The regular meeting of the Town of Cortlandville
Town Board was held at the Town Hall, 15 Terrace Road,
Cortland, N.Y. with Supervisor Nadolski presiding.
Board members present were Supervisor Nadolski and
Councilman O'Donnell, Councilman Manning and Council-
man Thorpe.
Others present were Town Clerk, Pauline Parker;
Attorney, John Folmer; Highway Sup't., Carl Eaton;
Deputy Town Clerk, June Bradshaw; Justice, Don Eaton;
Confidential Sec'y., Edna Puzo; Zoning Officer, Don
Fowler; Water & Sewer Sup't., Fred Walker; Newsreporter,
Dick Camerano, and residents Ken Andrews, Mr. Parsons
and Mr. Warren of Lamont Circle.
The meeting was called to order by Supervisor
Nadolski at 7:30 P.M..
Upon motion by Councilman Thorpe, seconded by
Councilman Manning, the minutes of August 5, 1981 and approve
the special meeting of August 17, 1981, were approved minutes
as written. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by Planning
Councilman Manning to receive and file the Cortland- Board
ville Planning Board minutes of July 28, 1981. All minutes
voting aye, the motion was carried.
RESOLUTION # 152 AUTHORIZE PAYMENT OF VOUCHERS

® Those in attendance were given the privilege of

the floor.
Zoning Officer, Don Fowler, apprised the Town Board
of a variance request from the Riverside Motel. They variance
would like to enlarge some rooms of which is non con- Riverside
forming. The usual procedure for such request is lengthly motel

as it must be approved by several agencies.
A discussion followed whereby it was the consensus
of the.Town Board that the request be submitted .to the
County Planning Board as soon as possible, and to
expedite the process wherever possible, but usual
procedure must be taken.
Ken Andrews, resident of Lamont Circle, expressed
City concern relating to the increase of school taxes for
school Cortlandville residents of the Cortland City School
taxes District. Due to the recent assessment update completed
in Cortlandville, he had not expected this to happen.
A letter written by Assessor, Robert Wells, directed
to Supervisor Nadolski, was read. This was relating to
the Cortland City School District budget impact.
A discussion was held whereby concern was expressed
by the Town Board that if a municipality is in compliance
with State Law, and proceeds with full value assessment,
are we being penalized. It appears to be an advantage
only when the whole county goes to full value and should
be considered in the future.
RESOLUTION # 153 AUTHORIZE SUPERVISOR TO CONTACT

BE IT RESOLVED that Supervisor Nadolski is hereby
authorized and directed to contact Mr. Harvey Kaufman,
Adminstrator at the Cortland City School District, by
letter expressing concerns of this Board and invite
him to attend our next meeting.
Ken Andrews reported that he had received a letter
from Assemblyman Riford regarding the Financial Assistance
State Program. The letter explained the formula used to
Financial arrive at the amount each municipality is to receive.
Assistance Seventy -Nine Million was received in Cortland County.
Program Mr. Andrews stated that he intends to pursue the matter
further with Governor Carey. Supervisor Nadolski referred
toa recent article in the Town and County Topics stating
that the population status is increasing at town levels
according to recent studies.
The Town Clerk advised the Town Board that she was

Census The Clerk also received the certification of the
1980 Census for the State of New York.
Upon motion by Councilman Manning, seconded by
Councilman O'Donnell, the reports were received and filed.

Councilman Manning presented the report of the
Recreation Director, Joan Stypeck. He commended her for summer
a nice job done. He requested" the 'Supervisor to recreation
forward letters of appreciation -to Joan Stypeck, Mr. program
Parsons, Mr. Warren and Ken Andrews for their part in
making the summer program a success.
Supervisor Nadolski showed the trophy and pictures
of the Cortlandville boys and girls softball teams.
They both `achieved first place in their league.
This was the first year for the girls team.

apply for. funding to purchase the Wright property. Wright

Supervisor Nadolski presented the SPCA report'�fo.r
May, June & July 1.1981 The 'SPCA has.requested a meeting SPCA
to discuss the town contributing funds for the care of report &
cats at their shelter. It was the consensus of the request
Town Board that our responsibility.is to Article 7
of the Agriculture and Markets Law which does not include
cats. The Town Board requested the 'Superviso..to meet
with Robin Remik and.advise of such.
Councilman Manning made a motion,.seconded by
Councilman O'Donnell to receive and file. the SPCA report.
All,voting aye, the motion was carried.
Reports of various department heads are on the
table -or may be reviewed in the Clerk's office upon request.
Councilman Manning requested the status of the
Recreation ,grant.

.Adiscussion followed whereby it was decided to Grant
present the program to the public through the news media
and then have an hearing for the public to express their
opinions and proceed from there.
Supervisor Nadolski had received information regarding
State Building Code -,`which we have adopted, and the State
State Fire Prevention Code_. He will give this to our Codes
Zoning Officer to review. It will be necessary to adopt
the fire code in the future.
The final papers needed to complete the bonding of
Sewer Distr.ict,# 2 - McLean Road Trunk Line Sewer have Bonding
been forwarded to FHA. This should be completed soon. Sewer
Supervisor Nadolski apprised the Town Board that
we are now _full members of the Upstate Municipal Risk members
Associa-Gion, and shall take advantage of their recommend- Risk Assoc.

