The Cortland County Industrial Development Agency, Lead Agency for this project, has made a Negative Declaration concerning_ this transaction. Supervisor Pierce offered those in attendance the privilege of the floor. I\10 comments or questions were made. A motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to adjourn the Public Hearing. All voting aye, the motion was carried. The Public Hearinq adjourned at -1:45 P.M. 146 Audit of Bills Friday November 20, 1987 Regular Meeting 7:45 P.M. The Regular- Meeting of the Town Board of the Town Of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Edwin O'Donnell Town Clerk Pauline Parker absent: Councilman Ronal Rocco Councilman Warren Manning Others present were Town Attorney, Phillip Rumsey; WKRT newsreporter, Eric Martin; newsreporter, Kevin Conlin; Town Highway Sup't, Carl Bush; Councilman elect, Theodore Testa; Peter Novelli, representing NCC Industries; and Town residents, Mr. and Mrs. James Stevens. The meeting was called to order by Supervisor Pierce at 7:45 o'clock p.m., following a Public Hearing regarding a zoning change on Luker Rd. for NCC Industries. RESOLUTION #200 AUTHORIZE PAYMENT OF VOUCHERS NOVEMBER Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited, and shall be paid as follows: General Fund Vouchers #576 - 637 $ 27,206.49 Highway Fund 320 - 335 629569.68 Water Fund 167 - 176 242,191.90 Sewer Fund 86 - 98 137805.58 Supervisor Pierce offered those in attendance the privilege of the floor. James Stevens of Ridgeview Ave. asked the Board if the Town could inspect his water and sewer lines on James Stevens Ridgeview Ave. inspect Supervisor Pierce assured Mr. Stevens that this sewer lines matter would be taken care of on Monday November 23 if this is convenient for all involved. RESOLUTION #201 ADOPT NONDISCRIMINATION POLICY FOR TOWN AND APPOINT AFFIRMATIVE ACTION ADVISORY OFFICER AND PERSONNEL COMMITTEE Adopt non- discrimination (Notion by Councilman O'Donnell policy Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED 1 1 1 WHEREAS, as a result of the Auditor's Report, it is determined that the Town of Cortlandville must adopt a non-discrimination policy, therefore Friday November 20, IV87 Page r BE IT RESOLVED, that the Town of Cortlandville hereby adopts an Affirmative Action policy to read as follows: It is the Town's intent to provide assurance to all employees and potential employees of compliance with it's policy of equal employment opportunity. The goal of this policy is to provide equal opportunity for any individual regardless of race, creed, color, national. origin, sex, age, disability or marital status to the terms, conditions and benefits of employment. Any employee who believes that he or she has not been afforded equal opportunity for promotion or transfer or other term or condition of employment may submit a written complaint describing the discriminating action with an assurance of protection against harassment and retaliation. The complaint should be filed with the Affirmative Action Advisory Officer. Additionally, cases involving discrimination because of race, sex or other non -merit factors may be appealed to the Personnel Committee of the Town Board by employees or applicants (applicants should file within 20 days of the alleged discriminatory action). It is the Town's intention to resolve all complaints internally and every effort will be made to do so. Employees and applicants also have the right to file a complaint with the New York State Equal Opportunity commission, Albany, New York or the U.S. Equal Employment Opportunity Commission, Washington, D.C. 20506. and be it further RESOLVED, that Town Supervisor, Melvin H. Pierce is hereby appointed to serve as Affirmative Action Advisory Officer for the Town for the years. 