HomeMy WebLinkAbout1965-11-04 November 4 , 1965 BUDGET HEARING The Annual Hearing for the Preliminary Budget was held November 4 , 1965 at 7 : 30 P . M . in the Town Hall . Those present to go over the budget were the newly elected officers of the Town, Tom Todd , Sid Jones and Emmons Ogden . Also present was Rev . Austin and the newly elected Government Body from the George Junior Republic . They were here to observe . The Publication notice from the Ithaca Journal was read to those present . • Mr . Gridley went over the entire budget item for item and explained these as he went . The regular Board Meeting for the Town of Dryden was called to order by Supervisor Gridley November 4 , 1965 at 9 : 55 P . M . Present were Supervisor Gridley , Justices Hoagland & Spaulding , 41, Assessor Abrams , Highway Superintendent Case and Attorney Amdur . Absent were Councilmen Lee & Benson . LIGHTING DISTRICT - VARNA Mr . Elmer VanArkel and Mr . Bud Munch were present with a new petition to diminish the new lighting district , and this petition had twenty - seven signatures . This petition requested that no additional new lights be added to the Varna Light District and stated that the originally petition circulated failed to give sufficient information as to the cost involved . Mrs . Amdur stated that it was spelled out explicitly . The original petition was taken from the minute book and read aloud , and in the contents the new figure of $ 1260 . 00 was stated . Mr . VanArkel went on to report that while out taking up his petition he had talked to many people , and the feeling had been that the people had not been given a chance to read the original :, . and one man said he had to practically twist an arm to see it . The Board told Mr . Van Arkel that they had no control over the way the petition was taken up . After much discussion on the area involved , the increased cost ( $ 1. 65 presently to approximately $ 3 . 00 future ) the illumination , the Public Hearing , Taggin -Wagon percentage it was decided to adjourn this until November 16 , 1965 . However , Mrs . Amdur did point out at this time that the ' Board ' was acting arbitrarily by not going ahead with the - order and the resolution passed at the Public Hearing and if some of the people who signed the original petition wished to they could take it to Court . Once the Town has acted on a petition it cannot be withdrawn . RESOLUTION #112 GENERAL BILLS Justice Spaulding offered the following resolution and asked its adoption . RESOLVED that the general bills be paid as audited . 2nd Hoagland Roll call vote - all voting YES . Absent Clm . Lee & Benson . RESOLUTION #113 HIGHWAY BILLS Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that the Highway bills totaling $ 4949 . 91 be pais as audited 2nd Justice Spaulding . Roll call vote - all . voti .ng YES . Absent Councilmen Lee & Benson . VARNA MEN ' S CLUB Mr . Gridley reported that he had gone to the Town Hall in Varna to meet with some of the Men ' s Club Members , and only one gentleman had _ . showed up . He explained the situation to him , and told him what the Town Board had decided to do . It was suggested by Justice Hoagland that a copy of the resolution be posted on the door of the Town Hall in Varna by the Town Clerk . Mrs . Amdur suggested that the Men ' s Club be given ninety days from the date of the notice , and if they did not do anything in that length of time it would be up to the Town to dispose of it . WATER DISTRICT - VARNA 63 Mrs . Amdur reported that as far as the Varna Water District was concerned - a resolution had been passed at the last Board Meeting to pay $ 800 . 00 to O ' Brien & Gere for general plans , maps and estimates . She further ✓ eported that we are eligible for a Farmer ' s Home Administration Loan . These loans are made on a first come , first serve basis , so Mrs . Amdur contacted the local office and filed an application . We cannot sign a contract until November 15 , 1965 being subject to a permissive ✓ eferendum , but the Loan office will go ahead and start work on it . TAGGIN - WAGON It was reported to the Board at this time that the reason Taggin - Wagon had not been transferred from Carl James to Taggin -Wagon Inc . was that the transfer had not been recorded in time to go on this years tax roll . Assessor Abrams reported that he had written a letter to Mr . Butler in regards to his request for lower taxes due to all the noise in his area , and suggested that Mr . Butler come to Grievence Day . Mrs . Admur reported that she had written a letter to Mr . Hodgson of Ringwood Court telling him what had been discussed at the last Board Meeting , and advising him of the Town Highway Law in regards to a private road . ( Letter attached ) CIt was recommended that a resolution be passed at this time for the Sewage Study so that we can collect the money due from the State . A study made by the state is paid by the state , however in order for the state to release these fees it must be okayed by the Town where the study was done .i RESOLUTION #114 SEWAGE STUDY Justice Spaulding offered the following resolution and asked it adoption . RESOLVED that the Town of Dryden okay this sewage study and sign the ✓ esolution sent in by the Firm of Sterns & Wheler . 