PUBLIC HEARING
INCREASE AGED EXEMPTION
INCOME LIMIT
A Public Hearing was held at the Town Hall, Town of
Cortlandville at 7:35 P-M. t.o discuss the adoption of a,
resolution to increase the aged.exemption income limit.
• In attendance were Supervisor Stanley Nadolski;
Councilman Edwin O'Donnell; Councilman Ray Thorpe; Council-
man Melvin Pierce; Attorney John Folmer and Town Clerk,
Pauline Parker.
Also present were Deputy Town Clerk, June Bradshaw;
Engineer Peter Novelli; Assessor, Robert Wells; Zoning
Officer, Don Fowler; Justice, Don Eaton; Highway Sup't.,
Carl Eaton; Legislator, Richard Tupper; Newsreporter,
Dick Camerano and several Town 'tesidents.
The Public Hearing was opened by Supervisor Nadolski.

Supervisor Nadolski explained that the state has
increased the ceiling for aged exemptions to $9;000.
He requested that the Assessor explain the program.

Assessor Wells stated that each level of government;
sets their own limits such as County, Towns, Villages
and school districts. Upon checking, most agencies are
considering increasing their limit to $ 8,200. The impact
on our budget} or costiwould be very minor. Examples
were given.
Assessor Wells recommended that our aged exemption
income limit be increased to $ 8,200. This amount would
also allow for uniformity for taxpayers.
Upon no further questions from those in attendance,
Councilman Thorpe made a motion, seconded by Councilman
Pierce;to close the public hearing. All voting aye, the •
motion was carried.

Town Board was held at the Town Hall, 15 Terrace Road,
Cortland, N.Y. with Supervisor Nadolski presiding.
Board members present were Supervisor Stanley

The Town Clerk read the published legal notice for
receiving of bids for the insulation of Highway Garage.
The Town Clerk opened and read aloud the following

shall be forwarded to Stephnick Roofing Co. Inc., and
RESOLVED that the certified check, held per bid instructions,

Supervisor Nadolski allowed those in attendance the
privilege of the floor.
Ken Andrews,_Reoreation Committee, reported of the
progress at the Recreation Park.
A door-to-door canvass of the residential areas
• will be conducted on Sunday, October 10, 1982, for
donations. The members of the ball teams, with parent
supervision, will be working on the canvass.
The Cortlandville Recreation Committee 1982 Program
Annual Report was submitted by Ken Andrews. A motion was
made by Councilman Pierce, seacoride-d by Councilman Thorpe
receive and file the annual report., All voting aye,
the motion was carried.

A letter received from the McGraw Central School
District was read supporting the installation of a
public sewer service in the Polkville area.
Councilman O'Donnell made 'a -motion, seconded by
Councilman Thorpe to receive Iand file the letter. All
voting aye, the motion was carried.
A discussion was held whereby Councilman Pierce
voiced concern of the support the school board exhibits
when it concerns spending of town money, but lack of
support on tax abatement (ETL Request). Councilman Thorpe
commented that he opposes'spending town funds for private
development. Assessor Wells advised that if and when the
Polkville Motel Development is completed, they, also,
will file the 485 exemption - 10 year tax abatement.
No action was taken.
A letter, with petition attached, was read from
Ms. Debbie Phelps, employee of the J.M. Murray Center,
which contained approximately 50 signatures.

