PRIVILEGE OF THE FLOOR – COMMON COUNCIL AND THE MAYOR:
Alderperson Nguyen thanked Ms. Alt for the information she provided on the proposed Federal Legislation regarding rent freezes. Alderperson McGonigal thanked Mr. Fairbanks for his comments and video regarding
the re-opening of Newman Municipal Golf Course and noted that he shared those
sentiments. CONSENT AGENDA ITEMS: 3.1 Capital Project Engineering Phase for Boiler Room Evaluation at the Ithaca
Area Wastewater Treatment Facility (IAWWTF)

WHEREAS, the Ithaca Area Wastewater Treatment Facility is in need of reliable boilers
used for comfort heating of indoor spaces and for process heating of the anaerobic
digesters, and
WHEREAS, the current boilers are reaching the end of their useful service life and are
increasingly unreliable and maintenance intensive, and
WHEREAS, an evaluation of heating requirements and energy sources for current as
well as future anticipated plant and process needs is necessary, and

WHEREAS, an Engineering Evaluation Cost Estimate has been prepared by MRB
Group for a lump sum of $18,500 which includes:
A. Boiler Evaluation -
a. Assess existing boilers.
b. Identify replacement boiler options (number, styles, sizes,
duel fuel options).
B. Energy Evaluation –
a. Evaluate Biogas and Natural Gas usage at plant.
b. Evaluate redundancy needs.
c. Evaluate biogas use in microturbines with heat recovery vs.
use for heating.
d. Consider potential heating needs for future sludge
processing projects.
e. Check for current grant funding opportunities to see if either
the study/design phase or construction phase might be
eligible, and
WHEREAS, the Special Joint Committee (SJC) approved said Capital Project at their
regular meeting of March 18, 2020; now, therefore, be it
RESOLVED, That Common Council hereby establishes the IAWWTF Capital Project
423J Boiler Room Evaluation in an amount not to exceed $18,500, and be it further
RESOLVED, That Common Council hereby recommends to the IAWWTF Owners that
this project be authorized and funded from the IAWWTF Capital Reserve fund in an
amount not to exceed $18,500 for the Engineering costs required for Ithaca Area
Wastewater Treatment Facility Boiler Room Evaluation.

3.2 Capital Project for Replacement Pumps and Piping for the Actiflow High Rate
Sand Ballasted Tertiary Treatment Phosphorus Removal System at the Ithaca
Area Wastewater Treatment Facility (IAWWTF)

WHEREAS, the Ithaca Area Wastewater Treatment Facility requires tertiary treatment
for phosphorus removal to meet discharge permit limits; and
WHEREAS, the current system has lost redundancy due to sand pump and chemical
pump failures; and
WHEREAS, the current style and age of pumps have contributed to redundancy and
reliability concerns, and
WHEREAS, piping associated with the system has worn thin in places due to the
abrasive sand pumped in the system; and
WHEREAS, electronic and control systems associated with the chemical feed system
do not meet current standards; and
WHEREAS, Koester Associates are the exclusive local representative for the Kruger
ActiFlow system; and

WHEREAS, a proposal has been provided by Koester Associates for $93,350.00 which
includes:
A. Supply and install 2 McLanahan 3X3 Sand Pumps,
a. Removal/demo of old pumps and piping.
b. Provide all material and labor for the purpose of replacing
and installing new pumps.
B. Supply and install 2 Verder 5000 peristaltic chemical feed pumps
a. Provide skid with valves, pressure dampeners and
calibration column.
b. Provide all PVC valves, unions, piping required to retrofit into
existing process.
c. Includes labor, start up and training.
WHEREAS, a contingency fund of 10% ($9,335.00) is necessary to allow for
replacement of piping discovered to be deteriorated/failing that is not covered by the
above work, subject to a time and material proposal, in addition to
electrical/instrumentation work associated with new pump installation; and
WHEREAS, the Special Joint Committee (SJC) approved said project at their regular
meeting of April 15, 2020; now, therefore be it
RESOLVED, That Common Council hereby establishes the IAWWTF Capital Project
424J Replacement Pumps and Piping for the Actiflow Tertiary Treatment Phosphorus
Removal System to be funded from the issuance of serial bonds in an amount not to
exceed $102,685, and be it further
RESOLVED, That Common Council hereby recommends authorization of this project
contingent upon action by all wastewater partners committing their percentage of
reimbursement shares to the Joint Activity Fund allocated per the Joint Sewer
Agreement as follows:

CITY ADMINISTRATION COMMITTEE:
4.1 Establishment of Fee for Use of Right of Way and to Authorize Approval of a Master License Agreement for Small Cell Facilities with 4G and 5G capability. Mayor Myrick recused himself from the discussion of this item as he has a family member who works for Verizon. He noted that although there would be no financial benefit to him nor any employment implications for his family member, he wished to
avoid any perceived conflicts of interest. Mayor Myrick was excused from the meeting during the consideration of this item. Resolution:

WHEREAS, Verizon has expressed interest in installing small cell or wireless facilities with 4G and 5G capability on poles primarily situated within the City’s right of way; and

WHEREAS, through the Master License Agreement and design guidelines, the City will retain ultimate control and authority over installations within the City’s right of way, including small cell or wireless facilities; now therefore be it
RESOLVED, That Common Council authorizes the following fees, which may be updated from time to time, for small cell or wireless facilities using poles within the right of way: One-Time Pole License Application Fees: $500.00 for an application for
attaching to up to 5 facilities, and
$100.00 for each additional attachment beyond 5, and $1,000.00 for an application for a new pole.
City-owned Poles Recurring Fee: $270.00 - per pole per year Privately Owned Poles Previously Permitted for Installation Recurring Fee: $135.00 – per pole per year; and
RESOLVED, That the Acting Mayor, subject to the advice of the City Attorney, is authorized to enter into an agreement substantially similar to the Master License Agreement included herewith requiring that Verizon comply with the included preliminary design guidelines, which guidelines may be updated at any time on the
determination of the Director of Planning.
Extensive discussion followed on the floor regarding the design guidelines which are still in development and are targeted to be ready for review by Common Council in July. City Attorney Lavine explained that Federal pre-emptions, stated in FCC rules and
others, prohibit local municipalities from discussing the safety of the technology, they

