PUBLIC HEARING
LOCAL LAW # 1
(PARKS & RECREATION RULES).
A Public Hearing was held at the Town of Cortland-
ville Town Hall at 7:30 P.M.
In attendance were Supervisor Nadolski; Council- •
man O'Donnell; Councilman Manning; Councilman Pierce
and Councilman Thorpe.
Also present were Town Clerk, Pauline Parker; Attorney,
John Folmer; Engineer, Charles Feiszli; Deputy Town Clerk,
June Bradshaw; Confidential Sec'y., Edna Puzo; Bookkeeper,
Joanne Phillips; Water & Sewer Sup't., Fred Walker;

The Public Hearing was opened by Supervisor Nadolski.
Councilman Manning read a proposed ordinance pre-
pared by Attorney Folmer, regulating the hours and the
use of Park and Recreation areas within the Town of
Cortlandville.
The Town Clerk read the legal notice as follows:

Supervisor Nadolski asked for comments from the
floor. It was stated that any law enforcement agency would
enforce the ordinance if, adopted.:
Councilman Manning explained the need and purpose of
the proposed ordinance.
Councilman Pierce made a motion, seconded by Council-
man Manning, to close the hearing. All voting aye, the
motion was carried.
The hearing was closed at 7:45 P.M.

A Public Hearing was held at the Town of Cortland-
ville Town Hall at 7:50 P.M.
In attendance were Supervisor Nadolski; Councilman

Federal Revenue Sharing funds to be

during the next fiscal year commenc-

approximately $45,000.00.

comments on the proposed use of

• James Larkin of Maplewood Lane requested the Town
Board to consider the petition to resurface 1.3 mile of
Lime Hollow Road,with blacktop,with the Federal Revenue
Sharing Funds.
Mr. James McNamara, Maplewood Lane, also spoke in
favor of using the funds to blacktop Lime Hollow Road. A
traffic count was recently done on that road by the State,
with the results of such unknown. He expressed concern

about the recent resurfacing of Ames Road and Hobart Hill
Road. Comparing the population and the use of those roads,
he felt Lime Hollow Road should have had priority .
Highway Sup't., Carl Eaton advised that the Lime
Hollow Road is scheduled for resurfacing next year.
The residents of the Lime Hollow Road have requested
resurfacing of the road with blacktop instead of oil and
stone. A discussion followed comparing the resurfacing
costs.
Ken Andrews, Lamont Circle, asked if more aid is
expected from the State in 1982.
No verification has been received from the State
regarding an increase of State Aid.
Richard Tupper, Lamont Circle, asked if some of the
funds could be applied to recreation.
Councilman Pierce made a motion, seconded by Council-
man Thorpe to close the hearing. All voting aye, the
motion was carried.
The hearing closed at 8:15 P.M..

A Public Hearing was held at the Town of Cortland-
ville Town Hall at 8:15 P.M..
In attendance were Supervisor Nadolski; Council-

Mr. Ken Andrews, Lamont Circle, stated that upon
reviewing the budget, he felt on honest effort was put
forth on the 1982 budget.

Questions were answered:
Funds are being set aside to purchase a sewer cleaner.
Special Assessments - Water & Sewer District, tax
notices will show a benefit charge for 1982 Water Fund -
$ 17 per single family unit charge and $ 11 per single
family unit charge. The Fire District charge will remain
the same.
New recreation area - a decision is forthcoming soon
whether to use matching fund through a grant or to proceed
on our own.
A request was received from the Water & Sewer Dept.
for a salary increase of $ 2500 each, over the 7% increase,
to bring the salary in line with the requirements of the
job.
Councilman Pierce made a motion, seconded by Council-
man Manning, to close the hearing. All voting aye, the
motion was carried.
The hearing was closed at 8:40 P.M..

Attorney Folmer advised the Board not to adopt Local
Law # 2, as it''can be accomplished by a resolution when we
get into the regular meeting.
Councilman Manning made a motion, seconded by Council-
man Pierce to close the hearing. All voting aye, the motion

The regular meeting of the Town Board of the Town
of Cortlandville was held at the Town Hall, 15 Terrace
Road, Cortland, New York with Supervisor Nadolski presiding.
Board members present were Supervisor Nadolski and
Councilman Edwin O'Donnell, Councilman Warren Manning,'
Councilman Melvin Pierce, Councilman Ray Thorpe, Town
Clerk, Pauline Parker and Attorney, John Folmer.
Others present were: Deputy Town Clerk, June Bradshaw;
Zoning Officer, Don Fowler; Justice, Don Eaton; Engineer,
Charles Feiszli; Assessor, Robert Wells; Confidential Sec'y., •
Edna Puzo; Bookkeeper, Joanne Phillips; Highway Sup't.,
Carl Eaton; Water & Sewer Sup't., Fred Walker, Newsreporters,
Dick Camerano and Jane Waldman.
Also present were residents Ken Andrews and Dick Tupper.
The following matter was discussed in between the
public hearings:
Mr. & Mrs. Joseph Homer and Mr. & Mrs. Robert Usher
McLean Rd. of the McLean Road expressed concern about the flooding
flooding situation in their area.
It was explained by the Town Board that the road in
that area is a County road, and the Town of Cortlandville
has nothing to do with that road.
County Highway Sup't., Walter Tennant, was contacted
by telephone and explained the situation. Some residents of
that area were reluctant to allow a drainage ditch to be
dug on their property, so it could not be done. He also
suggested that the Homer's and Usher's contact him.
The meeting was called to order by Supervisor Nadolski
at 8:45 PM.
Upon motion by Councilman Manning, seconded by Council-
man Pierce, the minutes of October 7, 1981 and special
meeting of October 19, 1981, were approved as written. All
voting aye, the motion was carried.
Councilman Thorpe made a motion, seconded by Council-
man Pierce to receive and file the Cortlandville Planning
Board minutes of September 29, 1981. All voting aye,
the motion was carried.
Reports of various department heads are on the table •
or may be reviewed in the Clerk's office upon request.
Hayes The Hayes Ambulance contract shall be renewed for 1982
Anbulance at $ 5,000. Information was received regarding the statistics
contract for 1981,

