PUBLIC HEARING INCREASE AGED EXEMPTION INCOME LIMIT A Public Hearing was held at the Town Hall, Town of Cortlandville at 7:35 P-M. t.o discuss the adoption of a, resolution to increase the aged.exemption income limit. • In attendance were Supervisor Stanley Nadolski; Councilman Edwin O'Donnell; Councilman Ray Thorpe; Council- man Melvin Pierce; Attorney John Folmer and Town Clerk, Pauline Parker. Also present were Deputy Town Clerk, June Bradshaw; Engineer Peter Novelli; Assessor, Robert Wells; Zoning Officer, Don Fowler; Justice, Don Eaton; Highway Sup't., Carl Eaton; Legislator, Richard Tupper; Newsreporter, Dick Camerano and several Town 'tesidents. The Public Hearing was opened by Supervisor Nadolski. The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE Notice is hereby given that a public hearing will be held ,by the Town Board of the Town of Cortlandville, Cort- land County, New York at the Town Hall, 15 Terrace Road in .the Town of Cortlandville on October 6, 1982, at 7:35 o'clock p.m., In the, matter of the adoption of a resolution exempting from taxation of real property owned by per- sons sixty-five (65) years of age or over whose income or combined income for the in- come tax year immediately 'preceding the date of applica- tion does not exceed an amount, not in excess of ' $10,500 _to be fixed by the Town Board subsequent to such public hearing, to the extent of fifty-percentu m (5096) of the assessed valua- tion thereof upon all future assessment rolls of the Town of Cortlandville pursuant to the provisions of Section 467 of the Real Property, Tax Law. The present income requirement used in comput- ing such exemptions is $7 200 and the maximum income level permitted by statute is S10,50o. .All parties in interest and citizens will be heard at the public hearing to be held as • aforesaid. He requested that the Assessor explain the program. "�L`r) "'Oz' Assessor Wells stated that each level of government; sets their own limits such as County, Towns, Villages and school districts. Upon checking, most agencies are considering increasing their limit to $ 8,200. The impact on our budget} or costiwould be very minor. Examples were given. Assessor Wells recommended that our aged exemption income limit be increased to $ 8,200. This amount would also allow for uniformity for taxpayers. Upon no further questions from those in attendance, Councilman Thorpe made a motion, seconded by Councilman Pierce;to close the public hearing. The meeting was called to order by Supervisor Nadolski at 7:30 P.M.. The Town Clerk read the published legal notice for receiving of bids for the insulation of Highway Garage. RESOLUTION # 187 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED payment BE IT RESOLVED that the vouchers submitted have been of claims audited and shall be paid as follows: General Fund Vouchers # 324-360 $ 8,271.96 Highway # 208-246 32,403.92 Water Fund # 156-171 2,437.30 Sewer Fund " # 50-52 1,103.23 Fire District " # 33-35 1,019.22 RESOLUTION # 188 AUTHORIZE PAYMENT TO STEPHNICK ROOFING Motion by Councilman Thorpe payment to Seconded by Councilman Pierce Stephnick VOTES: ALL AYE ADOPTED Roofing WHEREAS Stephnick Roofing Co.; Inc., of North Norwich, New York was awarded the bid to replace the roof on the Cortlandville Highway Garage, and WHEREAS the project has been completed and approved by the engineer and the highway sup't., therefore BE IT RESOLVED that payment in the amount of $ 12,928.00 shall be forwarded to Stephnick Roofing Co. Ken Andrews,_Reoreation Committee, reported of the progress at the Recreation Park. A door-to-door canvass of the residential areas • will be conducted on Sunday, October 10, 1982, for donations. The members of the ball teams, with parent supervision, will be working on the canvass. The Cortlandville Recreation Committee 1982 Program Annual Report was submitted by Ken Andrews. A motion was made by Councilman Pierce, seacoride-d by Councilman Thorpe receive and file the annual report., All voting aye, the motion was carried. Reports of.various departments are on the table or may be reviewed in the clerk's offi.ce,..upon request. Recreation canvass Annual Report Recreation to A letter received from the McGraw Central School District was read supporting the installation of a public sewer service in the Polkville area. Councilman O'Donnell made 'a -motion, seconded by Councilman Thorpe to receive Iand file the letter. All voting aye, the motion was carried. A discussion was held whereby Councilman Pierce voiced concern of the support the school board exhibits when it concerns spending of town money, but lack of support on tax abatement (ETL Request). Councilman Thorpe commented that he opposes'spending town funds for private development. Assessor Wells advised that if and when