INDIVIDUAL MEMBER – FILED RESOLUTIONS: 6.1 3rd Amendment to HUD Entitlement Citizen Participation Plan - COVID-19 By Alderperson Lewis: Seconded by Alderperson Brock WHEREAS, the Citizen Participation Plan establishes the City of Ithaca’s (City’s) procedures for involving the public in development and implementation of the HUD
Entitlement Program, and
WHEREAS, on March 31, 2020, in response to the COVID-19 pandemic, the U.S. Department of Housing and Urban Development (HUD) issued a Mega-waiver covering HUD-administered programs that included flexibility regarding citizen participation and
public hearings for HUD-administered funds awarded to the City, and
WHEREAS, the City contracts with the Ithaca Urban Renewal Agency (IURA) to administer, implement and monitor the City’s HUD Entitlement program in compliance
with all applicable regulations, and
WHEREAS, the City seeks to establish expedited procedures necessary to quickly and effectively administer federal funding made available to respond to the COVID-19 Pandemic in accordance with the HUD Mega-waiver, and
WHEREAS, the HUD Mega-waiver authorizes a minimum 2-day notice period for public hearings and a 5-day public comment period will temporarily satisfy citizen participation requirements through July 31, 2021 on the use of HUD funds awarded to the City; and
WHEREAS, on April 23, 2020, the Ithaca Urban Renewal Agency recommended that
the City of Ithaca adopt proposed amendments to expedite approval of funding of activities responding to the COVID-19 pandemic, including the following:
• Notice for Public Hearings:
Reduce the minimum notice period for public hearing to two (2) days from ten (10) days.
• Public Comment Period on Proposed Uses of Funds: Reduce the minimum time period for opportunity for public comment on proposed
uses of funds to five (5) days rather than thirty (30) days as normally required.
• Virtual Public Hearings: A virtual public hearing, rather than an in-person public hearing, will meet public hearing requirements when:
1. National/local health authorities recommend social distancing and limiting
public gatherings for public health reasons, and 2. Virtual hearings provide reasonable notification and access for citizens to comment in real time, and 3. A record of comments received, and responses shall be made available for
public review within 5 days following the public hearing.
• Applicability of Temporary COVID-19 Pandemic Amendments: April 2, 2020 – July 31, 2021
now, therefore, be it RESOLVED, That the City of Ithaca Common Council hereby adopts the proposed 3rd
amendment to the City of Ithaca HUD Entitlement Citizen Participation Plan, dated April
23, 2020. Carried Unanimously REPORT OF CITY ATTORNEY:
City Attorney Lavine reported that the City received a decision on the 209 Hudson
Street litigation. He stated that the Appeal was not successful. The variance is granted, and the subdivision needs to be permitted to proceed with the development.

Please enact a one month rent forgiveness policy for April 2020. If needed, enact a second month rent
forgiveness policy for May 2020. As CCs it is important to protect and preserve the overall safety,
stability and health of our community. Ithaca is about 70% renters. Many who can not afford full rent
for April or perhaps May.
Homeowners and commercial owners already have safety and protection via up to 3 months mortgage
relief, with no fees or credit score impact. Renters do not have that safety and security.
We all hope that NYS enacts a rent forgiveness program. However, we do not know. People need this
relief and security now.
NPR did a good report on this national rent issue yesterday, March 31st. The report stressed the last
thing we need is a couple months is large scale homelessness and social instability.
Please protect our community. I work hard and full time, but my hours have been cut way back. I can
not afford my full rent.

Who is to determine whether a property owner/landlord has suffered “financial hardship?”
I would suggest that if we are moving on rent forgiveness (absolving lessees of rent obligation entirely
during crisis vs deferral of rent) that ALL property owners/landlords who can prove that they received
rent from their current rent roll for the 6-12 previous months would qualify to be made whole on 100%
of rental losses during the COVID 19 mandated shutdown.
“RESOLVED, That the Common Council of the City of Ithaca urges our state and federal representatives
to pair any suspension of rent due to COVID-19 hardship with emergency funding to assist landlords
who are facing financial hardship due to nonpayment of rent.”

support Senate bill S8125A and Assembly bill A10224A, which for a 90 day period would suspend the
rent payments of residential tenants and small business commercial tenants who have suffered a loss of
income as a result of government-ordered COVID-19 restrictions, and suspend mortgage payments for
the same period for property owners facing financial hardship as a result of non-payment of rent; and be
it further”
This language is problematic as the term “suspend” does not articulate whether the rent is being
deferred or forgiven. Further, how do tenants prove that they have had an income loss? What is the
test?

Hello Common Council members. This comment is about the Cayuga St bridge replacement. I am
delighted to see that sidewalks will be expanded to 8 ft wide in both alternatives #2 and #3, which seem
to be the alternatives preferred over #1. Reading through the memo provided by the Office of the City
Engineer, it seems like there was an attempt to reduce cost by maintaining the existing bridge deck
width and reducing the driving lane widths to 10' each. The state DOT seems to not have allowed this
due to inability to share a lane of that width with bicycles, but I think it would be better to share a lane
that's 10' wide instead of 13' due to the traffic calming effects on this stretch of road (which would be
very desirable). Is there really no way to have driving lane widths reduced to 10 to 12 feet, thereby
calming vehicle traffic a bit AND achieving cost savings from not having to extend the bridge deck by
that much?

Please pass a rent freeze for the duration of the Covid-19 crisis. Many many people have no ability to
make an income and there will be mad evictions and debt as soon as the eviction ban is lifted. This crisis
is already hurting working class people far harder than anyone else, please do the right thing and use
the power you have to protect them.

Please consider supporting a Rent Freeze in Ithaca. Landlords are able to pause their mortgage
payments. Ithacans who can’t afford mortgages and thus are renting deserve the same financial
security. Many of my friends and I have faced cutbacks at work due to the coronavirus. So long as our
landlords are not having to pay for our housing, tenants should not have to pay for it. Thank you for
representing tenants today.

