Regular Meeting The Regular wAting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline H. Parker absent: Councilman Edwin O'Donnell Others present were Town Attorney, Philip Rumsey; Town Highway Superintendent, Carl Bush; newsreporter, Margaret McHugh; County Legislator, Madge McGrady; Patrick Faraday from WKRT; and Town Residents, Jeremy Mackey and Bob Moore. The meeting was called to order by Supervisor Pierce at 7:30 o'clock p.m. He requested that all those in attendance rise and pledge allegiance to the flag. ` ' A motion was made by Councilman Testa, seconded by Councilman Thorpe, to approve, as written, the Cortlandville Town Board minutes of September 07, 1988, September 19, 1988 and September 21, 1988. All voting aye, the motion was carried. A motion was made by Councilman Thorpe, seconded by Councilman Rocco, to receive and file the Cortlandville Planning Board minutes of September 27, 1988. All voting aye, the motion was carried. audit of bills Motion by Councilman Rocco Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers #457 - 478 $ 7,895.21 Highway Fund 277 - 282 20678.69 Water Fund 162 - 167 18,319.63 Sewer Fund 103 - 107 22,312.93 The reports of the various departments are on the table for review, and are available for inspection, on request, in the Town Clerks office. Supervisor Pierce offered those in attendance the privilege of the floor. Councilman Rocco apprised the Board that he has received correspondence from a few municipalities and residents, regarding weed and noise control. As soon as he has anything significant to report, he will do such. Wednesday October 05, 1988 Page 2 A motion was made by Councilman Thprpe, seconded by roo & file Councilman Testa, to receive and file the letter and Iettar& pet, petition by residents of Crestwood Court. All voting Crestwood Court aye, the motion was carried. The letter was lodging a formal complaint against the owners of the True Value Home Center, Inc. of Rt.281. A motion was made by Councilman Thorpe, seconded by Councilman Testa, to receive and file the letter from letter from Scott Foster , sales manager for Tricil (NY) Inc. All CrioiI rate inc. voting aye, the motion was carried. The letter was apprising the Town of a rate increase monthly of $2.00 for the Town Hall and $8.00 for the Park for trash removal, effective September 12, 1988. A motion was made by Councilman Rocco, seconded by Councilman Thorpe, to receive and file the letter to Supervisor Pierce from Roy Susskind, Executive Director Letter from of J.M. Murray Center Inc. All voting aye, the motion 3ooskind was carried. qaterIine The letter was requesting a resolution from the Town of Cortlandville stating that the Town would accept all responsibility for the water line starting from the Murray Center property east. This letter was forwarded to the Town Attorney, Phillip Rumsey for review. kutborioe Mel to write letter k1banese Plumbing RESOLUTION #247 AUTHORIZE SUPERVISOR TO WRITE LETTER Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, there has been an ongoing problem with the plumbing at the Town Hall since the new addition was finished, and WHEREAS, Albanese Plumbing, who was awarded the contract for plumbing in the addition, has not responded to requests to correct these violations, and WHEREAS, Resource Associates was responsible for completion of the addition, therefore BE IT RESOLVED, that Supervisor Pierce is authorized and directed to write a letter to Mark Albanese of Albanese Plumbing, regarding the violations and their intentions to correct them, and also RESOLVED, that a copy of said letter shall be sent to Resource Associates. RESOLUTION #248 RECEIVE TENTATIVE BUDGET FOR 1989 FOR receive Tentative Budget for 1989 Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED 0 BE IT RESOLVED, that the Town Clerk, Pauline Parker, presented to the Town Board the 1989 Tentative Budget for the Town of Cortlandville. Wednesday October 05, 19B8 Page 3 A motion was made by Councilman Thorpe, seconded by Councilman Rocco to receive and file the list of Election Inspectors from the Cortland County Board of election Elections. All voting aye, the motion was carried. ins pe CtOTES RESOLUTION #249 AUTHORIZE USE OF MEETING ROOM FOR ' Motion by Councilman Thorpe Seconded by Councilman Rocco defensive { VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Safety Council of Central New York is hereby authorized to use the Town Hall meeting ^ room one Saturday each month for the Defensive Driving Course, and