SPECIAL MEETING A special meeting of the Cortlandville Town Board was held on November 15, 1982 at the Town Hall, 15 Terr- ace Road, Cortland, New York with Supervisor Nadolski presiding. Board members present. were: Supervisor Nadolski, Councilman Melvin Pierce, Councilman Ray Thorpe, Council- man Edwin O'Donnell and Town_Clerk, Pauline Parker. Others present were Zoning Offic.er,, Don Fowler; ® Engineer,Peter Novelli; Deputy Town Clerk, June Bradshaw; Legislator, Richard Tupper; Newsreporter, Dick Camerano; resident, Ken Andrews and members of the Cortland County Planning Department, Mayo Snyder and Mohammad Riaz Shafqat; also members of the Cortland County Planning Board, Gwen Stiles, chairman; Carl Kimberly, and George Armstrong. Supervisor Nadolski called the meeting to order at 4:30 P.M. RESOLUTION # 229 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Pierce Seconded by Councilman Thorpe audit of VOTES: ALL AYE ADOPTED vouchers BE IT RESOLVED that the vouchers submitted have been audited and shall be paid as follows: GENERAL FUND Vouchers .# 399-447 $ 9,372.28 HIGHWAY # 271-275 21,531.75 WATER FUND # 193-197 431.64 SEWER FUND # 61-63 7,255.34 FIRE DISTRICT # 43 315.62 RESOLUTION # 230 ADOPTION OF THE TOWN OF CORTLANDVILLE BUDGETS FOR 1983 Motion by Councilman Pierce ® Seconded by Councilman Thorpe adopt 1g83 VOTES: ALL AYE ADOPTED Budget WHEREAS on the 3rd day of November 1982-, the Town Board of the Town of Cortlandville, held a public hearing on the preliminary budgets, approved by the Town Board, and filed with the Town Clerk, for the fiscal year commencing January 1, 1983, and having heard all persons in favor of or against the preliminary budgets as comp iced, or for or against any -item or items contained, therefore BE IT RESOLVED that the preliminary budgets, as approved, and filed and presented before this board at the above public hearing shall be amended by making the following changes therein: L_ Monday, November 15, 1982 Page 2 Adopt Personnel Policy HUD Grant application Water benefit charges (F1030) in the amount of $ 59,751.00 were added to revenues by a mistake. B7140.1 was 1200.00, changed to 1284.00 B7140.4 was 6750.00, changed to 6600.00 (total,decrease of 66.00) B,7310.4 was 6300.00, changed to 5800.00 (total decrease`of '500.00) F1030 was 59,571.00, changed to 59,751.00 (Typing error) AND BE IT FURTHER RESOLVED, that the preliminary budgets approved and filed, with the amendments hereinbefore set forth, and the same hereby is adopted and established as the annual budget of this town for the fiscal year beginning January 1, 1983, and such annual budget as so adopted be entered in the minutes of the Town Board, and BE IT RESOLVED that the Town Clerk of this town shall prepare and certify, as provided by law, duplicate copies of the annual budgets hereby adopted, together with the assessment rolls for the benefit of improvement for the Water Fund and the Sewer Fund, adopted pursuant to Section 202 a of the Town Law, and within five days thereof, deliver two copies to the Supervisor of the Town, and the Super- visor shall present the copies of the annual budgets to the Legislature of Cortland County within ten days, after his receipt thereof from the clerk. 1 0 • 1 RESOLUTION # 231 ADOPT PERSONNEL POLICY FOR TOWN OF CORTLANDVILLE Motion by Councilman Pierce Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Town Board of the Town of Cortland- • ville shall hereby adopt the Personnel Policy, presented by the Supervisor, and such policy shall;be delivered to all employees of the Town. (copy included at the end of S board minutes.) Supervisor Nadolski requested Engineer, Peter Novelli, to report to the Town Board relating to the application for the HUD grant.- Monday, November 15, 1982 Page 3 Engineer Novelli reported that as the result of the Public Hearing concerning the HUD Grant, he has prepared the application to include several projects such as: 1. 2. Gutchess Lumber - Lamont Circle - 8" water main loop Chelsea Apts. to Allen Drive 3. loop Pall Trinity to Luker Road to McLean Road 4. Construct new water supply in South Cortland which would include new well, new pump house, chlorination and emergency generator, with a 10" water main to the intersection of Tompkins Street and Route # 281 5. a pump station - forced main near ETL 6. a pump station - forced main - Bulk Milk, Polkville He reviewed estimated costs and possible means of matching funds and financing if we did receive the grant. A discussion followed regarding the grant. Engineer N-a-gelli stressed to the Town Board that it is very competitive in receiving the grant. RESOLUTION ## 232 AUTHORIZE ENGINEER TO SUBMIT HUD GRANT APPLICATION Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS a Public Hearing was duly held on November 3, 1982 to allow residents of the Town input for projects to be submitted by application for a HUD Grant, and WHEREAS the Town Board, per Board Resolution # 224, adopted November 3, 1982 did authorize the engineer of the Town of Cortlandville to prepare an application to submit for a HUD grant, and WHEREAS the Town Engineer has presented, for review, the projects to be submitted on the application, therefore submit HUD applicatio BE IT RESOLVED that the Town Board does hereby authorize and direct the Engineer to submit the completed HUD Block Grant application to the U.S. Department of Housing and Urban Development, for their consideration of water improvements to the Town. Mr. Mayo Snyder, chairman, Cortland County Planning County Department gave a presentation to the Town Board of a Planning proposed Luker Road industrial site. Dept. - That location is not zoned as industrial at the present Luker Rd time. This request has been received by the Town for Zoning their consideration. Change Councilman O'Donnell made a motion, seconded by Councilman Thorpe, to adjourn the meeting. Parker, Town Clerk , Adopted November 15, 1982 1, TOWN OF CORTLANDVILLE PERSONNEL POLICY The adoption of this Personnel Policy by the Cortland- ville.Town Board shall apply to all permanent full-time employees. Temporary employees and employees serving on a temporary appointment, extra hire, seasonal, and as sub- stitutes for employees on leave shall not accrue any benefits. The Cortlandville Town Board shall establish all offices and positions, and define the powers, duties, and responsi- bilities. The Town Board shall appoint an,d hire all employees and officers, except that the Town Clerk shall appoint the Deputy'C1erk, and the Highway Superintendent shall appo.i.nt'the .Deputy and laborers. The Deputy Town Clerk shall be trained to perform all duties of the Town Clerk's office. The Deputy Town Clerk shall have all the powers equal to this office and perform all duties in the absence or incapacity of the Town Clerk. The Deputy Highway Superintendent shall be trained to perform all duties and shall be capable to be responsible for the Highway Department in the absence or incapacity of the Highway Superintendent. There will be a six (6) month probationary period for each new employee hired. All new employees shall be hired at a base salary schedule and after six (6)'months from date of employment, shall be eligible to receive a salary increase. The Town Board shall set the salaries and frequency of payrolls. WORKING HOURS: HIGHWAY DEPARTMENT: All Highway Department employees, except clerical, shall work forty (40) hours per week. The work day shall be from 7:00 a.m. to 12:00 p.m., noon, and from 12:30 p.m, to 3:30 p.m., Monday through Friday. The employees shall re- ceive a fifteen (15) minute work break, taken at the job site or at the Highway garage each morning. ADMINISTRATION STAFF: The work week shall be thirty-five (35) hours per week. The work day shall be eight (8) continuous hours including one (1) hour for lunch, which shall be scheduled by the department head for their department. The work day shall be from 9:00 a.m. to 5:00 p.m., Monday through Friday. The summer schedule from June 1st to September 1st shall be thirty (30) hours per week. The work day shall be from 9:00 a.m. to 4:00 p.m., Monday through Friday, including one (1) hour for lunch. Any change from this schedule shall be made only for reasonable cause authorized by the Town Board. Adminstration staff shall perform all duties relative to their position in the Town Hall, not at their homes. Employees will directly report to the bookkeeper their personal days, sick days, and vacation time in writing immedi- ately when taken and not at the end of the month. This will no longer be a responsibility of the department head. WATER & SEWER DEPARTMENT: The work week shall be thirty-five (35) hours per week. The work day shall be eight (8) continous hours including one (1) hour for lunch which shall. be scheduled within the department. The work day shall be from 7:30 a.m. to 3:30 p.m., Monday through Friday. Exceptions to the above mentioned schedule and to be included in the work day shall be checking the water pumps each right and three (3) times on the week -end with coverage scheduled within the department. The Water and Sewer Department is on call in case of emergencies until the job is done and shall receive compensatory time. TEMPORARY EMPLOYEES: The employee shall be one who works a maximum of nineteen (19) hours per week at the convenience of the department head. Temporary employees do not receive fringe benefits. 