S upervisor Dietrich called the Town of Danby Town Board Meeting
to order at B : OO P . M .
PLEDGE OF ALLEGIANCE :
S upervisor Dietrich led all present to the Pledge of Allegiance
to the American flag .
S upervisor Dietrich announced that there were students present
tonight to observe our Town Board proceedings .
Approval of September 22 , 1990 Public Hearing Minutes
A motion was made by Councilperson Eckstrom and seconded by
Councilperson Oltz to approve the Town of Danby Town Board
Minutes of the September 22 , 1990 Public Hearing as published .
A roll call vote on the motion resulted as follows :

Approval of September 10 , 1990 Town Board Minutes
A motion was made by Councilperson Eckstrom and seconded by

Approval of September 27s 1999 Town Board Minutes
A motion was made by Councilperson WOlt and seconded by
Councilperson Marisa to approve the September 27 , 1990 Town of
Danby Town Board Minutes as published .

PRIVILEGE OF THE FLOOR :
Councilperson Schwartz reported that he is still working with Mr .
Dwight Mengel on the " Park and Ride " service for the Town of
Danby .
County Representative Report
Tompkins County Representative Proto reported on the following :
1 ) Rabies - there are recent reports of rabid raccoons in
Chemung and Tioga Counties . Representative Proto reported
that in the event a rabid raccoon is reported in a county ,
the New York State Health Department requires every cat in
the home county be inoculated within 30 days .
Discussion followed and Representative Proto reported Tompkins
County has a regulation that requires all cats to have a rabies
vaccination .
2 ) Regulations for the release of raccoons - The Department of
Conservation has a regulation that prohibits releasing
raccoons that have been trapped or caught .
Representative Proto suggested the Town Board consider a meeting
with the Tompkins County Health Department for a presentation of
rabies information .
3 ) Southerntier Region _ Conference on _- HIV-AIDS - Representative
Proto attended a conference ' in Binghamton , New York on HIV --
AIDS in September 1990 .
4 ) Job _Training_ _.-- The New York. State Department of Labor and
the County will open a new Job service in Center Ithaca
soon .
5 ) Unique_,_Natu, ral Area Studies_-_ - The Unique Natural Areas
Study for Tompkins County is completed . Eleven areas were
identified in the Town of Danby .
6 ) Follow - up on ,Lindstrom La_ ndfill , _Public Meetinq-
Repr- esentati. ve Proto reported he has requested information
on the closure plan for Landstrom Landfill .
7 ) Tompkins County Budget - Tompkins County Budget Hearing for
Fiscal Year 1991 is scheduled for November 7 , 1990 at 5 : 00
P . M . Individual department budgets will be reviewed by the
B udget and Administration Committee on October 24 and 25 .

Landfill Monitoring Group
Joel Gagnon reported the Landfill Monitoring Group met Sunday ,
October 7 , 1990 .
The Landfill Monitoring Group has completed Part II : " Things
they would like the Town of Danby to consider " :

1 ) Closure of Michigan Hollow Road until such time thet.
Tompkins County takes over the road ;
2 ) The Town to request Tompkins County Board of
Representatives to recognize the Landfill Monitoring Group
as an official county committee ;
3 ) The Town Board to pursue compensation for Danby
residents into a closure of the landfill soon ;
4 ) The Town document the extent and magnitude of the
leachate plume and indicate what plans it will put in place
to clean it up ;
5 ) The Town of Danby to be made a clear and interested
party and all relevant information regarding the landfill
be sent to the Town as it occurs at the county level .
Joel reported the Committee would like to request the County to
seriously and vigorously investigate alternatives to keeping the
Landstrom Landfill site open .
Discussion followed and Representative Proto suggested a copy of
the September 10 , 1990 Town of Danby Public Information Meeting
Minutes ( held in West Danby ) be sent to the Tompkins County Board
of Representatives .
Joel Gagnon reported the Landfill Monitoring Group have prepared
information to present to the Tompkins County Board of
Representatives Tuesday , October 9 , 1990 . Joel also reported
the group wants to present a strong case on why there are no
acceptable ways of mitigating the environmental impacts short of
closing the Landstrom Landfill .
Representative Prato reported the Construction Management
Committee has put together a report of options for extending the
Landstrom Landfill . Copies are available for review at the Board
of Representatives office . Representative Prato reported he
asked the County for information relating to the material changes
in the original closure plan and the event of a new closure plan .
Representative Proto suggested the Town of Danby may want to
involve the Army Corps of Engineers in regard to wetland areas at
the County Landfill .
COMMUNICATIONS :
Park and Ride
Councilperson Schwartz reported the Town of Danby received a
letter from the Danby Fire District in regard to the Danby Fire
Department parking lot on Route 968 as a possible location for
the " Park. & Ride " participants . The letter stated that questions
on liability , care and upkeep , abandoned vehicles , and / or
overnight parking , etc . will be addressed as final arrangements
are completed .
Discussion followed and Supervisor Dietrich stated he would have
the Fire District and Town Attorneys draw up an agreement for the
use of the Fire Department parking lot for " Park and Ride " .
Rabies Vaccination Clinics
News Release - from Tompkins County Department. of Health - Rabies
Vaccination Clinics .
Supervisor Dietrich reported a Rabies Clinic is scheduled for
Monday , October 22 , 1990 , 7 : 30 P . M . at the Danby Fire Station .
All cats and dogs over three ( 3 ) months of age are required by
law to be vaccinated against rabies . The Tompkins County Health
Department will hold Rabies Clinics October 22 thru October 25 , .
1990 throughout Tompkins County .

