PUBLIC HEARING
DISSOLUTION OF EXISTING SPECIAL
SEWER IMPROVEMENT DISTRICTS
The public hearing was called to order by Super-
visor Nadolski at 7:30 P.M.
In attendance were Supervisor Nadolski; Council-
men Pierce, Manning, Thorpe and O'Donnell. Also Town
Clerk, Pauline Parker; Attorney, John Folmer and several
employees and residents.

IN THE MATTER
OF
The dissolution of existing special
Sewer Improvement Districts in the
Town of Cortlandville, Cortland Coun-
ty, New York, Pursuant to Section
209-r of the Town Law
WHEREAS, in accordance with the
provisions of Section 209-r of the Town
Law, it has been proposed that the
public interest will be served by
dissolving alf of the special sewer im-
provement districts wholly located in
the Town of Cortlandville, Cortland
County, New York, and managing,
maintaining, operating and repairing
as a Town'function, any improvement
or service provided or authorized to
be provided by said districts; and
WHEREAS, it is proposed that
upon such dissolution of said special
sewer improvement districts, the
costs of any improvement provided or
authorized to be provided by such
districts, including the principal of
and interest on any bonds or other
obligations authorized to be issued for
the purposes of such districts, or .
which have been issued for the pur-
poses of such district and are oufstah-
ding and unpaid as of the date of such
dissolution, shall be borne by the en-
tire area of the Town outside of
i villages, all of the lands within such
area being determined to be lands
benefited by such improvements,
such costs to be assessed, levied and
collected from the several lots or
parcels of land within the Town out-
side of Villages in just proportion to
the amount of benefit which the im-
provements shall confer,;upon such
lands or parcels; and
WHEREAS, in the event of such
dissolution the cost of the manage-
ment, maintenance, operation and
repair of such improvements or ser-.
vices provided or authorized to be
provided by such districts shall
thereafter be a charge upon the entire "
area of the Town outside of Villages
and shall be levied and collected in
-the same manner and at the same
time as other Town charges; and —
WHEREAS, it is now desired to
conduct a public hearing on the pro-
posed dissolution of said districts pur-
suant to Section 209-r of the Town
Law; and
WHEREAS, it being required by
said Section that any resolution
adopted subsequent to such hearing
shall specifically state that the cost of
the management, maintenance,
operation and repair of any improve-
ment or service provided authorized
to be provided shall thereafter be a
charge upon the area of the Town out-
side in any Villages and shall be
levied and collected in the same man-
ner and -at the same time as,other
Town charges, but it further appear-
ing that Subdivision 3 of Section 209-r
of the Town Law provides that the
Town Board may establish sewer
rents and water rates as provided by
law, and it being the intention of the
Town Board in the event the said
Attorney Folmer explained the
order. The existing districts would
be.dissolved and the function of those
districts would be provided as a town
function.
Supervisor Nadolski explained
that this would be set up in accord-
ance with Town Law, as a benefit
district - not ad valorum. The service
must be available to the property
owner to be charged.
The tape is on file in the Town
Clerk office and is available upon
request.
The public hearing was closed
at 8:05 P.M.

NOW, on motion of Councilman
Pierce and seconded by Councilman
O'Donnell, it is hereby
ORDERED, that the Town Board of
the Town of Cortlandville, Cortland
County, New York, shall meet and
hold a public hearing in the meeting
room, Town Hall, Terrace Road,
Town of eortiandville, Cortland Coun-
ty, New York, on the 1st day of April,
1981, at 7:45 o'clock p.m., Eastern
Standard Time, on that day to con-
sider whether or not it is in the public
interest to dissolve the following
I special sewer improvement districts
in said Town: Being all of the special
sewer, improvement districts
heretofore established in said Town
and including, but not limited to, the
special sewer improvement districts
designated'as follows:
Cortlandville Sewer District No. 1
Cortlandville Sewer District No. 2
and to hear all persons interested in
the subject thereof concerning the
same and to take such further action
upon said proposal as is required by
I law: and it is
FURTHER ORDERED{ that in the
event the proposed dissolution of the
aforesaid improvement districts is
i determined to be the public interest,
the basis of apportioning, levying and
assessing of improvement costs and'
the cost of the management,
maintenance, operation and repair of
such improvements or services pro-
vided or authorized to be provided by
said districts shall be as described in
the preambles hereof: and it is
FURTHER ORDERED, that notice
of said public hearing shall be proved-
ed by publishing at least ten but not
more than twenty days before such
hearing a copy of this order in the
Cortland Standard, the , official
newspaper, of said Town, and; by
posting a copy of this order on,.the-
Town sign board in the'Town Hall,
Terrace Road, Town of Cortlandville,
Cortland County, New York; and it