the Polkville Motel Development is completed, they, also, will file the 485 exemption - 10 year tax abatement. No action was taken. A letter, with petition attached, was read from Ms. Debbie Phelps, employee of the J.M. Murray Center, which contained approximately 50 signatures. • RESOLUTION_ # 189 RECEIVE AND.FORWARD,PETITION-TRAFFIC SIGNAL LIGHT -ROUTE # 281 AND MADISON STREET Motion by Councilman Pierce Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED McGraw School support of sewer projeci petition - signal light MurrayCentez Wednesday, October 6, 1982 Page 4 WHEREAS a petition was received from the employees of the J.M. Murray Center and such petition requested a traffic signal light be installed at the intersection of Route ## 281 and Madison Street, and WHEREAS such road is a state highway, therefore BE IT RESOLVED that the petition shall be received and filed by the Town Board, and RESOLVED that the Town Clerk shall forward such request to the necessary agencies to review the request. Supervisor Nadolski reported that he has received letter, phone calls, etc. opposing transient vendors selling furniture and etc. in the Town. Councilman Thorpe made a motion, seconded by Councilman O'Donnell, to receive and file the correspond- ence. All voting aye, the motion was carried. A discussion was held whereby it was the consensus of the Town Board that a provision should be made now, in the form of an interim ordinance, to have control of the situation. There appears to be no problem with dealers with perishable goods. The Zoning Commission are working to include this in the revised ordinance. Attorney Folmer discussed examples that. other municipalities are now using. The Town Board requested the Attorney to have a sample ordinance prepared to review at the Special Meeting, October 18, 1982. This would allow time to have a public hearing at the next regular meeting. A letter was received and read from NYS Insurance Department requesting a street listing of our area covered by the fire district. Councilman Pierce made a motion, seconded by Councilman Thorpe, to receive and file the letter. All voting aye, the motion was carried. The matter is being taken care of by the Zoning Officer with assistance from the County Fire Co.-ordinator. Ken Andrews, postal employee, advised that the Post Office is in the process of updating all mailing addresses in the area to include the house numbering system adopted by the County. Arrangements are being made to utilize the County Planning Department as the prime location for residents to receive their numbered mailing address. Supervisor Nadolski reviewed information received from Niagara Mohawk Power Corporation regarding the cost F1 • 1 0 1 Wednesday, October 6, 1982 Page 5 increase for street lighting for 1983. Councilman Thorpe made a motion, seconded by Council- man O'Donnell, to.receive and file the correspondence. All voting aye, the motion was carried. A discussion followed concerning the cost and problems relating to street lights. If a street light=is installed, it must remain for a 15 year period. RESOLUTION # 190 AUTHORIZE FEASIBILITY STUDY -HIGHWAY STREET LIGHTING Motion by Councilman Thorpe Seconded by Councilman O'Donnell Feasibility VOTES: ALL AYE ADOPTED Study - Highway BE IT RESOLVED that the Supervisor and the Engineer are Lighting hereby authorized and directed to do a feasibility study of Highway -Street Lighting in the Town of Cortlandville and investigate establishing them on a special district basis. Supervisor Nadolski apprised the Town Board that the property located on the West Road in Blodgett Mills has filing deed been purchased from the County. This was the result of Blodgett us submitting the highest bid at the tax sale. Such Mills transfer has been filed at the County Clerks office. property Councilman Thorpe made a motion, seconded by Councilman O'Donnell to receive and file the transfer deed. A11 voting aye, the motion was carried. - Attorney Folmer.advised the Town Board that he never had nor examined the transfer. Attorney Folmer obtained the noise ordinance adopted by the City of Cortland. He agreed to take this to,the noise Cortlandville Planning Board for their review. ordinance A petition was received last month from concerned citizens regarding the noise initiated at -Praise -Tabernacle Church in Polkville on different occasions. Supervisor Nadolski apprised the Town Board that the Cortlandville Planning Board recently approved the request received from Praise Tabernacle Church to build • an addition at their location._ RESOLUTION # 191 AWARDING.OF BIDS -INSULATION -HIGHWAY GARAGE Motion by Councilman Thorpe Seconded by Councilman ,O'Donnell. awarding VOTES: ALL AYE ADOPTED of bids Insulation Highway Garage Wednesday, October 6, 1982 Page 6 