On March 15th The Ithaca fire department did not respond to a five-year-old seizing one block away
from the central fire station. This was because of a drastic reduction in the Ithaca fire department EMS
response is under a new policy implemented by the fire chief and the mayor. This was labeled Charlie
and as of today the Ithaca Fire fire department is not responding to Charlie’s. Relying on responding
ambulances coming from farther away to make a huge difference when there is an airway problem. And
such as can happen with seizing patient. And if you’re someone that can’t afford a car to drive yourself
to the ER this policy may have more of an impact on you.I have notified the council of my concerns
about this policy especially since other fire departments in the area have been able to maintain their
responses by utilizing the CDC recommendations for PPE. At a time when The EMS system is under
stress and other communities are looking to step up to the plate the mayor and Ithaca fire Chief have
gone into a defensive crouch. I know they are concerned about fire responses but mutual aid is always
an option and the fire burning through this country now with the coronavirus and we need to step up
and address it and cutting back on EMS response when we are in the middle of a healthcare crisis . Why
was this policy not presented to public. I wrote a detailed letter of my concerns to the mayor and city
Council I hope they will release it to the public. The Ithaca firefighters are a wonderful asset to this
community ,professional and caring ,Let them do their job in this time of crisis. I was a Lt at the
Binghamton fire department for 30 years before moving to Ithaca and I’m still working as a paramedic.
The support shown to EMS by the local businesses and citizens has been wonderful. The response from
the city of Ithaca has been disheartening .

Proposed resolution Senate Bill 8125A
April 1, 2020
To: Common Council and the Mayor of the City of Ithaca
Earlier today I became aware of the proposed resolution in support of Senate Bill 8125A and Assembly
Bill A10224A to be considered at tonight’s meeting.
Unfortunately I do not have time to write a lengthy critique to you about this poorly drafted and ill
considered piece of legislation, however well intentioned, but will attempt to briefly illustrate why this
resolution before your board tonight should not be adopted.
1) There is a distinct likelihood that as drafted, it is an unconstitutional taking that will invite
litigation for years to come, and may expose the state to financial ruin in the name of political
expediency. see Lucas v. South Carolina Coastal Council, 505 U.S. 1003 (1992)
2) For purposes of discussion, I will refer to the Senate copy of the legislation.
Section 1(a) provides in pertinent part that any residential tenant or small business commercial
tenant in the state that has lost income or has been forced to close their place of business as a result
of government ordered restrictions in response to the outbreak of coronavirus disease 2019 (COVID-
19), shall have all rent payments suspended for ninety days following the effective date of this act.
Such residential tenant or small business commercial tenant shall not and shall never be required to
pay any rent waived during such time period. Every residential tenant or small business commercial
tenant whose lease expires during this time period shall be subject to an automatic renewal lease at
the current rent charged.
a. “Residential tenant” is defined to include the tenant named in the lease plus, spouse, children
and an occupant per 235-f RPL- who suffers a "loss of income". So if the parents are not harmed, but
the child loses a paper route, they have a right to suspend payment. There is no threshold loss defined,
meaning that any claimed loss, even one penny shall trigger a suspension of payments for 90 days and
that “residential tenant” "shall never be required to pay any rent 'waived'. There is no distinction in this
section between what is a “suspension” of rent and what is a “waiver”, but apparently the Senate
believes it can waives its legislative wand and forever deprive property owners of 90 days rent. This is an
unconstitutional taking and impairment of leasehold contract in violation of the U.S. Constitution, Article
I Section X Clause I.
b. June - August is turn over time for students. As written, a student that has a lease expiring July
31 is entitled to an automatic renewal, even if the unit has already been leased to another individual for
coming academic year. That student could conceptually remain in occupancy at a lower rent than has
already been agreed to in a written contract with another person. Is this Board prepared to hire more
judges to handle the litigation and public turmoil that will result?
c. In the event of a commercial lease that has automatic escalation such as if the taxes go up or
there is an annual adjustment, does this mean that the contract as written no longer applies? No one
knows, because the drafters did not consider these possibilities.
d. What if the lease that is “automatically extended” is a 20 year lease? How long is the extension
for - 90 days or 20 years?
e. The loss of rents directly affects the value and taxable value of property.
Section b provides (b) (i) Any person or entity who faces a financial hardship as a result of being
deprived rent payments for property pursuant to this section shall receive forgiveness on any
mortgage payments for such property for ninety days, in an amount determined by the following
fraction multiplied by such mortgage payment, up to the total dollar amount of lost rent: (A) The
numerator shall be the total amount of rent payments suspended for his or her tenants over the
ninety day period laid out in this section; and (B) The denominator shall be the total amount of rent
payments typically owed for such entire property over the ninety day period laid out in this section.
(ii) Any person or entity qualifying for mortgage payment forgiveness under this subdivision shall not
and shall never be required to pay any mortgage waived during such time period.
a. This section interferes with the terms of every commercial mortgage in the state. Do you think
it likely that the home of commercial banking in the United States is not going to challenge this? The
law of unintended consequences will be to de-legitimize New York as a banking business state, driving
more services to other states.
We are all struggling the challenges of this pandemic. It is in no one’s best interest to rush through
legislation that will do more harm than good for the sake of political expediency.
The unintended consequences of this law will be to reduce the availability of capital for new
construction in the state, increase costs, drive business away, and deprive residents of opportunity.
I strongly urge that the Board not adopt this resolution.

While I agree drastic cuts are necessary, I strongly oppose that all of the power for the cuts to be in the
mayor’s hands. Two city councilors (I suggest the chair of the PEDC and Administrative)should be added
to give other perspectives. This simply gives the mayor too much authority.

My name is Rob and I am a firefighter here in the City of Ithaca. I am writing to you in regards to the
severe Fire Department budget cuts the Mayor is proposing. I want to preface my statement by
acknowledging the many individuals throughout the City that are being impacted by this situation, the
decisions you will be asked to make are tough. These cuts, especially the three furloughs, are short sited
and will endanger our community and our department for years to come.
Furloughing firefighters Dove, Teeter, and Bloodnick is a decision with long-lasting consequences in
terms of both public and firefighter safety. These firefighters are currently three weeks into an eleven-
week recruit training program at the NYS Fire Academy, training that is mandatory before serving on the
frontline. If these three firefighters are unable to complete their training this year, they will not be able
to serve as frontline firefighters until at least July of next year. Many of you have had the experience of
Fire Ops 101, I have personally had the chance to attend it with three of you. I know you are aware of
how necessary this training is.
Our number of frontline personnel are already at dire levels. As of today, we have 57 members who are
ready for duty. With the furloughs, this will drop to 56, and with the three retirements taking place over
the next several months, we will be at 53, assuming no one else is injured, becomes sick, or opts to
retire. There is a six month period from the date of hire until a new firefighter is ready for the frontline.
The City cannot afford to throw away their investment in these three firefighters who are close to
completing their mandatory training.
I understand that all departments are facing severe cuts, but not counting the three firefighter
furloughs, we have seen severe cuts already. We currently have an unfilled position, in July the Mayor is
proposing to cut the two firefighters and Deputy Chief position that you fought hard for this past budget
season. Over the last ten years, our staffing has reduced from 69 positions in 2009 down to our current
62. If the City wants the Fire Department to be open, it needs funding. We cannot work from home; the
calls we go to cannot wait a few minutes, much less, months, or years for times to get better. Structural
fires, car wrecks, gorge rescues, medical emergencies, etc. remain the same in good times and bad and
require trained personnel to manage safely and efficiently.
If the City is unwilling to fund the training of new firefighters, we will soon run into a situation where
stations are closed, and our services diminished. The City must find a way to preserve these positions
and finish training these recruits. They are critical to our community's safety and the safety of all the