WHEREAS a petition was received from the employees of
the J.M. Murray Center and such petition requested a
traffic signal light be installed at the intersection
of Route ## 281 and Madison Street, and
WHEREAS such road is a state highway, therefore
BE IT RESOLVED that the petition shall be received and
filed by the Town Board, and
RESOLVED that the Town Clerk shall forward such request
to the necessary agencies to review the request.
Supervisor Nadolski reported that he has received
letter, phone calls, etc. opposing transient vendors
selling furniture and etc. in the Town.
Councilman Thorpe made a motion, seconded by
Councilman O'Donnell, to receive and file the correspond-
ence. All voting aye, the motion was carried.
A discussion was held whereby it was the consensus
of the Town Board that a provision should be made now,
in the form of an interim ordinance, to have control
of the situation. There appears to be no problem with
dealers with perishable goods. The Zoning Commission
are working to include this in the revised ordinance.
Attorney Folmer discussed examples that. other municipalities
are now using.
The Town Board requested the Attorney to have a
sample ordinance prepared to review at the Special Meeting,
October 18, 1982. This would allow time to have a public
hearing at the next regular meeting.
A letter was received and read from NYS Insurance
Department requesting a street listing of our area covered
by the fire district.
Councilman Pierce made a motion, seconded by
Councilman Thorpe, to receive and file the letter. All
voting aye, the motion was carried.
The matter is being taken care of by the Zoning
Officer with assistance from the County Fire Co.-ordinator.
Ken Andrews, postal employee, advised that the Post
Office is in the process of updating all mailing addresses
in the area to include the house numbering system adopted
by the County. Arrangements are being made to utilize
the County Planning Department as the prime location for
residents to receive their numbered mailing address.

from Niagara Mohawk Power Corporation regarding the cost

increase for street lighting for 1983.
Councilman Thorpe made a motion, seconded by Council-
man O'Donnell, to.receive and file the correspondence.
All voting aye, the motion was carried.
A discussion followed concerning the cost and problems
relating to street lights. If a street light=is installed,
it must remain for a 15 year period.
RESOLUTION # 190 AUTHORIZE FEASIBILITY STUDY -HIGHWAY

BE IT RESOLVED that the Supervisor and the Engineer are Lighting
hereby authorized and directed to do a feasibility study
of Highway -Street Lighting in the Town of Cortlandville
and investigate establishing them on a special district
basis.
Supervisor Nadolski apprised the Town Board that the
property located on the West Road in Blodgett Mills has filing deed
been purchased from the County. This was the result of Blodgett
us submitting the highest bid at the tax sale. Such Mills
transfer has been filed at the County Clerks office. property
Councilman Thorpe made a motion, seconded by
Councilman O'Donnell to receive and file the transfer
deed. A11 voting aye, the motion was carried. -
Attorney Folmer.advised the Town Board that he never
had nor examined the transfer.
Attorney Folmer obtained the noise ordinance adopted
by the City of Cortland. He agreed to take this to,the noise
Cortlandville Planning Board for their review. ordinance
A petition was received last month from concerned
citizens regarding the noise initiated at -Praise -Tabernacle
Church in Polkville on different occasions.
Supervisor Nadolski apprised the Town Board that
the Cortlandville Planning Board recently approved the
request received from Praise Tabernacle Church to build
• an addition at their location._

sealed bids were publicly solicited for insulation of the
highway garage, in accordance with the specifications
and terms set forth in the information to bidders, and
WHEREAS three (3) sealed bids were received,.opened and
read aloud by the Clerk, and
WHEREAS, all bids submitted were in proper form, and
have been reviewed, therefore 0
BE IT RESOLVED that the Town Board of the Town of Cortland-
ville does hereby award the bid to the lowest bidder,
William Coffin, Inc. of Tully, N.Y. in the amount of

RESOLVED that all other bids submitted are hereby

the,Town of Cortlandville elected to have its proportionate
share of the Cortland County Sales and Use -Tax which
is due the area of the Town outside of Villages to pay
in cash directly to the Town to be used for any legal
Town, outside village purposes and
WHEREAS, pursuant -to the Towns election referred to
herein, the amount of Sales Tax to be received by the
Town of Cortlandville will exceed the amount necessary
to fund the portion of the Budget attributable to areas
outside of Villages, and
WHEREAS, there will therefore be a surplus of Sales Tax
available and which this Board desires to be credited
against the County Tax in the area of the Town outside
of Villages, and
WHEREAS, the surplus referred to herein will be in the
amount of $ 3872000 .
NOW THEREFORE, be it
RESOLVED, that the Cortland County Legislature be and
hereby is requested to apply said amount of $ 387,000
surplus Sales Tax as referred to herein, to.the reduction
of the County Tax levied against the real property in.
the area of the Town of Cortlandville outside of the
Villages for the fiscal year 1983, and be it further
RESOLVED, that the Town Clerk be, and she is hereby
authorized and directed to forward a certified copy of

