Page 1 SPECIAL MEETING A Special Meeting of the Cortlandville Town Board was held April 26, 1982 at the Town Hall, 15 Terrace Road, Cortland, New York with Supervisor Nadolski presiding to discuss the zoning request of Richard Osborne -Lawrence Dippold located on Route ## 281. Board members present were Supervisor Stanley Nadolski; Councilman Edwin O'Donnell; Councilman Melvin Pierce; Councilman Warren Manning; Councilman Ray Thorpe; Town Clerk, Pauline Parker and Attorney John Folmer. Also present were Ray Osborne, Attorney Gilhooley, Newsreporter Dick Camerano and Town residents, Newton Parker, Jack Fitzgerald and Paul Wilcox. Supervisor Nadolski called the meeting to order. Supervisor Nadolski read a letter received from William Clemens, chairman of the Cortlandville Planning Board, regarding the action taken by them at their special meeting held on April 20, 1982 with four members present. A motion was made by Robert Kelley, seconded by Earl Randolph, to recommend to thb Town Board that the propert- ies of Osborne and Dippold be re -zoned from R-1 to Business transitional, contingent upon acceptance by the Town Board of written committments from both Osborne and Dippold to waive landowners rights to construct multi- family dwellings. The motion was defeated with 1 aye, 2 nays and 1 abstention. Supervisor Nadolski gave those in attendance the privilege of the floor. Attorney, Thomas Gilhooley, reviewed with the Town Board the request for the zoing change from R-1 to Business transitional. He cl.iscussed the difference.between business and business transtitional zoning. Area residents Mr. Newton Parker of Meadow Lane, Mr. Jack Fitzgerald of Hillside Drive, and Mr. Paul Wilcox of Meadow Lane voiced their opinions opposing the zoning change request. Attorney Folmer reviewed with the Town Board and those in attendance that the application was submitted to all of the proper agencies in the proper manner. The County Planning Board report did not indicate that they considered the request spot zoning. RESOLUTION ## 89 DENIAL OF ZONING CHANGE REQUEST OF OSBORNE-DIPPOLD Motion by Councilman Thorpe Seconded by Councilman Pierce ROLL CALL VOTE: Monday, April 26, 1982 Page 2 191 U LJ • Ci Councilman O'Donnell No Councilman Pierce No Councilman Manning No Councilman Thorpe No Supervisor Nadolski No DENIED BE IT RESOLVED that the request for re -zoning on the part of Mr. Osborne and Mr. Dippold be denied. A motion was made by Councilman Pierce, seconded by Councilman Thorpe, that the meeting be closed.. All voting aye, the motion was carried. A question was raised concerning the validity of the vote. Supervisor Nadolski reopened the meeting. Attorney Folmer explained that a negative motion required a yes vote. Councilman O'Donnell voted yes Councilman Pierce voted yes Councilman Manning voted yes Councilman Thorpe voted yes Supervisor Nadolski voted yes Councilman Thorpe made a motion, seconded by Council- man Pierce to adjourn the meeting.