I wish we were conducting conversations under better circumstances. I understand the gravity of the
situation currently facing us.
After reviewing the latest information, I have concluded the following;
The proposed plan includes Furloughing three firefighters, bringing back only while in the academy, and
then furloughing again. This plan accounts for three retirements that will not be filled, as well as two
open vacancies budgeted to be filled in July. This means a total reduction of 8 positions. At first, I
thought we were discussing three firefighters that would be temporarily furloughed and replaced as
retirements happened. It is now clear to me that we are losing eight positions. This is unacceptable.
Words cannot express the fear I feel for the safety of the members of the department as well as the
citizens of the community. Eight is absolutely too many. We cannot sacrifice the safety of the women
and men that continue to come to work every day for temporary monetary savings.
In 2009 we had 69 uniformed firefighters. We sacrificed positions during the tough times in 2010 and
2011. Right now, we have 62, including the three proposed to be furloughed. We have seen
unprecedented growth as a city since then. Again this year, when presented with the best financial
position the city has been in, we had to fight to avoid cuts!! We compromised and delayed filling
vacancies until July. To say I am frustrated by advocating to prevent cuts in the best of times is an
understatement. We have sacrificed and been short-staffed for years. We have never recovered since
the last time cuts took place. I cannot allow any more cuts.
This hits on a much deeper level than just a few positions. This truly crushes the morale of the
dedicated people continuing to show up to work every day and face the unknown. This will destroy the
relationship we have worked to improve between the city and the members of the department. We
have been working to eliminate the “us vs. them” mentality that was present before. I fear that this
action will cut so deeply that it will take a generation to repair.
No matter the decision, we will continue to serve. We will be there for you. Just don’t force us to do it
with one arm tied behind our backs.

Hello to all, I hope this finds you well and safe.
I am writing because I would like to state that I am concerned with the push for increased infrastructure
of 4-G technology and I am opposed to the rollout of 5G technology in the Ithaca area. This technology
comes with health risks for humans here as well as the plants and animals in this area. There is a
growing body of scientific research that suggests that 5G is harmful to health. It is enough to warrant
caution and further testing, if not rejection of this technology- at least until improvements are made, if
that is possible.
This is a public health issue because we cannot easily avoid the affects of this technology. It is not like
some other health issues where reasonable precautions can help us, or where we can personally avoid
exposure by making our own choices. I have lived in Ithaca for 15 years, and contributed to the
community like so many other people here. I feel we should have a say and that our voices should
matter, because we will not be able to escape the consequences.
Our internet is already fast enough generally, and the risks are not worth whatever gains are being
discussed. At the very least, this technology needs further research, especially in light of the negative
health impacts already being studied. Please do not take this unnecessary risk that will impact us all.
Please look at a broad view of scientific research as well as common sense.
It is unethical to subject citizens and the environment to harm, especially when there is no need. Thank

I share today to call in common sense and human decency. I am progressive, I use technology for my
livelihood, and look forward to new paradigms in wireless communication that will usher in innovation
and automation in ways we can now barely imagine possible. I also believe that health is the fulcrum of
well being and consent is the cornerstone of community. Let us not rush into filling our homes, schools,
offices, and public spaces with technology that has the potential to disrupt our biology in negative ways.
Are we not still dealing with the error of Asbestos and Lead to this day? The human body is a miracle
with many mysteries yet to be discovered. Just because an "expert" deems it's safe does mean the case
is closed. Who is funding this research? In what capacities has it been fulfilled? The time to draw the
line for public safety is now. It will avoid a costly retreat later. Please join me in the growing movement
of awareness around the dangers of EMF. Studies have shown significant risks associated with 3G and
4G. There are even signs posted in fall creek telling pedestrians to stand clear of broadcast receivers. If
6 feet is too close... how is 7 feet safe? These are imaginary thresholds in a gradient reality. So instead
of saying NO to 5G. I say YES, when the testing is unanimous and the results are emphatically YES... 5G

been researching on the adverse effects of 5G technology on health and environment, and it turns out
that there are not enough testing on the safety of this new technology and many scientists and doctors
warn about the danger of 5G. There are some reports that it may have adverse effects on our health,
especially for young children and immune compromised people who are vulnerable to EMF exposure as
well as birds and bees among other natural habitats.
I am opposing the installation of 5G until further testing for safety is confirmed. Please protect the

I strongly oppose any approvals that would facilitate 5G deployment in Ithaca.
At this time the verified dangers of pulsed polarized radio frequency radiation are not commonly known.
This is in part because the studies that have been sponsored by the industry muddy the water with false
assurances.
We should have a moratorium on any such development until thorough independent studies have been
done.

There is not enough research to show that it is safe.
As an active indigenous resident, I also cannot stand by this decision as it relates to the unknown effect
that it has on our ecosystem. With the changes we are experiencing now, it is of utmost important to do

around it, only hypotheses from scientific data.