The regular meeting of the Town of Cortlandville
Town Board was held following the public hearing at the
Town Hall, 15 Terrace Road, Cortland, N.Y. with Super-
visor Nadolski presiding.
Board members present were Supervisor Nadolski
and Councilmen O'Donnell, Manning, Pierce and Thorpe.
Others present were Town Clerk, Pauline Parker;
Attorney, John Folmer; Justice, Don Eaton; Engineer,
Charles Feiszli; Highway Sup't., Carl Eaton; Water &
Sewer Sup't., Fred Walker; Deputy Town Clerk, June
Bradshaw; Zoning Officer, Don Fowler; Assessor, Robert
Wells, and Newsreporters Dick Camerano, Tim Fox and
Eric Schutts. Town residents in attendance were Ken
Andrews, Ed Brown, Ray Bingham and Howard Rew.
The meeting was called to order by Supervisor
Nadolski at 8:20 P.M.
Upon motion by Councilman Manning, seconded by
Councilman Pierce, the minutes of March 4th, March 16th
and March 18th, 1981 were approved as written. All
voting aye, the motion was carried.
RESOLUTION # 69 AUTHORIZE EXTENSION FOR TAX COLLECTION
TO JUNE 1, 1981

BE IT RESOLVED that the Supervisor is hereby authorized
and directed to sign the application for the extension
tax of time for the Tax Collector of the Town of Cortlandville,
collection to collect taxes until June 1, 1981.

Planning man O'Donnell to receive and file the Planning Board
Bd. minutes minutes of February 23, 1981. All voting aye, motion
was carried.
Councilman Manning made a motion, seconded by Counil-

report of the McGraw Fire Department.

Those in attendance were given the privilege of the
floor.
Councilman O'Donnell made a motion, seconded by
Councilman Thorpe, to receive and file the letter from
Larsen Engineers in regards to fluoridation adjustment.
All voting aye, the motion was carried.
Complaints have been received regarding dumping
at the railroad site on the Kellogg Road.
Supervisor Nadolski has contacted the County Highway
Depit. and the Health Dept. He was advised that the county
will take care of it soon.
Highway Sup't., Carl Eaton, reported that the drains
have been cleaned, but will not correct the problem at
Pleasantview Drive. He suggested making a ditch on each
side and filling with stone.
Supervisor Nadolski will contact the residents on
Pleasantview to get their opinion.

Engineer Feiszli reported that several well drillers
repair
were contacted and quotes were received.
A contract was entered into, from the lowest quote,
to observe the happenings inside the well. The pump was
pulled, and a TV rig was placed inside the well.
Pall Trinity Micro has been contacted and advised
that we are working on the well.
Mr. Ray Bingham, a representative of the Cortland
County Federation of Sportsmans Club Inc., reported on the
increasing of
proposed increase of licensing fees for sportsmen.

The NYS Conservation Council recommended that they
licensing
would go along with the increase of licensing fees with
fees
the stipulation that they allow the NYS Council the control
of fish and wildlife services.
The Cortland County Federation of Sportsmans Clubs
Inc. passed a resolution supporting the license increase
if the creation of a Fish and Wildlife Commission was
also to be adopted.
The NYS Conservation Council recently reported that
the proposal for the increase of licensing fees was
defeated in committee for lack of support. Further action
is not anticipated until 1983.

CORTLANDVILLE ENVIRONMENTAL COUNCIL

RESOLUTION # 74 AUTHORIZE PAYMENT FOR PORTION OF
COST TO STUDY CONRAIL '

WHEREAS Conrail has proposed an abandament of a section
of their railroad in Broome County, and
WHEREAS a feasibility study is being done, with the cost
of such study being shared by three counties: Broome,
Cortland and Onondaga at an estimated cost of $ 6,000
and the share of Cortland County being shared as follows:
City of Cortland $990.00
Town of Cortlandville 350.00
Village of Homer 500.00
Village of Marathon 160.00
THEREFORE, BE IT RESOLVED that the Supervisor is hereby
authorized and directed to forward -$ 350., as the Town of
Cortlandville's share, to the Cortland County Treasurer,
who in turn will forward the total county share to the
proper agency.
RESOLUTION # 75 AUTHORIZE FORWARDING THE VILLAGE OF
HOMER FIRE CONTRACT TO AUDIT AND CONTROL

on the renovation of the Fire Station at the Municipal
Building.

RESOLUTION # 76 AUTHORIZE DISSOLVING ALL OF THE SPECIAL
SEWER IMPROVEMENT DISTRICTS IN THE TOWN
OF CORTLANDVILLE, CORTLAND COUNTY, NEW
YORK, PURSUANT TO SECTION 209r OF THE
TOWN LAW

