Regular {`Meeting
The Regular Meeting of the Town Board of the Town
of Cortlandvil.le, was held at the Town Hall, 1'5 Terrace
Road, Cortland, New York, with Supervisor Pierce
presiding.
Members present: Supervisor Melvin Fierce
Councilman Raymond Thorpe
Councilman Ronal Rocco
Councilman Theodore Testa
Town Clerk Pauline Parker
absent: Councilman Edwin O'Donnell
Others present were Town Attorney, Phillip Rumsey;
newsreporters, Kevin Conlon from the Cortland Standard
and Jay Radzavicz from WhRT; .Judith Hayes from Seguin
Community Services; Town residents from Crestwood Court,
and several residents from Highland Road area.
The meeting was called to order by Supervisor
Pierce at 7:30 o'clock p.m. He requested that all those
in attendance rise and pledge allegiance to the -Flag.
RESOLUTION #120 AWARD BID FOR NEW 12 TON EQUIPMENT

It was the consensus of the members of the Town
Board that using the home at 4102 Highland Road, Seguin
Community Services would be causing an oversaturation of
similar facilities in the area.
The board rejected alternative sites presented by
local residents for the group home. They were advised
that they could forward the list to the State if they
desired.
RESOLUTION #122 RESPONSE TO SEGUIN COMMUNITY SERVICES'
REQUEST TO ESTABLISH A RESIDENCE ON

VOTES; ALL AYE ADOPTED
WHEREAS, a public hearing pursuant to Mental Hygiene Law
Section 41.34 was held on April 20, 1988 concerning a
site on Highland Road in the Town of Cortlandville for
operation of a community residential. -facility for the
disabled as proposed by Seguin, and
WHEREAS, it is agreed between the Town of Cortlandville
and the sponsoring agency Seguin that the 40 day period
of 'time for municipal response expires May Oc?, 1988,
NOW THEREFORE BE IT
RESOLVED,that the Town Hoard objects to the
establishment of a facility of the kind described by the
sponsoring agency, Seguin, because to do so would result
in such a concentration of community residential
facilities for -the mentally disabled in the municipality
and the area in proximity to the site selected on
Highland Road or combination of such facilities and
other facilities licensed by other state agencies that
the nature and character of areas within the Town of
Cortlandville would be substantially altered, and be it
further
RESOLVED, that a certified copy of this resolution shall
be forwarded to Seguin as the sponsoring agency and the
appropriate State Commissioner.
The reports of the various departments are on -the
table for review, and are available for inspection, on
request, in the Town Clerks office.
A motion was made by Councilman Rocco, seconded by

city has decided to terminate the existing sales tax

A discussion followed regarding the sales tax
issue. SUpervisor Pierce apprised the Town Board that
hr_ has requested a meeting of Town officials of the
area, to discuss this issue.

to permit replacement of mobile homes at the Cortland

but are not yet official amendments to the town
ordinances.

AN AQUIFER PROTECTION DISTRICT

proposed Local Law No. 1 for 19881 amending Local Law

on May le, 1988 at 7:00 o'clock p.m. at the Town Hall,
15 Terrace Road, Cortland, NY, and also

WHEREAS, several residents addressed the Town Board with
concerns with lack of cooperation from the owner of True
Value Home Center- of West; Road, Cortland, regarding
several issues including blocked access to Crestwood
Court, ruts left in private lawns by delivery trucks,
and an unsightly .and overfilled dumpster, and
WHEREAS, it was the consensus of the Town Board that the
most sensible way to approach this problem is to talk to
the owners, therefore

BE IT RESOLVED, that the Supervisor is hereby authorized
and directed to contact MIrs. Goodrich in DeRuyter, to
make her aware that there is a problem, and try to

the Town that the City has decided to terminate the
existing sales tax distribution agreement with the
county of Cortland, and
WHEREAS, if there is -a redistribution, this would take
monies away from the Town of Cortlandville, which the
Town uses for Sewer improvement, therefore

EDA - ITEMIZED STATEMENT OF ACCOUNTS OF

WHEREAS, through a 19B3 agreement, the City of Cortland
contributes about $15,000.00 to economic development on
behalf of the Town of CortIandville, and
WHEREAS, Supervisor Pierce wuuld Iike the Economic
Development committee and Richard A, Teichman Jr
executive vice president of the committee` to account
for how that money has been spent, therefore
BE IT RESOLVED, that the Supervisor is hereby authorized
and directed to write a letter to the EDC, requesting an
itemized accounting of expenses.
A motion was made by Councilman Thorpe, seconded by
Councilman Rocco, to adjcurn the meeting. All voting
aye, the motion was carried.
