Page 1 approve minutes The regular meeting of the Town of Cortlandville Town Board was held at the Town Hall, 15 Terrace Road, Cortland, N.Y. with Supervisor Stanley Nadolski presiding. Board members present were Supervisor Nadolski and Councilmen O'Donnell, Manning, Pierce and Thorpe. Others present were Town Clerk, Pauline Parker; Attorney,, John Folmer; Highway Sup't., Carl Eaton; Engineer, Charles Feiszli; Deputy Town Clerk, June Bradshaw; Zoning Officer, Don 'Fowler; Assessor, Robert Wells; Justice, Donald Eaton; and Newsreporters Tim Fox and Dick Camerano. Also in attendance were Robin Remick, Manager of the SPCA and Ken Andrews. The meeting was called to order by Supervisor Nadolski at 7:30 P.M. Upon motion by Councilman O'Donnell, seconded by Councilman Thorpe, the minutes of April lst and April 20th , 1981 were appr,©ved- as-wr tt:en . Planning Councilman Manning made a motion, seconded by Board Councilman Pierce to receive and file the Planning Board minutes of March 30, 1981. All voting aye, minutes motion was carried. RESOLUTION # 82 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman O'Donnell payment of Seconded by Councilman Pierce vouchers VOTES: ALL AYE ADOPTED BE IT RESOLVED that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers # 151-186 $11,155.89 Highway # 66-82 6,091.84 Water District # 1 # 38-46 9,2o6.62 Water District # 3 # 3-5 303.91 Water District # 4 # 2-3 7,478.71 Sewer District # 1 # 8 35.31 Sewer District # 2 # 5 6.25 Councilman Pierce made a motion, seconded by SPCA Councilman O'Donnell. to receive and file the SPCA report report of March 1981. All voting aye, motion was carried. Attorney Folmer explained the need of amending Section 10-A and Section 13 of the Dog Ordinance, which has been requested by the SPCA. RESOLUTION # 83 SETTING DATE FOR PUBLIC HEARING -- Public AMENDING DOG CONTROL ORDINANCE Hearing dog ord. BE IT RESOLVED that a Public Hearing shall be held at the Town.Hall on Tuesday, May 19, 1981 at 7:30 P.M. in regards to amending the Cortlandville Dog Control Ordinance. Councilman Manning made a motion, seconded by Councilman O'Donnell, to receive and file the SPCA report of April, 1981. Highway Sup't, Carl Eaton, advised that the flag, located at the intersection of Rt. # 281 and Rt. # 13 needs to be replaced. Supervisor Nadolski will see that it is replaced. All voting aye, motion was carried. A letter from Architects -Engineers, Quinlivan, Pierik & Krause relating to remodeling or preservation of buildings was reviewed. Councilman Pierce made a motion, seconded by Councilman O'Donnell to receive and file the letter. All voting aye, motion was carried: The Cortland County Health Dept. advised, by letters, of the completion of a course -in Water Supervisor Management from Michigan State University by Fred Walker, Sr. and Fred Walker, Jr. They were commended for taking the course. Councilman Pierce made a motion, seconded by Council- man O'Donnell, to receive and file the letters. All voting aye, the motion was carried. A letter received from Texaco, Inc. advised they '— Texaco would not supply gasoline in this area after April 30, 1981. Sewer#2 Approval was received from FHA to rebuild the meter pit meter pit in Sewer District # 2. Councilman Pierce made a motion, seconded by Councilman Thorpe, to receive and file the letter. All voting aye, the motion was carried. Supervisor Nadolski apprised the board that we. are in the position to close our contract within the next month with FHA. A letter was received from the Association of state Towns suggesting letters be sent to all State Legisla- revenue tones requesting them to restore state revenue sharing. sharing Supervisor Nadolski responded to the request. Engineer Feiszli reported.on the problems of Well Well #3 # 3• The TV pictures taken showed nothing. Development of the well was needed and started. Large stones appea.dd to be coming through the screen, so another screen was placed. The well is now being tested, and the capacity has increased considerably. The pump has been damaged because of the stones and will have to be replaced. Due to the cost, it was decided to purchase a rebuilt pump, as was recommended by the engineer. Estimated costs were submitted ranging from $5400 to 6555• A submersible pump would be approximately 9500. Engineer Feiszli recommended staying with the existing size pump, and someday investigate for another site, rather than having all the wells at one location. M Wednesday; May 6, 1981 Page 4 RESOLUTION # 84 AUTHORIZE PROCEDURES WITH WELL # 3 Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that authorization is hereby given to repair proceed with a responsible pump company, for the necessary Well #3 repair of Well # 3, to put it back into operation as soon as possible to prevent further complications. • RESOLUTION # 85 AUTHORIZE ATTORNEY TO CONTACT CARLTON POTTER -- PERFORMANCE BOND Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS, per Resolution # 136 of September 5, 1979, Carlton Carlton Potter presented a Performance Bond in the amount Potter - of $ 500, to be held until