HomeMy WebLinkAbout1963-08-13 .: 420 . August 13 , 1963 The regular monthly meeting of the Dryden Town Board was called to order by Supervisor Gridley at 8 : 00 p . m . Present were Cim . Baker and Saltonstall , Justice Hoagland , Assessor Abrams , and Atty . Williamson . Absent : Justice Spaulding . Moved by Clm . Saltonstall. f seconded by Cim . Baker , that reading of the minutes of the previous meeting be dispensed with . Carried and so ordered . Justice Hoagland was called out and returned during the following discussion . Mr . Leo Barry , Raymond Robideau , and Vernon Klein of the New York Board of Fire Underwriters were present to review a suggested ordinance which would set up standards according to the National Electrical Code and require inspection of installation or altera- tion of wiring by the Board of Underwriters . It was explained that this kind of ordinance is being encouraged strictly as a safety operation for the prevention of fire from improper wiring . The proposal was referred to Atty Williamson for review and con- sideration before the next meeting . Sup . Gridley reported that Justice Spaulding has returned from the hospital after his operation and is making satisfactory recovery . Town of Dryden portion of Slaterville Road , matter was referred to Atty . Williamson for follow up . L etter from O ' Brien and Gere re : sewer study was read and filed . Moved by Clm . Saltomstall , seconded by Justice Hoagland , that this Board rescind the motion of July 9 , 1963 ( pg . 418 ) re : cooperation with the Village of Dryden in application for compre - h ensive sewer study . Carried and so ordered .. Clm . Saltonstall offered the following resolution and moved its adoption : RESOLVED , that the Village of Dryden and the Town of D ryden jointly make application to the State of New York for a Comprehensive Sewage Study of a portion of the Virgil Creek Drain - age Basin , the limits of which shall be mututally determined by the applicants , the State of New York and the Consulting Engineers , and be it further V/ / /me. RESOLVED , that the 'Teton. of Dryden is hereby authorized to administer this study , aid be it further RESOLVED , that the Consulting Engineering Firm of S terns and Wheeler is hereby designated as the Consulting Engineers to undertake the work of this study subject to the approval of the application by the State of New York , and be it further RESOLVED , that Lewis H . Gridley , Supervisor , is hereby authorized to sign said application on behalf of the Town of Dryden . Resolution seconded by Justice Hoagland . Roll call vote , all present voting YES . Absent : Justice Spaulding . Assessor Abrams presented proposal of American Air Service Inc . f or preparation of tax maps at an estimated cost of 315 . 900 . 00 . It was explained that professional maintenance of such maps then would be about 3500 . 00 per year . Matter tabled until all budget 421 needs can be reviewed . Moved by Clm . Baker , that a public hearing be held at 8 : 15 p . m . on September 10th , regarding amend - ment of the Ordinance authorizd:ng conduct of Bingo so that it will conform to new state statutes regarding conduct of Bingo . Assessor Abrams gave detailed report on completion of tax roll , which he will place on file - showing net overall increase of $ 904 , 441 . 00 of assessed evaluation . Moved by Justice Hoagland , seconded by Clm . Saltonstall , that Assessor Abrams as multiple dwelling inspector be designated to act as enfoning officer for the Building Reports Ordinance . Carried and so ordered . Assessor Abrams requested clerical assistance for his office . Moved by Clm . Saltonstall , seconded by Clm . Baker , that one Deputy Town Clerk be appointed for work assigned by the Town Board to assist the Assessor and the Supervisor and for clerical work as needed . Re : Yard lights Justice Hoagland reported that one , has been 4 22 installed on pole in front of off ice g placement of one for garage area to be determined after checking possibilities . Supervisor Gridley reported , with reference to highway matters , that about 4 miles of semi -permanent improvement have been completed on Town roads . Moved by Clm . Saltonstall , seconded by Clm . Baker , that Justice Hoagland be authorized to attend Justice School at Cornell University for two days this week , and that Justice Hoagland be authorized to bill the Town for mileage costs to conference of State Magistrates at Whiteface , and that Justice Hoagland be authorized to purchase tapes for use in Court hearings , he to furnish the recorder . Lewis Gridley , Supervisor Jane Korbas , Town Clerk • • • G 1 • AN ORDINANCE TO AMEND THE ORDINANCE ADOPTED BY THE TOWN OF DRYDEN , AUTHORIZING THE CONDUCT OF BINGO' - BY CERTAIN ORGANIZATIONS FOR CERTAIN PURPOSES IN SUCH TOWN The ordinance to permit the conduct of Bingo passed by the Town Board of the Town of Dryden on the ' .3: . 