2. EMPLOYMENT OF RELATIVES: After the adoption of this Personnel Policy, the Town Board shall not hire siblings, or persons with parental or matrimonial relationships to members of the staff or departments to help avoid nepotism, conflict of interest, and inter -personal strife. Additionally, no two people living together shall be employed by the Town. VACATION: All full-time employees covered by this Personnel Policy shall receive the following vacation calculated on the calendar year: YEARS OF CREDIT VACATION (WORKING DAYS) 1 5 2 10 5 15 10 20 Maximum I. Full-time employees may carry forward a maximum of five (5) earned vacation days from one calendar year to the next. 2. Vacation shall be earned in one (1) calendar year and taken in the next calendar year. 3. For new full-time employees, vacation earned within the first calendar year of employment shall be apportioned according to the number of months employed and shall be taken in the next calendar year. 4. Full-time employees who terminate their employment are entitled to the vacation earned in the previous year, plus the prorated vacation earned in the calendar year in which employment with the Town .is terminated. 5. Full-time employees whose employment begins on or be- fore the 15th day of any month shall receive vacation credit for that month; however, full-time employees whose employment begins after the 15th day of any month shall begin receiving vacation credit on the first day of the month following their employment. 3. VACATION cont'd: 7. Full-time employees on leave of absence shall have their vacation reduced by a pro rata percentage of the leave time versus the total -years; i.e., full-time employeewho is on a leave of absence for six (6) months and has five (5) years of service shall be allowed seven and one-half (72) days vacacation in the following year. 8. Vacation days shall be taken at a time acceptable to the department head. 9. When vacation days conflict within a department per- ference shall be given to the employee with seniority. MERIT: Merit is the factor that will prevail in. the case of promotion, demotion; lay-off, recall and reduction in forces. OVERTIME: No time shall be worked in excess of the basic work week unless specifically directed or authorized by the depart- ment head or a designated representative. Any such time worked in excess of the basic work week shall be compensated for in the following manner: 1. Upon mutual agreement of the employee and the depart- ment head, the employee may accumulate up to fifteen (15) hours compensatory time. Said compensatory time must be taken by the employee with in ninety (90) days of receipt. 2. The employee that has worked overtime will report the time to the bookkeeper, in writing, stating date, time, and the reason for.overtime. 3. The employee will report to,the'bookkeeper, in writing, when the compensatory time is taken stating date and time. 'v WAGES: Employees shall be paid on a biweekly basis for a total of twenty-six (26) pay periods. The pay check shall be made available for distribution to all employees, except the Highway Department employees, prior to lunch time on Friday. Highway Department employees shall be paid prior to quitting time on Friday or at the discretion of the department head. SICK LEAVE: FULL-TIME"EMPLOYEES: Full-time employees shall be permitted to accumulate up to one hundred and sixty (160) working days of paid sick leave, to be applied toward time off due to illness or injury which is not work related. Such leave shall be re- duced by one (1) day for each sick day paid. Sick leave shall accumulate at the rate of one (1) day per month, twelve (12) 'days per year. 1. The employee whose employment begins on or before the 15th day of any month shall receive one (1) sick leave day for the month. The employee hired after the 15th day of any month shall not receive a sick leave day for that month. 2. Employees who terminate their employment, retires, or is dismissed shall not be paid for accrued sick leave. 3. The employee may request a medical leave without pay for illness or other non -work related disability for a period not to exceed twenty-six (26) weeks. However, a medical leave without pay will not begin until all accrued sick leave, if any, has been used. The request for medical leave without pay must be accompanied by a doctor's statement which indicates the need for the leave and the anticipated length of the particular illness or disability. Medical leave without pay is subject to the approval of the Town Board. 5. W SICK LEAVE cont'd: FULL TIME EMPLOYEES: 4. Employees on sick leave for more that fifteen (15) consecutive calendar days of a given month are not eligible to accrue vacation or sick leave for that month. If a paid holiday falls within the fifteen (15) calendar days, the employee shall be paid for that holiday. 