a corrected right hand water Performance valve was installed and approved, and Bond WHEREAS the corrected valve was installed by Water & Sewer Sup't, Fred Walker, and the charges of backhoe, labor and materials for such services were billed to Carlton Potter in the amount of $ 195.00, and WHEREAS the amount charged has not been paid due to a misunderstanding, therefore BE IT RESOLVED that Attorney Folmer is hereby authorized and directed to contact Carl -ton., Potter and discuss an agreero tof the charges, and proceed to finalizing the return of.the Performance Bond. A representative of Henco Inc. has provided information regarding ways of raising funds -to defray recreation expenses for uniforms and equipment for the recreation fund program. Councilman O'Donnell and Councilman Manning raising volunteered to serve as a committee to investigate further. Supervisor Nadolski reported to the Board of his contact with the residents of Pleasantview. He has Pleasantview talked with many of the residents there. The houses are lower than the road which causes the water to flow in that manner during heavy rains, especially those that have put in asphalt driveways. ® A discussion followed; whereby the Town Board requested the Supervisor to invite the residents of that area to - the next meeting. Different alternatives would be presented and constructive ideas for consideration would be welcomed. Numerous people coming into Town Hall have problems locating the Justice's office. Thy matter will be invest- igated further. Wednesday, May 6, 1981 Page 5 RESOLUTION # 86 REAPPOINT WARREN E. BARTH TO BOARD OF ASSESSMENT REVIEW WarrenBarth Motion by Councilman Thorpe reappointed Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT RESOLVED that Warren E. Barth is hereby reappointed to a five year term of the Board of Assessment Review, such term shall expire April 30, 1986. RESOLUTION # 87 INVESTIGATE STATUS OF PETER MORENUS is Peter TO TOWN AND COUNTY COUNCIL Morenus environmental Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the status of Peter Morenus, on the two Environmental Council's, Town and County, be explored, and proceed with=Whatever is necessary to have continuity of the office. RESOLUTION # 88 AUTHORIZE SUPERVISOR TO EXECUTE CONTRACT - RE:MUNICIPAL PARK t r Conttact ConracMotion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Supervisor._ is hereby authorized and directed to execute the contract for the Federal Grant -In -Aid with Central New York State Park and Recreation Commission for the Cortlandville Municipal Park. A discussion was held regarding hiring consulting engineers to develop the proposed plans and specs for Muni -Park the Cortlandville Municipal Park. Engineer Feiszli had completed the application and the necessary forms to apply for the funding to get the project started. Councilman Manning expressed concern if Engineer Feiszli had enough time to follow through on the project. The recreation committee recommends that consulting engineers be hired and allow the town engineer to act as "clerk of the works". Supervisor Nadolski apprised the town board that our engineer is anticipating taking a position with a private consulting firm at the end of May, but would consider working for the Town for 2 hours a day. RESOLUTION # 89 AUTHORIZE RECREATION COMMITTEE TO PURSUE COST OF ENGINEERING -MUNICIPAL PARK engineer's Motion by Councilman O'Donnell Muni -Park Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Recreation Committee is hereby authorized and directed to pursue the cost and proposals of consulting engineers regarding the Cortlandville Municipal Park and report back to the Town Board with a recommendation. 1 • 1 Wednesday, May 6, 1981 Page 6 91 Attorney Folmer, in checking,found that Peter Morenus had been appointed to the Cortlandville Environmental Council per Resolution # 73, adopted April 1, 1981. It has been in the paper that Mr. Morenus was appointed to the County Environmental Council by the County'Legislature. RESOLUTION # 90 ACCEPT PROPOSAL FROM ENGINEER- CHARLES FEISZLI • Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT RESOLVED that the proposa submitted by the engineer, Charles Feiszli, is hereby acce ted, with the execption of that portion dealing with fringe benefits, and RESOLVED that Attorney Folmer shall investigate the fringe, benefits portion, and report to the Town Board for a decision. A discussion regarding funding of the Cortlandville Municipal Park occured. The matter was tabled until the attorney had the opportunity to review the contract. RESOLUTION # 91 AUTHORIZE REQUEST FORWARDED, TO LOWER -SPEED LIMIT ON McLEAN ROAD Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Town Clerk is hereby authorized and directed to sign and forward a request to the County Highway Dept., and request that such be forwarded to New York State Dept. of Transportation.', lovrer the speed limit on the McLean Road to have a uniform speed limit of 35 miles per hour in both directions in the area of Cortland Wood Products and Gutchess Lumber Company. RESOLUTION # 92 AUTHORIZE HIRING - MIKE DARLING - MOW LAWN - LAMONT CIRCLE Feis zli proposal McLean Road - speed limit Motion by Councilman Manning Lamont isSeconded by Councilman Pierce Circle VOTES: ALL AYE ADOPTED mow lawn BE IT RESOLVED that the Town Board hereby authorizes the hiring of Mike Darling, age 16, to mow the lawn at the Lamont Circle Park,_and shall be paid $10.00 per mowing. Supervisor Nadolski volunteered to contact Mr. Camerano, of the Cortland Standard, and request him to write an article in the paper regarding dogs running at large. I r) Wednesday, May 6, 1981 Page 7 ins-.irance proposal trailer permit application water & sewer connections correction of water & sewer mills RESOLUTION # 93 AUTHORIZE SUPERVISOR TO GET PROPOSAL FOR BIDS FOR INSURANCE POLICIES Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Supervisor is hereby authorized and directed to contact Warren Barth to request him to prepare an insurance proposal for the Town of Cortland- ville to go out for bids on the insurance policies. • RESOLUTION ## 94 AUTHORIZE ISSUANCE OF A TRAILER PERMIT TO HELLER FARMS Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED WHEREAS an application for a trailer permit has been received, and the premises have been inspected by the Zoning Officer, therefore BE IT RESOLVED that the Town Clerk is hereby authorized and directed to issue a house trailer permit to Heller Farms upon payment of the proper fee. Said trailer to be located on the Monroe Road, R.D.## 1, McGraw, New York, in the Town of Cortlandville. RESOLUTION # 95 DENY JERRY TRUMAN APPLICATION TOWN WATER AND SEWER CONNECTIONS Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS an application was submitted by Jerry Truman of Jerry's Excavating, for approval, for making water and sewer connections in the Town of Cortlandville, and WHEREAS the application did not state plumber qualifications, therefore BE IT RESOLVED that the application submitted by Jerry Truman is hereby denied. RESOLUTION ## 96 AUTHORIZE CORRECTION OF MARJORIE O'DELL WATER AND SEWER BILLS • Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS an error was made when the meter was read in December, and a correction has been requested by Richard O'Dell, and WHEREAS in reviewing the account, errors were made in the past, therefore BE IT RESOLVED that Marjorie O'Dell be rebilled for water and sewer charges, showing such corrections, and the penalty shall be waived and allowed 30 days to pay the corrected charges, as recommended by the engineer. Wednesday, May 6, 1981 Page 8 Supervisor Nadolski reported to the Town Board of varying interest rates available at various banks as per interest resolution #22 adopted January 7, 1981. rates - Attorney Folmer referred to Section 29 of the Town banks Law which allows the Supervisor to deposit monies of the town as directed by the town board. Supervisor Nadolski requested Councilman Pierce concession and Thorpe to assist Highway Sup' t . , Carl Eaton, to highway trucks investigate the advantages of converting highway trucks • from gasoline to propane gas. The girls of the Lamont Circle area have requested a girls softball team and the necessary equipment. girls It was the consensus of the board that they should softball be allowed to have a team if there were enough funds available. Recently, damage occurred at the park in Lamont Circle because of cars entering the area. It was recommended that a gate, with a lock, be placed at the entrance of the park. It was also suggested that signs be posted stating hours that the park would be open. Supervisor Nadolski apprised the Town Board that a real estate firm has contacted.him about land for sale adjoining the Municipal Bldg. on the north side. This consists of 2 acres and has a house, a trailer and a building out back. They are asking $ 60,000 but would negotiate. Supervisor Nadolski requested that all board members work as a committee to investigate this further as this could be of value to the recreation park. No action was taken. Justice Eaton has requested more help in his office es the CETA girl working there has left. Supervisor Nadolski contacted the CETA director, and another CETA person is working in his office, at no expense to the town. Supervisor Nadolski apprised the Town Board of a meeting with two representatives from NYS Dept. of Transportation. The speed limit between the City of Cortl.nd and the intersection at Route # 281 will be reduced to 45 MPH. A request was received by DOT from the former super- visor to redesign the intersection of Starr Road and Route # 90 to eliminate the accidents which have occured there. Webb Rd Highway Sup't., Carl Eaton will contact Walt sign Tennant, as that is a county road. Attorney Folmer advised the Supervisor not to sign the contract regarding the Municipal Park due to the Muni -Park time limit involved and funding must be established. -The contract matter will be explored further. Councilman Manning made a motion, seconded by • adjourn Councilman Pierce to recess the regular meeting and go into executive session to discuss the Sewer Contract which is in litigation.
