Page 1 PUBLIC HEARING AMEND RATES FROM SEWER DISTRICT ORDINANCE The Public Hearing was called to order by Super- visor Nadolski at 7:30 p.m.. In attendance were Supervisor Nadolski, Councilmen Pierce, Manning, Thorpe and O'Donnell. Also Town Clerk, Pauline H. Parker, and Attorney, John Folmer and several employees and residents. The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OFCORTLANDVILLE, Notice Is hereby given that a public hearing will be held by the Town Board of the Town of Cortlandville, Cortland County, New York, at the Town Hall, 15 Terrace Road in the Town of Cortlandville on March 4, 1981, at 7:30 o'clock p.m., in the mat- ter of the adoption of an ordinance amending Section 204 of the Town of Cortlandville Sewer District Ordin- ance enacted September 30, 1957, and ` thereafter amended to read as follows: The Town Board shall, from time to time, by resolution adopted after a public hearing, establish sewer rates ;to be charged within the Sewer Districts of the Town of Cortlandville. The Board shall publish in the official newspaper of the Town a notice of public hearing regarding such rate changes not less than fourteen days prior to the date of such public hear- ing. All parties in interest and citizens will be heard at the public hearing to be held as aforesaid. The Town residents that were in attendence expressed no opinions. Councilman Manning made a motion, seconded by Councilman O'Donnell to close the hearing. All voting aye, motion was carried. Board members present were Supervisor Nadolski and Councilmen O'Donnell, Manning, Pierce and Thorpe. Others present were Town Clerk, Pauline H. Parker; Attorney, John Folmer; Deputy Town Clerk, June Bradshaw; Engineer, Charles Feiszli; Justice, Donald Eaton; Assessor, Robert Wells; Zoning Officer, Don Fowler; Highway Sup't, Carl Eaton;'Confidential Sec'y, Edna Puzo and newsreporters Dick Camerano, Eric Schults and Tim Fox. Also present were Town residents Ken Andrews, Mr -and Mrs. Leon Moore, Mrs. Dorothy Johnson, Mrs. Betts, Mr. Becker, Mr. Rainbow. The meeting was called to order by Supervisor Nadolski at 7:35 p.m.. Upon a motion by Councilman O'Donnell, seconded by Councilman Manning the minutes were approved as written approve of January 7, January 19, February 4 and February 17, 1981. minutes All- toting aye, the motion was carried. Councilman Pierce made a motion, seconded by Council- Planning man Thorpe to receive and file the Planning Board minutes Bd. Minutes of January 26, 1981. All voting aye, motion was carried. Reports of Department Heads are.on.the table. They are also on file in the Clerk's office and are available upon request. RESOLUTION # 50, AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Thorpe Seconded by Councilman Pierce - VOTES: ALL AYE ADOPTED BE IT RESOLVED that the vouchers submitted have been audited and shall be paid as follows: General Fund. Vouchers # 48 - 96 $ 22,242.93 Highway # 29 - 45 3,518.69 Water District # 1 # 14 - 25 2,310.10 Water District # 5 # 1 85.00 Sewer District # 1 # 3 11.22 Sewer District # 2 " # 2 - 3 12•75 The privilege of the floor was given to those in attendance. Residents of Pleasantview Drive explained their concern in regards to the petition they had submitted to the Town. Whenever it rains hard'the water goes in their driveways, and into their garages and -basements. The problem has occurred more often since Ryersons has put in the blacktop. The catch basin there is not handling the water nor is the catch basin at the other end of the street. They also expressed concern about the crown of the road being high. A discussion followed whereby the Town Board request- ed the Engineer and Highway Sup't. to investigate the problem and research records. Upon motion by Councilman Manning, seconded by Council- man O'Donnell, the matter was tabled for further study. All voting aye, motion was carried. Attorney Folmer apprised the Town Board of delaying the delay Public Hearing for amending the dog ordinance. public There are several areas of the dog ordinance which need hearing to be reviewed and then a hearing will be held to include Dog's all changes at the same time, at a later date. A letter received from Mr. Neil M. Gingold was read in SEQR regards to SEQR . Upon motion by Councilman Pierce, seconded by Council= letter man Thorpe, the letter was received and filed. All voting aye, motion was carried. A letter received from the Cortland County Youth Bureau tpproval was read. They advised that the Town of Cortlandville has )f rec. been approved to receive recreation funds of $ 2,970.00, -unds contingent upon the approval of the State Legislature. Councilman O'Donnell made a motion, seconded by Council- man Thorpe, to receive and file the letter. All voting aye, the motion was carried. A letter was received from the Cortland County Legislature Conrail advising that Supervisor Nadolski has been appointed to serve committee on the committee in regards to the potential abandonment of the Conrail line. Councilman O'Donnell, made a motion, seconded by Council- man Manning to receive and file the letter. All voting aye, the motion was carried. Wortley A letter received from Congressman George C. Wortley report was read regarding his objection of