It was a Cortland, New York 13045 72-1t clarification of some wording in the proposed law. 1 4 Wednesday �esday April Ob , 19B9 Page 2 Attorney, William Pomeroy, representing the Cortland County Automobile Association addressed the Board. He voiced concern regarding the continued operation of automobile dealers in the Town, as they are classified as a non -conforming use. He stated that he thought this part of the proposed law singles out automobile dealers and would discourage future development in -the Town of Cortlandville. Nancy Jarvis, a member of the Cortland County Planning Department and editor of the proposed ordinance, stated that after a study of several municipalities in the State, she tried to screen the basics used by other localities and was not trying to single out car dealers as a prohibited use. They were included only because there are many of the latter located over sensitive areas of the aquifer, and they deal with dangerous toxic substances. Automobile dealerships are not the major concern, as they must comply with State codes. It was necessary to include verbage in -this proposal for independent garages also. A few residents of the Town voiced concern that this proposed law would depreciate the value of their property. James Feuss of the Cortland County Health Department answered many questions regarding State and County regulations of public water and sewer. Maureen Barringer representing the Cortland County Chamber of Commerce presented to the Town Board, a lengthy list of concerns regarding the proposed law as presented. Jamie Dangler of 807 Pheasant Run, chairman of the Clean Water Committee and a member of the Aquifer Committed, stated that there seems to be some misinterpretation of parts of the proposed law. She said that this law, whose purpose is to protect the Aquifer, the source of drinking water for the majority of residents of the Town, is intended to be a compromise. There was concern voiced as to how to dispose of hazardous materials. There was also concern over lawn spraying and manure spreading over the Aquifer. Some residents felt that educating the public about proper disposal of such wastes is the answer to protecting our water supply. It seemed to be the general consensus of the people in attendance that the Town Board needs to clarify parts of the proposed law. They also need to take more time to consider the input heard at this meeting before passing the proposed amendment. A motion was made by Councilman Thorpe, seconded by Councilman O'Donnell., to adjourn -the Public Hearing. All voting aye, the motion was carried. REGULAR MEETING Regular Meeting The Regular Meeting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Edwin O'Donnell Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline Parker Others present were Town Attorney, Phillip Rumsey; Town H'way Superintendent, Carl Bush; Town Code Enforcement Officer, Bruce Weber; Deputy Town Clerk, Diane Demeree; newsreporters, Kevin Conlon and Jack Miller; Jim Feuss from the Health Department; Maureen Berringer, representing the Cortland Chamber of Commerce; Mayo Snyder- and Nancy Jarvis from the Cortland_ County Planning Department; Attorney William Pomeroy, representing the Cortland County Automobile Association; and many area residents and business owners. RESOLUTION 48B AWARD THE BID FOR HIGHLAND ROAD AREA WATER IMPROVEMENT - PROJECT PHASE III TO VACRI CONSTRUCTION Notion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL. AYE ADOPTED WHEREAS, on March 021 19887 the Town Engineer, Hayne Smith was authorized to let out bids for the Highland Road Area improvement Project - Phase III, and WHEREAS, on March 31, 19ee, submitted sealed bids were opened and given to the Town Engineer for review, and WHEREAS, the lowest bid submitted was received from Vacri Construction in the amount of $91,150.00, and such bidder has met; all the requirements, therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby award the Highland Road Area Water Improvement Project - Phase III to Vacri Construction of Binghamton, New York in the amount of $91, 150.00. A motion was made by Councilman Thorpe, seconded by Councilman O'Donnell, to recess the regular meeting to hold a Public Hearing concerning proposed Local Law No. 1 for the year 1988 creating an Aquifer Protection District, amending Local Law No. 1 for the year 1966 (Town of Cortlandville Eoning Law) . RESOLUTION #89 TABLE AMENDMENT OF LOCAL LAW NO. 1 FOR 1988 CREATING AN AQUIFER DISTRICT, AMENDING LOCAL LAW NO 1 FOR 1986 - TOWN OF CORTLANDVILLE ZONING LAW Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that action on Local Law No. 1 for 1988, creating an Aquifer District', amending Local Law No 1 for 1986, is hereby tabled for further review. A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a letter- from the Cortlandville Planning Board, All voting aye, the motion was carried. The letter was expressing the Planning Board's approval of the proposed amendment of Local Law No. 1 for 1986. RESOLUTION #91 ACKNOWLEDGE PETITION FROM RESIDENTS _OF7 HOMESTEAD AND HALSTEAD AVENUES Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, a petition was received from residents of Homestead Avenue and Halstead Road in the Town of CortlandvilIe, requesting Town Sewer hookups, and WHEREAS, Supervisor Pierce stated that it is the Town's intention to provide Town Sewer for these residents in the very near future, therefore