2nd Justice Hoagland . Roll call vote - all voting YES . It was reported at this time by Mrs . Amdur that the Village is to make their Sewer System large enough to take care of the Town until the Town is ready to go in on it , however , they are not obliged to do so , but it has been recommended . If the Village does go through with it , it will be done this way , thaithe Town will have to contract with then Village . Mrs . Amdur reported on her findings in regards to Junk Yard Ordinances and Junk Cars . She stated that one could have as many cars on ones own property as one wishes as long as they do not breed rats , or are a hazard to children . Mrs . Amdur further reported that the Town Board had no jurisdiction in regards to the property on the Turkey Hill Road however , she had heard that this particular property was being cleaned u p . . Mrs . Amdur then reported on the Hulsla.nder Case , and the Survey made `' by Mr . Rice . She had asked Assessor Abrams to assess the value of the property damaged . Mr . Abrams figured the lost as follows : Value per acre $ 100 . 00 , Agriculture $ 150 . 00 , fence payment $ 65 . 64 and Hay 610 . 00 a total of $ 325 . 64 . The question was then raised as to rather o r not she could use the Town Assessor in matter such as this . Mrs . Amdur stated that she had checked into this and found that the County Supervisor used a Real Estate Dealer . It was decided at this time M to have Mrs . Amdur contact the Hulsla.nders and set up a meeting with them to discuss this payment . RESOLUTION # 115 HULSLANDER Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that an amount not to exceed $ 325 . 64 - be paid to the Hulslanders . 2nd Justice Hoagland . Carried . SEWER DISTRICT Mr . Gridley reported that a resident on the Sapsucker Woods Road has contacted him in regards to having some sewage in that area . It was suggested at this time that we have an informal petition or letter so that we might know how many people in that area were interested . Mr . Gridley will talk with the interested person along this line and look into the services available . 64 DISPOSITION OF RECORDS Mr . Gridley at this time brought out the Local Records Disposition Request List and stated that the vault would either have to be cleaned or we would have to move out , and he would like authorization given to the Town Clerk to send in the request and obtain the necessary permission . i RESOLUTION #116 DISPOSITION OF RECORDS i Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that the Town Clerk send the Local Records Disposition Request List to Albany and obtain permission to dispose of all records that she can . 2nd Justice Hoagland . Carried . Richard Case - Highway , Superintendent recommended the purchase of a new pick - up truck and helwould like to advertise for bids . The present truck is a 1960 and has 200 , 000 miles on it . RESOLUTION #117 PURCHASE OF NEW TRUCK Justice Hoagland offered the following resolution and asked its adoption . RESOLVED taht this matter be referred to the Highway Committee . 2nd Justice Spaulding . Carried . TAX COLLECTOR It was suggested at the budget hearing that the tax collectors fee be raised from $ 600 . 00 to $ 1 , 000 . 00 an increase of $400 . 00 RESOLUTION # 118 TAX COLLECTOR Justice Spaulding offered the following resolution and asked its adoption . RESOLVED that the tax collector be raised from $ 600 . 00 to $ 1 , 000 . 00 . 2nd Justice Hoagland . Roll call vote - all voting YES . BUDGET RESOLUTION #118 ADOPTION OF BUDGET Justice Spaulding offered the following resolution and asked its adoption . 1 . WHEREAS , this Town Board has met at the time and place specified in the notice of public hearing on the preliminary budget and heard all persons desiring to be heard thereon ; NOW therefore be it RESOLVED , that this Town Board does hereby adopt such preliminary budget as originally ; compiled , as the annual budget as adopted by this Town for the fiscal year beginning on the first day of January 1966 , and that such budge -Las so adopted be entered in detail in the minutes of the proceedings of this Town Board , and be it FURTHER RESOLVED , that the Town Clerk of this Town shall prepare and certify , in duplicate , copies of said annual budget as adopted by this Town Board , together with the estimates , if any , adopted pursuant to Section 202a , subdivision 2 , of the Town Law , and deliver one copy thereof to the Supervisor of this Town to be presented by him to the Board of Supervisors of this County . 2nd Justice Hoagland . Ithaca , New York • Re : Ringwood Court Dear Mr . Hodgson : In our recent conversation I ' adTvised you that I would check into the matter of Ringwood . Court further and also discuss the same at the meeting of the Town ° Board which took place on October 12th . I made a further check of. the law in connection with Town highways , and as I told you during our telephone conversa - tion , there is no time at which a private road rigat be accepted by the Town Board as a public road , except in a case when the Town has accepted or recognized the road as a public street ., and the road has been kept in repair or taken in charge and adopted by such public authority during the prescribed period , now ten years . This is not the case in connection with Ringwood Court . In other words. , public travel in and of itself is not sufficient to oblige the Town r to accept a private road as . a Town highway , but public travel must be accompanied by municipal dominion , maintenance and control over the prescribed period in order to• make the road a . Town : road by user ; . If a future attempt