a federal report encourag- ing people to leave the Northeast for the Sunbelt. Councilman Pierce made a motion, seconded by Councilman O'Donnell to receive and file the letter. All voting aye, the motion was carried. Councilman Pierce made a motion, seconded by Councilman Frank Thorpe, to receive and file Resolution No. 81-1 from the McNeal Cortland County Planning Board in regards to the variance variance request for Frank McNeal for a sawmill. All voting aye, the motion was carried. Councilman Thorpe made a motion, seconded by Councilman lalisbury Pierce, to receive and file the letter concerning the naming Road of Salisbury Road from the County Legislature. All voting aye, the motion was carried. Justice He may purchase as his budget allows. shelving RESOLUTION # 51 AUTHORIZE JUSTICE TO ATTEND ANIMAL CONTROL ACADEMY Motion by Councilman Thorpe schooling Seconded by Councilman Manning" Animal VOTES: ALL AYE ADOPTED Control BE IT RESOLVED that the Justice is hereby authorized to attend the Animal Control Academy at Cobleskill, • June 21 thru June 26, 1981 and RES01_'VED that any expense incurred by same, be reimbursed, subject to audit by the Town Board. RESOLUTION # 52 AUTHORIZE ENGINEER TO INVESTIGATE A COMPUTER PROGRAM Motion by Councilman Manning Seconded'by Councilman O'Donnell VOTES: ALL AYE ADOPTED computer BE IT RESOLVED that the engineer is hereby authorized program and directed to investigate the need, cost and effective usuage of a computer program and the availability of the County, City or other programs, and report his findings to the Town Board. A discussion was held in regards to a contribution contribution to the City of Cortland,for this year, to help maintain youth the cost of youth programs in the area. programs Councilman Thorpe made a motion, seconded by Council- man Pierce, to table the matter for further study. All voting aye, the motion was carried. Councilman Manning will contact Mr. Tokar. The Cortlandville Planning Board has selected the planning last Tuesday of the month to'hold their monthly meeting Board at the Town Hall, commencing with the meeting in April. meeting's A discussion followed in regards to the lack of space at Town Hall for. -offices and storage. This license fees increase would also include increased revenue to the Towns. RESOLUTION # 53 DIRECT LETTERS TO SPORTSMEN CLUBS -- OPINION OF INCREASED':FEES Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS the -Conservation Department has proposed an increase of sporting license fees and have requested an input from local governments, therefore Wednesday, March 4, 1981 Page 4- BE IT RESOLVED that Supervisor Nadolski is hereby directed to send letters to the sportsmens clubs in the area to advise them of the proposed increase and ask for their comments. RESOLUTION # 54 AUTHORIZE BOOKKEEPER TO ATTEND ACCOUNTING SCHOOL schooling Motion by Councilman Thorpe bookkeeper Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that the bookkeeper is hereby authorized to attend a double entry accounting school offered by Audit and Control in Guilderland, New York on March 10, 11,12,24,25 and 26, 1981, and RESOLVED that any expense incurred by same, be reimbursed, subject to audit by the Town Board. RESOLUTION # 55 AUTHORIZE PURCHASE OF TRANSCRIBER purchase of AND RECORDER transcriber & recorder Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that authorization is hereby given to purchase a Lanier transcriber and recorder unit► the cost not to exceed $ 654-92 and RESOLVED that the - cost of such equipment shall be shared by the Supervisors (A122014), Assessors (A1355 -4) and Engineer's (A14.4.0.4) contractual. Former Attorney, John Garckier, received a letter Water Dist, from the Bond Attorneys for Water District # 5, advising # 5 that a bill of $ 85.00 had not been paid. This has been checked and submitted this month for payment. RESOLUTION # 56 AUTHORIZE DON FOWLER TO ATTEND MEETINGS IN CLAY schooling Motion by Councilman Manning Zoning Officer Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that Zoning Officer, Don Fowler, is hereby authorized to attend the NYS Housing and Building Code meetings to be held in the Town of Clay on March 18th, 25th and April 1st and 8th, 1981, and RESOLVED that any expense incurred by same, be reimbursed, subject to audit by the Town Board. A letter from NYS Dept. of Transportation was read regarding our involvement in the Donavon Plan. Donavon Councilman O'Donnell made a motion, seconded by Plan Councilman Pierce, to table the matter for further invest- igation. All voting, aye, the motion was carried. • 1 • I 25 Wednesday, March 4, 1981 Page 5 Supervisor Nadolski apprised the Town Board that he has received information regarding Self -Insurance Self -Insurance Pool's. This bill is in the State Legislature now. pools This is being proposed for various regions but would be governed by the State Insurance Board. Supervisor Nadolski recommended that the Recreation Committee proceed with the hiring .of a Recreation Director for the summer of 1981. 