Hall, 15 Terrace Road, Cortland, New York with Supervisor Nadolski presiding. Board members present were Supervisor Nadolski; Councilman Melvin Pierce; Councilman Warren Manning; Councilman Edwin O'Donnell; Town Clerk Pauline Parker and Attorney John Folmer. Others present were Engineer, Peter Novelli; Assess- or, Robert Wells; Deputy Town Clerk, June Bradshaw; Zoning Officer, Don Fowler; Justice, Don Eaton; Confid- ential Sec'y., Edna Puzo; Highway Sup't., Carl Eaton; Legislator Richard Tupper; Newsreporter Dick Camerano and -.town -residents Ken Andrews, Mr. and Mrs. Wayne Currie, Charles Feiszli and Mr. and Mrs. Gary Henry. The meeting was called to order by Supervisor Nadolski. Reading of.the minutes were dispensed with as all board members had received copies prior to the meeting. approve minutes Councilman Pierce made a motion, seconded by Councilman O'Donnell, to accept the minutes of June 2, 1982, June 21, 1982 and June 28, 1982, as written. All voting aye, the motion was carried. Councilman O'Donnell made.a motion -,.seconded by Planning Councilman Manning to receive and file the Cortlandville Bd. minutes Planning Board minutes of June 29, 1982. All voting aye, the motion was carried. RESOLUTION # 122 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers # 200 245 $ 7 958.24 Highway # 122 - 152 23,225.01 Water Fund # 72 - 94 15,201.65 Sewer Fund # 24 - 29 1,421.21 ® Supervisor Nadolski gave the privilege of the floor to Mr. Wayne Currie, representative of Polkville Motel Developments. Mr. Currie presented the Town Board with a written proposal for sanitary sewer hook up located along Route 11 south of Route 41 in Polkville. The proposal included sewer hook ups for members of the Polkville area as well as for the proposed construction of a new motel in Polkville. audit of vouchers Polkville Sewer - WayneC0=ie Wednesday, July 7, 1982 Page 2 Charles Feiszli, P.E. of Resource Engineering Polkville presented (2) two options in which the proposed plan Sewer could become a reality with the estimated cost between Cont'd $ 87,000 - $ 93,000. An application for funding has been submitted to the local IDA program. Mr. Currie stated he would be the developer only and would not be operating the motel. It would be operated by a national public company. Gary Gary Henry, Blodgett Mills, verbally petitioned Henry- the Town Board for a refund of a $ 25.00 dog seizure dog fee fee. He stated that his dog was picked up by the SPCA, complaint on June 2, 19821by the road in front of his house. He was issued (3) three appearance tickets by the SPCA and each ticket was issued incorrectly. Mr. Henry appeared before Justice Eaton and all charges were dismissed. He advised that his dogs have permission to be on his neighbors property and also produced papers showing he had previously ordered a new tag as the original was lost. Because all charges were dismissed, he felt it was unfair to pay an impoundment fee or the boarding cost. Councilman O'Donnell made a motion, seconded by Councilman Pierce to table the matter. The Town Board requested the attorney to investigate further and report back to them at the July 19, 1982 special meeting. All voting aye, the motion was carried. RESOLUTION # 123 AUTHORIZE CHANGING TIME-JULY SPECIAL MEETING change of Motion by Councilman O'Donnell time - 7/19 Seconded by Councilman Manning meeting VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Special Town Board meeting, scheduled July 19, 1982 at 4:00 P.M., shall be resched- uled for 7:00 P.M. on July 19, 1982. Councilman Manning made a motion, seconded by Coun- S.P.C.A. cilman O'Donnell, to receive and file the monthly report report from the S.P.C.A.. All voting aye, the motion was carried. Reports of various departments are on the table or may be reviewed in the Clerk's office, upon request. Councilman Manning made a motion, seconded by Coun- Insurance cilman Pierce to receive and file a Govern,.mental Ins - Disclosure urance Disclosure Statement from Cortland Agency Inc.. Department of Transportation advising that the Town will receive $ 36,128.00. thru the CHIPS "CHIPS" Program pr,ogram.All voting aye, the motion was carried. Supervisor Nadolski stated that we have received the first installment in the amount of $ 9,032. RESOLUTION # 124 DESIGNATE CHIPS PROGRAM FOR ROAD REPAIRS ® Mo'.-ion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the funds received from NYS under the CHIPS Program in the amount of $ 36,128.00 shall be designated for the use of road repairs. Councilman Pierce made a motion, seconded by Council- man O'Donnell to receive and file a letter from State of New York Department of Motor:. Vehicles in reference to "CHIPS" Vending Vehicles. All voting aye, the motion was carried. . Caution Arms must be -on all frozen dessert vending vehicles, effective September 1, 1982. Councilman Manning made a motion, seconded by Council- man O'Donnell to receive and file a letter received from Ground the Cortlandville Planning Board requesting the Town Water Board and Zoning Board of Appeals to attend a Ground Water Management Management Program, Tuesday July 27, 1982 at 8:00 P.M.. meeting All voting aye, motion was carried. Councilman Manning made a motion, seconded by Council- man O'Donnell to receive and file (2) two letters from New York State Department of Transporation in regards to speed the request to lower the speed limit on Sleepy Hollow, limit Winkle Way and Bowling Green. All voting aye, motion was lowered carried. The first letter advised that the reduction of the speed limit was denied. They also suggested that the Town post warning signs at those locations because of the layout of the tract. The second letter advised that a resident requested that they reconsider their decision. They again suggested that the Town post warning signs there. Legislator, Richard Tupper, reported that the residents of that