I feel the public needs to be notified of the risk-benefit analysis of installing small cell antennae that will
be vigilantly exposing us to short wave millimeter radiation. I have a preschool in my home and several
telephone poles near my house. There is plenty of evidence on 4G technology negatively affecting
neural pathways of developing brains. There is disturbing research concerning 60ghz radiation affecting
the absorption of oxygen because that is how it travels so efficiently. I live on a hill full of happy bird life
and would suffer immensely to watch the quality of life in our town suffer for the benefit of faster
internet and more money for mobile tech giants. I wish not to be a Guinea pig and instead would like to
open this discussion more in Tompkins county before rushing headlong into something that could be a
grave mistake to all I hold dear. I would move from this county likely if faced with such onslaught of
radiation in my neighborhood with no place to seek shelter from the waves. The cells are so close to
each other. Please consider pausing this decision and bringing in the opinions of the public and Including
global research ( like why are certain cities and countries banning 5G and why are people resisting this
technology worldwide) to determine if we even SHOULD. THANKS. I would love to be in attendance at

I am a resident of Ithaca and have 3 children that attend Ithaca City school district. I am very concerned
about the possibility of small cell 4G/5G radiation facilities being installed and turned on in Ithaca.
Wireless small cell antennas emit microwave-non-ionizing radiofrequency radiation- and essentially
function as cell towers. Each installation can have over a thousand antennas that are transmitting
simultaneously. They increase electromagnetic radiation near homes. Property values drop after a cell
tower is installed near a home. I personally know a woman that had to move out of her house after a
small cell was installed across the street from her house and now rents an Air-BnB until she can sell her
house and find a city that has banned these small cell towers. She experienced headaches, dizziness,
brain-fog, insomnia, shortness of breath from these towers emitting radiation directly into her home
constantly. This is very concerning especially for children. Will these be installed near schools, day-
cares, hospitals, and elderly care homes? I will sue the city if that is the case. Many cities in NY have
sued their cities and WON these cases, examples are Huntington, NY and Oyster Bay, NY. The city
should look into who is ultimately responsible when these cases go to court, is Verizon the responsible
party or the city? This is a 2020 statement by Verizon wireless in their annual report: “We are subject to
a significant amount of litigation, which could require us to pay significant damages or settlements…In
addition, our wireless business also faces personal injury and wrongful death lawsuits relating to alleged
health effects of wireless phones or radio frequency transmitters. We may incur significant expenses in
defending these lawsuits. In addition, we may be required to pay significant awards or settlements.”
This is very unsettling information. Verizon is admitting to us that people are harmed or die from
wireless radiation and they have to pay for damages in court. Who is asking for 4G/5G in our town? Is
there anyone in our city requesting faster WiFi for the trade off of these health consequences?
The World Health Organization classifies EMFs as a "class 2b" carcinogen, the same classification as lead
and asbestos. Verizon openly admits that 5G/60 GHz is absorbable by oxygen (the lower frequencies are
NOT absorbed by oxygen). Microwave radiation works by agitating and spinning molecules within food
to heat it up. Imagine what happens to our bodies when these 60 GHz radiation waves start to agitate
and spin our oxygen molecules within our bloodstream. Oxygen is the most important element to all of
biological life. This 60 GHz radiation WILL affect our body's ability to absorb oxygen properly.
Cumulative daily radiation exposure is associated with serious health effects. Examples are headaches,
migraines, dizziness, cancer, insomnia, memory problems, depression just to name a few. Many people
already have EMF sensitivities from the wireless radiation frequencies that we currently use. EMF
sensitivity is a recognized disability under the American Disability Act and if these towers affect Ithaca
residents with this disability, the city is discriminating against these residents. Will Ithaca go to every
home and determine if the residents have a documented EMF sensitivity? If the city isn't willing to do
this then they will be liable and will have to remove these towers near any place in Ithaca that these
residents go (like grocery store, church, work, etc) since those residents are being discriminated against.
The American Academy of Pediatrics is one of many medical organizations that is calling for federal
action to protect children from wireless radiation. For example, the American Academy of Pediatrics
webpage on Cell Towers states:
“An Egyptian study confirmed concerns that living nearby mobile phone base stations increased the risk
for developing:
-Headaches
-Memory problems
-Dizziness
-Depression
-Sleep problems”
In fact, the American Academy of Pediatrics (AAP), our largest organization of children’s doctors, has
repeatedly written the US government that current regulations on cellular radiation are outdated and
non protective for children and pregnant women. “Children are not little adults and are
disproportionately impacted by all environmental exposures, including cell phone radiation. Current FCC
standards do not account for the unique vulnerability and use patterns specific to pregnant women and
children. It is essential that any new standard for cell phones or other wireless devices be based on
protecting the youngest and most vulnerable populations to ensure they are safeguarded throughout
their lifetimes.”
The FCC does not monitor radiation exposures from cell installations and many cell towers are in
violation of the radiation limits. The Wall Street Journal did an investigative report in 2014 examining
over 5,000 cell antennas sites and found that 1 in 10 sites violated the rules during safety audits for
carriers and local municipalities “underscoring a safety lapse,” yet the FCC has issued just two citations
to cell carriers since 1996 because “the FCC says it lacks resources to monitor each antenna.” A CBS
Atlanta investigation also found radiation excesses up to 400 percent of the limit close up to the
antennas on rooftop posing serious health risks especially to any worker coming on the roof. Will the
city of Ithaca be responsible if these towers are not FCC compliant or will Verizon be? How often will the
city check these towers for compliance and who will check them (Verizon or the city)? If a small cell
goes up by my house, I will get an independent company to check the radiation levels and I will sue the
city if it is not in compliance. I will check it everyday, every night if I have to. I am NOT in agreement
with these towers being placed anywhere near human life and I will continue to fight this since I know in
my heart I am doing the right thing. Luckily, there are so many avenues by which to fight this. That I am
grateful for!
I would love to talk more about this in person and bring hundreds of studies to show the City Council
members. Thank you for taking the time to listen to my concerns about these small cell towers.

