HomeMy WebLinkAbout1961-06-07 358 June 7 , 1961 The regular monthly meeting of the Dryden Town Board was called to order by Supervisor Gridley at 8 : 00 p . m . Present were Clm . Baker and Saltonstall , Justices Hoagland and Spaulding , Hwy . Supt . Beach , Asst . Hwy . Supt . Case , Atty . Williamson , and , later , Assessor Abrams . Mr . Leonard C . Bacon , N . Y . State Building Code representative was present to discuss the state Building Code . His remarks and the following discussion included the following information : Under Sec . 383 of the Executive Law the code can be accepted by a simple resolution - and , subsequently , if it does not prove useful it also can be removed by a simple resolution . The code is designed to be permissive rather than restrictive , and to set standards for_ all types of buildings humanly occupied ( does not include farm buildings , but does includersuch buildings as g arages that are 'secondary to residences ) . The code must be accepted as a whole - not in parts . The standards are minimum requirements , but also will protect the property owner and the community on the type of construction being done . It cannot help conditions that already exist , but can protect future building . It also will give a record of new construction and changes , with costs , which is an advantage in keeping tax rolls to date . The State office keeps research current on construction procedures , and will give recommendations on construction : It is simple to administer , with a detailed check list as a guide to find requirements for the particular type of building . In some communities it is handled by the city e ngineer or the assessor , and in some by a separate office . The code does not cover situations such as a concern coining into a community to do roofing or similar jobs , because that is not construction . However , if control is desired for protection of property owners , in the administration of the code a requirement for permits for this kind of work can be added . This matter was referred by Supervisor Gridley to the Committee on Buildings and Grounds for further study . Three representatives of the Neptune Hose Co . Inc . were present to discuss possibility of amending their contract ( see minutes o f Dec . 6 , 1960 - pg . 345 ) . Clm . Saltonstall offered the f ollowing resolution and moved its adoption : He it Resolved that at budget hearing time , in the fall of 1961 , a public hearing be held to amend the contract with Neptune Hose Co . Inc . with an increase of $ 500 . 00 per year for the last three years of the contract ( 1963 , -64 , and -65 ) , it being the understanding that said amendment is by mutual consent of the Town Board of Dryden and the Neptune Hose Co . Inc . . Resolution seconded by Clm . Baker . Roll call vote , all voting YES . Moved by Clm . Saltonstall , seconded by Justice Spaulding , that G eneral Bills totaling $ 2760 . 66 be paid as audited . Roll call ✓ ote , all voting YES . Moved by Clm . Baker , seconded by Justice Hoagland , that Highway bills totaling $ 9244 . 04 be paid as audited . Roll call vote , all voting YES . Application of Robert Wing for temporary junk yard license was read , and approved for a one year period . The other three owners who have failed to apply for temporary license are to receive another letter , asking that the application be submitted within 20 days . Moved by Clm . Baker , seconded by Justice Hoagland , that the slate of Ins ect r of Election , submitted by the Republican Partty , /kida� lfR M ch as the Democratic Party has suggested the same slate as last year , the same be accepted . 'Saltonstall , that Charles Downey and Charles McGory be appointed custodians of the ✓ oting machines for the Town of Dryden , at a remuneration not to e xceed $ 70 . 00 each . Motion carried and so ordered . Moved by C1m . Baker , seconded by Clm . Saltonstall , that the Inspec - tors of Election receive the same salary as last year - $ 14 . 00 . for E lection Day , $ 1 . 00 plus 8 ¢ per mile one way for the school of in- struction meeting , and $ 1 . 00 per hour for registration days . Motion carried and so ordered . ' Supervisor Gridley advised that Mr . Taathilx], of 'N . Y . S . Electric and Gas , had 'l inquired whether the Town of Dryden now would be in- terested in the right of way previously discussed for the Baker H ill Road , if there werenno limitations on it . It was agreed that there was no ' need for action at this time , singe,latt. o1' athe_ ',Mt ; h as been set up on the Erwin Plan . (pleasant Rd . already) Atty . Williamson reviewed reply from Atty . General ' s office re : TV franchises . ( ', See correspondence file - 1961 ) Such a franchise cannot be in perpetuity , but for a " reasonable length of time " ; it can be e xclusive or ' not ; and the Public Service Commission has no jurisdiction . In discussion of the question of controlling number of poles , Atty . Williamson suggested that a franchise agreement could include under- standing that cable owner tty to negotiate with utilities to utilize e xisting poles insofar as possible .