WHEREAS, in accordance with the provisions of Section 209-r
Dissolving of the Town Law, it has been proposed that the public interest
Sewer will be served by dissolving all of the Special Sewer •
Districts Improvement Districts wholly located in the Town of
Cortlandville, Cortland County, New York; and
WHEREAS, a public hearing was duly called, held and con-
ducted by the Town Board of said Town at the Town Hall,
Terrace Road, in the Town of Cortlandville, New York, on
the lst day of April, 1981 at 7:30 o'clock P.M., Eastern
Standard Time, in connection with the dissolution of said
Sewer Districts; and
WHEREAS, all persons interested in the subject matter
thereof.w.ere afforded the opportunity to be heard; NOW,
THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Cortlandville,
Cortland County, New York, as follows:
Section 1. It is hereby determined that it is in the
public interest to manage, maintain, operate and repair as
a Town function, all of the improvements and services
provided or authorized to be provided by all of the Special
Sewer Improvement Districts in the Town of Cortlandville,
Cortland County, New York, which have been heretofore
established in the said Town of Cortlandville, including,
without limiting the generality of the foregoing, the
following enumerated Districts:
Cortlandville Sewer District No. 1
Cortlandville Sewer District No. 2
Section 2. All of the aforesaid Districts are hereby
dissolved pursuant to Section 209-r of the Town Law.
Section 3. It is hereby further determined that the
costs of any improvement provided or authorized to be
provided by said Districts including the principal of and
interest on any bonds or other obligations authorized to
be issued for the purposes of such Districts or which
have been issued for the purposes of such Districts and
are outstanding and unpaid as of the date of such dissolution,
shall be borne by the entire area of the Town of Cortland-
ville outside of Villages, all of the lands within such •
area being determined to be the lands benefited by such
improvements and such costs.shall be assessed, levied
and collected from the several lots or parcels of land
within said Town of Cortlandville outside of Villages in
just proportion to the amount of benefit which the improve-
ments shall confer upon such lots or parcels.
Section 4. It is hereby further determined that the.

cost of management, maintenance, operation and repair
of all improvements or services in the aforesaid Districts
shall, after such dissolution, be a charge upon the area
of the Town of Cortlandville outside of Villages and shall
be levied and collected in the same manner and at the
same time as other Town charges, provided that it is
the intention of the Town Board that such costs will be
raised -in the first instance from sewer rates, charges
and fees.
Section 5. The aforesaid Districts shall be dissolved
as of the First day of January, 1982.
® Section 6. This resolution is adopted subject to
permissive referendum in accordance with the provisions
of subdivision 2 of Section 209-r of the Town Law.
The question of the adoption of the foregoing resol-
ution was duly put to vote, said vote being unanimous
in favor thereof.
The resolution was thereupon declared duly adopted.

WHEREAS, in accordance with the provisions of Section 209r
of the Town Law, it has been proposed that the public
interest will be served by dissolving all of the Special
Water Improvement Districts wholly located in the Town Dissolve
of Cortlandville, Cortland County, New York.; and Water
Districts
WHEREAS, a public hearing was duly called, held and con-
ducted by the Town Board of said Town at the Town Hall,
Terrace Road, in the Town of Cortlandville, New York, on
the lst Day of April, 1981 at 8:15 P.M., Eastern Standard
Time, in connection with the dissolution of said Water
Districts; and
WHEREAS, all persons interested in the subject matter
thereof were afforded the opportunity to be heard; NOW,
THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Cortlandville,
® Cor-Ua,nd County, New York, as follows:
Section 1. -It is hereby determined that it is in the
public interest to manage, maintain, operate and repair
as a Town function, all of the improvements and services
provided or authorized to be provided by all of the Special
Water Improvement Districts in the Town of Cortlandville,
Cortland County, New York, which have been heretofore
established in the said Town of Cortlandville, including,
without limiting the generality of the foregoing, the
following enumerated Districts:

Cortlandville Water District No.3
Cortlandville Water District No.4•
Cortlandville Water District N0.5
Section 2. All of the aforesaid Districts are hereby
dissolved pursuant to Section 209r of the Town Law.
Section 3. It is hereby further determined that
the costs of any improvement provided or authorized to
be provided by said Districts including the principal of •
and interest on any bonds or other obligations authorized
to be issued for the purposes of such Districts or which
have been issued for the purposes of such Districts and
are outstanding and unpaid as of the date of such
dissolution, shall be borne by the entire area of the Town
of Cortlandville outside of Villages, all of the lands
within such area being determined to be the lands benefited
by such improvements and such costs shall be assessed,
levied and collected from the several lots or parcels of
land within said Town of Cortlandville outside of Villages
in just proportion to the amount of benefit which the
improvements shall confer upon such lots or parcels.
Section 4. It is hereby further determined that
the cost of management, maintenance, operation and repair
of all improvements or services in the aforesaid Districts
shall, after such dissolution, be a charge upon the area
of the Town of Cortlandville outside of Villages and shall
be levied and collected in the same manner and at the same
time as other Town charges, provided that it is the
intention of the Town Board that such costs will be raised
in the first instance from water rates, charges and fees.
Section 5. The aforesaid Districts shall be dissolved
as of the first day of January, 1982.
Section 6. This resolution is adopted subject to
permissive referendum in accordance with the provisions
of subdivision 2 of Section 209r of the Town Law.
The question of the adoption of the foregoing .,
resolution was duly put to vote, said vote being unanimous
in favor thereof.
The resolution was thereupon declared duly adopted.

Engineer BE IT RESOLVED that the Engineer is hereby authorized
Seminar to attend a seminar in Ellenville on April 28 - 30, 1981
for the American Water Works Association, and
Resolved that any expense incurred by same, be reimbursed,
subject to audit by the Town Board.

made a motion, seconded by Councilman Thorpe, to adjourn adjoirnment