Dear Common Council members,
I am writing as a concerned member of the Ithaca community to oppose the spread of 4G and the
implementation of 5G wireless technology in our city. There are studies showing that wireless radiation
frequencies can effect the human endocrine (hormone) system, the immune system, increase the risk of
various types of cancers, increase the risk for neuropsychiatric effects including depression, damage
DNA, affect brain function, reduce memory functions, induce apoptosis (programmed cell death that can
lead to neurodegenerative disease), and multitudes of other effects documented in peer-reviewed
studies, as well as anecdotal reports of electro-hypersensitive symptoms.
Current standards of radiation frequency exposure that have been adopted by the U.S. Federal
Communications Commission (U.S. FCC) are based on short duration exposure and not for long duration,
high frequency exposure, which would be normal if more small cell radiation antenna were installed in
Ithaca. I think this needs to be considered and addressed to potentially change the outdated standards
that are currently in place for our country. Until then it seems irresponsible to roll out hoards of
antennas with all of the mounting evidence that shows the danger of wireless communication
technologies. Also, in this time of COVID-19 I find it appalling that non-essential business such as 5G
implementation is being considered as worthy of funding.
I think it is extremely important for more research done by scientists outside of the telecommunications
field be conducted to make unbiased assessments on the impact this technology has on living
organisms. I also think that our law makers and representatives should take it upon themselves to look
into the studies that already exist so that they can make informed decisions on whether or not to allow
large telecommunications companies to implement more wireless communication in cities throughout
our country. To me, the clearly demonstrated risk 5G poses to our entire community, with babies and
the elderly being most the susceptible, does not outweigh the benefit of having faster internet
capabilities.

First off, let’s just establish that Ithaca would be ahead of the curve - rather than behind by waiting at
least a few years to install and activate 5G locally. On a cynical note - the whole 5G thing is just another
excuse for cell phone companies to get you to need to “upgrade your phone” - making phones and
technologies that don’t operate on the 5G network obsolete. For that matter - do we really need to live
on and in our phones more than we currently do ? I know I’m not alone in my frustrations regarding how

technological “upgrade and innovation in the name of progress “ is that - just like “progress” we have
witnessed in the past - this technology too comes with a host of risks both to human health and to the
health of animals, and “essential worker” insects like our pollinating bees ... I’ll leave the science behind
all that to the comments I’m sure others are making. Bottom line - lets take our time on 5G - there’s no
rush on this one... Let them test it out and improve technology where they do - and lets be one of the
cities that was wise enough to wait.

These are the facts I know and I am available to share my evidence and experience by request. 5G was
developed by the military as a millimeter length weapon. The National Toxicology Program's 14 year, 25
million dollar study shows clear evidence of harm from 2G and 3G. There is much we are not being told
and studies of harm to any biological cell is vastly studied independently through open science.
Can we call it a nefarious technology? Can we trust the government in Washington DC and their
agencies? How would we know? Are these questions enough to put a moratorium on introducing this
without having answers? Let's look at it further.
The science I have studied shows at 60 gigahertz, 5G causes deleterious damage to oxygen molecules.
There was a passionate senator who questioned a panel from Telecom in a hearing and they admitted
more studies should be done but to this date they have not produced. One study shows 5G knocking
birds and bees right out of the sky in flight dead. Many municipalities and places all around the world
have rejected this technology. I have strong evidence refuting what the industry, the government, the
media, and Western Rockefeller science has to say about this matter. It's compartmentalized and is the
reason their message has such impact.
It takes 7 seconds to send a text to Japan. Do we really need something faster? My background to make
such statements is that I have been to several different colleges, studied many aspects of science for 4
decades, research both sides of an issue thoroughly, I am a combat veteran and I protected nuclear
missiles for the Army and the Navy.
So I implore you to search your critical thinking skills, look at the evidence, and your moral obligation
and ask yourself is it okay to allow a technology that has not been studied, or at least not been disclosed
to the public, or to receive revenue from a large multi-billion monopoly who very well may not have
everyone's best interest in mind, to say the least?

If I thought screaming into the void of frequencies would acomplish much you would hear my voice on

understand that you are meeting to discuss this topic, and I would like to state for the record that the
city of Ithaca should halt turning on all5G towers until independent safety studies can be completed.
There are several other communities opting for the halt, and we would be wise to do the same.
Pioneer Dr. Devra Davis is the reason why we no longer have smoking on airplanes. After winning that
battle, she turned her attention to the dangers of WIFI and has been very vocal about the potential
dangers of 5G. She is currently waging a lawsuit against the FCC. I encourage you to read the scientific
studies on her website / EHTRUST.ORG and watch her international lectures on the subject on youtube.
Unlike smoking, wifi has been an extremely useful tool in modernizing our world, but its convenience
and value does not mean we ignore the risks. I hope that a halt on 5G in Ithaca will give us time to find
a balance based on Health, transparency and of course the convenience of high speed internet.

Studies have shown significant risks associated with 3G and 4G networks. These networks are what our

Currently, in Fall Creek there are signs telling pedestrians to stand clear of broadcast receivers. If 6 feet
is too close... how is 7 feet safe? These are imaginary thresholds in a gradient reality.

New 4GLTE/low band 5G Hybrid antennas are being located in neighborhoods. These technologies
increase data download speeds and the number of cell signals and information broadcast in the same
airspace. The amount of modulation and pulsing that occurs in creating and shaping the cell signal from
these antennas results in homes in a neighborhood being bathed 24/7 with strong, always-on radio
frequency (RF) energy (RF radiation, RFR) that easily passes through walls. Several decades of
international scientific research confirms that RFR from wireless antennas and wireless devices is
biologically active in humans and is now considered to be a human health problem. Included are cellular
stress, increase in harmful free radicals, genetic damages, structural and functional changes of the
reproductive system, learning and memory deficits, neurological disorders, and negative impacts on
general well-being in humans ( EMFscientist.org , "Scientists call for protection from non-ionizing
Electromagnetic field exposure"). Therefore recent increases in health symptoms in residents living
near newly installed small cell antennas in neighborhoods may be related to the signals they emit.
I have struggled with sensitivity to RFR for about 20 years, and have had to minimize my exposure to
RFR in order to survive. It is a health condition that cannot be treated or cured; the only way to
minimize symptoms is to minimize exposure to RFR. It has been necessary to hardwire all devices in my
house that are required for internet access, and in some cases install shielding to minimize RFR getting
into my home from the outside, and avoid environments where strong RFR is present. I am concerned
not only for my health, but also that of those who live in our city and town of Ithaca and the population
in general. With the growth in use of wireless technology, experts in this field estimate that in the U.S. ,
Canada and Western Europe, about 35% of the population already have moderate symptoms of RFR
sensitivity, and 3% have severe symptoms. This will only get worse as we increase the use of more
powerful 4G/5G wireless technology. At a minimum, new 4G/5G small antennas should not be installed
in residential neighborhoods.

