WHEREAS, at the Town Board meeting of August 3, 1988,
Mr. John Mac Neill of the Economic Development Committee
apprised the Town Board that the EDC suggested that
someone from the Town Board represent the Town at their
meetings so that he could keep the Board updated on
happenings of the EDC, therefore
BE IT RESOLVED, that Supervisor Pierce does hereby
appoint Councilman Raymond Thorpe to attend the meetings
of the Economic Development Committee, and also
RESOLVED, that all activities of said committee shall be
reported to the Town Board.

hereby amended by adding new paragraphs 6. and 7. to
Section 11.2 to read as fo1lows:

Building Permit shall be authorized at such time as all
conditions are met. Application to the zoning Officer
for any Building Permit or Certificate of Zoning
Compliance authorized by resolution of the Planning
Board under which a site plan approval is granted, shall
be made within sixty days from the date the resolution
is filed with the Town Clerk.
7. The Planning Board on its own motion, may revoke
any site plan approval for noncompliance with conditions
set forth in the granting of said approval after first
holding a public hearing and giving notice of such
hearing as provided in Section 11.5(3). The foregoing
shall not be the exclusive remedy, and it shall be
unlawful and punishable hereunder for any person to
violate any condition imposed by a site plan approval.
SECTION 2. Local Law Number 1 for the Year 1986 is
hereby amended by adding the following to paragraph 3.
of Section 12.2:
The Planning Board may conduct a public
hearing on the application. If a public hearing is
considered desirable by a majority of the authorized
members of the Planning Board, such public hearing shall
be conducted within forty-five (45) days of the
acceptance of the application and shall be advertised in
a newspaper of general circulation in the Town at least
five (5) days before the public hearing.

SECTION 3. Local Law Number 1 for the Year 1986 is
hereby amended by deleting paragraph 7. of Section 12.2
and adding a new paragraph 7. and 8. to Section 12.2 to
read as follows:
7. If approval or conditional approval is

shall be added to the minimum fee $1.00 for each
$1,000.00 of construction value above $5,000.00.
SECTION 5. If any clause, sentence, paragraph,
sectionor part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid, such
judgment shall not affect, impair or invalidate the
remainder thereof, but shall be confined in its
operation to the clause, sentence, paragraph, section or
part thereof directly involved in the controversy in
which judgment shall have been recorded.
SECTION 6. This Local Law shall take effect in
accordance with the provisions of the Municipal Home
Rule Law and upon filing in the Office of the Secretary
of State. . .

WHEREAS, Councilman Rocco apprised the Board that there
have been several complaints regarding noise in the Town
at early and late hours, and
WHEREAS, at present, the Town has no ordinance to
control the noise, and
WHEREAS, Mr. Rocco has expressed a desire to head a
committee to explore the possibilities of establishing a
noise ordinance for the Town, and
WHEREAS, per Resolution #195 of 1988, a committee was
appointed to handle weed control in the Town, which
could also include noise control, therefore
BE IT RESOLVED, that Resolution #195 for the Year 1988
shall be amended to read as follows:

appoint Councilman Ronal Rocco to head a committee of 4
to create a possible ordinance regarding weed control