BE IT ENACTED by the Town Board of the Town of Cortland-
ville as follows:
Section 1. Notwithstanding any other provision of
law, on and after the effective date hereof any notice
required to be published with reference,to public hearing
regarding the proposed adoption of any ordinance or
amendment thereof by the- Town Board of the Town of Cortland-
ville or any such notice regarding the adoption of any
such ordinance or amendment shall contain a summary of
the proposed or enacted ordinance or amendment and the
publication of the full text thereof shall not be required.
Section 2. This Local Law No. 1, 1982 is adopted
pursuant to permissive referendum as provided by Section
24 of the Municipal Home Rule Law of the State of New
York.
Section 3. This Local Law No. 1, 1982 shall become
effective upon filing with the Secretary of State of the
State of New York as provided by law.

A discussion was held concerning the offices being
open on Election Day, November 2, 1982. It was the
consensus of the Town'Board that'all offices would be
open because no one is running for office this year.
Supervisor Nadolski apprised the Town Board of the
• proposed contract for 1983 from the S.P.C.A. They have
offered two options for next year.
1983 Sheltering services only - $ 4,417.50
1983 DCO and sheltering - 14,675.00
1982 DCO and sheltering 8,360.00

A discussion followed relating to the Dog Control
Program mandated by the State. Revenus received are
supposed to pay for the program and this is not happening.
We are mandated to provide a Dog Control Officer (DCO)
and a shelter.

and directed to negotiate a contract for 1983 for the dog
control program with the SPCA or some other source.
A discussion was held concerning the use of the new
numbering system for the Town Hall.
Councilman Pierce made a motion, seconded by Council-
man Thorpe to table the matter for further study. All
voting aye, the motion was carried.

A discussion was held concerning -the -new state program
- STOP DWI. The new program is set up where the revenues
received from municipalities are forwarded to the County STOP -DWI
level. Each county is initiating . a STOP DWI program, program
to be funded by these revenues. Legislator, Richard
Tupper, explained what Cortland County has proposed.
He explained that it is possible, upon request. for the
towns to be reimbursed for their additional cost.
Supervisor Nadolski apprised the Town Board that he
has received copies of requests sent from.Virgil, Preble
and Scott to the County.

WHEREAS, a public hearing was held by the Town Board, of
the Town of Cortlandville at the Town Hall on October
6, 1982 at 7:30 P.M., in the matter of the adoption of
a REsolution exempting real property from taxation pursuant
to the provisions of Section 467 of the Real Property
Tax Law,
RESOLVED, that Resolution # 153 of October 19, 1977, is
hereby amended, and be it further
RESOLVED, that the Assessor of the Town of Cortlandville,
shall exempt from taxation, real property, owned by persons
sixty-five (65) years of age or over, whose income or
combined income for the income tax period immediately

preceding the date of application does not exceed Eight
thousand, Two hundred dollars ( $ 8,200.00 ) to the
extent of fifty percentum ( 50 % ) of the assessed
valuation thereof, upon all future Assessment Rolls of
the Town of Cortlandville pursuant to the provisions of
Section 467 of the.Real Property Tax Law.

STATE LEGISLATOR - GASOLINE SALES TAX

BE IT RESOLVED that the Supervisor is hereby authorized
and directed to contact our State Legislator's and
object to the new method of distributing gasoline sales
tax in New York State.
RESOLUTION # 208 AUTHORIZE WRITE OFF FINAL WATER BILL

VOTES: ALL AYE ADOPTED write off

WHEREAS a final bill, in the amount of $ 3.08 charged
to account # W-1483 has not been paid, and such charge
cannot be collected 'Via taxes, as such property has been
removed, therefore
BE RESOLVED that the final bill charged to Seymour Bradshaw,
account # W-1483 shall hereby treated as a write off.
Councilman O'Donnell made a motion, seconded by
Councilman Pierce to adjourn the meeting. All voting aye, adjourn
the motion was carried.