BE IT RESOLVED, that said petition is hereby received and filed. RESOLUTION #92 ACKNOWLEDGE PETITION FROM RESIDENTS OF HOXIES GORGE - POOR ROAD CONDITIONS Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, a petition was received by the Town Highway Superintendent, Carl Bush, from residents of Hoxie Gorge Road apprising the Town of the poor road conditions in that area, and WHEREAS, Supervisor Pierce and Mr. Bush recently met with some residents of said area to discuss the problem, therefore BE IT RESOLVED, that said petition is hereby received and filed. The letter was apprising Mr. Krichbaum of the continuing_ interest in the quality of the Tioughnioga River. The letter was confirming a telephone conversation regarding computation of water rates for municipalities. RESOLUTION #98 AUTHORIZE SUPERVISOR PIERCE TO RENT TWO NEW VOTING MACHINES FOR 1988 Authorize Mel to Motion by Councilman Rocco rent 2 voting machines Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, there have been problems with voting machines in the past, as some are very old and it has become difficult to get parts for these machines, and WHEREAS, the Voting Machine Service Center Inc. of Gerry, NY has given the Town of Cortlandville an option to rent machines and apply the rental fees to future purchase of said machines, and WHEREAS, monies have not been appropriated for voting machines for 1988, therefore BE IT RESOLVED, that the Supervisor is hereby authorized to rent two voting machines for the year 1988, with the option to purchase said machines in the 1989 fiscal year. Little York Rd., Homer, New York, for plumber recognition and was found to be in proper order, therefore BE IT RESOLVED, that the application submitted by Bruce Crandall, is hereby approved for both water and sewer connections, and be it further RESOLVED, that their name shall be added -to the approved plumber list of the Town of Cortlandville. RESOLUTION #105 AUTHORIZE SUPERVISOR TO SEND LETTER TO TRANSPORTATION COMMITTEE - CORTL_AND COUNTY AIRPORT EXPANSION Motion by Councilman Rocco Authorize Mel to Seconded by Councilman O'Donnell send letter to VOTES: ALL AYE ADOPTED Transportation Comm WHEREAS, the Cortland County Legislature recently took action for a proposed extension of a runway at the airport, which is located in the Town of Cortlandville, and WHEREAS, it has been brought to the attention of the Town Board that of the three legislators elected to represent the Town of Cortlandville, none of them were appointed to that committee, and WHEREAS, the Town Board was not notified in advance that an extension of the runway was being considered, therefore BE IT RESOLVED, that Supervisor Pierce is hereby authorized ad directed to send a letter to the County Le=gislature expressing the concerns of the Town Board relating to the County Airport expansion. A motion was made by Councilman Thorpe, seconded by Councilman Rocco, to recess the regular meeting and convene to an executive session, on a matter of pending litigation. All voting aye, the motion was carried. The following information was received from the Supervisor's Office: A motion was made by Councilman Rocco, seconded by Councilman Testa, to adjourn the Executive Session and reconvene the Regular Meeting. All voting aye, the motion was carried. RESOLUTION #106 AUTHORIZE REFUND OF SETTLEMENT AMOUNT SEWER RELEVY - WILLIAM PORTER M EN f, > E Q, ee_5 o 1---L A T k 0 N "t�_ 15 G O F 19 g 9 Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED aa3 Wednesday April 06, 198B Page 9 WHEREAS, the Town purchased from the City of Cortland certain sewer accounts originally charged by the City for service to Town of Cortlandville parcels 86.13-01- 56.000, 86.13--01-60.000, and 86.13-01-62.000 in the amount of $7,807.32 which included operation and maintenance and debt service arrears, and WHEREAS, said accounts represented charges to several ® different parcel owners between 1978 and 1986, and WHEREAS, the sir; year breach of contract statute of limitations has expired for the commencement of suit on many of such charges, and WHEREAS, such delinquent charges may not properly be included in the annual tax levy since, in part, there was no torn improvement area in place when most of the sewer charges were incurred, and WHEREAS, said sewer charges plus additional interest penalties were in fact relevied in the 19BB town and county tax bills for said parcels, and WHEREAS, after negotiations, art agreement has been reached with the current owner of said parcels on a disposition of said relevied sewer charges, NOW., THEREFORE, BE 1T RESOLVED, that upon proper payment in full of all three of the 19B8 town and county tax bills for Cortlandville parcels 86.1.3-01-56.000, 36.13-01-60.000, and 86.13-01- 62.000, the Town Clerk is hereby authorized and directed to refund from the appropriate account or accounts, all of the amounts due for all of said sewer rel.evies on said bills, excepting the sum of $4,000.00 which represents the settlement; amount, and be it further RESOLVED, that in the event such bills are not paid in full within a reasonable period of time, a copy of this resolution shall be forwarded to the Co; -eland County Legislature as a request; to authorize a. removal of the sewer relevies on the three 19BB ta- bills set forth herein. A motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to adjourn the meeting. A 11 1 voting aye, the motion Was carried.