Trailer Permit - Clayton Welch Sales Tax 1983 Budget WHEREAS pursuant to Resolution # 182 for the year 1982, sealed bids were publicly solicited for insulation of the highway garage, in accordance with the specifications and terms set forth in the information to bidders, and WHEREAS three (3) sealed bids were received,.opened and read aloud by the Clerk, and WHEREAS, all bids submitted were in proper form, and have been reviewed, therefore 0 BE IT RESOLVED that the Town Board of the Town of Cortland- ville does hereby award the bid to the lowest bidder, William Coffin, Inc. of Tully, N.Y. in the amount of $ 11,935.00 , and RESOLVED that all other bids submitted are hereby denied, and BE IT FURTHER RESOLVED that Supervisor Nadolski is hereby authorized and directed to sign a contract with William Coffin, Inc.. RESOLUTION # 192 AUTHORIZE ISSUANCE OF A TRAILER PERMIT TO CLAYTON WELCH Motion by Councilman O'Donnell Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS an application for a trailer permit has been received, and the premises have been inspected, and approved, by the Zoning Officer, therefore BE IT RESOLVED that the Town Clerk is hereby authorized and directed to issue a house trailer permit to Clayton Welch, upon payment of the proper fee. Said trailer to be located on premises owned by Ivan Parker, # 2883 Route 11, R.D.# 1, McGraw, N.Y. in the Town of Cortland- ville. RESOLUTION # 193 REQUEST COUNTY LEGISLATURE TO APPLY SURPLUS SALES AND USE TAX TO REDUCE COUNTY TAX LEVY IN AREAS OUTSIDE • VILLAGES FOR 1983 Motion by Councilman Pierce Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, pursuant to Resolution No. 118 adopted at a Special Meeting of this Board held on August 29, 1978, Wednesday, October 6, 1982 Page 7 the,Town of Cortlandville elected to have its proportionate share of the Cortland County Sales and Use -Tax which is due the area of the Town outside of Villages to pay in cash directly to the Town to be used for any legal Town, outside village purposes and WHEREAS, pursuant -to the Towns election referred to herein, the amount of Sales Tax to be received by the Town of Cortlandville will exceed the amount necessary to fund the portion of the Budget attributable to areas outside of Villages, and WHEREAS, there will therefore be a surplus of Sales Tax available and which this Board desires to be credited against the County Tax in the area of the Town outside of Villages, and WHEREAS, the surplus referred to herein will be in the amount of $ 3872000 . NOW THEREFORE, be it RESOLVED, that the Cortland County Legislature be and hereby is requested to apply said amount of $ 387,000 surplus Sales Tax as referred to herein, to.the reduction of the County Tax levied against the real property in. the area of the Town of Cortlandville outside of the Villages for the fiscal year 1983, and be it further RESOLVED, that the Town Clerk be, and she is hereby authorized and directed to forward a certified copy of this resolution -to the Cortland County Legislature. RESOLUTION # 194 APPOINT RAY THORPE-CITIZENS ADVISORY COMMITTEE -GROUNDWATER PROGRAM Motion by Councilman Pierce Seconded by Councilman 0"Donnell VOTES: ALL AYE ADOPTED BE IR RESOLVED that Councilman Ray Thorpe is hereby appointed to represent the Town of Cortlandville as a member of the Citizens Advisory Committee for the County Ground- water program. BE IT ENACTED by the Town Board of the Town of Cortland- ville as follows: Section 1. Notwithstanding any other provision of law, on and after the effective date hereof any notice required to be published with reference,to public hearing regarding the proposed adoption of any ordinance or amendment thereof by the- Town Board of the Town of Cortland- ville or any such notice regarding the adoption of any such ordinance or amendment shall contain a summary of the proposed or enacted ordinance or amendment and the publication of the full text thereof shall not be required. Section 2. This Local Law No. 1, 1982 is adopted pursuant to permissive referendum as provided by Section 24 of the Municipal Home Rule Law of the State of New York. Section 3. United Way Councilman Pierce made a motion, seconded by Councilman O'Donnell, that the correspondence be received and filed, and that it be tabled for further investigation. Supervisor Nadolski apprised the Town Board of a Flood Insurance Study meeting to be held on October 12, Flood Insurance 1982 at 2:30 P'M. at Cortland City Hall. Study Councilman O'Donnell and Councilman Pierce plan on attending the meeting. RESOLUTION # 198 AUTHORIZE APPLICATION FORWARDED TO THE STATE -MONIES -FIRE CODE Motion by Councilman Pierce Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED application WHEREAS New York State has mandated a Fire Code program funding - and funds will soon