area are upset of the denial by the State. He has discussed the problem with the County Highway,Sup't., and he is willing to assist us in posting warning signs. � a Wednesday, July 7, 1982 Page 4 RESOLUTION # 125 AUTHORIZE WARNING SIGNS FOR TRAFFIC CONTROL AT SLEEPY HOLLOW, WINKLE WAY BOWLING GREEN Motion by Cou�jcilrlan Manning Traffic Seconded by Councilman O'Donnell Control signs VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Highway Sup't. is hereby author- ized and directed to install warning signs to lower the speed limit for traffic control at Sleepy Hollow, Winkle Way and Bowling Green and FURTHER RESOLVED that the Supervisor is hereby authorized and directed to forward the proper request to the New York State Department of Transportation to reduce the speed limit in that area. Councilman Pierce reported that the residents of Sleepy Hollow, Winkle Way and Bowling Green have also requested that some street lights be installed in that area. A discussion followed concerning the moratorium on street lights in the Town and also excessive street light- ing in other areas in the Town. RESOLUTION # 126 AUTHORIZE ENGINEER TO STUDY STREET LIGHTING WITHIN THE TOWN Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that the engineer is hereby authorized street and directed to contact Niagara Mohawk and request their lighting assistance to do a study of street lighting in the Town, both for the need of and excessive lighting and report their findings to the Town Board. Councilman Manning made a motion, seconded by Council- man O'Donnell to receive and file a letter received from state New York State Department of Environmental Conservation sewer app. in regards to Paradise Pines Campground. All voting aye, the motion complaint was carried. RESOLUTION # 127 AUTHORIZATION FOR RECEIVING OF BIDS FOR SAND -SALT CHEMICAL SPREADER Motion by Councilman Manning Seconded.by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Town Clerk is hereby authorized and directed to receive the bids for one new sand -salt chemical spreader and RESOLVED that such bids received shall be opened and awarded on August 4, 1982 at 7:30 P.M.. Attorney,Folmer apprised the Town Board that the Zoning Commission are near completion of revising the Zoning Ordiance of the Town. It is hopeful that this can be completed this year. Attorney Folmer advised that unless the Town Board adopts a local law to the contrary, it will be necessary to publish the revised ordinance in its entirety for both the public hearing and to enact it, which would be costly. LAWRENCE Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT RESOLVED that Justice, Donald Eaton, is hereby authorized and directed to attend a seminar at St. Lawrence University July 26 - July 30, 1982, and RESOLVED that any expenses incurred by same be reimbursed, subject to audit by the Town Board. RESOLUTION # 131 AUTHORIZE COURT CLERK TO ATTEND COURT CLERK SEMINAR AT ST. LAWRENCE Motion by Councilman Manning court Seconded by Councilman O'Donnell clerk VOTES: ALL AYE ADOPTED seminar BE IT RESOLVED that Court Clerk, Mardis Kelsen, is hereby authorized and directed to attend a seminar at St. Lawrence University July 26 .- July 30, 1982, and RESOLVED that she shall go at her own expense, with no reimbursement from the Town, as McGraw pays her expenses. RESOLUTION # 132 SETTING DATE FOR PUBLIC HEARING - SEWER RENT RATE INCREASE public hearing Motion by Councilman Manning sewer rates Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that a public hearing shall be held on August 4, 1982 at 7:40 P.M. at the Town Hall, by the Cortlandville Town Board to amend portions of the Sewer Ordinance relative to4sewer rent rate increase. Supervisor Nadolski advised that action must be taken refund by our board concerning the unpaid water and sewer benefit water & tax that has been returned to the County TreasurErfor sewer collection. Councilman O'Donnell made a motion, seconded by Council- man Manning, to table the matter for further action until the July 19, 1982 special meeting, per request of the attorney. All voting aye, the motion was carried. RESOLUTION # 133 AUTHORIZE ESTABLISHMENT OF HIGHWAY EQUIPMENT CAPITAL RESERVE FUND Motion by Councilman Manning Seconded by Councilman Pierce Establish VOTES: ALL AYE ADOPTED Capital RESOLVED, that pursuant to Section 6-c of the General Reserve Municipal Law, as amended, this Cortlandville Town Board Fund - Highway Equipment 1 Cl 1 Wednesday, July 7, 1982 Page 7 HE 1 • a n does hereby establish a Capital Reserved Fund to finance the cost of contruction, reconstruction, acquisition of heavy highway equipment, and RESOLVED, it is the intent of this board to accumulate all of the cost of the heavy highway equipment the maximum cost of which is estimated to be $164,000.00, and RESOLVED, the Supervisor is hereby directed to deposit moneys of this reserve fund in a separate bank to be known as the "Highway Equipment Capital Reserve Fund", and RESOLVED, the Supervisor is authorized to invest, from time to time, the moneys of this fund pursuant to Section 6-f of the General Municipal Law, and RESOLVED, no expenditure shall be made except upon authorization of this board, and FURTHER RESOLVED, that this resolution is subject to a permissive referendum as provided by Town Law § 55- RESOLUTION # 134 AUTHORIZE TOWN PERSONNEL TO ATTEND COMPUTER DEMONSTRATION Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that appropiate personnel are hereby authorized to attend a computer demonstration at Cornell University, sponsored by Radio Shack, on July 15, 1982, and RESOLVED that any expenses incurred by same be reimbursed, subject to audit by the Town Board. computer demonstration Councilman Manning made a motion, seconded by Council- man O'Donnell to recess the regular meeting and convene to executive session to discuss the matter of litigation and personnel.
