She is concerned because Mr. Yaman apprised those present that extension of the sewer in question opens up 50 acres of land for Industrial development. Councilman Thorpe assured Ms. Dangler and Mr. Moore that the process that an applicant has to go through to develop over the Aquifer gives the Town Board the opportunity to thoroughly assess all aspects involved. Town resident, Roger Davis, asked the Board if there would be a change in the assessment of the building which was originally intended for use as a warehouse, and is now proposed to be used as office space and warehouse space for.Smith Corona. Town Assessor, David Briggs apprised those present that the assessment depended on several factors. If the project is finished by March 1, 1989, the assessment will change. If the project is not finished, the assessment will remain the same as it was as of March 01, 1988. All changes made to a building are evaluated every year and Taxable Status date is March 1 of each year. There was a discussion following, regarding the process of bonding for such a project. Town Attorney, Phillip Rumsey explained the process, which is always estimated high to give an approximate cost. With no further discussion a motion was made by Councilman Rocco, seconded by Councilman O'Donnell, to close the public hearing. Mr. Roger Branchini presented, to the Board, his proposed plan for student housing on Rt. 281 between the Water Works and T.D.R. Oil. Supervisor Pierce offered the privilege of the Brent Cross floor to Brent Cross of Weathervane Estates on Rt . 222. geathervane Mr. Cross requested the Town to accept the roads at roads Weathervane Estates, as is, until they can be finished in the spring. Without this approval, he cannot sell lots due to funding requirements. Town Zoning Officer, Bruce Weber apprised the Board that the subdivision has two roads to be considered. Mr. Cross is willing to put up a bond to secure proper installation of said roads. Supervisor Pierce apprised Mr. Cross that he needs to meet with Town H'way Superintendent, Carl Bush, to determine exactly what he needs to do to meet the Town's requirements. RESOLUTION #285 DECLARE NEGATIVE IMPACT - SPECIAL PERMIT - MARVIN WINDOWS Declare Negative Impact - Marvin Motion by Councilman O'Donnell idindows Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, per State Environmental Quality Review Act, Marvin Windows is required to file a Short Environmental Assessment Form to determine whether his proposed project in the Town of Cortlandville will have any significant impact on the environment, and 1 r: 1 40 1 357 Wednesday December 07, 19ee Page 3 WHEREAS, the Town Board, as Lead Agency for this project, has reviewed said Assessment Form, therefore BE IT RESOLVED, that the Town Board does hereby declare that the proposed project of Marvin Windows will have no significant impact on the environment, and also RESOLVED, that Supervisor Pierce is hereby authorized -to sign a Negative Declaration regarding this application. RESOLUTION #286 APPROVE SPECIAL PERMIT - MARVIN WINDOWS Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, application was made by Marvin Windows for an Aquifer Protection Area Permit and recommendations have been received from the County Planning Board and the Town of Cortlandville Planning Board, and a hearing has been duly held before the Town Board, now therefore BE IT RESOLVED, that an Aquifer Protection Area Permit is hereby authorized for Marvin Windows, contingent on county Health Department approval of the well for said location. RESOLUTION #287 AUTHORIZE SALARY INCREASE - MARGARET CAPPS - JUSTICE DEPARTMENT Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, Margaret Capps has completed the probationary six month period in the position of Deputy Court Clerk, in compliance with the personnel policy of the Town of Cortlandville, therefore BE IT RESOLVED, that an annual salary increase of $300.00 shall be granted to Margaret Capps from $11,000.00 to $11,300.00 to be paid from A1110.1 effective December 5, 1988. RESOLUTION #288 AUTHORIZE H'WAY SUPERINTENDENT TO RAISE NIGHT RATE ® Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Highway Superintendent, Carl Bush is hereby authorized to raise the highway night rate increase from $.15 to $.45 per hour, effective Sunday November 27,_ 1988. RESOLUTION #X91 AUTHORIZE SUPERVISOR TO WRIT1= LETTER TO NYS DOT - TRAFFIC LIGHT - RT 281 Authorize Supervi AND LUKER ROAD write letter -traffic light - Rt 282 & Motion by Councilman O'Donnell Luker Road Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, there have been numerous complaints about the increased traffic at the intersection of Rt. 281 and Luker Road in the Town of Cortlandvilla_ and WHEREAS, after completion of the building by NCC Industries on Luker Road, there will be a very large increase in traffic at said location, therefore BE IT RESOLVED, that Supervisor Pierce is hereby authorized to write a letter to the New York State Department of Transportation to request them to review the situation and present their recommendation. A motion was made by Councilman Testa, seconded by Councilman O'Donnell, to adjourn the meeting. All voting aye, the motion was carried.