be available for municipalities, Fire Codes therefore BE IT RESOLVED that the Supervisor is hereby authorized and directed to make application for funding -assistance from NYS Department of Fire Prevention and Control to enforce the Fire Code. RESOLUTION # 200 SCHEDULE DATE FOR SPECIAL MEETING- OCTOBER 28, 1982 Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that a special meeting shall beheld on schedule Thursday, October 28, 1982 at 4:30 P.M. at the Cortlandville special Town Hall to adopt the tentative budgets as the prelimin- ary budgets for 1983, and RESOLVED that the Town Clerk is hereby authorized and directed,to prepare 20 copies of the Preliminary Budget of 1983, to be available to the public, upon request, after its adoption on October 28, 1982, and shall prepare more if needed. RESOLUTION # 201 SCHEDULE DATE FOR SECOND PUBLIC HEARING -FEDERAL REVENUE SHARING Federal Revenue Motion by Councilman Thorpe Sharing PH Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that a Public Hearing shall be held on November 3, 1982 at 7:30 P.M. at the Cortlandville Town Hall, for the second required public hearing on the proposed use of Federal Revenue Sharing Funds for 1983. RESOLUTION # 202 SCHEDULE DATE FOR PUBLIC HEARING --- 1983 PRELIMINARY BUDGET Budget Motion by Councilman O'Donnell Hearing Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that a Public Hearing shall be held on November 3, 1982 at 7:45 P.M. at the Cortlandville Town Hall to review the preliminary budget for 1983. Wednesday, October 6, 1982 Page 11 273 A discussion was held concerning the offices being open on Election Day, November 2, 1982. It was the consensus of the Town'Board that'all offices would be open because no one is running for office this year. Supervisor Nadolski apprised the Town Board of the • proposed contract for 1983 from the S.P.C.A. They have offered two options for next year. 1983 Sheltering services only - $ 4,417.50 1983 DCO and sheltering - 14,675.00 1982 DCO and sheltering 8,360.00 increase from 1982 - 6;315.00 1 • 1 A discussion followed relating to the Dog Control Program mandated by the State. Revenus received are supposed to pay for the program and this is not happening. We are mandated to provide a Dog Control Officer (DCO) and a shelter. RESOLUTION # 203 AUTHORIZE SUPERVISOR TO NEGOTIATE A 1983 CONTRACT FOR DOG CONTROL PROGRAM Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Supervisor is hereby authorized and directed to negotiate a contract for 1983 for the dog control program with the SPCA or some other source. A discussion was held concerning the use of the new numbering system for the Town Hall. Councilman Pierce made a motion, seconded by Council- man Thorpe to table the matter for further study. All voting aye, the motion was carried. 1983 SPCA Contract house numbering system A discussion was held concerning -the -new state program - STOP DWI. The new program is set up where the revenues received from municipalities are forwarded to the County STOP -DWI level. Each county is initiating . a STOP DWI program, program to be funded by these revenues. Legislator, Richard Tupper, explained what Cortland County has proposed. He explained that it is possible, upon request. for the towns to be reimbursed for their additional cost. Supervisor Nadolski apprised the Town Board that he has received copies of requests sent from.Virgil, Preble and Scott to the County. RESOLUTION # 204 AUTHORIZE LETTER TO COUNTY LEGISLATURE, DWI PROGRAM STOP -DWI Motion by Councilman Pierce program Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby request the Cortland County Legislature to consider reimbursement of the funds, generated by the new STOP DWI laws, to the Towrs of Cortland County to be applied against the costs of handling DWI related matters. RESOLUTION # 205 APPOINT EDWARD STILES AS MEMBER OF Edward BOARD OF ASSESSMENT REVIEW Stiles Bd le Ass'mt. Motion by Councilman O'Donnell Review Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that Edward Stiles is hereby appointed as a member of the Cortlandville Board of Assessment Review, to replace Warren Barth, effective immediately and such term shall expire April 30, 1986. RESOLUTION # 208 AUTHORIZE WRITE OFF FINAL WATER BILL Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED write off water bil WHEREAS a final bill, in the amount of $ 3.08 charged to account # W-1483 has not been paid, and such charge cannot be collected 'Via taxes, as such property has been removed, therefore BE RESOLVED that the final bill charged to Seymour Bradshaw, account # W-1483 shall hereby treated as a write off. Councilman O'Donnell made a motion, seconded by Councilman Pierce to adjourn the meeting. All voting aye, adjourn the motion was carried. The meeting was adjourned at 9:40 P.M..
