PUBLIC HEARING HIGHLAND ROAD AREA WATER IMPROVEMENT PHASE III A Public Hearing was held at the Town Hall, 15 • Terrace Road, Cortland, New York, at 7:30 p.m., concerning establishment of a water improvement project for the residential area east of Highland Road to adjacent residential areas including Highland, Northway, Fieldcrest, and College View Roads in the Town of Cortlandville. Members present: LEGAL NOTICE Town,of Cortlandville Order Pursuant to Town Law Section 209-q (3) Whereas, there was filed in the Office of the Town Clerk of the Town of Cort- landville, Cortland County, New York, general plans relating to the establish- ment of a water improve- ment project for the residential area east of Highland Road to adjacent residential areas including Highland, Northway, Field- crest and College View, Roads in the Town of Cort- landville and designated "Highland Road Area Water Improvement - Phase 111," as required by Section 209-q and 209-c of the Town Law, and are 'available for public inspection, and Whereas, the proposed improvement consists of the extension of water lines into the said area by construc- tion of service pipe, in ac- cordance with the said plans now on file in.the Of- fice of the Town Clerk of the Town of Cortlandville, and Whereas, the maximum amount proposed to be ex- pended for said im- provements is $125,000.00, and Whereas, the proposed method of financing the said improvement is from bonds issued by the Town of Cort- landville at a maximum term of 20 years at prevail- ing interest, said bonds to be retired by payments from users and benefitors of the water improvement through water rates, charges and fees in the first • instance and if necessary by Town charges, it is hereby Ordered, that a meeting of the -Town Board of said Town of Cortlandville shall be held at the Town Hall, Terrace Road, Cortland, New York on the 2 day of March, 1988 at 7:30 o'clock p.m, of that day to hear all persons interested in the proposed water improve- ment, and for such other ac- tion of said Town Board with relation to the said water improvement as may be required by law or be deemed proper. There being no comments or questions, a motion was made by Councilman O'Donnell, seconded by Councilman Rocco, to adjourn the Public Hearing. All voting aye, the motion was carried. Audit of Bills RESOLUTION #62 AUTHORIZE PAYMENT OF VOUCHERS - MARCH Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES; ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers #70 - 99 $39,356.99 Highway Fund 42 - 52 5,712.03 Water Fund 26 - 34 12,857.73 Sewer Fund 15 - 17 2,318.36 Alice Blatchley, Town Historian reviewed her annual Al-ce B. report with The Board. She advised that she sent a copy Annual Report of this report to the County Historian and the State Historian. RESOLUTION #63 AUTHORIZE SUPERVISOR TO SEND LETTER TO MARGARET JONES-BICENTENNIAL COMMISSION Authorize Mel to send letter Motion by Councilman O'Donnell to Bicentennial. Seconded by Councilman Thorpe Commission VOTES: ALL AYE ADOPTED WHEREAS, the Supervisor received a letter from Margaret B. Jones of the Cortland County Bicentennial Commission, stating that the Commission wishes to plant a tree somewhere in the Town of Cortlandville as part of their celebration of the Constitution, and WHEREAS, Ms. Jones requested a reply from the Town of our intent. therefore BE IT RESOLVED, that Supervisor Pierce is hereby authorized and directed to write a letter to Margaret Jones accepting the proposal of the Commission. 1 1 Wednesday March 02, 1988 Page 3 RESOLUTION #64 ADOPT HIGHLAND ROAD AREA WATER PROJECT PHASE III Motion by Councilman Thorpe Adopt Highland K Seconded by Councilman O'Donnell Water Project VOTES: ALL AYE ADOPTED Phase III WHEREAS, there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the establishment of a water improvement project for the residential area east of Highland Road to adjacent residential areas including Highland, Northway, Fieldcrest and College View Roads in the Town of Cortlandville and designated "Highland Road Area Water Improvement Phase III,"as required by Section 209-q (2) and 209-c of the Town Law, and WHEREAS, an Order was duly adopted by the Town Board on February 03, 1988 reciting the filing of said general plans, the improvements proposed, and the estimated expense thereof and specifying March 02, 1968 at 7:30 o'clock p.m. as the time and the said Town Hall in the said Town of Cortlandville as the place where the said board would meet to consider- the documents filed as aforesaid and to hear all persons interested in the subject thereof, concerning the same, and WHEREAS, such Order was duly posted and published as required by law, and WHEREAS, a hearing in the matter was duly held by the board on the 2nd day of March, 1988 commencing at 7:30 p.m. at the Town Hall in the said town and discussion upon the matter having been had and all. persons desiring to be heard having been duly heard including members of the board and various other persons, and NOW, upon the evidence given upon such hearing and upon the motion of Raymond G. Thorpe, Councilman, seconded by Edwin O'Donnell, Councilman, and unanimously passed, it is RESOLVED AND DETERMINED, that the plans heretofore filed with the Town Clerk of the Town of Cortlandville are in compliance with Section 209-c of the Town Law of the State of New York and are otherwise sufficient, and that to establish the aforesaid water- improvement