I am writing to request a moratorium on the roll-out of 5G, until potential hazards for human health and
the environment have been fully investigated by scientists and medical doctors independent from
industry.
There are thousands of independent studies that show adverse health impacts from wireless radiation.
Children are more vulnerable, and they depend on us to protect them. Studies also show wireless
radiation harms birds, bees, trees and nature, something most of the people in this town have great
respect for.
The US National Toxicology Program $30M study on cell phone radiation found male rats exposed for
two years to cell phone radiation developed significantly increased gliomas (brain cancer) and schwann
cell tumors, the very same types of tumors increased in long-term human cell phone users.
5G will not replace current 3G and 4G networks. It will be in addition to these networks, further
increasing involuntary exposure.

The insurance industry is aware of the risks and will not insure against electromagnetic radiation.
According to a 2019 Swiss Re Report, 5G is rated as a “high impact” emerging risk affecting property and
casualty claims in more than 3 years. As the biological effects of EMF in general and 5G in particular are
still being debated, potential claims for health impairments may come with a long latency.
The peer reviewed research shows wireless radiation is a threat to the physical health of everyone living
in this town in close proximity to the numerous new cell towers that will need to be installed for 5G to
work.
Who’s responsible for health, doctors or scientists? The only individuals saying 5G is safe are industry
scientists and lawyers.
When there is scientific uncertainty, the precautionary principle must be applied and you must err on
the side of caution.
While the 1996 Telecommunications Act paved the way for deregulation and monopolization of the
Industry and protects telecom providers from liability, it does not protect local government officials that
authorize the approval of cell facilities.
People around the world being injured by these toxic frequencies are holding those responsible for
approval, accountable. I suggest you strongly consider this before approving a technology lacking in
safety studies.

promoting disinformation about wireless communications and 5G wireless / mobile technology. There
were a couple of dubious (old) studies that have been mis-used, cherry picked, and refuted to provide a

I encourage and implore members of Common Council to not mistake the high volume and intensity of

A rapid roll-out of 5G in the city would be a boon to its residents and provide much needed high-speed
internet access as well as needed competition to entrenched incumbents. I encourage Common Council
to move expeditiously to do what it can to encourage 5G providers to install and provide service in
Ithaca - the sooner, the better.

Hello Ithaca City Council members. Thank you for your service to the community. I am writing
concerning the master license agreement for small cell facilities with 4G and 5G capability. I want to
share with you some of the known biological effects of pulsed and polarized non ionizing radiation, also
know as wireless radiation, in which the community’s inescapable exposure would increase
exponentially, if you decide to approve the agreement. There are many studies documenting these
negative effects and I have sent you a separate email citing many studies to take into consideration.
Martin L. Pall, PhD, Professor Emeritus of Biochemistry and Basic Medical Sciences Washington State
gives an overview of such biological effects:
“1. Attacks our nervous systems including our brains leading to widespread
neurological/neuropsychiatric effects and possibly many other effects. This nervous system attack is of
great concern.
2. Attacks our endocrine (that is hormonal) systems. In this context, the main things that make us
functionally different from single celled creatures are our nervous system and our endocrine systems,
even a simple planaria worm needs both of these. Thus the consequences of the disruption of these two
regulatory systems is immense, such that it is a travesty to ignore these findings.
3. Produces oxidative stress and free radical damage, which have central roles in essentially all chronic
diseases.
4. Attacks the DNA of our cells, producing single strand and double strand breaks in cellular DNA and
oxidized bases in our cellular DNA. These in turn produce cancer and also mutations in germ line cells
which produce mutations in future generations.
5. Produces elevated levels of apoptosis (programmed cell death), events especially important in causing
both neurodegenerative diseases and infertility.
6. Lowers male and female fertility, lowers sex hormones, lowers libido and increaseds levels of
spontaneous abortion and, as already stated, attacks the DNA in sperm cells.
7. Produces excessive intracellular calcium [Ca2+]i and excessive calcium signaling.
8. Attacks the cells of our bodies to cause cancer. Such attacks are thought to act via 15 different
mechanisms during cancer causation.”
For the sake of the health of the Ithaca community, I strongly urge you, to turn down this agreement.
Many other communities have also made the decision to use the precautionary principle until there are
studies proving the safety of this technology being used long term on the population. Please, we beg
you, do not force this onto your community for the sake of more money for the telecommunication
industry. You community’s fate is in your hands.

I am a long-time resident of the City of Ithaca and I am extremely concerned about the impending
installation of and the radiation emissions from small cell facilities.
The human body, as well as all other living organisms, was never meant to withstand the intense
onslaught of continual exposure to extremely high electromagnetic frequency, as is found in millimeter
wave technology, commonly known as 5G. Independent doctors and scientists from all over the world
have demonstrated the negative health impacts of this unsafe technology. These include, but are not
limited to: radiation burns on the skin, cellular disruption leading to tumor formation, emotional and
cognitive dysfunction, hypoxia (insufficient oxygen supply to tissue), sterility and other reproductive
structural and functional changes, significantly elevated cancer risk, neurological disorders, suppression
of immune function, sleep disruption, tinnitus, headaches, DNA and other genetic damage, and more.
Conversely, there has not been one single study of any kind (including from the telecommunications
industry itself) that has concluded that this technology is safe.
Nowhere have I seen a proper compilation and dissemination of information regarding these and other
facts in Ithaca, even though our city is planning to install these millimeter wave towers every 500 feet or
so. These small cell facilities emit constant, harmful levels of radiation at a range of 2,000 feet. This is in
direct violation of my sovereign right as a resident of this city and a citizen of this country to informed
consent. Informed consent involves providing every person in our community all available information
regarding 5G (facts, studies, data, testimonies, etc.) so we the people know what is being imposed upon
us. We then have the right to give or deny consent to this exposure. Due to this lack of information, the
people of this city cannot come to their own conclusions and therefore make an informed decision. This
mandatory imposition is in direct violation of our human rights.
I hereby deny the City of Ithaca permission to install small cell, millimeter wave (5G) towers anywhere
within 4,000 feet of my property located at 202 Dey St., Ithaca, NY.

