Regular Meeting The Regular Meeting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Edwin O'Donnell Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline Parker Others present were newsreporter, Mike Middlestadt; Town attorney, Phillip Rumsey; Town Code Enforcement Officer, Bruce Weber; and Gary Creselli, Dr. Renner, and Dr. Lee Ambrose, representing Renaissance Associates. The meeting was called to order by Supervisor Pierce at 5:00 o'clock p.m; He requested that all those in attendance rise and pledge allegiance to the flag. RESOLUTION 4130 AUITHORIZE PAYMENT OF VOUCHERS JULY Audit of Motion by Councilman O'Donnell Vouchers Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: ` General Fund Vouchers #353 - 378 $635369.91 Highway Fund 196 -208 17,477.53 Water Fund 115 - 127 63431.58 Sewer Fund 71 - 75 5,508.94 A motion was made by Councilman O'Donnell, seconded by Councilman Rocco, to receive and file the letter from Congressman Sherwood Boehlert. Tunison A motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to receive and file correspondence from Senator Alfonse D'Amato. All voting aye, the motion was carried. Said correspondence was regarding the need for funding for the Tunison Laboratory of Fish Nutrition. A motion was made by Councilman O'Donnell, seconded by Councilman Rocco, to receive and file the letter from Homer Mayor, Mary Alice Bellardini to the NYS Department of Transportation. Renaissance Wednesday July 20, 1988 Page 2 RESOLUTION #181 RECEIVE AND FILE PERMANENT EASEMENT AND RIGHT-OF-WAY FOR CONSTRUCTION OF SANITARY SEWER MAINS WITH CORTLAND -COUNTY INDUSTRIAL DEVELOPMENT -AGENCY-_ roo and file Motion by Councilman Thorpe permanent easement Seconded by Councilman O'Donnell Cortland Co. ZDA VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Permanent Easement and Right - Of -Way for Construction of Sanitary Sewer Mains with Cortland County Industrial Development Agency for the McLean Road - Luker Road Sewer Project is hereby received and filed. A motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to receive and file the letter reo& file from Harold Herzog to Supervisor Pierce. RESOLUTION #182 AUTHORIZE FISCAL OFFICER TO TRANSFER MONIES FROM FEDERAL REVENUE SHARING Authorize transfer Motion by Councilman O'Donnell monies from FIS to' Seconded by Councilman Testa General fund VOTE8: ALL AYE ADOPTED WHEREAS, $2,000.00 per year for 1983, 1984, & 1985 of Federal Revenue Sharing Funds were received and designated for recreation purposes, and WHEREAS, these funds have accumulated interest, therefore BE IT RESOLVED, that the Fiscal Officer of the Town of Cortlandville is hereby authorized and directed to transfer the Federal Revenue Sharing funds in the amount of $6,954.90 into General Fund B (87140) for park use, and also RESOLVED, that the account set up at Marine Midland bank for Federal Revenue Sharing funds shall be closed as we are no longer receiving funds. RESOLUTION #183 REFERRAL TO CORTLANDVILLE PLANNING BOARD - APPLICATION FOR SPECIAL PERMIT RENAISSANCE ASSOCIATES Referral to Planning Board Motion by Councilman O'Donnell apaoieI permit Seconded by Councilman Thorpe Renaissance VOTES: ALL AYE ADOPTED WHEREAS, Renaissance Associates are proposing a project located in the Primary Aquifer Protection District, and WHEREAS, the next step in the process of acquiring a special permit for developing over the Aquifer, is a review by the Cortlandville Planning Board, therefore Ll 280 Wednesday July 6, 1988 Page 3 BE IT RESOLVED, that the application for a special permit from Renaissance Associates is hereby referred to the Cortlandville Planning Board for review. RESOLUTION #184 SET DATE FOR PUBLIC HEARING SEPTEMBER 7, 1988 - SPECIAL PERMIT RENAISSANCE Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, Renaissance Associates have submitted a request for a special permit to develop over the Aquifer, and WHEREAS, this permit has been referred to the Cortlandville Planning Board, and WHEREAS, the continuing process requires a Public Hearing before the Town Board, therefore BE IT RESOLVED, that a Public Hearing shall be held before this Town Board on September 7, 1988 at 7:30 p.m., to review said application, contingent on acceptance by the Cortlandville Planning Board and the Cortland County Planning Board. RESOLUTION #185 AUTHORIZE SUPERVISOR PIERCE TO WRITE LETTER TO PROPER AUTHORITIES REGARDING ___R1.2i-5 AND STARR ROAD INTERSECTION Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, there has been several accidents in the area of Rt 215 and Starr Road due to the slope of the road, and WHEREAS, there are a number petitions forthcoming from residents of the area, therefore BE IT RESOLVED, that Supervisor Pierce is hereby authorized and directed to write a letter to the proper authorities, requesting action to alleviate this problem. Supervisor Pierce apprised the Town Board that the next Town Board agenda will include meeting with the Cortland County Industrial Development Agency. A motion was made by Councilman Rocco, seconded by Councilman Thorpe, to adjourn the regular meeting. All voting aye, the motion was carried. The meeting was adjourned at 5:25 p.m. Pauline H.
