Regular Meeting
The Regular Meeting of the Town Board of the Town
of Cortlandville, was held at the Town Hall, 15 Terrace
Road, Cortland, New York, with Supervisor Pierce
presiding.
Members present: Supervisor Melvin Pierce
Councilman Raymond Thorpe
Councilman Edwin O'Donnell
Councilman Ronal Rocco
Councilman Theodore Testa
Town Clerk Pauline Parker
Others present were Town Attorney, Phillip Rumsey;
newsreporter, Kevin Conlon; Nancy Jarvis of the Cortland
County Planning Department; and Judith Hayes of Seguin
community services.
Supervisor- Pierce offered those in attendance the
privilege of the floor.
Nancy Jarvis of the Cortland County Planning
Department distributed the revised copies of the Aquifer
Protection Law to the Town Board members. They reviewed
the changes made to said law.
As a result of the review, [Is. Jarvis advised that
she would make the necessary changes, and prepare the
final draft. She requested that Attorney Rumsey advise
if there were any legal corrections needed before the
final draft was made.
Judith Hayes of Seguin Community Services apprised
the Board that they are proposing to purchase the
Property at 4102 Highland Road to establish another
group home.
It will. be necessary to have a public hearing to
inform the public of the proposed development. A date
was not set.
The Town Board asked Ms. Hayes to explain the
status of their property on Fairview Drive.
She explained that the Fairview Drive project was
let out to bid. The bids received were much higher than
anticipated. It will be let out again to bid in hopes of
keeping costs down.
Ns Hayes left brochures to be made available to the
Town residents. These brochures explain the process and
goals of Seguin community Services.

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:

A motion was made by Councilman O'Donnell, seconded
by Councilman Thorpe, to receive and file a letter from
rec & file Michael J. Clenhan, Assistant Director of the NYS
letter from Retirement System. All voting aye, the motion was

#57 of the Town of Cortlandville, providing the benefits
Of Section 41-j, allowance for Unused Sick Leave for
Town employees.
A motion was made by Councilman Thorpe, seconded by
councilman O'Donnell, to receive and file a letter from
rec & file John H. Buck of Buck Engineering. All voting aye, the
letter from motion was carried.

A motion was made by Councilman Thorpe, seconded by
rec & file Councilman O'Donnell, to receive and file a letter from

DRA -mining mining permit for Cortlandville Sand & Gravel, Inc.
permit renewal owned by Joe Gunzenhauser. All voting aye, the motion
was carried.
The permit, issued by the New York State of
Environmental Conservation Department is a renewal
effective March 14, 1988 and expiring July 13, 1990.
RESOLUTION #78 ACCEPT RESIGNATION JACQUELINE ROSEN -
CORTLANDVILLE ZOhNING BOARD OF APPEALS

VOTES: ALL AYE ADOPTED
WHEREAS, since Jacqueline Rosen is no longer a resident
of the Town of Cortlandville, therefore
BE IT RESOLVED, that the resignation of Jacqueline Rosen
from the Cortlandville Zoning Board of Appeals is hereby
accepted, with regret, and shall be effective
immediately, and also
RESOLVED, that Supervisor Pierce is hereby authorized
and directed to forward a letter to Jacqueline Rosen,
thanking her for her service to the Town of
Cortlandville.

RESOLUTION ##79 AUTHORIZE SUPERVISOR TO WRITE LETTER
TO SENATOR SEWARD AND ASSEMBLYMAN
RAPPELEA - SUSQUEHANNA FLOOD CONTROL
Motion by Councilman Thorpe
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, the Highway Superintendent received a letter -
from Cortland County Soil and Water Conservation
District, requesting the Town's support in securing
-funds to finance a project called the Susquehanna Flood
Control Program, and
WHEREAS, this letter also requested that Town Board
members write a letter of support for this program to
our representatives in the Senate and Congress,
therefore
BE IT RESOLVED, that Supervisor Pierce is hereby
authorized and directed to write a letter to Assemblyman
Rappeles and Senator Seward, voicing the Town's support
for funding of said program.
RESOLUTION #80 AUTHORIZE AERIAL SURVEY OF STARR ROAD
AND LAMONT CIRCLE
Motion by Councilman Thorpe
Seconded by councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, it is necessary to survey the area of Starr
Road and Lamont Circle, which includes elevations, and
WHEREAS, it is very expensive to hire surveyors to do
the required job, and
WHEREAS, an aerial survey would cost the Town
considerably less and provide us with -the necessary maps
and information, therefore
BE IT RESOLVED, that the Town Engineer, Hayne Smith, is
hereby authorized to hire TVG Photogrammetric Mapping
Services from Lanse Pennsylvania for the cost of
$4,795.00.

