PUBLIC HEARING
LOCAL LAW NO. 1, 1982
A Public Hearing was held at the Town Hall, Town of
Cortlandville at 7:30 P.M. to discuss the adoption of
a local law to allow publication of ordinances and admend-
ments to be summarized.
In attendance were Supervisor Nadolski; Councilman.
Pierce; Councilman Thorpe; Councilman Manning; Council-
man O'Donnell; Attorney Folmer and Town Clerk, Pauline
Parker.
Also present were Deputy Town Clerk, June Bradshaw;
Engineer Peter Novell; Assessor Robert Wells; Confidential
Sec'y, Edna Puzo; Zoning Officer, Don Fowler; Justice,
Donald Eaton; Highway Sup't., Carl Eaton; Legislator,
Richard Tupper; Newsreporter, Dick Camerano and many
Town residents.
The Public,_- Hearing was opened by Supervisor.Nadolski.

John Folmer advised the Board that Town Law requires
that wh-.en the Town Board considers the adoption of an
ordinance, that certain public notices be published prior
to conducting a Public Hearing and subsequent to the adopt-
ion of the ordinance. The statute requires that the ordin-
ance,be reproduced and published ver batum in the news-
paper.
The Town Board has the right, if they so choose, to
adopt a Local Law which would allow the Town to publish
a summary of any ordinance.

The Town is now in the process of revising the Zoning
Ordinance which consist of about 75 pages and it would
be very costly to publish. Attorney Folmer stated that
basically it is a cost saving factor for the Town.
Councilman Thorpe stated that just because a summary
is published, the full text of any ordinance is still a
public record and may be examined in the Town Clerk's
office at any time.
There were no comments from°'.,those in attendance.
Councilman Pierce made a motion, seconded by Council-
man O'Donnell to close the hearing. All voting aye, the
motion was carried.

The regular meeting of the Town of Cortlandville
Town Board was held at the Town Hall, 15 Terrace Road,
Cortland, New York with Supervisor Nadolski presiding.
Board members present were Supervisor Nadolski;
Councilman Edwin O'Donnell; Councilman Warren Manning;
Councilman Melvin Pierce,; Councilman Ray Thorpe; Town
Clerk, Pauline Patkei ,and'Aitorney John Folmer.
Others present were Engineer, Peter Novelli; Assessor,
Robert Wells, Deputy Town Clerk, June Bradshaw; Zoning
Officer, Don Fowler; Confidential Sec'y, Edna Puzo;
Highway Sup't., Carl Eaton; Justice, Donald Eaton;
Legislator, Richard Tupper; Newsreporters Dick Camerano
and Eric Silverman , town residents Ken Andrews, Henry
Baranello, Ross Hall, Frances Morgan, Mr. & Mrs. Homer,
Jane Zogg and three (3) men from Stephnick Roofing Com-
pany.
The meeting was called to or,,der by Supervisor Nadolski.
The Town Clerk read the published legal notice for
the receiving of bids for a new roof for the Highway
Garage.
Councilman O'Donnell made a motion, seconded by
Councilman Thorpe, to officially close the receiving of
bids: All voting aye, the motion was carried."'

A representative from the Stephnick Roofing Co. questioned
the use of felt rolls stated in the specs, instead of fiber-
glass. All bids received were given to the highway sup't,

the engineer, and the attorney to review.
Reading of the minutes were dispensed with as all
approve board members had received copies prior to the meeting.

Supervisor Nadolski allowed those in attendance the
privilege of the floor.
Legislator, Richard Tupper, reported to the Town
privilege Board that he has received some phone calls from his
of floor constituents in the area of Isabel Drive, Abdallah Ave.,
Louise Drive and Levydale Park. They have requested that
similiar posting of signs be placed in their area to
reduce the speed limit.
A discussion followed whereby it was the consensus
of the Town Board that it would be necessary for those
residents to present a petition, signed_by the,marjority
of the people in that area, to proceed on the request.
Ke.n Andrews reported of the progress at the Recreation
Park.
He expressed concern of children climbing on the fence,
and parents and users of the park not being familiar
with the rules and regulations adopted by the Town. He
suggested an article be submitted to the news media to
advise the public. The Supervisor shall provide the
information to the newsreporter.