American Community Cablevision
American Community Cablevision plan to activate a second
channel for governmental and educational access users . An
informational meeting is scheduled for October 18 , 1990 .
Interested persons should contact ACC ' s access coordinator ,
Lauren Stefanelli .
Discussion on the Town of Danby Cablevision Franchise Agreement
followed .
OTHER REPORTS :
Community_ Council
Bill Center reported on the following :
1 ) The After School Program is underway .
2 ) Danby Annual Halloween Party will be held at the Town of
Danby Fire Station on October 27 , 1990 from 7 - 8 P . M . Town
of Danby residents are invited to attend .
H inhwaY
B ridge over Miller Creek
H ighway Superintendent Coddington reported he met with the County
Representatives in regard to the Bridge over Miller Creek
maintenance and repairs .
Hornbrook Road
H ighway Superintendent Coddington reported that New York State
G as and Electric will conduct a survey on Hornbrook. Road to
determine how many residents are interested in obtaining natural
gas .
Senior Citizen Report
E dw . M . Roberts reported the Senior Citizens went on a trip to
O ld Forge and the Adirondacks . The seniors will be attending
the Ice Capades in Binghamton later this month .
Councilperson Marisa asked Edw . M . Roberts to report to the
senior citizens that we very much miss the Senior Citizen column
in the Danby Area News .
Code Enforcement Reports
August 1990 - Building Permits were issued for the following :
S ix ( 6 ) new homes , two ( 2 ) garages , one ( 1 ) storage shed , two ( 2 )
additions and six ( 6 ) renewal building permits . One Certificate
of Occupancy was issued . Total building permit fees collected
$ 1 , 949 . 00 .
September 1990 - Building Permits were issued for the following :
Two ( 2 ) new homes , one ( 1 ) garage , two ( 2 ) storage sheds , and two
( 2 ) renewal permits . Five ( 5 ) Certificates of Occupancy were
issued . Total building permit fees collected - $ 560 . 00 .
Fire District Report
Fire District representative Bill Genter reported the Danby Fire
D istrict has submitted the Annual Fire District Budget for 1991 .
The Fire District Budget for 1991 is $ 155 , 763 and represents a
12 % increase . The major increase in the budget is due to the
purchase of a new brush truck and increased attorney fees .
County Youth
S upervisor Dietrich reported that the Town of Danby will seek a
large increase in the 1991 budget for youth services for new
programs .

Danby CATV Committee - Sub-committee of Planning Board
D anby CATV Committee ( a sub - committee of the Town of Danby
P lanning Board ) have requested to be officially recognized by the

A motion was made by Supervisor Dietrich and seconded by
Councilperson Eckstrom that the Town Board respond to the Danby
CATV Committee as follows :
" The Town of Danby Town. Board recognizes the valuable
time and energy of the Danby CATV Committee in its
diligent work negotiating a contract with American
Community Cablevision . "

NEW, BUSINESS :
Resolution #70 of 1990
Adjustment in Code Enforcement Officer Contractual Monies
By Supervisor Dietrich : Seconded by Councilperson Marisa
WHEREAS , Legal fees of $ 6 , 000 . 00 were budgeted in both Planning
Board and Code Enforcement Officer Contractual monies , and thus
far have been charged only to the Code Enforcement Officer , be it
RESOLVED , That the sum of $ 665 . 45 be charged to Planning Board
A8120 . 4 and $ 665 . 45 be credited to Code Enforcement Officer
Contractual 48010 . 4 , and be it further
RESOLVED , That Maycumber reimbursement of legal fees in the
amount of $ 1 , 153 . 15 be appropriated for use in A8020 . 4 . This
will zero out legal line in the Code Enforcement Officer Account
and leave a balance of $ 4 , 834 . 55 in A8020 . 4 legal line .

NEW_ HIGHWAY BARNS
Bids to Supply Propane Gas to the New Highway Barns
Superintendent Coddington reported that sealed bids for supplying
propane gas to the Town of Denby New Highway Barns on Hornbrook
Road were opened on October 5 , 1990 at 3 : 00 F . M .
Sealed bids were received from the following :
Ehrhart Propane Gas , Trumansburg , NY
Petrolane ( Surban Propane ) , Watkins Olen , NY
Agway Petroleum , Syracuse , NY
Discussion followed and the bid materials were reviewed by the
Town Board .
Motion to Award Bid to Supply Propane Gas to the New Highway
Barns
A motion was made by Councilperson Eckstrom and seconded by
Councilperson Oltz to recommend the Town of Danby award the bid
for supplying Propane Gas for the Danby New Highway Barns for one
( 1 ) year to Agway Petroleum for their low bid .

A motion was made by Councilperson Eckstrom and seconded by
Councilperson Schwartz that the Town of Danby Town Board approve
the Agreement between Sunny Brook Builders and the Town of Danby ,
dated September 180 1990 for Danby Town Hall roof repairs and
direct Supervisor Dietrich to make payments according to the
terms of the contract .

1991 Budget
The Town Board discussed possible dates for working sessions for
the Fiscal Year 1991 Budget . Councilperson Eckstrom distributed
copies of the working document to the Town Board for their review
and comment .
A brief discussion followed in regard to the Town purchase of
additional space .