5. A doctor's statement may be required for employees absent more than seven (7) consecutive calendar days. Employees absent more than fourteen (14) calendar days must furnish the supervisor with a doctor's statement approving their return to work. 6. Sick leave may only be used for the employee's personal illnesses or disabilities and may not be taken before it is earned. Time off needed to attend to illnesses and disabilities of other family members must be charged to vacation leave, personal leave, or taken as leave without pay. LEAVE OF ABSENCE: Full-time employees with more than five (5) years of consecutive service may request a leave of absence with- out pay not to exceed twenty-six (26) weeks for valid or legiti- mate reason. Leave of absence will be granted on an individual basis and must be approved by the Town Board. WORKMEN'S COMPENSATION: The employee receiving Workmen's Com- pensation cannot accrue sick leave or vacation time. Exception: If the employee of the Town is injured and a Workmen's Compensation Claim is justified, the employee may choose to be paid sick pay, if available. In the event the employee has been paid sick pay and the Town is reimbursed any portion of that money by the Work- men's Compensation Board or any other agency, the employee's sick time will be recredited to him in an amount equal to the reim- bursement. (Resolution No. 63, Adopted 1979) No `1 PERSONAL LEAVE: Full-time employees shall be entitled to take up to three (3) paid personal leave days each calendar year, but such leave shall not be cumulative from year to year. The employee shall notify the bookkeeper before taking a personal leave day. 1. In no event may personal leave time be used on the day prior to or following a holiday, or an employee's vacation, nor may personal leave time be used in lieu of sick leave, leaves of absence, etc. 2. New full-time employees shall receive a proportionate share of personal leave days in the year in which they are employed. Example: If employment begins on or before March 1st, the employee receives three (3) personal leave days for the calendar year. If employ- ment begins on 'or before July lst, the employee re- ceives two (2)'personal leave days for the calendar year. If employment begins on or before November 1st, the employee receives one (1) personal leave day for the calendar year. If employment begins after November lst, the employee receives no personal leave days until the following year. PENSON: New full-time employees are required to join and pay into the New York State Retirement System with the Town paying its share 1. The employee shall be allowed to use unused sick leave days as extra pension credit at the time of retirement. 2. The employee who terminates their employment shall be allowed to make application to receive their share of money they have paid into the New York State Retirement System. HEALTH INSURANCE: Full-time employees shall be allowed to join the Town's its share. Health Insurance Program with the Town paying 7. HEALTH INSURANCE cont'd: 1. The employee shall be allowed to remain in the Town's Health Insurance Program upon retirement. 2. If an employee has been employed for the Town for ten (10) years, and du.e to death of such employee, the surviving spouse may continue the Health Insurance Program and the Town shall pay 75% of the cost of the health insurance for the surviving spouse. (Resolution No. 165, adopted October 7, 1979) JURY DUTY: If a full-time employee is called to serve or serves on. Jury Duty, the employee shall be given time to serve and be paid their regular salary.. 1. If a full-time employee is called to serve or serves on Jury Duty, they shall endorse their Jury Duty pay- check, making said payable to the Town upon receiving their regular salary, so.that neither the employee nor Town shall suffer any loss. 2. In the event the paycheck from Jury Duty is more than their regular salary, the employee shall keep the amount over and above their regular salary. EDUCATIONAL BENEFITS: Full-time employees may attend an insti- tution to take job related courses with the cost of tuition only paid by the Town upon satisfactory completion of said course and if said course is approve in advance by the depart'- ment head and the Town Board. 1. The employee taking the job related course must agree verbally to remain in the employment of the Town for at least one (,1) year from the date of course completion. HOLIDAYS: Holidays for full-time employees are to be as follows: 1. New Year's Day 2. Washington's Birthday 3. Good Friday HOLIDAYS cont'd: 4. Memorial Day 5. Independence Day 6. Labor Day 7. Columbus Day 8. Election Day 9. Veteran's Day 10. Thanksgiving Day 11. Christmas Day 12. One (1) paid Floating Holiday 1. Full-time employees shall be guaranteed twelve (12) paid holidays plus the day before Christmas and New Years if Christmas Day and New Years. Day falls on a workday. 