A residential canvass will be conducted soon by
volunteers for fund raising.
A suggestion was made that the Town Board .meet early
and visit the park to see what has been accomplished.

subject to audit by the Town .Board.
Reports of various departments are on the table or reports
may be reviewed in the Clerk's office, upon request.
Councilman O'Donnell made'a motion, seconded by
Councilman Manning, to receive and file a letter received
from Crown City Biathlon Club thanking the Town for letting Biathlon
them use the roads for their roller ski program. All Club letter
voting aye, the motion was carried.
A letter was received from the Regional Conference
of Historical Agencies in regards to the suggested use
of the Wright home for a Cortlandville.Historical Museum Museum
and other town uses. Councilman O'Donnell made a motion,
seconded by Councilman Thorpe to table the discussion.
All voting aye, the motion was carried.
Copies will be given to each Town Board member to
review before ',the next meeting.

A quarterly report was.received from the state
comptroller showing the receipts received from the justice
STOP,DWI department and how they were dispersed.
The state has initiated,a new program, STOP DWI,
which is performed at the county level, $ 6,750 was sent
to the county for our share of the cost of the program
from revenues normally received by the town. The 'town
was never allowed any input regarding the new program.
The county decides what to do with the funds.
County Legislator, Dick Tupper, apprised the Town
Board that the county has adopted the program and explained
what the County has proposed to accomplish.

WHEREAS the state has initiated another mandated program
which will result in a loss of revenue at the town level,
and
WHEREAS town revenues are being sent to the county, by
the state,, to finance the new STOP DWI program, therefore
BE IT RESOLVED that the supervisor is hereby authorized
and directed to petition the County Legialature and request
that monies received from the STOP DWI program, be included
in their budget to be transmitted back to the:town level
to offset the cost of the town justice department, and
RESOLVED that if no satisfaction is received -from the county,
that such request shall be sent to the state.

Heritage shall be forwarded to the Zoning Commission to

RESOLVED that the.Zoning Commission is requested to review
the proposal.and attempt to include a provision in the
revised zoning ordinance for vendors permits and regulations

Councilman Thorpe made a motion, seconded by Council-

Councilman Pierce made a motion, seconded by Council-
man O'Donnell.to receive and file the (SPDES) permit
(SPDES) from NYS Department of Environmental Conservation to
Paradise Pines Compground located on Carr Hill Road, Cort-
land, New York. All voting aye, the motion was carried.
Supervisor Nadolski read a letter received from the
Polkville Motel Developments. They are in the final stage
Polkville for leasing, and requested a committment letter from the
Developements Town for the placement of sewering.
Engineer Novelli reviewed the -cost estimates of the
project with the Town Board.
Zoning Officer advised.that a request has been
received by the Cortlandville Planning Board for a three
lot subdivision. _ -by Mr. Currie. The request has been
forwarded to` the County Planning Board to act on and a
public hearing is scheduled for September 28, 1982.
Councilman Pierce made a motion, seconded by Council-
man Thorpe, to table the matter until a recommendation
has been received from the Cortlandville Planning Board.
All voting aye, the motion was carried.
Councilman Thorpe made a motion, seconded by Council-
man Manning to receive and file all the correspondence

Supervisor Nadolski reminded the board of the several
requests that have been received the past few years.
Examples were cited. A discussion followed whereby
it was the consensus of the board to table the matter for
further investigation. Attorney Folmer will investigate
formats used by other areas and submit for consideration.

the resignation of Assessment Review Board member, Warren
Barth, effective August 6, 1982, with regret.
Supervisor Nadolski advised the Town Board that three
or four names have been recommended to him for a replacement
for Mr.. Barth. Councilman O'Donnell made a motion, seconded
by Councilman Thorp& to table the decision -for replacing
Mr. Barth, to the next meeting, so the Town Board members
may study the recommendations further. All voting aye,
the motion was carried.
A discussion was held regarding increasing the dog
license fees and doing a dog-enumeration`in the Town. Our
fees are $ 3.50 for spayed'dr�`heutered: and $ 8.50 for unspay-
ed or unneutered dogs. The Supervisor advised that the
SPCA is doing a good job of licensing dogs. He recommends
that we forego the enumeration this year and keep the license
fees the same.

Attorney Folmer advised that nothing.has been received
railroad or accomplished regarding purchasing the railroad right-of-way
behind ETL located behind ETL.
The Town Board requested the attorney to proceed and

Justice, Don Eaton, advised that'an attempt is being
made to receive a $ 15, completed case fee for all lower raise fees
courts. He encouraged that letters be sent to state for lower
Legislators to encourge the passing of this bill. courts
Councilman Pierce asked what.the status was regarding
placing a street light in the Bowling Green area.
This matter will be pursued further.