1987, 1988, and 1989, and be it further RESOLVED, that Councilmen Edwin O'Donnell and Raymond Thorpe, and Councilman - elect Theodore Testa are hereby appointed to serve as the Personnel Committee to handle cases appealed by Town employees and applicants for the years 1987 and 1988. RESOLUTION #2.02 ADOPT LOCAL LAW NO.b ZONING CHANGE_ Adopt Local - LUKER ROAD - NCC INDUSTRIES Law No 6 Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, a request was received from NCC Industries for a zoning change on Luker Road and approved per resolution 9173 of 1987, and WHEREAS, a Public Hearing was held on November 20, 1987, at the Town Hall, pursuant to Town Law, Section 264, providing for said zoning change, therefore BE IT RESOLVED, that Local Law No.6 for 1987 is hereby passed and enacted in the following form: .Adopt Local Law No 6 4S Friday November 20, 1987 Page 3 PROVIDING FOR A ZONE CHANGE OF THE PARCEL OF LAND BORDERING L.UKER ROAD AND KNOWN AS CORTLANDVILE TAX MAP PARCEL NO. 95.00-01-15.2 FROM R-1 TO INDUSTRIAL SECTION 1. The Zoning Map of the Town of Cortlandville heretofore adopted by Local Law No. 1 for the Year 1986 is hereby amended by changing the parcel of land bordering Luker Road and known as Cortlandville Tax Map No. 95.00-01-15.2 (24.73± acres) (Joseph and Benny Gunzenhauser) from "Residential R-1" to "Industrial" zone designation. Said zone change shall be entered upon said Zoning Flap SECTION 2. The Zoning Map of the Torn of Cortlandville heretofore adopted by Local Law No. 1 for the Year 1986 is hereby amended by changing the one acre triangular parcel adjoining the center portion of the parcel described in Section 1, which one acre parcel is known as a portion of Cortlandville Tax flap No. 95.00- 01-20.00 (Joseph and Benny Gunzenhauser) from "Business" -to "Industrial" zone designation. Said zone change shall be entered upon said Zoning Map. SECTION 3. This Local Law shall take effect in accordance with the provisions of the Municipal Home Rule Law. RESOLUTION #2T3 ADOPT THE TOWN OF CORTLANDVILLE BUDGET FOR 1988 Adopt Budget Motion by Councilman O'Donnell for 1988 Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, on the 4th day of November, 1987, the Town Board of the Town of Cortlandville, held a public hearing on the preliminary budgets, approved by the Town Board, and filed with the Town Clerk, for the fiscal year commencing January 01, 1988, and having heard all persons in favor of or against any items therein contained, therefore BE IT RESOLVED, that the preliminary budgets approved and filed, and the same hereby is adopted and established as the annual budget of this Town for the fiscal year beginning January 01, 1968, and such annual budget, as so adopted, is filed with the Town Clerk, and RESOLVED, that the Town Clerk of this Town shall prepare and certify, as provided by law, duplicate copies of the annual budgets hereby adopted, together with the assessment rolls for the benefit of improvement for the Water Fund and the Sewer Fund, adopted pursuant to Section 202-a of the Town Law, and within five days thereof, deliver two copies to the Supervisor of the Town, and the Supervisor shall present the copies of the annual budgets to the Legislature of Cortland County within ten days, after his receipt thereof from the Clerk. 149 Friday November 20, 1487 Page 4 RESOLUTION ##204 AUTHORIZE PAYMENT FOR HOLIDAY ON ICE PROGRAM Holiday on Ice Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, during the past several years the Town has contributed to the "Holiday on Ice" program to allow Town residents to participate in this program, therefore BE IT RESOLVED, that the Supervisor is hereby authorized and directed to forward $225.00 to the Cortland Youth Bureau for sponsorship of the "Holiday on Ice" program. RESOLUTION 4,205 APPROVE DAVID CARR WATER AND SEWER CONNECTIONS - OWN HOME Approve David Motion by Councilman O'Donnell Carr w & s Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, an application was submitted by David Carr of 56 Fairview Drive, Cortland, N.Y., for plumber recognition and was found to be in proper order, therefore BE IT RESOLVED, that the application submitted for David Carr is hereby approved for both water and sewer connections to make connections at his home. and RESOLVED, that his name shall not be added to the approved plumber list, as per request from David Carr. RESOLUTION IV206 APPROVE RONALD VAN DEE - WATER AND SEWER CONNECTIONS Approve Ron !Motion by Councilman O'Donnell Van Dee W&S Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, an