paul Viscuso of 122 Heisey Road , Willseyville , New York to serve as the Town of Danby Planning Board Representative , now therefore be it RESOLVED , That the Town of Danby Town Board recommends the appointment of Paul Viscuso to the Tompkins County Planning Board as the Town of Danby Representative to fill the remaining term of Joel Gagnon . and be it further RESOLVED , That the term of appointment is to begin immediately and will expire on December 31 , 1994 . v � 5 i Town Board Minutes April 8 , 1991 A roll call vote on the resolution resulted as follows : Eckstrom Aye Marisa Aye O ltz Aye S chwartz Aye D ietrich Aye Carried Unanimously RESOLUTION NO . 28 OF 1991 RECOMMENDATION OF APPOINTMENT - TOMPKINS COUNTY YOUTH BOARD By Councilperson Schwartz : Seconded by Supervisor Dietrich WHEREAS , Frederic Dietrich now serves as The Town of Danby representative on the Tompkins County Youth Board , and WHEREAS , Mr . Frederic Dietrich can no longer serve as the Town of Danby Representative on this Board , and WHEREAS , Deborah Fitzpatrich has expressed an interest in replacing Mr . Dietrich as the Town of Danby representative , now be it RESOLVED , That the Town of Danby Town Board recommends the appointment of Deborah Fitzpatrich of 91 Nelson Road , Ithaca , New York to the Tompkins County Youth Board to replace Mr . Frederic Dietrich for a term to expire on December 31 , 1992 . A roll call vote on the resolution resulted as follows : Eckstrom Aye Marisa Aye O ltz Aye Schwartz Aye D ietrich Aye Carried Unanimously RESOLUTION 0 29 OF 1991 ACCEPTANCE OF WEST DANBY METHODIST CEMETERY By Supervisor Dietrich : Seconded by Councilperson Schwartz WHEREAS , there has been established in this Town a cemetery known as the WEST DANBY METHODIST CEMETERY ASSOCIATION , INC . , which association maintains a public cemetery on Maple Avenue Road in West Danby , New York , Tompkins County , New York , and owns real property in said Town , and WHEREAS , said association has under its care certain funds for perpetual care , permanent maintenance , special trust , general , deposited in a local bank , and WHEREAS , the association has been and still is unable to procure sufficient income from above investments , the members of the association and from the representatives of the deceased persons interred in the cemetery , and WHEREAS , the cemetery association has requested that the Town of Danby , pursuant to Section 1506 ( j ) of the Not - for - Profit Corporation Law , accept the conveyance of the cemetery premises and transfer of assets , now therefore be it RESOLVED , that the Town of Danby accept the conveyance of the cemetery premises and the transfer of the assets from the cemetery association , such conveyance shall be subject to all agreements as to lots sold and all trust , restrictions and conditions upon the title or use of the real property or assets . Discussion followed and the Town Board will refer the request from the West Danby Cemetery Association to the Town Attorney for review of the documents . it I syO - / 6 Town Board Minutes April 8 , 1991 Motion to table Resolution No 29 A motion was made by Councilperson Eckstrom and seconded by Supervisor Dietrich to table Resolution # 29 of 1991 - - Conveyance of West Danby Methodist Cemetery until the documents have been reviewed by the Town Attorney . A vote on the motion resulted as follows : E ckstrom Aye Marisa Aye O ltz Aye Schwartz Aye D ietrich Aye Carried Unanimously RESOLUTION NO 30 OF 1991 DOG CONTROL RESEARCH By Councilperson Marisa : Seconded by Councilperson Eckstrom WHEREAS , Tompkins County Department of Health and NYS Department of Agriculture and Markets has alerted all municipalities of rabies in surrounding counties , and WHEREAS , Tompkins County believes rabies can spread into our County at any time , and WHEREAS , The Town of Danby Town Clerk needs to update the Town Dog Control records and listings and has requested clerical help be approved for this project , now therefore be it RESOLVED , That the Town of Danby Town Board approve the Town Clerk to expend A872 funds , for clerical assistance and postage to update dog control records , and be it further RESOLVED , That the amount expended shall not exceed $ 150 . 00 .