RESOLUTION # 154 AMEND RESOLUTION # 138 OF AUGUST

BE IT RESOLVED that Resolution.# 138, adopted August
Well # 3 5, 1981 is hereby amended to read:
That the necessary funds needed to handle the
emergency in Well # 3 shall be transferred from
Water District # 1, surplus funds, unappropiated
fund balance, and not the contingent account.

authorized and directed to transfer $ 3,000. from
Water District # 3, unappropiated fund balance to
Water District # 3 - SW8340.4, and expended for the
purpose of relocating the water lines on McLean Road.

BE IT RESOLVED that the Budget Officer is hereby authorized
person23:�l and directed to transfer $ 1,000 from General Fund A,
Justice A1990.4, Contingent Account to Justice, Personal
Services, A1110.1 to pay the salary of Cheri Hubbard,
who works three hours per day for minimum wage and
the total of her salary shall not exceed $ 1,000.
A, letter received from Mr. Donald Niver, Village
McGraw of McGraw Mayor was read. Upon completion of their
trunk line sewer, they would allow those Cortlandville
sewer residents living along Route 41 and Route 11 to hook up
project to the sewer line. An agreement will be worked out with
them concerning this at a later date.
Supervisor Nadolski advised that anyone connecting
would pay the connection fees plus sewer use charge to the
Village of McGraw. Polkville residents :etc.., would
have to make request to our board first and then we would
request McGraw to acknowledge the request.

BE IT RESOLVED that the request from the Village of
McGraw to be wholly exempt for their property used for
the trunk line sewer shall be turned over to the
Assessor to be reviewed and determine eligibility.
Councilman Manning made a motion, seconded by Council-
man Thorpe, to receive and file the Cortland County County
Community Disaster Plan. All voting aye, the motion Disaster

RESOLUTION # 158 AUTHORIZE LETTERS - SUCCESS OF
RECREATION PROGRAM
Motion by Councilman Thorpe
Seconded by Councilman Manning
VOTES: ALL AYE ADOPTED
BE IT RESOLVED that Supervisor Nadolski is hereby
authorized and directed to forward letters to Joan
Stypeck, the Cortland County Jaycees and Robert Bean
for their assistance in the success of our recreation
program for this summer.
Supervisor Nadolski requested the Town Board
to act on compensating the Deputy Supervisor for the
timehe serves in the absense of the Supervisor,
retroactive to 1978.
Councilman Thorpe made a motion, seconded by
Councilman O'Donnell, to table the matter to allow
the attorney time to investigate further.
RESOLUTION # 159 AUTHORIZE FIRST NATIONAL BANK TO
COLLECT TOWN TAXES

VOTES: ALL AYE ADOPTED
BE IT RESOLVED that the First National Bank of Cortland
is hereby authorized to handle the collection of town
taxes for Cortlandville.

PARKS

VOTES: ALL AYE ADOPTED
BE IT RESOLVED that a public hearing shall be held on
October 7, 1981 at 7:30 P.M. at the Cortlandville Town
Hall to establish hours and allowed beverages for
Cortlandville Parks, and if adopted shall be Local Law
# 1 of 1981.

The Village of McGraw now has an Open Container
Law which applies to their park area. Beverages are
permitted but an application must be submitted for a
permit for the privilege. Attorney Folmer will
investigate further.
RESOLUTION # 161 AUTHORIZE SUPERVISOR TO SIGN
APPLICATION FOR YOUTH STATE AID
RECREATION PROGRAM

VOTES: ALL AYE ADOPTED
Youth BE IT RESOLVED that the Supervisor is hereby authorized
State Aid and directed to sign the application for the NYS
application Division for Youth to apply for State Aid for Youth
Programs for 1982, and forward to the necessary agencies.
Supervisor Nadolski has received the survey map of
survey the property owned by Marsie E. Wright.
Wright Upon motion by Councilman O'Donnell, seconded by

Attorney Folmer has been advised that the Sewer
Sewer Contracts for the City of Cortland are in the process
Contracts of being typed. The formulas have been developed
by the City's engineer, and will be available soon.
RESOLUTION # 162 TRANSFER OF PETTY CASH FUNDS

VOTES: ALL AYE ADOPTED
WHEREAS the Town Clerk now has a total of two petty
petty cash funds, $200 each, designated for Tax Collecting
cash and Custodian, and

to the custodian.

and directed to sign the assignments of the Fire Protection
Contracts with the Village of Homer, and the Village of
McGraw, to the Fire District.
Attorney Folmer has made the first appearance in Hoxie Gorge
court in regards to the Hoxie Gorge law suit. More law siut
paperwook must be -submitted and a hearing will be held
in the future.
® Ken Andrews of Lamont Circle expressed concern of
the Town of Cortlandville having to pay for construction ThTreatarecost

cost of the City of Cortland Sewer Treatment Plant. Plant
Attorney Folmer explained that we have agreed in our
negotiations with the City that we would pay a fair
share of maintenance and operation of the plant, but
not construction cost.
Water & Sewer Sup't, Fred Walker, expressed concern
of repairing the motor of Well # 3. He was advised repair
that the someone should be here Monday morning to start Well #3
the repairs.
Councilman Manning made a motion, seconded by adjourn
Councilman Thorpe to recess the regular meeting and
enter into executive session. All voting aye, the
motion was carried.
Councilman Thorpe made a motion, seconded by
Councilman O'Donnell to adjourn the executive session
and reconvene the regular meeting. All voting aye,
the motion was carried.