Councilman Manning made a motion, seconded by Council-
man Thorpe to receive and file the Hayes Ambulance Service
report. All voting aye, the motion was carried.
Councilman Thorpe made a motion, seconded by Council-
man Manning to receive and file the petitions rec' d from petitions
New York Telephone Company and New York State Electric NY Telephone
& Gas against the State Board of Equalization and Assess-
ment. All voting aye, the motion was carried.
Councilman Pierce made a motion, seconded by Council-
man O'Donnell to receive and file the SPCA report for
August, September and October 1981. All voting aye, the SPCA
motion was carried. report
A discussion was held regarding increasing the dog
licensing fees for 1982 or seizure fees so the dog program
can be self supporting. The state must be notified by
October lst. to change the fees of dog licensing. The
matter was tabled for further study.
Supervisor Nadolski apprised the Town Board of
another Animal Control Program at SU of NY Agric. & Tech-
nical College at Cobleskill. He stated he would keep
the letter until next year because the program isn't
until June 25 & 26, 1982.
A discussion was held regarding the Wright property
on the West Road, which we are in the process of purchasing.
It was the consensus of the Town Board that heat should Wright
be left on in the house during the winter. property
Supervisor Nadolski has been approached to rent the
tradler located on the property. The matter was tabled
for further study. No action was taken.
RESOLUTION # 186 SETTING DATE FOR SPECIAL MEETING
NOVEMBER 16, 1981
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe
VOTES: ALL AYE ADOPTED
BE IT RESOLVED that the meeting scheduled on Monday,
November 16, 198.1 at 4:00 P.M. is hereby cancelled and

RESOLVED. that a Special .Meeting shall be held on Monday, meeting
November 16, 1981 at 7:30 P"."M. to adopt the preliminary
budgets as the adopted budgets for 1982 in the Town Clerk's
office.

John Folmer advised that we wait .to see the results of that
case. No action was taken.
Attorney Folmer reviewed that status of roads in the
abandoned
Town which have not been used in several years. A road may
roads
be declared abandoned if it has not been used after 6
years in accordance with Highway Law, which would apply
to the easterly portion of the Hoxie Gorge Road and also
Kinney Hill Road. No action is necessary to abandon such
roads,as it just happens.
The question was asked if the Town Board has the
street
authority to change the name of a street. Attorney Folmer
name
read Section 64.9 of the Town Law which states names may
change
also be changed and altered as the Town Board may determine.
RESOLUTION # 187 AUTHORIZE LEGAL DEFENSE FOR TOWN OFFICIALS
Motion by Councilman Pierce
Seconded by Councilman Thorpe
VOTES: ALL AYE ADOPTED
WHEREAS pursuant to Chapter 277 of the Laws of 1981 it is
Legal permitted for the Town of Cortlandville to provide the
Defense indemnification and defense of public officers and employees
Town for acts performed in their public service;

BE IT RESOLVED that the Town Board of the Town of Cortland-
ville does hereby resolve to confer upon the officers and
employees of the Town of Cortlandville the benefit provided
by Chapter 277 of the Laws of the State of New York effective
on June 22, 1981.
Attorney Folmer advised that the acceptance of MacBean
Lane was done in November, 1978. The county has been
notified.

seminars. The matter was tabled for further investigation.

variance which is non -conforming and variance
WHEREAS such application has been submitted to the County

December 2, 1981 at 7c30 P.M., at the Towri Hall to Discuss
the variance application submitted by Riverside Motel.
RESOLUTION # 191 AUTHORIZE ISSUANCE OF A TRAILER PERMIT
TO STANLEY WILK

VOTES: ALL AYE ADOPTED trailer

WHEREAS an application for a trailer permit has been StanleyWilk
received, and the premises have been inspected by the
Zoning Officer, and
WHEREAS such trailer location is in residential zoning
classification and a variance is necessary, therefore
BE IT RESOLVED that the Town Clerk is hereby authorized
and directed to issue a house trailer permit to Stanley
Wilk upon payment of the proper fee, and contingent
upon approval of the Cortlandville Zoning Board of Appeals.
Said trailer to be located on the Blodgett Mills West Road,
R.D.# 2, Cortland, New York, in the Town of Cortlandville.
Councilman Pierce has had many residents in his area
of the Town complain about the proposed change of boundary

election lines of the election district. This process is changed
district every 10 years, after the census is taken, to equalize
the weighted voting in the County Legislature if the
population has changed by 5%.
Councilman Pierce will contact our Legislators to
see what can be done.
Rosen Councilman Pierce has received another complaint
junk yard regarding Rosen's junk yard on Rt. # 13. The attorney and
the zoning officer will check further on the matter.

Councilman Manning made a motion, seconded by Council-
man Pierce, to recess the regular meeting and convene to
executive session to discuss a personnel problem All
voting aye, the motion was carried.
Councilman Manning made a motion, seconded by Council-
man O'Donnell, to adjourn the executive session and recon-
vene the regular meeting. All voting aye, the motion was
carried.
Councilman Pierce made a motion, seconded by Council-
man Thorpe, to adjourn the regular meeting. All voting
aye, the motion was carried.
The meeting was adjourned at 9:.50 P.M..