is in the public interest, and it is further RESOLVED AND DETERMINED, that the establishment of a water improvement as proposed in said plans be authorized pursuant to Section 209-q (b) (r_) of the Town Lawg that the improvement therein mentioned be constructed and the service therein mentioned be provided for upon the required funds being made available or provided for, and that such improvement shall be designated and known as the "Highland Road Area Water Improvement -Phase III,". and it is further RESOLVED, that the proposed improvement, including costs or rights of way, construction costs, legal fees, engineering and consultant fees, and all other expenses approximate to be a maximum of a1255000.00 shall be financed as follows: C;a ,L A () Wednesday March 02, 19B8 Page 4 100% of the cost thereof will be financed with bonds issued by the Town of Cortlandville for a term of a maximum of 20 years and at the interest rate prevailing at the time of sale, said bonds to be retired by payments received from the users and benefitors of the water improvement through water rates, charges and fees in the first instance, and if necessary by Town charges, and it is further RESOLVED, that the Town Clerk of this Town shall within ten (10) days after the adoption of this Resolution file a certified copy thereof in the Office of the Cortland County Clerk as provided for by the Town Law, Section 209-q (b) (c), and it is further RESOLVED, that this Resolution is adopted subject to permissive referendum. A motion was made by Councilman Thorpe, seconded by Councilman Rocco, to recess the Regular Meeting to hold a Public Hearing on proposed Amendments to the Water District Ordinance of the Town of Cortlandville. All voting aye, the motion was carried. Supervisor Pierce offered those in attendance the privilege of the floor. No comments or questions were made. The reports of the various departments are on the table for review, and are available for inspection, on request, in the Town Clerks office. RESOLUTION ##65 AUTHORIZATION TO ACCEPT" SUPERVISOR'S ANNUAL REPORT FOR 1987 Authoriz to Motion by Councilman O'Donnell accept Superv°s Seconded by Councilman Thorpe report for 1987 VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board of the ToNn of Cortlandville is hereby authorized to accept the Supervisor's annual report -for the Town of Cortlandville for the year 1987, and also RESOLVED, that a copy of said report shall be filed with the Town Clerk, and also RESOLVED, that the Town Clerk shall cause a notice to be published within ten (10) days after receipt thereof, stating that a copy of such report is on file in the Town Clerk's office and available for public inspection and copying, in accordance with Town Law, Section 29, Article 10-A, amended June 29, 1979, and RESOLVED, that a copy of said report; shall be mailed to the Office of the State Comptroller of the State of New York. Pauline Parker, Town Clark read to the Board a letter from Sam Cincotta Sr. regarding the need for the Town to flush out his water lines regularly, as the letter from water in these lines becomes stagnant since he is at the Sam Cincotta Sr end of a dead end of the water line. RESOLUTION #66 AUTHORIZE WATER DEPARTMENT TO FLUSH WATER LINES REGULARLY FOR CUSTOMERS LOCATED ON THE END OF DEAD END LINES Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Town Board received a letter from a Town resident, requesting us to flush the water lines regularly, therefore BE IT RESOLVED, that the Water Department Superintendent is hereby authorized and directed to designate an employee of the Water Department to flush the water lines of residents residing near the ends of dead end water line=_• in the Town, once a month during the months of May, June, July, August, September, and October, Authorize Water Dept, to flush dead end lines Wednesday March 02, 1988 Page 6 RESOLUTION #67 AUTHORIZE TOWN CLERK TO ATTEND THE STATE ASSOCIATION OF TOWN CLERKS AND INTERNATIONAL MUNICIPAL TOWN CLERKS ASSOCIATION CONFERENCE Authorize In Clork to attend St & Int. RESOLUTION #68 AUTHORIZATION TO AMEND THE WATER DISTRICT ORDINANCE OF THE TOWN OF CORTLANDVILLE Authorize to amend Water Motion by Councilman O'Donnell ordinance Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, a Public Hearing, upon due notice, was held by the Town Board of the Town of Cortlandville at the Town Hall on March 02, 1988 at 7:45 o"clock p.m. in the matter of amending the Water District Ordinance of the Town of Cortlandville enacted September 30, 1957, and thereafter amended, and WHEREAS, the Town Board deems such proposed amendments to be in the best interests of the Town and water users therein, now therefore be it RESOLVED, that the Water District Ordinance of the Town of Cortlandville, enacted September 30, 1957, and thereafter amended, is hereby further amended as follows: Article IV, Subdivision 1 is amended to read as follows: All water service, other than water mains for improvement extensions or new service areas, including, but not limited to, meters, excavation from mains to curb -stops, tapping mains, curb bores, pipe from mains to curb -boxes, shut-off valves at mains and curbs and all necessary labor and materials used in furnishing a connection from mains to curb boxes, shall be installed by the Town Water Superintendent, his agents or employees or such persons as he may designate, at the expense of the consumer, which expense shall be the existing cost of labor and materials plus ten percent (10%). The consumer shall further be charged the sum of five dollars ($5.00) for Town inspection of the consumer's service connection from curb boxes to buildings. 