is made by property owners to offer the road to the Town by dedication , it will , of course , have to be brought up to the specifications of the Town Highway Depart meat , as well as the Town of Dryden Planning Board , which now has authority to approve roads . Any further inquiries as to the possibility of the future dedication of the road should be addressed to the Town Highway Superintendent and the Town of Dryden Planning Board , both at the Town Hall of Dryden : If you have any. question with regard to any of the above , please contact me . . PRESENT : Ii: ° Wr), _.cur. £,U, d : C. Members of Town Board In the Matter of ORDER The Petition for the Improvement of the Varna Lighting District . WHEREAS , an informal written petition , dated August 26 , 1965 , E was heretofore and on September 15 , 1965 ; duly filed with this Board requesting that it conduct a public hearing pursuant to Section 202 - d , Subdivision 2 , of the Town Law of the State of New York relative to the improvement of the Varna Lighting District a by an increase in the maximum amount expended for said lighting district annually from the present sum of $ 667 . 75 to the pro - posed maximum sum of . $ 1260 . 00 annually , in order to provide substitution of 21 - 7000 Lumen Mercury Lights in and place and in stead of the existing lights and to provide 7 additional 7000 Lumen Mercury Lights in the Hamlet of Varna over and along Route 366 , the cost of said services to be assessed by the Town Board , in proportion as nearly may be , to the benefit which each lot or parcel will derive therefrom ; and whereas a -public hearing was duly _ . held , after due and proper notice published in the Ithaca Journal , at the Varna Community Association Building , Varna , ('1 New York , an September 28 , 1965 , at 7 : 30 P . M . , and the Town Board having thereupon determined that it is in the public interest to authorize such increase of such maximum amount , it is , pursuant tb the provisions of said Section 202 -d , Subdivision 2 , of the -4 r, 1 Town Law of the State of New York , hereby ORDERED , that the amount expended for the Varna Lighting District annually be increased from the present sum of $ 667 . 75 to the maximum sum of $ 1260 . 00 annually , in order to provide, I substitution of 21 - 7000 Lumen Mercury Lights in place and in l stead of the existing lights and to provide 7 additional 7000 Lumen Mercury Lights in the Hamlet of Varna over and along Route 366 , the cost of said services to be assessed by the Town _ Board , in proportion as nearly may be , to the benefit which each ' lot or parcel will derive therefrom , and that the Town Board shall enter into the necessary and proper negotiations and agreements with the New York State Electric and Gar . r • • ration in order to effectuate this improvement . The Meeting was called to order by Supervisor Gridley at ( 9 A . M . ) Present were Justices Hoagland & Spaulding , Councilman Lee and Highway Superintendent Case . Absent - Councilman Benson . It was pointed out by Mr . Gridley that in January 1965 that Mr . Case and Mr . Abrams were appointed Inspectors of Sub - Division Control , and Mr . Abrams was also appointed Multiple Resident Inspector , and that this resolution had been inadvertantly omitted from the minutes . RESOLUTION #119 APPOINTMENTS Justice Spaulding offered the following resolution and asked it adoption . WHEREAS , at the January 1965 meeting this Board did appoint Highway Superintendent Case and Assessor Abrams as Inspectors of Sub - Division Control and Mr . Abrams was also appointed Multiple Resident Inspector , and WHEREAS , the resolution was inadvertantly omitted from the January meeting , now therefore , be it resolved that this Town Board goes on ✓ ecord as making Highway Superintendent Case Sub - Division Control Inspector at a fee of $ 200 . 00 , and Assessor Abrams be appointed Sub - D ivision Control and Multiple Resident Inspector at a fee of $ 00 . 00 . 2nd Justice Hoagland . Carried . The Town Board was interested in finding out if the Planning Board o f the Town of Dryden had also been appointed Zoning Commission . A Search of the minute books showed that they had been appointed so September 5 , 1962 . RESOLUTION #120 LIGHTING DISTRICT Councilman Lee offered the following resolution and asked its adoption . RESOLVED that the Town Board of the Town of Dryden proceed with the L ighting Contract for the Hamlet of Varna and sign the Contract with the Gas & Electric and sign the Order . _ . 2nd Justice Spaulding . Roll call vote - all voting YES . ( Copy of this order is attached ) H ighway Superintendent Case had at the November 4 , 1965 meeting ✓ equested to purchase a new pick - up truck , and this had been referred to the Highway Committee . RESOLTUION #121 PURCHASE OF TRUCK Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that Highway Superintendent Case be authorized to advertise f or bids for one pickup truck at a price not to exceed $2 , 200 and for the bids to be opened December 14 , 1965 at 8 P . M . 2nd Councilman Lee . Carried . Supervisor Gridley informed the Board at this time that he had received the Fire Contracts and they were ready for signatures . RESOLUTION #122 FIRE CONTRACTS Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that the Fire Contracts be signed by the Town Board as sub - mitted as of this date . 2nd Councilman Lee . Carried . The meeting was adjourned by Supervisor Gridley .
