PUBLIC HEARING LOCAL LAW NO. 1, 1982 A Public Hearing was held at the Town Hall, Town of Cortlandville at 7:30 P.M. to discuss the adoption of a local law to allow publication of ordinances and admend- ments to be summarized. In attendance were Supervisor Nadolski; Councilman. Pierce; Councilman Thorpe; Councilman Manning; Council- man O'Donnell; Attorney Folmer and Town Clerk, Pauline Parker. Also present were Deputy Town Clerk, June Bradshaw; Engineer Peter Novell; Assessor Robert Wells; Confidential Sec'y, Edna Puzo; Zoning Officer, Don Fowler; Justice, Donald Eaton; Highway Sup't., Carl Eaton; Legislator, Richard Tupper; Newsreporter, Dick Camerano and many Town residents. The Public,_- Hearing was opened by Supervisor.Nadolski. The Town Clerk.read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE NOTICE OF PUBLICHEARING ON Local Law No. 1, 1982 NOTICE is hereby given that there has been introduc- ed before the Town Board of the Town of Cortlandville, Cortland County, New York, on August 3, 1982, Local Law No. 1 of the year 1982, entitled "A Local Law providing for publication of ordinances, amendments and notices in relation thereto, providing for, the publication of sum- maries of such ordinances, and amendments in legal notices relating thereto." NOTICE is further giver, that the Town Board of the Town of Cortlandville will conduct a public hearing on the proposed Local Law at Town Hall, 15 Terrace Road, Cortland, New York at 7:30 p.m; on September 1„1982, at which time all persons in- terested will be heard. Parker Town Clerk, Town of Cortlandville Cortland County, New York 189-1t John Folmer advised the Board that Town Law requires that wh-.en the Town Board considers the adoption of an ordinance, that certain public notices be published prior to conducting a Public Hearing and subsequent to the adopt- ion of the ordinance. The statute requires that the ordin- ance,be reproduced and published ver batum in the news- paper. The Town Board has the right, if they so choose, to adopt a Local Law which would allow the Town to publish a summary of any ordinance. Wednesday, September 1, 1982 The Town is now in the process of revising the Zoning Ordinance which consist of about 75 pages and it would be very costly to publish. Attorney Folmer stated that basically it is a cost saving factor for the Town. Councilman Thorpe stated that just because a summary is published, the full text of any ordinance is still a public record and may be examined in the Town Clerk's office at any time. There were no comments from°'.,those in attendance. Councilman Pierce made a motion, seconded by Council- man O'Donnell to close the hearing. All voting aye, the motion was carried. Board members present were Supervisor Nadolski; Councilman Edwin O'Donnell; Councilman Warren Manning; Councilman Melvin Pierce,; Councilman Ray Thorpe; Town Clerk, Pauline Patkei ,and'Aitorney John Folmer. All voting aye, the motion was carried. pay vouchers RESOLUTION # 165 AUTHORIZE PAnIENT OF VOUCHERS Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers # 285 - 319 $ 5,930.72 Highway " # 180 - 199 6,560.41 Water Fund of# 134 - 152 4,914.50 Sewer Fund of# 46 - 47 498.11 Supervisor Nadolski allowed those in attendance the privilege of the floor. Legislator, Richard Tupper, reported to the Town privilege Board that he has received some phone calls from his of floor constituents in the area of Isabel Drive, Abdallah Ave., Louise Drive and Levydale Park. They have requested that similiar posting of signs be placed in their area to reduce the speed limit. A discussion followed whereby it was the consensus of the Town Board that it would be necessary for those residents to present a petition, signed_by the,marjority of the people in that area, to proceed on the request. Ke.n Andrews reported of the progress at the Recreation Park. He expressed concern of children climbing on the fence, and parents and users of the park not being familiar with the rules and regulations adopted by the Town. He suggested an article be submitted to the news media to advise the public. The Supervisor shall provide the information to the newsreporter. • 1 Wednesday, September 1, 1982 Page 3 A residential canvass will be conducted soon by volunteers for fund raising. A suggestion was made that the Town Board .meet early and visit the park to see what has been accomplished. RESOLUTION # 166 AUTHORIZE CHANGE OF TIME-SEPTEMBER SPECIAL MEETING • Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that -the Special Town Board meeting, scheduled September 20, 1982 at 4:30 P.M., shall be rescheduled for 7:00 P.M. on September 20, 1982 so the Town Board members may visit the park. fund raising chang time RESOLUTION # 167 AUTHORIZE ROBERT WELLS TO ATTEND ASSESSORS ASSOCIATION CONFERENCE AND SCHOOL Bob. W. School Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that Robert Wells is hereby authorized and directed