Regular Meeting
_ The Regular Meeting of the Town Board of -the Town
of Cortlandville, was held at the Town Hall, 15 Terrace
Road, Cortland, New York, with Supervisor Pierce
presiding.
Members present: Supervisor, Melvin Pierce
Councilman, Warren Manning
Councilman, Raymond Thorpe
Councilman, Edwin O'Donnell
Town Clerk, Pauline Parker
absent: Councilman, Ronal Rocco
Others present were Newsreporter, Kevin Conlon;
Highway superintendent, Carl Bush; Chairman of the
Cortlandville Planning Board, Richard Tupper; and local
resident, William McDermott..
The meeting was called to order by Supervisor
Pierce at 5:00 P.M. He requested that all those in
attendance rise and pledge allegiance to the flag.
Motion was made by Councilman Thorpe, seconded by
Councilman O'Donnell, to receive and file the
application for a mining permit for Gunzenhauser Real
Estate. All voting aye, the motion was carried.
The application was received from NYS DEC, of which
they have been declared the SEAR Lead Agency.
Motion was made by Councilman Thorpe, seconded by
Councilman O'Donnell, to receive and file the letter of
resignation from Frederick G.. Compagni, Legislator for
District 14 in Cortland County, effective June 16, 1987.
Motion was made by Councilman Thorpe, seconded by
Councilman O'Donnell, to receive and file a letter from
Judith Riehlman, Cortland County Clerk. All voting aye,
the motion was carried.
The letter was notification of the vacancy which
will occur from the resignation of Frederick G.
Compagni, County Legislator for District 14. This
resignation to be effective June 16, 1987.
Motion was made by Councilman Thorpe, seconded by
Councilman O'Donnell, to receive and file a letter from
Councilman Ronal Rocco to Supervisor Pierce.
The letter was an endorsement to appoint Mr.
Richard Tupper, Chairman of the Cortlandville Planning
Board to fill the vacancy in the County Legislature,
created from the resignation of Frederick G. Compagni.

RESOLUTION # 106 APPOINTMENT OF RICHARD C. TUPPER -
COUNTY LEGISLATOR - DISTRICT 14

VOTES: ALL AYE ADOPTED
WHEREAS, Frederick G. Compagni, Cortland County
Legislator for Legislative District 14 in the Town of
Cortlandville has filed with the Cortland County Clerk
his resignation from that County Office, effective June
16, 1987, and
WHEREAS, the County of Cortland Local Law No. 7 for the
Year 1971 provides that in the event of a vacancy in the
Office of County Legislator, the vacancy shall be filled
by the majority vote of the members of the Town Board of
the Legislative District within thirty (30) days of the
vacancy, now therefore,
BE IT RESOLVED, that the Cortlandville Town Board does
hereby appoint Richard C. Tupper, 12 Lyncort Drive in
the Town of Cortlandville, to the vacancy existing in
the Office of Cortland County Legislator in Legislative
District 14.
RESOLUTION # 107 - APPROVE GAGGLE CO. INC. - WATER AND
SEWER CONNECTIONS
Motion by Councilman O'Donnell
Seconded by Councilman Manning
approve VOTES: ALL AYE ADOPTED

water & WHEREAS, an application was submitted by Kim Whetzel,
sewer president of Gaggle Co. Inc. for plumber recognition,
and was reviewed by the Board, therefore
BE IT RESOLVED, that the application submitted for
Gaggle Co. Inc. of 2935 Slaterville Road, Brooktondale
N.Y. is hereby approved for both water and sewer
connections, and be it further
RESOLVED, that this company be added to the approved
plumber list of the Town of Cortlandville.
Motion was made by Councilman O'Donnell, seconded
pumpstation by Councilman Manning, to receive and file a letter from
Village Edward R. Purser to Hayne Smith, Town Engineer.
Terrace Apts The letter was regarding the removal of the sewer
etc. pump station located at the Country Town Houses and
Village Terrace Apartments.