41,72 i 4 , /f ois hereby amended to read as follows : SECTION 1 . PURPOSE . The purpose of this ordinance is to amend an ordinance adopted by the To Board of Dryden dated O Itcc %%authorizing the conduct of ; Bingo in said Town to change the reference in such ordinance from Article 14 -G of the General Municipal Law to Article 14- H of the General G Municipal Law , as so renumbered by Chapter 438 of the Laws of 1962 and to set forth herein the following additional amended and renumbered restrictions concerning the conduct of the game of Bingo by an authorized organization in such Town as required by Section 479 of the General Municipal Laws of the State of New York as amended by Chapter 438 of the Laws of 1962 : 1 . No person , firm , association , corporation or organization other than a licensee under the provisions of Article 14 -H of the General Municipal Law , shall conduct such game or shall lease or otherwise make available for conducting Bingo a hall or other premises for any consideration whatsoever , direct or indirect . 2 . No Bingo games shall be held , operated or conducted on or within any leased premises if rental under such lease is to be paid , wholly or partly , on the basis of a percentage of the receipts or net profits derived from the operation of such game . 3 . No authorized organization licensed under the provi - sions of Article 14- H of the General Municipal Law shall purchase or receive any supplies or equipment specifically designed or adapted for use in the conduct of Bingo games from ;' other than a supplier licensed under the Bingo Control Law or from another authorized organization . 4 . The entire net proceeds of any game of Bingo and of any rental shall be exclusively devoted to the lawful purposes of the organization permitted to conduct the same . 5 . No prize shall exceed the sum or value of two hundred fifty, dollars in any single game of Bingo . 6 . No series of prizes on any one Bingo occasion shall aggregate more than one thousand dollars . 7 . No person except a bona fide member of any such organ- ization shall participate in the management or operation of such game . 8 . No person shall receive any remuneration for partici - pating in the management or operation of any game of Bingo . 9 . The unauthorized conduct of a Bingo game and any will- ful violation of any provision of this ordinance shall constitute and be punishable as a misdemeanor . RESOLVED that the Town Board of the Town of Dryden enacts AN ORDINANCE AUTHORIZING CONDUCT OF BINGO GAMES and pursuant to authority of Section 130 of the Town Law, Article 14-G of the General Municipal Law ( as added by the Laws of 1957 , Chapter 8514.) , Article 19 -B of the Executive Law and Article I , Section 9 , Subdivision 2 , of the State Constitution , the Town Board of the Town of Dryden , Tompkins County , New York , does ORDAIN AND ENACT as follows : Section 1 . TERRITORY AFr'ECTED . This Ordinance shall be applicable to all territory within the limits of the Town of Dryden . .. Section 2 . LEGALIZATION OF "BINGO " It shall be lawful for any authorized organization , namely, a bona fide religious , charitable , or non-profit organization of veterans , volunteer fire= • men , and similar non-profit organizations , upon obtaining a License therefor . as provided by the General Municipal Law, Article 14-G, and rules and regula- �, tions adopted by the State Lottery Control Commission pursuant to the State Lottery Control Law to conduct the game or games of Bingo in the territory of the Town ofDryden . . Section 3 . RESTRICTIONS UPON CONDUCT OF BINGO GAMES , • ( a) No game shall be conducted on the first day of the week commonly called Sunday. • ( b ) No person , firm, association, corporation or organization , other than an " authorized organization " licensed under the provisions of said Article 14-G of the General Municipal Law, shall be permitted to conduct such games . ( h ) The unauthorized conduct of a Bingo game and any wilful violation of any provision of this Ordinance , shall constitute and be punishable as a Misdemeanor . • • 4 A . • ( i ) No bingo game shall be held , operated or conducted on or within any leased premises if rental unddr such lease is to be paid , wholly or partly, on the basis of a percentage of' the receipt or net profits derived from the operation of such game . Section 11 . DELEGATION OF AUTHORITY The Town Board of the Town of Dryden may, pursuant to Section 1198 of It the General Municipal Law , delegate to an officer or officers of such • Township designated by the Town Board for such purpose any of the Authority t granted to such Governing Body by said Article 11.E-G of the General Municipal I ' Law in relation to the issuance , amendment and cancellation of' Licenses , the conduct of investigations and hearings; the supervision of the operation of the Games , and the collection and transmission of Fees .. Section 5 . PENALTIES FOR VIOLATION The making of any false statement in any application for a License or in any statement annexed thereto , or any other violation of the provisions of said Article 111 -G of the General Municipal Law or any violation of the terms of such a license , shall constitute a Misdemeanor, and shall subject the offender to forfeiture of license , and shall render the offender ineligible to apply for a license for one ( 1) year thereafter, all pursuant to the provisions of Section 495 of the General Municipal Law . Section 6 . EFFECTIVE DATE This Ordinance shall become effective : ( a) Upon approval of same by a majority of the Qualified Electors of' the Town of Dryden , voting on a Proposition therefor duly submitted at a Special Election held Id thin ' the Town as provided by Law; and ( b) Upon filing with the State Lottery Control Commission a copy of' such Ordinance , within ten ( 10 ) days after its adoption as above provided .