application was submitted by Ronald VanDee of 21 1/2 Richard Street, Cortland, N.Y., for plumber recognition and was found to be in proper order, therefore BE IT RESOLVED, that the application submitted for Ronald VanDee is hereby approved for both water and sewer connections, and be it further RESOLVED, that his name shall be added to the approved plumber list of the Town of Cortl.andville. RESOLUTION r 207 APPROVE JOHN MURDOCK - WATER AND SEWER CONNECTIONS Motion by councilman O'Donnell Approve John Seconded by Councilman Thorpe Murdock W&S VOTES: ALL AYE ADOPTED WHEREAS, an application was submitted by John Murdock of 4127 Fuller Road, Cortland, N.Y., for plumber recognition and was found to be in proper order, therefore _t�" Friday November 20, 1987 Page 5 BE IT RESOLVED, that the application submitted for John Murdock is hereby approved for both water and sewer connections, and be it further RESOLVED, that his name shall be added to the approved plumber list of the Town of Cortlandville. RESOLUTION # 208 AUTHORIZE APPLICATION FEE FOR HIGHLAND ROAD WATER HOOKUPS Application fee Highland Road Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, per Town of Cortlandville Water Ordinance, the usual cost to hookup to Town water is $140.00 which includes the cost of a water meter, an inspection fee, and installation of service from the main to the curb box, and WHEREAS, a Contractor for the Town has made installation of water services from the main to the curb boxes for properties adjoining Highland Road, per Water Project titled "Highland Road Area Water Improvement Project", therefore BE IT RESOLVED, that the Town Board does hereby waive the full payment of $140.00 for one installation to each of the properties where said water service from the main to the curb box has been installed by the Town, however, the applicant shall pay the sum of $60.00 for the purchase of each water meter plus an inspection fee. There was a discussion regarding the Highland Road Area Water Improvement Project. The Councilmen asked Highland Road various questions regarding water pressure, progression Project of the Project, future expansion, etc. progression Supervisor Pierce assured the Town Board that all is progressing according to schedule. Testing will be done by the middle of December. The finish work such as lawn repair and reseeding will be done in the spring of 1968. RESOLUTION # 20.9 ACCEPT NOTICE OF LIQUOR LICENSE RENEWAL - WILLOWBROOK GULF CLUB Liquor license renewal Willowbrook Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED, that notice has been received from the Willowbrook Gulf Club of Virgil Road, Cortland, New York, advising that they are renewing their liquor license in accordance with the Alcoholic Beverage Control Law. 1 1 1 1 51 Friday November 20, 1987 Page b RESOLUTION #210 ACCEPT AND POST SEASONAL LIMITED HIGHWAY USE LIST - 1987 - 1986 Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE_ ADOPTED BE IT RESOLVED, that the Town Board does hereby accept from the Highway Superintendent, the list of roads in the Town of Cortlandville which will have limited use durinq the winter season, and further RESOLVED, that the Town Clerk is hereby instructed to post said list on the bulletin board for public access. Seasonal Limiter use - Highway Supervisor Pierce apprised the Board of a notice Health Ins. from our Health Insurance provider that the rate will increase increase 70.1% for the coming year. This would be a $45,000.00-+- increase for the Town. A discussion followed regarding the availability of emergency funds for the Town, if more water contamination should occur. Supervisor Pierce and Mr. Rumsey assured those present that funds exist in the Budget to alleviate any problem which may arise, or State Laws allow for emergency procedures. Peter Novelli, representing NCC Industries apprised the Board of the proposed schedule for construction of their warehouse on Luker Road. Supervisor Pierce instructed Town Attorney, Phillip Rumsey to draw up the legal papers involved in dealing with NCC Industries regarding installation of Town water to the Luker Road area.