We recognize that the City of Ithaca is facing unprecedented challenges during this extraordinary time.
As a local non-profit organization, Historic Ithaca is doing our part to support our community through
these challenges. We are seeing firsthand, in the last weeks, the difficult decisions that municipalities
throughout New York State are forced to make, due to lack of federal aid. That aid, we believe, should
be committed to assisting local governments at this time of essential need; we have reached out to our
elected federal officials to advocate and with our colleagues' groups for this aid.
We understand the dire financial straits that have necessitated the furlough of dedicated city
employees. Undoubtedly, this was a wrenching decision. We are alarmed that the Historic Preservation
Planner for the City of Ithaca, Bryan McCracken, was part of the recent furloughs. As you know, Ithaca
has a large number of individually listed properties and properties that are part of our historic districts.
Bryan's direct work with countless property owners through individual consultation and the ILPC over
the years has been invaluable and made our community livable and attractive for both residents and
visitors. Place is important. With his specialized training and education, Bryan serves as an important
partner on several initiatives and grant applications and recently, in sustainability as it relates to
preservation. We appreciate his expertise and willingness to work with everyone. Ithaca is a Certified
Local Government with a preservation ordinance that has been actively used for decades. As such, the
city is respected by many other communities throughout the region and the state for its commitment to
historic preservation.
We hope that Bryan will be restored to his position at the nearest available opportunity.

Last month, instead of a local rent freeze, you voted to back a pair of bills in Albany. But we’re not
hearing anything from Albany. Now a bill has been introduced in Congress in Washington, HR 6515, that
would achieve the same main things and then some. HR 6515 would suspend rent payment for the
duration of the crisis, meaning no rent obligation, no late fees, no debts, no retaliation; it would similarly
suspend residential mortgage payments for the duration of the crisis; it would enforce these
suspensions; it would let property owners apply for relief, provided that they agree to protections for
their tenants; it would likewise provide relief to lenders of those unpaid mortgages; and it would include
a buyout fund to prevent speculative purchases of multifamily housing and encourage sales to
cooperatives, land trusts, nonprofit providers and municipalities.
A Senate companion bill is coming soon. Politically speaking, that’s where a push from Ithaca can do the
most good. Not so much by approaching Representative Tom Reed, who despises us anyway, but by
calling on Senators Schumer and Gillibrand, who may be persuaded to do the right thing.

the expansion of the Telecomm's 4G towers, and the roll out of their new fifth generation (5G) network.
The new antennas are part of the next generation wireless network, and will be added on top of the
existing 3G / 4G / 4G LTE. There is strong scientific evidence proving that exposure to EMF radiation
from the EXISTING 3G/ 4G/ 4GLTE and WIFI technology causes harmful biological impacts. And there is

We ask that you remove item 3.3 from the consent agenda tonight and impose a moratorium on “small
cells” and other wireless infrastructure permits process and deployment until the COVID-19 emergency
is over.
The wireless providers are using the COVID-19 emergency as cover to expand and cement their rapid
and virtually unsupervised deployment of harmful wireless infrastructure. Our local leaders should not
have to dedicate time and resources to policing whether the wireless companies are following local and
state law, they have far more important things to do.
The FCC wireless permit rules allow emergency moratoria. Homeland Security guidelines emphasize that
maintenance of existing communications capability is the priority. New construction is not “essential.”
The COVID-19 emergency has led to a government shut-down of non-essential activity. Hospitals,
emergency response and local officials are overwhelmed and they must be allowed to focus on what is
indeed “essential”. Now is not the time to be dedicating resources to expanding, rather than just
maintaining, our networks.
The FCC has directly held a local jurisdiction can impose a temporary halt to deployment and permits
during emergencies. In the Matter of Accelerating Wireline Broadband Deployment by Removing
Barriers, FCC 18-111, 33 FCC Rcd 7705, 7784-7785, 157 (2018) (“We recognize that there may be limited
situations in the case of a natural disaster or other comparable emergency where an express or de facto
moratoria that violates section 253(a) may nonetheless be necessary to protect the public safety and
welfare’ or to ‘ensure the continued quality of telecommunications services.’”)
Homeland Security has declared that local government is on the forefront and can take control over
determining whether to temporarily halt all non-essential activity. Homeland Security guidance
documents prioritize maintenance of existing Communications Systems, and do not support “essential”

Cities can and should impose a moratorium on deployment in their local area and freeze the permit
process until the COVID-19 emergency is over.
Please take this opportunity to focus on the pressing needs that our people and our city faces and table
this until we are through this crisis and can have a real and meaningful opportunity to explore this issue
as it deserves. In the meantime, it would be helpful to have a public zoom forum to let people know
what has already been done in terms of small cell installation and rollout and keep us informed of any

I can't believe that amidst an economic and health crisis, the Council is considering allowing 5G in our
area. As a longtime Ithaca resident, I am truly horrified by the dangers of 5G, as literally thousands of
studies have shown. This is why countries such as Switzerland are holding off on 5G until more research
is done. I implore the Council to pause on this. This issue is so important that if you go ahead and allow
this, I will do everything in my power to get everyone in favor of it voted off the council.

Hello Council Members,
I am aware that you are currently discussing a proposed financial agreement with Verizon for the
expansion of the Telecomm's 4G towers, and the roll out of their new fifth generation (5G) network.
The new antennas are part of the next generation wireless network, and will be added on top of the
existing 3G / 4G / 4G LTE. There is strong scientific evidence proving that exposure to EMF radiation
from the existing 3G/ 4G/ 4GLTE and WIFI technology causes harmful biological impacts. There is
essentially no research on the safety of 5G. This is an undeniable risk.
Furthermore, the FCC’s exposure and testing limits have not been updated in decades. They were set
well before the invention of smartphones, and reflect what was deemed safe 25 years ago (!)
Ithaca Common Council and the Tompkins County Legislature have the power to stop this tonight.
Following the Homeland Security and the FCC orders, local authorities have emergency powers to place
a moratorium on non-essential activity, including to pause all pending wireless zoning and right-of-way
applications and to shut down new wireless construction.
As a resident of Ithaca and Tompkins County, I am joining fellow residents in calling for a temporary
moratorium on this issue until scientific studies are done which prove that the technology is safe, and
until we are able to have full public comment and discussion to explore the topic.
I would like to see independently produced, scientific research that explicitly proves 5G safety before
exposing our community to even more EMF radiation leading to unknown, potentially severe health
outcomes.
What's the rush? Why don't we wait for the safety studies to be conducted? Or at least wait until after
the COVID-19 pandemic so that your constituents can attend the meeting in-person to voice their
concerns?
This is a human rights and public health issue that deserves our full discussion and participation.