2. In the event that a holiday falls on Sunday, the following Monday is to be given. In the event that a holiday falls on Saturday, the preceding Friday is to be given. 3. Full-time employees may take their floating holiday upon mutual agreement of the employee and the depart- ment head. Employees do not have to take the floating holiday at the same time. FUNERAL LEAVE: In the event of a death of one of the following employee's family - parents (including foster or step-parents), spouse, children, brother, sister, grandparents or other relative who is a member of the household - the full-time employee shall be excused from work upon request the day of the funeral and up to three (3) additional days with pay, provide the employee was scheduled to work those days. 1. In the event of the death of an employee's mother-in- law, father-in-law, brother-in-law, sister-in-law, or spouse' grandparents, the full-time employeF ;jai' ',)­ om FUNERAL LEAVE cont'd: excused from work upon request the day of the funeral and up to one additional day and shall not suffer any loss in pay, provided the employee was scheduled to work those days. MILEAGE: Employees required to use personal motor vehicle for official Town business, but not for travel between home, office, and attendance to Town function meetings, shall be reimbursed for mileage. The mileage rate shall be set each calendar year by the Town Board. 1. An employee involved in an accident while on Town business must notify the Supervisor immediately and complete and "Accident/Injury Investigation Report" form. TOWN MOTOR VEHICLES: Any motor vehicle owned by the Town shall be used only for official Town business and not for personal business. 1. An employee involved in an accident while using Town vehicles or equipment must notify the Supervisor immediately and complete and "Accident/Injury Investi- gation Report" form. CODE OF ETHICS: The Code of Ethics adopted October 21, 1970 by the Cortlandville Town Board shall become a part of this Personnel Policy and is attached hereto. 10. 0 ©DDrNlnV n HIGHWAY DEPARTMENT CFrTTnnI T A. Gross pay shall be based on a normal work week of forty (40) hours. A normal work day shall be from 7:00 a.m. to 12:00 p.m., noon, and from 12:30 p.m. to 3:30 p.m., Monday through Friday. Employees shall receive a fifteen (15) minute work break taken at the job site or at the Highway garage each morning. B. Any employee called on duty on his day off or on a holiday will receive a minimum of four (4) hours pay. SECTION II A. A new employee hired as a laborer by the Highway Department shall receive a starting salary of minimum wage per hour for a minimum of thirty (30) days, but not longer than a ninety -day (90) probationary period. Upon satisfactory completion of said probationary period, said employee shall be assigned a position and paid a rate accordingly. B. A new employee hired for any other position other than laborer in the Highway Department shall be assigned a title and paid a salary accordingly. SECTION III A. Any employee who works on a holiday shall be granted com- pensatory time off; said time to be taken within twelve (12) months of the holiday worked. Said compensatory time shall be mutually acceptable to the employee and A'F way Superintendent. A-1. SECTION iV A. Any job being done by the Highway Department which requires two (2) or more men shall be done under the supervision of a working foreman appointed by the Highway Superintendent. 7 1 A-2. CODE OF ETHICS TOWN AND LOCAL LAW TOWN OF CORTLANDVILLE Local Law No. 1 for the year 1970 establishing standards of conduct for officers and employees of the Town of Cortlandville. Be it enacted by the Town Board of the Town of Cortlandville l as follows: Section 1 - Pursuant to the Provisions of Section 806 of the General Munidpal Law,4Z, the Town of Cortlandville recognizes that there are rules of ethical conduct for public officers and employes which must be observed if a high degree of moral conduct is to be ` obtained and if public confidence is to be maintained in car unit of local government. It is the purpose of this local law to promu - gate these rules of ethical conduct for the officers and employees" of the Town of Cortlandville. These rules shall serve as a guide for official conduct of the officers and employees of the Town of Cortlandville. The rules of ethical conduct of this local law as adopted, shall not conflict with, but shall be in addition to any prohibition of Article 18 of the General Municipal Law or any othezi general or special law relating to ethical