4 A one day seminar on computer systems will be held computer . in Syracuse on March 5, 1981, sponsored by the American seminar Management System Inc. There is no cost for the program. RESOLUTION # 57 AUTHORIZE ATTORNEY TO PREPARE A PROPOSAL FOR REPRESENTING TOWN OFFICIALS Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that Attorney Folmer is hereby authorized Attorneylocal Law and directed to prepare a proposal for adopting of a local proposal - law to authorize the Town Attorney to defend a town r represent official should they have a lawsuit brought against them. epresentlE Civil Nancy Schroeder, representative of NYS Civil Service, has requested the use of our meeting room on Friday, service March 20, 1981 from 9:00 A.M. to 12:00 noon. She will be meeting's available to talk to any civil service employee. RESOLUTION # 58 RESCIND RESOLUTION # 180 ADOPTED NOVEMBER 5, 1980 Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED BE IT RESOLVED that Resolution # 180, adopted on November 5, 1980 is hereby rescinded and shall become null and void. RESOLUTION # 59 AUTHORIZE ALL LEGAL NOTICES TO BE CHARGED TO THE DEPARTMENT RESPONSIBLE Motion by Councilman O'Donnell Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED Legal BE IT RESOLVED that all legal notices shall be charged Notices to the contractual account of the town agency which is responsible for the publication. O'Donnell Councilman - Warren Manning ABSENT: None IN THE MATTER OF The dissolution of existing special Water Improvement Districts in the Town of Cortlandville, Cortland County, New York, Pursuant to Section 209-r of the Town Law WHEREAS, in accordance with the provisions of Section 209-r of the Town Law, it has been proposed that the public interest will be served by dissolving all of the special water improvement districts wholly located in the Town of Cortlandville, Cortland County, New York, and managing, maintaining, operating and repairi g as a Town function, any improvement or service provided or authorised to be provided by said districts; and. NEW YORK 13045 Wednesday, March 4, 1981 Page 7 27 RESOLUTION # 62 ADOPTION OF SEWER ORDER Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED F1 C] • Sewer combine districts Wednesday, March 4, 1981 Page 8 RESOLUTION # 63 AUTHORIZATION TO AMEND SECTION # 204 OF TOWN SEWER ORDINANCE Amend Motion by Councilman O'Donnell Sewer Ordinance Seconded by Councilman Manning VOTES: ALL AYE ADOPTED WHEREAS a Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall on March 4-, 1981 at 7:30 P.M. in the matter of the adoption of an ordinance amending Section # 204 of the Town of Cortland- ville Sewer District Ordinance enacted September 30, 1957, and • WHEREAS, there were no objections to the change thereof, therefore BE IT RESOLVED that Section # 204 of the Town of Cortland- ville Sewer Ordinance is hereby amended as follows: The Town Board shall, from time to time, by resolution adopted after a public hearing, establish sewer rates to be charged within the Sewer Districts of the Town of Cortlandville. The Board shall publish in the official newspaper of the Town, a notice of public hearing regarding such rate changes not less than fourteen days prior to the date of such public hearing, and FURTHER RESOLVED that this resolution shall become effective upon publishing and posting as required by law. Mr. Sandman, Engineer PallTrinity has informed us that their water filter going into their plant are problems and silt, that they cannot longer. A discussion followed concern of ruining our wel continues. from Pall Trinity Micro Corp., filters on our water lines filtering out so much sand tolerate the condition any whereby the Town Board expressed and pump if the situation RESOLUTION # 64 AUTHORIZE ENGINEER TO PROCEED WITH INVESTIGATION OF THE WELL Motion by Councilman Manning check Seconded by Councilman O'Donnell well VOTES: ALL AYE ADOPTED BE IT RESOLVED that the engineer is hereby authorized and directed to contact well drillers and get some cost figures to submit. An emergency meeting will be called, if necessary, to direct him further. Assessor Wells reported that the assessment update assessment is progressing on schedule. Impact notices will be mailed update by April 1st. and the informal reviews are scheduled from April 13 - April 17, 1981, by appointment. The state has added extra requirements to the program to be eligible for the rebate, but those requirements have been met. • Wednesday, March 4, 1981 Page 9 G� 1 • 1 1 An error had occured on the assessment rolls some time ago. A request was submitted to the County, last fall, for correction, but at the present, still has not been corrected. The Town Clerk received a request from Del Palm, County Legislator, to forgive the tax payer of a penalty. She responded to him that the correction would have to be made at the County level, first, as required by law. RESOLUTION # 65 AUTHORIZE SUPERVISOR AND TOWN CLERK TO SIGN HOME RULE REQUEST Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS it is necessary to submit a Home Rule Request to the NYS Senate and Assembly to amend the Highway Law in relation to an increase of limits for the Town of Cortlandville of amounts to be raised by taxes to 150,000, therefore Assessment error Home Rule Request BE IT RESOLVED that the Supervisor and Town Clerk are hereby authorized and directed to sign the Home Rule Request and forward to the necessary agencies.
