HomeMy WebLinkAbout1959-04-06 288 April 6 , 1959 . The regular monthly meeting of the Dryden Town Board was held April 6th at 8 : 00 P . M . at the Office Building . Present were Supervisor Gridley , Councilmen Baker and Salton- stall , Justice Hoagland , Superintendent of Highway Beach and Assessor Abrams . The minutes of the March meeting , also of the special meeting held March 24th , were read for information and approval . The minutes of the special were approved . On March 12th the Town Board met with the Planning Board to hear their report . Justice Hoagland reported that the . Town Board offered some revisions to the proposed Zoning Ordinance . The Planning Board will report again to the Supervisor at a later date . March 30th the Town Board met with Mr . Malone , a ±epresentitive of the State Building Code Commision , who explained the advantages gained by having a State Building Code in a Town . As a member on this committee , Justice Hoagland recommended that this Town adopt the State Building Code if and when they adopt the Zoning Ordinance . Moved by Clm . Saltonstall , seconded by Clm . Baker , that the General bills totaling $ 1 , 101 . 83 and the Youth Project bills of $ 110 . 03 be paid as audited . Roll Call Vote , All voting YES . Moved by Justice Hoagland , seconded by Clm . Baker , that the Highway bills totaling $ 2433 . 10 be paid as audited . Roll call vote , all voting YES . One bid for trailer was submitted by the Binghamton Heil Equipment Corporation of Vestal , N . Y . • at a price of $ 2000 . 00 . . Moved by Justice Hoagland , seconded by Clm . Saltonstall , that this bid be accepted and the Highway Superintendent be empowered to complete the transaction . Roll call vote , all voting YES . Highway Superintendent Beach recommended that a 10 $ an hour increase be given all employees of the . Highway Department effective April 1st , 1959 . Justice Hoagland moved that this recommendation be accepted . The motion was seconded by Clm . Baker . Roll call vote , all voting YES . Justice Hoagland offered the following resolution and asked its adoption : Resolved that telephone tolls incurred by the Justices of the ' Peace that are necessary for the conduct of their legal business be a Town charge when certified . This resolution was seconded by Clm . Saltonatall . Roll call vote , All voting YES . A communication was read from the State Traffic Commission stating that a Yield sign had been placed at the intersection of Route 13 and Etna lane , Co . Rd . 109 . This communication was placed on file . The next regular Board meeting will be held May 4th at 8 : 00 P . M . The minutes of this meeting were read and approved . If, for any reason, delivery is not made within 10 days from this date, the cash selling price quoted herein will be subject to adjustment to conform to our regular cash selling price of the goods covered by this proposal in effect at the time of delivery. If the price adjustment results in an increase in price, you shall have the privilege of accepting delivery at the increased price or cancelling your acceptance of this proposal by giving written notice of such cancellation to us within 5 days after notice of such price increase is given to you. The trade allowance set forth herein is based upon our appraisal of the trade-in referred to in its present mech-anical condition and with the equipment and attachments thereon and free of all liens. Such trade-in shall be subject to reappraisal by us at the time it is delivered to us and if it is reappraised at a different value than the. trade _allowance set forth, herein, because of difference in mechanical condition or -because of removal or • substitution of equipment or parts or attachments, or because it is subject to a lien not set forth herein, the trade allowance set forth herein shall be changed to such reappraisal value and the difference between the trade allowance set forth herein and the reappraisal value shall be paid in cash by you at the time that the new equipment covered by this .proposal is delivered ' to you. If you are dissatisfied with such reappraisal you shall have the option of . cancelling your acceptance of this proposal. • 3. You agree to accept the goods covered by this proposal, as fulfillment thereof, with such changes in design and materials, or either of them, that we may make. : 4. If any sales or excise taxes now in effect, shall be increased, or any new sales, excise, floor or processing taxes shall be imposed by federal, state or local laws, you are to reimburse us for any and all such increased or new taxes that we may be required to pay or to reimburse to others by reason of the manufacture, purchase or sale of the equipment covered by this proposal. The amount of such increased or new taxes may be billed as a separate item or added to the price of the equipment to which they are applicable, at our option. 5. We shall not be responsible for loss, damage or delays in transportation after shipment, nor for failure to supply any goods covered by this proposal or to deliver the same on time where prevented by strikes, fires or accidents, or by the demand exceeding the available supply, or by any other cause beyond our reasonable con- trol. 6. The equipment covered by this proposal will be sold under our regular new equipment warranty set forth below and no other. WARRANTY • BINGHAMTON HEIL EQUIPMENT CORP. warrants new equipment to be free from defects in material and workmanship under normal use and service, its obligation under this warranty being limited to making good at its factory any part or parts thereof which shall he returned to it with transportation charges prepaid, and which its examination shall disclose to its satisfaction to have been thus defective, provided that such part or parts shall be so returned to it not later than ninety ( 90 ) days after delivery of such equipment to the original pur- chaser. This warranty is expressly in lieu of all other warranties expressed or implied and of all other obligations or liabilities on its part, and it neither assumes nor authorizes any other person to assume for it any other liabil- ity in connection with the sale of its equipment. - This warranty shall not apply to any equipment which shall have been repaired or altered outside of its fac- tory in any way so as, in its judgment, to affect its stability, or reliability, nor which has been subject to misuse, negligence or accident, or loaded beyond the factory rated load capacity. It makes no warranty whatever in respect to tires, rims, ignition apparatus, horns or other signalling de- vices, starting devices, generators, batteries, speedometers or other trade accessories inasmuch as they are usually warranted separately by their respective manufacturers. 11:14 ■ 289 April 11 , 1959 . The April 6th adjourned meeting of the Town B oard reconvened at the Office Building on April 11th following the Road inspection tour . resent were Supervisor Gridley , Justice Hoagland , Councilmen Baker and Saltonstall and Supt . of Highway Beach . Moved by Justice Hoagland , seconded by Clm . Saltonstall , that the Town sign an agreement to top the Ferguson Road from Route 38 , west to Mill Street intersection , also : that portion of road from County Road # 105 to the bridge in Malloryville . Motion carried by all • voting YES . ' Moved by Clm . Saltonstall , seconded by Clm . Baker , that the section o f road between County road #x161 and the Railroad , known as Town road ;# 53 , or approximately 800 Feet , be widened to 18 feet ; the balance o r approximately 700 feet to be improved . Motion carried by all voting YES . . Moved by Clm . Baker ; seconded by Clm . Saltonstall , that the section o f Town road No . 13 , between County road #163 and County road #105 be widened to 18 feet . Motion carried by all voting YES . ' A discussion followed regarding the ,Baker Hill Road . It was mutually agreed that the committee return to the Gas and Electric e ngineering department to discuss further the possibility of crossing New York State Gas and Electric property . The Zoning committee appeared before the Town Board to make their formal report , which was unanimously accepted . A report in detail is to be forwarded tornthe• Town by their Secretary Mrs . Payne .