conduct and interest in i contracts of municipal officers and employees. i Section 2, Definition. (a) "Municipal Officer or Employeeof s means an officer or employee of the Town of Cortlandville, whether[ paid or unpaid, including members of any administrative board, com- mission or other agency thereof. No person shall be deemed to be a municipal officer or employee solely.".by reason of being a volun- tear fireman or civil defense volunteer, except a chief engineer oa= assistant chief engineer. (b) "Interest" means a pecuniary or material benefit accruinal, to a municipal officer or employee unless the context otherwise requires. i Section 3. Standards of Conduct. Every officer or employ. of the Town of Cortlandville shall be subject to and abide by the ';following standards of conduct: I I. i 11 (a) ..Gifts. He shall not directly or indirectly, solicit; any gift; or accept or receive any gift havingvalue a of �25.00 or mo-:j whether in the form of money, services, loan, travel, entertainm J, hospitality, thing or promise, or any other form, under circumst e; in which it could reasonably be inferred that the gift was intender to influence him, or could reasonably be expected to influence him, in the performance of his official duties or was intended as a re- ward for any official action on his part. (b) Confidential information. He shall not disclose confide - tial information acquired by him in the course of his official dut e ,or use such information to further his personal interest. (c) Representation before one's own agency. He shall n*ot re ceive or enter into any agreement, express or implied, for compensa- tion for services to be rendered in relation to any matter for any municipal agency of which he is an officer, member or employee or of any municipal agency over which he has jurisdiction or to whir he has the power to appoint any member, officer or employee. (d) Representation before any agency for a contingent fee. He shall not receive, or enter into any agreement, express or impl ed for compensation for services to be rendered in relation to any matter before any agency of his municipality, whereby his compensa- tion is to be dependent or contingent upon any action by,such agency with rempect .to such matter, provided that this paragraph shall no prohibit the fixing at any time of fees based upon the reasonable value of the services rendered. (e) Diselosure'of interest in legislation. To the extent that he knows thereof, a member of the Town Board and any officer or em ployee of the Town of Cortlandville, whether paid or unpaid, who participates in the discussion or gives official opinion to the To%1, Board on any legislation before the Town Board shall publicly dis- close on the official record the nature and extent of any direct o Rindirect financial or other private interest he has in such legisla- tion. :)HN J. He shall. ;'not invest or hold any investment directly or indirectly in any financial, business, commercial or other private transaction, whi creates a conflict with his official duties. (g) Private employment. He shall not engage in, solicit, negotiate for or promise to accept private employment or render se' - vices for private interests when such employment or service. create a conflict with or impairs the proper discharge of his official duties. (h) Future employment. He shall not, after the termination of service or employment with such municipality, appear before any board or agency of the Town of Cortlandville in -relation to any caqu proceeding or application in which he personally participated duri t the period of his service or employment or which was under his act % consideration. Section 4. Nothing herein shall be deemed to bar or prevent the timely filing by a present or former municipal officer or emplc�� ee of any claim, account, demand or suit against the Town of Cort-1 landville, or any agency thereof on behalf of himself or any member i of his family arising out of any personal injury or property damag or for any lawful benefit authorized or permitted by law. Section 5. Distribution of Code of Ethics. The Supervisor o the Town of Cortlandville shall cause a copy of this code of ethics to be distributed to every officer and employee of the Town within ten days after the effective date of this local law. Each officer and employee elected or appointed thereafter shall be furnished a copy before entering upon the duties of his office or employment. Section 6. Eenalties., In addition to any penalty contained in any other provision of law, any person who shall knowingly and intentionally violate any of the provisions of this code may be fined, suspended or removed from office or employment, as the case may be, in the manner provided by law.