to attend the 1982 N.Y.S. Assessors Association Conference and Training'School at.Stevensville,,:N':Y,. on September 20,21,22, 1982; ands, RESOLVED that any expenses incurred by same, be reimbursed, subject to audit by the Town .Board. Reports of various departments are on the table or reports may be reviewed in the Clerk's office, upon request. Councilman O'Donnell made'a motion, seconded by Councilman Manning, to receive and file a letter received from Crown City Biathlon Club thanking the Town for letting Biathlon them use the roads for their roller ski program. All Club letter voting aye, the motion was carried. A letter was received from the Regional Conference of Historical Agencies in regards to the suggested use of the Wright home for a Cortlandville.Historical Museum Museum and other town uses. Councilman O'Donnell made a motion, seconded by Councilman Thorpe to table the discussion. All voting aye, the motion was carried. Copies will be given to each Town Board member to review before ',the next meeting. 248 Wednesday, September 1, 1982 Page 4 A quarterly report was.received from the state comptroller showing the receipts received from the justice STOP,DWI department and how they were dispersed. The state has initiated,a new program, STOP DWI, which is performed at the county level, $ 6,750 was sent to the county for our share of the cost of the program from revenues normally received by the town. The 'town was never allowed any input regarding the new program. The county decides what to do with the funds. County Legislator, Dick Tupper, apprised the Town Board that the county has adopted the program and explained what the County has proposed to accomplish. RESOLUTION # 168 AUTHORIZE SUPERVISOR TO PETITION THE COUNTY FOR REVENUES -STOP DWI Petition PROGRAM STOP,DWI Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS the state has initiated another mandated program which will result in a loss of revenue at the town level, and WHEREAS town revenues are being sent to the county, by the state,, to finance the new STOP DWI program, therefore BE IT RESOLVED that the supervisor is hereby authorized and directed to petition the County Legialature and request that monies received from the STOP DWI program, be included in their budget to be transmitted back to the:town level to offset the cost of the town justice department, and RESOLVED that if no satisfaction is received -from the county, that such request shall be sent to the state. RESOLUTION # 169 REQUEST ZONING COMMISSION TO REVIEW Vendors VENDORS PERMITS TO BE ADDED TO TOWN permits ORDINANCE Motion.by Councilman Manning Seconded by.Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS the existing Town Ordinance does not provide any restrictions to vendors selling their wares by the road- side, and is becoming more popular, therefore BE IT RESOLVED that the letter received from Stevens Heritage shall be forwarded to the Zoning Commission to review,and RESOLVED that the.Zoning Commission is requested to review the proposal.and attempt to include a provision in the revised zoning ordinance for vendors permits and regulations for roadside stands. 1 40 1 0 Wednesday, September 1, 1982 Page :5 249 Councilman Pierce made a motion, seconded"by Council- file man Thorpe to receive and file the Cortland County Indust- PTM rial Development -Agency application for the Pall Trinity application Micro Corporation project. All voting aye, the motion Stevens was carried. letter RESOLUTION#'170 -AWARDING OF BIDS -HIGHWAY GARAGE ROOF award of Motion by Councilman Thorpe bids Seconded by Councilman Manning VOTES: ALL AYE ADOPTED 1 WHEREAS pursuant to Resolution # 164 for the year 1982, sealed bids were publicly solicited for roofing of'high- way garage,'in,accordance with the specifications and terms set forth in -the information -to _bidders; and WHEREAS, five sealed bids were received, opened and read aloud by the Clerk, and WHEREAS, all bids submitted were in proper form, and have been reviewed, therefore BE IT RESOLVED that the -Town Board ville, does hereby -award the ,bid to Roofing Company Inc. in the amount deck repair at $ 3.00 per sq. ft., of the Town of Cortland - lowest bidder, Stephnick of $ 12,628.00 plus and RESOLVED that all other'bids submitted,are hereby rejected, and BE IT FURTHER RESOLVED that Supervisor Nadolski is hereby authorized'and directed to sign the contract with the Stephnick Roofing Company Inc. Councilman O'Donnell to receive and file a letter from the Department of Agriculture and Markets regarding an Agricultural Districts Program Workshops at different locations. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by letter Councilman Manning to receive and file a -letter received from Mrs. Don E. Fowler,in regards to naming the Cort- landville Park. All.voting aye, the motion was carried. Councilman Thorpe made a motion, seconded by Council- man O'Donnell to receive and file the certiorari proceeding Certiorari received from Barker's of Cortland, Inc. All voting aye, proceeding the motion was carried. Councilman Pierce made a motion, seconded by Council- man O'Donnell.to receive and file the (SPDES) permit (SPDES) from NYS Department of Environmental Conservation to Paradise Pines Compground located on Carr Hill Road, Cort- land, New York. All voting aye, the motion was carried. Supervisor Nadolski read a letter received from the Polkville Motel Developments. They are in the final stage Polkville for leasing, and requested a committment letter from the Developements Town for the placement of sewering. Engineer Novelli reviewed the -cost estimates of the project with the Town Board. Zoning Officer advised.that a request has been received by the Cortlandville Planning Board for a three lot subdivision. _ -by Mr. Currie. The request has been forwarded to` the County Planning Board to act on and a public hearing is scheduled for September 28, 1982. Councilman Pierce made a motion, seconded by Council- man Thorpe, to table the matter until a recommendation has been received from the Cortlandville Planning Board. All voting aye, the motion was carried. Councilman Thorpe made a motion, seconded by Council- man Manning to receive and file all the correspondence Water & Sewer received in regards to the refund of water and sewer Benefit Tax benefit tax. All voting aye, the motion'was carried. The matter is pending in the council's office at Audit and Control. A petition was -received requesting a noise ordinance be enacted for the Town of Cortlandville. The petition Petition represented those area residents of Polkville, McGraw Noise Ord. and was collected by the O'Gormans. Councilman Pierce Wednesday, September 1, 1982..-. Supervisor Nadolski reminded the board of the several requests that have been received the past few years. Examples were cited. A discussion followed whereby it was the consensus of the board to table the matter for further investigation. Attorney Folmer will investigate formats used by other areas and submit for consideration. RESOLUTION # 172 ACCEPT ELECTION INSPECTORS LIST FOR election 1982-1983 - inspec. RESOLUTION # 180 ACCEPT RESIGNATION OF WARREN BARTH- resign. ASSESSMENT REVIEW BOARD Warren Barth Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Town Board shall hereby accept the resignation of Assessment Review Board member, Warren Barth, effective August 6, 1982, with regret. Supervisor Nadolski advised the Town Board that three or four names have been recommended to him for a replacement for Mr.. Barth. Councilman O'Donnell made a motion, seconded by Councilman Thorp& to table the decision -for replacing Mr. Barth, to the next meeting, so the Town Board members may study the recommendations further. All voting aye, the motion was carried. A discussion was held regarding increasing the dog license fees and doing a dog-enumeration`in the Town. Our fees are $ 3.50 for spayed'dr�`heutered: and $ 8.50 for unspay- ed or unneutered dogs. The Supervisor advised that the SPCA is doing a good job of licensing dogs. ' RESOLUTION # 182 AUTHORIZATION TO ADVERTISE FOR BIDS bids insulation FOR INSULATION OF THE HIGHWAY GARAGE Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the engineer is hereby authorized and directed to advertise for the receiving of bids for insulating the highway garage, and RESOLVED that such bids shall be received, opened and read aloud by the clerk on October 6, 1982 at 7:30 PM.. Supervisor Nadolski advised the Board that the bridge Bl. Mills in Blodgett Mils should be completed in a week to 10 days. bridge Engineer Peter Novelli received information September McLean Sewer 1, 1982 that the McLean Truck Line Sewer bond will be completed within the next two weeks. RESOLUTION # 183 APPOINT JOHN CATALANO TO RECREATION John Catalano COMMITTEE Rec. Com. Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS John Catalano.has. been .a represtative from Cortland - Ville to the County Youth Bureau, therefore . BE IT RESOLVED that John Catalano, is hereby appointed to serve on the Cortlandville Recreation committee, effective immediately. Attorney Folmer advised that nothing.has been received railroad or accomplished regarding purchasing the railroad right-of-way behind ETL located behind ETL. The Town Board requested the attorney to proceed and report his fi.ndingspext month. Justice, Don Eaton, advised that'an attempt is being made to receive a $ 15, completed case fee for all lower raise fees courts. He encouraged that letters be sent to state for lower Legislators to encourge the passing of this bill. courts Councilman Pierce asked what.the status was regarding placing a street light in the Bowling Green area. This matter will be pursued further. Councilman Manning made a.motion, seconded by Council- man O'Donnell, to adjourn the meeting. All voting aye, the motion was carried.
