Regular {`Meeting The Regular Meeting of the Town Board of the Town of Cortlandvil.le, was held at the Town Hall, 1'5 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Fierce Councilman Raymond Thorpe Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline Parker absent: Councilman Edwin O'Donnell Others present were Town Attorney, Phillip Rumsey; newsreporters, Kevin Conlon from the Cortland Standard and Jay Radzavicz from WhRT; .Judith Hayes from Seguin Community Services; Town residents from Crestwood Court, and several residents from Highland Road area. The meeting was called to order by Supervisor Pierce at 7:30 o'clock p.m. He requested that all those in attendance rise and pledge allegiance to the -Flag. Wednesday May 04, 1988 Page 3 It was the consensus of the members of the Town Board that using the home at 4102 Highland Road, Seguin Community Services would be causing an oversaturation of similar facilities in the area. The board rejected alternative sites presented by local residents for the group home. They were advised that they could forward the list to the State if they desired. RESOLUTION #122 RESPONSE TO SEGUIN COMMUNITY SERVICES' REQUEST TO ESTABLISH A RESIDENCE ON Response to _ HIGHLAND ROAD _ Seguin Home on Highland Road Motion by Councilman Thorpe Seconded by Supervisor Pierce VOTES; ALL AYE ADOPTED WHEREAS, a public hearing pursuant to Mental Hygiene Law Section 41.34 was held on April 20, 1988 concerning a site on Highland Road in the Town of Cortlandville for operation of a community residential. -facility for the disabled as proposed by Seguin, and WHEREAS, it is agreed between the Town of Cortlandville and the sponsoring agency Seguin that the 40 day period of 'time for municipal response expires May Oc?, 1988, NOW THEREFORE BE IT RESOLVED,that the Town Hoard objects to the establishment of a facility of the kind described by the sponsoring agency, Seguin, because to do so would result in such a concentration of community residential facilities for -the mentally disabled in the municipality and the area in proximity to the site selected on Highland Road or combination of such facilities and other facilities licensed by other state agencies that the nature and character of areas within the Town of Cortlandville would be substantially altered, and be it further RESOLVED, that a certified copy of this resolution shall be forwarded to Seguin as the sponsoring agency and the appropriate State Commissioner. The reports of the various departments are on -the table for review, and are available for inspection, on request, in the Town Clerks office. RESOLUTION #128 SET DATE FOR PUBLIC HEARING - May 13, 1988 - LOCAL LAW 3. FOR 1988 - CREATING AN AQUIFER PROTECTION DISTRICT Motion by Councilman Testa Set Date for Public Seconded by Councilman Rocco fearing - Aquifer VOTES: ALL AYE ADOPTED Dist. BE IT RESOLVED, that a Public Hearing concerning proposed Local Law No. 1 for 19881 amending Local Law No. 1 of 1986 (Town of Cortlandville Zoning Law), creating an aquifer protection district, shall_ be held on May le, 1988 at 7:00 o'clock p.m. at the Town Hall, 15 Terrace Road, Cortland, NY, and also RESOLVED, that the Town Board meeting scheduled -for 5:00 p.m. is hereby changed to 7:00 o'clock p.m. following the public hearing. RESOLUTION {;130 AUTHORIZE SUPERVISOR PIERCE TO MEET WITH OWNERS OF TRUE VALUE HOME CENTER ON WEST ROAD - DISCUSS PROBLEMS _ PRESENTED BY CRESTWOOD COURT RESIDENTS Authorize Mel to meet with owners (lotion by Supervisor Pierce of True Value Seconded by councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, several residents addressed the Town Board with concerns with lack of cooperation from the owner of True Value Home Center- of West; Road, Cortland, regarding several issues including blocked access to Crestwood Court, ruts left in private lawns by delivery trucks, and an unsightly .and overfilled dumpster, and WHEREAS, it was the consensus of the Town Board that the most sensible way to approach this problem is to talk to the owners, therefore 1 1 Wednesday May 04, 19B8 Page B BE IT RESOLVED, that the Supervisor is hereby authorized and directed to contact MIrs. Goodrich in DeRuyter, to make her aware that there is a problem, and try to alleviate it, and fur -they -- RESOLVED, that if satisfaction is not received from verbal discussion, Town Attorneyr Phillip Rumsey id hereby authorized and directed to send a letter 11 to the owners of True Value Home Center, stating the concerns of the residents of Crestwood Court. RESOLUTION #131 AUTHORIZE A MORATORIUM ON SEWER FOR THE TOWN OF CORTLANDVILLE Motion by Councilman Thorpe Seconded by rouncllman Rocco VOTES: ALL AYE ADOPTED WHEREAS, the mayor of the City of Cortland has nutified the Town that the City has decided to terminate the existing sales tax distribution agreement with the county of Cortland, and WHEREAS, if there is -a redistribution, this would take monies away from the Town of Cortlandville, which the Town uses for Sewer improvement, therefore BE IT RESOLVED that the Town Board d b , �� hereby authorize a moratorium on sewer cl ����(� own of Cortlandville' with the exception of Business and Industry' RESOLUTION #132 AUTHORIZE SUPERVISOR PIERCE TO CONTACT EDA - ITEMIZED STATEMENT OF ACCOUNTS OF RICHARD A. Motion by Councilman Thorpe S�econded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, through a 19B3 agreement, the City of Cortland contributes about $15,000.00 to economic development on behalf of the Town of CortIandville, and WHEREAS, Supervisor Pierce wuuld Iike the Economic Development committee and Richard A, Teichman Jr executive vice president of the committee` to account for how that money has been spent, therefore BE IT RESOLVED, that the Supervisor is hereby authorized and directed to write a letter to the EDC, requesting an itemized accounting of expenses.