be it further RESOLVED, that the Town Clerk is hereby authorized and directed to forward a copy of the scheduled course dates to the Cortland County Motor Vehicle Department for informational purposes. RESOLUTION #250 SET DATE FOR PUBLIC HEARING OCTOBER 19, Motion by Councilman Thorpe public hearing Seconded by Councilman Rocco Traffic Ord. VOTES: ALL AYE ADOPTED BE IT RESOLVED, that a Public Hearing shall be held on October 19, 1988 at 5:15 o'clock p.m. at the Town Hall concerning a proposed Ordinance prohibiting the parking of vehicles on all highways within the Town of Cortlandville between 1:00 o'clock a.m. and 7:00 o'clock a.m. from November 1 to May 1, and providing for penalties for violations of said Ordinance. Town Resident, Bob Moore questioned how a parking ordinance would be enforced. Town Highway Superintendent, Carl Bush apprised those present that the Sheriff's Department removes vehicles that hinder the removal of snow in winter months. RESOLUTION #251 AUTHORIZE H'WAY SUPERINTENDENT TO Motion by Councilman Rocco Seconded by Councilman Testa Aothorizeoigas Parking MOTION WITHDRAWN - NO ACTION TAKEN RESOLUTION #252 AUTHORIZE ROAD SIGN FOR CRESTWOOD COURT Motion by Councilman Rocco authorize sign No One Seconded Motion Crestwood Court No Action Taken Wednesday October 05, 1988 Page 4 RESOLUTION #253 ADOPT BENNIE ROAD WATER IMPROVEMENT AREA AND SET DATE FOR PUBLIC HEARING �e���e 8o�d ��un� Motion by Councilman Thorpe Ad opt Water Project Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the establishment of a water improvement project for a portion of Bennie Road east �- from N.Y.S. Rt. 13 in the town of Cortlandville and designated "Bennie Road Water Improvement," as required by Section 209-q and 209-c of the Town Law, and are available for public inspection, and WHEREAS, the proposed improvement consists of the extension of water lines into the said area by construction of approximately 1,300 lineal feet of service pipe east from N.Y.S. Rt. 13 along Bennie Road in accordance with the said plans now on file in the Office of the Town Clerk of the Town of Cortlandville, and WHEREAS, the maximum amount proposed to be expended for said improvement is $50,000.00, and WHEREAS, the proposed method of financing the said improvement is from the issuance of serial bonds in the maximum amount of $50,000.00 issued by the Town of Cortlandville for a maximum term of fifteen years at prevailing interest, said principal and interest to be paid from the users and benefitors of the water improvement through water rates, charges and fees assessed to the Town wide water improvement, It is hereby ORDERED, that a meeting of the Town Board of the said Town of Cortlandville shall be held at the Town Hall, Terrace Road, Cortland, New York on the 19th day of October, 1988 at 5:00 o'clock p.m. of that day to hear all persons interested in the proposed water improvement, and for such other action of said Town board with relation to the said water improvement as may be required by law or be deemed proper. A lengthy discussion followed regarding the problem trash recycling of recycling trash. Supervisor Pierce suggested that there should be a committee with members of the villages and towns to work together to alleviate the problem of recycling in our County. �- Councilman Rocco suggested independent haulers should be added to said committee. Councilman Thorpe would like to see all responsibility of recycling assumed by the County. Supervisor Pierce apprised the Town Board that the Solid Waste Committee of the County Legislature took action today and will be submitting an application for funding of the program. County Legislator, Madge McGrady apprised the Town Board of the situation in the County regarding nursing homes and hospital bed availability. She is a member of Madge McGraAy the County Health Committee which met recently., nursing homes 3a7 1 1 Wednesday October 05, 1988 Page 5 A motion was made by Councilman Thorpe, seconded by Councilman Rocco, to recess the regular meeting and convene to an Executive Session in the matter of pending litigation. All voting aye, the motion was carried. The following information was received from the Supervisor's office: A motion was made by Councilman Thorpe, seconded by Councilman Testa, to adjourn the Executive Session and reconvene the Regular Meeting. All voting aye, the motion was carried. No action was taken. A motion was made by Councilman Testa, seconded by Councilman Thorpe, to adjourn the regular meeting.