RESOLUTION #82 AUTHORIZATION TO BILL CITY OF CORTLAND
AND HOMER WATER CUSTOMERS EXACTLY WHAT
THE TOWN OF CORTLANDVILLE IS BILLED
WHEREAS, the City of Cortland requested the Town of
Cortlandville to act as a collecting agent for those
customers served by the City of Cortland for water
and/or sewer services, but are located in the Town of
Cortlandville; because they are not allowed to relevy if
necessary, and
WHEREAS, the Town of Cortlandville agreed to the
request, and
WHEREAS, this process is costing the Town more money
than what we can collect, and
WHEREAS, a request has been sent to NYS Audit & Control
for review, therefore
BE IT RESOLVED, that the Town of Cortlandville shall
bill these customers services served by another
municipality, the exact charge billed to the Town,
pending approval from Audit & Control.
RESOLUTION #83 AUTHORIZATION TO BILL TOWN RESIDENTS
THE INCREASED WATER RATES BEGINNING

WHEREAS, it had been the intent to bill Town residents
the increase in water rates, beginning with the April
1st billing, as a result of the Public Hearing held on
(larch 02, 198B, and
WHEREAS, Town Attorney, Phillip Rumsey apprised -the
Board that this can not be done, therefore
BE IT RESOLVED, that the water rate increase for
residents of the Town of Cortlandville shall take effect
with the July 1st billing.

BOARD - PROPOSED AMENDMENT CREATING

BE IT RESOLVED, that the proposed amendment to the
Cortlandville Zoning Law creating an Aquifer Protection
District is hereby referred to the Planning Boards of
the Town of Cortlandville and County of Cortland for
recommendation.

RESOLUTION 435 AUTHORIZE TOWN BOARD TO BECOME LEAD
AGENCY - PROPOSED AMENDMENT CREATING
AN AQUIFER PROTECTION DISTRICT
Motion by Councilman Thorpe
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Town Board of the Town of
Cortlandville declares itself the lead agency under the
State Environmental Quality Review Act concerning the
proposed amendment to the Cortlandville Zoning Law
creating an (-Aquifer Protection District.
RESOLUTION #86 DECLARE AQUIFER PROTECTION LAW TO BE
A TYPE I ACTION -- SEQRA
Motion by Councilman Thorpe
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
RESOLVED, that the proposed amendment to the
Cortlandville Zoning Law creating an Aquifer Protection
District, is found by the Board to be an action subject
to the State Environmental Quality Review Act f(SEQRA),
does not involve a Federal agency, does not involve a
decision by any other agencies, and be it further
RESOLVED, that such proposed amendment is classified as
a Type I action under SEQRA pursuant to 6 NYSCRR 617.12
(b), for which a full Environmental Assessment Form is
required, and be it further
RESOLVED, that the attached full Environmental
Assessment Form prepared by this Board is hereby
adopted, received and filed with the Town Clerk.
RESOLUTION #87 DECLARE NEGATIVE IMPACT - AQUIFER
PROTECTION DISTRICT
Motion by Councilman Thorpe
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
RESOLVED, that concerning the proposed amendment of the
Cortlandville Zoning Law creating an Aquifer Protection
District, the attached Negative Declaration (Notice of
Determination of Non -Significance) pursuant to the State
Environmental Quality Review Act, is hereby approved,
adopted, received and filed with the Town Clerk, and
based thereon, an Environmental Impact Statement will
not be required, and be it further
RESOLVED, that pursuant to 6NYCRR 617.10 (a), the Town
Clerk shall file a copy of this resolution making the
determination with the Commissioner- of the Department of
Environmental Conservation, the appropriate regional
office of the Department of Environmental Conservation,
and the Planning Boards of the Town of Cortlandville and
County of Cortland.

A motion was made by Councilman Rocco, seconded by
Councilman Thorpe, to recess the regular meeting and
convene to an executive session, regarding in the matter -
of pending litigation. All voting aye, -the motion was
carried.
The following was received from the Supervisor's
office:
A motion was made by Councilman Thorpe, Seconded by
Councilman O'Donnell, to adjourn the executive session
and reconvene the Regular Meeting. All voting aye, the
motion was carried.
No action was taken.
A motion was made by Councilman Testa, Seconded by
Councilman Thorpe to adjourn the Regular Meeting. All
voting aye, the motion was carried.
The meeting was adjourned at 6:45 p.m.