1 11 " ;-s? !.6 Wednesday March 02, 1488 Page 7 Article V, Subdivision 5. is amended by adding the following: For all major water shut -offs for repairs or connections, affected customers will be notified, where practicable, personally and/or through the local media. Article VII is amended to read as follows: WATER RATES Rates for water consumed shall be as follows: a. $1.05 per one thousand (1000) gallons of consumption, per quarter, for all water consumed up to and including 50,000 gallons per quarter, with a minimum -fee of $6.00 per quarter. b. $.75 per one thousand (1000) gallons of consumption, per quarter, for all water consumed in excess of 50,000 gallons per quarter, up to and including 300,000 gallons per quarter. c. $.60 per one thousand (1000) gallons of consumption, per quarter, for all water consumed in excess of 300,000 gallons per quarter. Article X, Subdivision 1. is amended to read as follows: 1. All bills will be mailed to the property owner.who shall in all cases be responsible for timely payment. For the purpose of convenience only, bills will be mailed to tenants of property when written requests signed by both the owner and tenant are filed with the Town Clerk. Such written requests must be on forms available from the Town Clerk. All bills shall be payable at the office of the Town Clerk, and the failure of anyone to receive a bill will not be considered sufficient reason for not paying within the time hereinafter prescribed. Article X, Subdivision 3. is amended by replacing the word "shall" with "may" and replacing the amount of "$3.00" with the amount of "$10.00." Article XIII, Subdivision 4 is amended by adding a. new unnumbered paragraph, between the two existing paragraphs, to read as follows: All mains and distribution .lines shall be constructed and repaired with ductile iron of titon push -on type or mechanical joint. All mechanical pipe shall be installed with lead tipped gaskets, and all push -on pipe will have at least three bronze wedges per joint. All pipe and fittings shall meet AWWA standards. A motion was made by Councilman Thorpe, seconded by Councilman O'Donnell, to receive and file a letter from Senator James L. Seward. All voting aye, the emotion was carried. RAPPLEYEA, JR= - WELFARE RESIDENCY LAW Authorize Supervisor Motion by Councilman Thorpe to write letter Seconded by Councilman O'Donnell to James Seward VOTES: ALL AYE ADOPTED WHEREAS, there has been an influx of people moving into Cortland County due to the low criteria necessary to receive benefits from Social Services, and WHEREAS, if there was a residency requirement for these applicants there would be fewer people applying for welfare benefits, and WHEREAS, a large percentage of the County Budget is for financing of Social Services, and WHEREAS, something needs to be done to alleviate the problem of overpopulation of welfare recipients, therefore BE IT RESOLVED, that Supervisor Pierce is hereby authorized and directed to write a letter to Senator James L. Seward and Assemblyman Clarence D. Rappleyea, Jr. regarding a residency law for welfare recipiants. RESOLUTION #73 AUTHORIZE CEO, BRUCE WEBER, TO ATTEND BUILDINGS OFFICIALS EDUCATIONAL CONFERENCE Authorize Pete Alteri to attend co urs e Motion by Councilman Rocco Authorize Bruce Seconded by Councilman Thorpe to attend eonf. RESOLUTION #74 AUTHORIZE SALARY INCREASE FOR LONNA MAXSON -- DEPUTY TOWN CLERK Motion by Councilman O'Donnell Authorize pay Seconded by Councilman Thorpe increase to VOTES: ALL AYE ADOPTED Lonna Maxson WHEREAS, Lonna Maxson has completed the probationary six month period in the position of Deputy Town Clerk, in compliance with the personnel policy of the Town of Cortlandville, therefore BE IT RESOLVED, that an annual salary increase of $300.00 shall be granted to Lonna Maxson from 11,550.00 to 11,850.00 to be paid -From F8310.1 and G8110.11 effective February 29, 1988. RESOLUTION #75 AUTHORIZE CORRECTION IN ANNUAL SALARY OF FRED WALKER SR. - WATER DEPARTMENT Authorize correc Pay for F.Walke7 Motion by Councilman Rocco Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, Supervisor Pierce, Chief Fiscal Officer for the Town of Cortlandville, miscalculated the 1988 yearly salary for Frederick Walker Sr. when figuring the 1988 budget, therefore BE IT RESOLVED, that a correction from $22,890.00 to $23,205.00 shall be made to the yearly salary of Fred Walker, Sr. to correct said error, to be retroactive from January 01, 1988. Wednesday March 02, 19BB Page 10 RESOLUTION #76 AUTHORIZE CORRECTION IN ANNUAL SALARY OF DAVID THOMAS - WATER DEPARTMENT Authorize pay Motion by Councilman O'Donnell correction Seconded by Councilman Testa David Thomas VOTES: ALL AYE ADOPTED WHEREAS, Supervisor Pierce, Chief Fiscal Officer for the Town of Cortlandville, miscalculated the 1988 yearly salary for David Thomas, Water Department employee, when figuring the 1988 budget, therefore BE IT RESOLVED, that a correction from $17,640.00 to $17,955.00 shall be made to the yearly salary of David Thomas to correct said error, to be retroactive from January 01, 1988. A motion was made by Councilman Thorpe, seconded by Councilman O'Donnell, to adjourn the regular meeting. All voting aye, the motion was carried.