RESOLUTION # 108 - AUTHORIZE SUPERVISOR PIERCE TO SIGN
REVISED AGREEMENT WITH COUNTRY TOWN
HOUSES AND VILLAGE TERRACE APARTMENTS
Motion by Councilman O'Donnell
Seconded by Councilman Manning
VOTES: ALL AYE ADOPTED
WHEREAS, on March 4, 1987 per Resolution # bb Supervisor pump station
Pierce was authorized to negotiate removal of the sewer revised
pump station for Country Town Houses and Village Terrace agreement
Apartments, and
WHEREAS, a revised agreement has been drawn up per
letter dated June 1, 1987, from Edward R. Purser to
Hayne Smith, therefore
BE IT RESOLVED, that Supervisor Pierce is hereby
authorized and directed to sign the revised agreement
with Village Terrace and Country Town Houses, pending
approval from Town of Cortlandville attorney, Phillip
Rumsey.
RESOLUTION # 109 - AUTHORIZE PAY INCREASE - EDNA PUZO
TYPIST
Motion by Councilman Thorpe
Seconded by Councilman Manning
VOTES: ALL AYE ADOPTED
WHEREAS, Edna Puzo, typist has completed the six month pay increase
probationary period in compliance with the personnel Edna Puzo
policy of the Town of Cortlandville, and
WHEREAS, Edna Puzo took the required Civil Service exam
and passed, and
WHEREAS, Supervisor Pierce sent a letter, which is on
file, which recommends that -the raise be retroactive
from January 1, 1987, therefore
BE IT RESOLVED, that Edna Puzo, typist, shall be granted
a salary increase of $300.00, retroactive from January
1, 1987.
RESOLUTION # 110 - AUTHORIZE PAY INCREASE - FRED WALKER
SR. - WATER AND SEWER SUPERINTENDENT
Motion by Councilman Thorpe
Seconded by Councilman Manning
VOTES: ALL AYE ADOPTED
WHEREAS, Fred Walker Sr. has completed the six month pay increasE
probationary period in compliance with the personnel Fred Walker
policy of the Town of Cortlandville, and -
WHEREAS, Fred Walker Sr. took the required Civil Service
exam and passed, and

WHEREAS, Supervisor Pierce sent a letter, which is on
file, which recommends that the raise be retroactive
from June 1, 1987, therefore
BE IT RESOLVED, that Fred Walker Sr., Water and Sewer
Superintendent, shall be granted a salary increase of
$300.00, retroactive from June 1, 1987.
RESOLUTION # Ill - AUTHORIZE PAY INCREASE - EILEEN M.
MALAY - CHIEF COURT CLERK
Motion by Councilman Thorpe
Seconded by Councilman Manning
VOTES: ALL AYE ADOPTED
pay increase WHEREAS, Eileen M. Malay has completed the six month
Eileen Malay probationary period in compliance with the personnel
policy of the Town of Cortlandville, and
WHEREAS, Town Justice, Mardis Kelsen sent a letter,
which is on file, which recommends that Ms. Malay be
granted her pay increase retroactive from January 1,
1987, therefore
BE IT RESOLVED, that Eileen M. Malay, Chief Court Clerk,
shall be granted a salary increase of $300.00,
retroactive from January 1, 1987.
RESOLUTION # 112 - AUTHORIZE PAYMENT OF VOUCHERS - JUNE
Motion by Councilman Thorpe
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:
audit of General Fund Vouchers #311 - 336 $ 6,117.32
bills Highway Fund #156 - 172 8,453.44
Water Fund # 82 - 91 4,096.66
Sewer Fund # 40 9.62
Wm McDermott William McDermott of Highland Road appeared before
the Town Board to ask questions about his proposed
subdivision subdivision on Highland Road.
Highland Rd The Town Board reviewed the subdivision plans with
him, but referred him to the Planning Board.
Councilman Thorpe made a motion, seconded by
Councilman O'Donnell, to adjourn the regular meeting and
recess to an executive session to discuss pending
litigation. All voting aye, the motion was carried.

The following was received from the Supervisor's
office:
Councilman Thorpe made a motion, seconded by
Councilman O'Donnell, to adjourn the executive session
and reconvene the regular meeting. All voting aye, 'the
motion was carried.
No action was taken.
Councilman Manning made a motion, seconded by
Councilman Thorpe, to adjourn the meeting. All voting
aye, the motion was carried.
The meeting was adjourned at 5:47 p.m.
